    DECISION OF THE EEA JOINT COMMITTEE No 140/2020

    of 25 September 2020

    amending Annex XVI (Public Procurement) to the EEA Agreement [2023/1399]

    THE EEA JOINT COMMITTEE,

    Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

    Whereas:

    (1)

    Commission Implementing Regulation (EU) 2019/1780 of 23 September 2019 establishing standard forms for the publication of notices in the field of public procurement and repealing Implementing Regulation (EU) 2015/1986 (‘eForms’) (1) is to be incorporated into the EEA Agreement.

    (2)

    Implementing Regulation (EU) 2019/1780 repeals, with effect from 25 October 2023, Commission Implementing Regulation (EU) 2015/1986 (2), which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement with effect from 25 October 2023.

    (3)

    Annex XVI to the EEA Agreement should therefore be amended accordingly,

    HAS ADOPTED THIS DECISION:

    Article 1

    Annex XVI to the EEA Agreement shall be amended as follows:

    1.

    The following point is inserted after point 6h (Commission Implementing Decision (EU) 2016/1804):

    ‘6i.

    32019 R 1780: Commission Implementing Regulation (EU) 2019/1780 of 23 September 2019 establishing standard forms for the publication of notices in the field of public procurement and repealing Implementing Regulation (EU) 2015/1986 (‘eForms’) (OJ L 272, 25.10.2019, p. 7).’

    2.

    The text of point 6g (Commission Implementing Regulation (EU) 2015/1986) shall be deleted with effect from 25 October 2023.

    Article 2

    The text of Implementing Regulation (EU) 2019/1780 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

    Article 3

    This Decision shall enter into force on 26 September 2020, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).

    Article 4

    This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
