DECISION OF THE EEA JOINT COMMITTEE
No 192/2014
of 25 September 2014
amending Annex XI (Electronic communication, audiovisual services and information society) and Protocol 37 (containing the list provided for in Article 101) to the EEA Agreement [2015/1260]
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Articles 98 and 101 thereof,
Whereas:

Commission Decision C(2014)462 of 3 February 2014 on establishing the European Regulators Group for Audiovisual Media Services is to be incorporated into the EEA Agreement. |

(2) |
For the EEA Agreement to function well, Protocol 37 to the EEA Agreement is to be extended to include the European Regulators Group for Audiovisual Media Services set up by Commission Decision C(2014)462, and Annex XI is to be amended in order to specify the procedures for association with this Group. |

(3) |
Annex XI and Protocol 37 to the EEA Agreement should therefore be amended accordingly, |
HAS ADOPTED THIS DECISION:
Article 1
The following is inserted after point 5q (Directive 98/84/EC of the European Parliament and of the Council) of Annex XI to the EEA Agreement:

‘5r. |
C(2014)462: Commission Decision C(2014)462 of 3 February 2014 on establishing the European Regulators Group for Audiovisual Media Services.
The provisions of the Decision shall, for the purposes of this Agreement, be read with the following adaptation: In Article 4(1), the words “and an EFTA Surveillance Authority representative” shall be inserted after the word “Commission”. Modalities for association of the EFTA States in accordance with Article 101 of the Agreement: The EFTA States shall participate fully in the European Regulators Group for Audiovisual Media Services, except for the right to vote.’ |
Article 2
The following point is inserted after point 38 of Protocol 37 to the EEA Agreement:

‘39. |
The European Regulators Group for Audiovisual Media Services (Commission Decision C(2014)462 of 3 February 2014 on establishing the European Regulators Group for Audiovisual Media Services).’ |
Article 3
The texts of Commission Decision C(2014)462 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.
Article 4
This Decision shall enter into force on 26 September 2014, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).
Article 5
This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
