    Application: brought under Articles 236 EC and 152 EA, in which Ms De Fays seeks annulment of her 2005 career development report and an order for the Commission to pay her damages for non-material loss suffered as a result of the delay in drawing up that report and the repetition of assessments contained in the report, which were not an accurate reflection of her actual performance.

    Held: Case F‑123/07 De Fays v Commission is removed from the register of the Tribunal. The Commission is to pay reasonable costs and expenses incurred by the applicant. The Commission is to bear its own costs.
