    THE PRESIDENT OF THE EUROPEAN PARLIAMENT,

    Having regard to the Treaty establishing the European Community, and in particular the penultimate indent of Article 272(5) thereof,

    Having regard to the Treaty establishing the European Atomic Energy Community, and in particular Article 234 thereof,

    Having regard to the Financial Regulation of 21 December 1977 applicable to the general budget of the European Communities, as last amended by Regulation (EC,ECSC, Euratom) No 2673/1999(1), and in particular Article 15 thereof,

    Having regard to the Interinstitutional Agreement of 6 May 1999 between the European Parliament, the Council and the Commission on budgetary discipline and improvement of the budgetary procedure(2),

    Having regard to the general budget of the European Union for the financial year 2000(3),

    Having regard to preliminary draft supplementary and amending budget No 1 of the European Union for the financial year 2000 submitted by the Commission,

    Having regard to draft supplementary and amending budget No 1 of the European Union for the financial year 2000 established by the Council on 16 June 2000,

    Having regard to the debates and deliberations of the European Parliament of 4 and 6 July 2000,

    Having regard to the resolution adopted by the European Parliament on 6 July 2000,

    Having regard to the deliberations of the Council of 20 July 2000, in the course of which the Council did not modify Parliament's amendments,

    The procedure laid down in Article 272 of the Treaty establishing the European Economic Community and Article 234 of the Treaty establishing the European Atomic Energy Community having thus been completed,

    Supplementary and amending budget No 1 of the European Union for the financial year 2000 as set out in the annex has been finaly adopted.

    When the Commission considers it necessary to draw on this reserve, it convenes a three-way meeting as soon as possible in order to obtain the agreement of the two arms of the budgetary authority on the need to use the reserve and on the amount required. The reserve is drawn on by means of a transfer to the budget headings concerned.

    Article 32 of the Financial Regulation states that the balance from each financial year, whether surplus or deficit, is entered as revenue expenditure in the budget of the subsequent financial year.

    The relevant estimates of such revenue or expenditure are entered in the budget during the budget procedure and, where appropriate, in a letter of amendment submitted pursuant to Article 14 of the Financial Regulation. They are drawn up in accordance with the principles set out in Article 15 of Regulation (EEC, Euratom) No 1552/89, as last amended by Regulation (Euratom, EC) No 1355/96 (OJ L 175, 13.7.1996, p. 3).

    After the closure of the accounts for each financial year, any discrepancy in relation to the estimates is entered in the budget for the following financial year through a supplementary and/or amending budget.

    A deficit is entered in Chapter B0-3 0 of the statement of expenditure of Section III "Commission".

    Expenditure on the common agricultural policy dealt with by the EAGGF Guarantee Section consists of refunds financed pursuant to Article 2(1) of Regulation (EC) No 1258/1999 (OJ L 160, 26.6.1999, p. 103) and intervention expenditure financed in accordance with Article 2(2) of that Regulation, the rules for financing being laid down in Council Regulation (EEC) No 1883/78 of 2 August 1978 on general rules for financing interventions by the EAGGF Guarantee Section (OJ L 216, 5.8.1978, p. 1), as last amended by Regulation (EC) No 1259/96 (OJ L 163, 2.7.1996, p. 10).

    The appropriations entered for the European Agricultural Guidance and Guarantee Fund, Guarantee Section have as a general rule been arrived at:

    It will also fund expenditure on technical and administrative assistance, to both the Commission and the beneficiaries of the measures, which does not fall within the standing remit of public administration, covering the identification, preparation, management, monitoring, audit and supervision of plant health measures. Such technical and administrative assistance may only continue as long as the programmes themselves.

    A maximum amount of EUR 1100000 is authorised for this type of expenditure.

    The appropriations in this article also contain a maximum amount of EUR 200000 intended to cover expenditure on studies, meetings of experts and information and publicity meetings linked to plant health measures.

    It also funds the former multiannual measures, in particular those approved and implemented under the other abovementioned Regulations, which are not covered by the priority Objectives of the Funds.

    In the case of the FIFG this was expenditure relating to the support and financing of studies and projects relating to the conservation and management of fishery resources and the protection of marine species as well as the relationship between fisheries and the environment, the use of new techniques to improve the cost-benefit ratio of inspections, the formation of producer organisations and the institution of plans for improving the quality of their products, and networking among the various parties involved in the fishing industry using innovative techniques of communication and data-exchange, including the running of such networks. The appropriation also covered pilot projects, project assessment, collecting basic data, organising meetings of experts and working groups, as well as assessing, publishing and otherwise disseminating results. From 2000 onwards, the new resource-management support measures will be funded from Article B2-9 0 3.

    During the budgetary procedure and even during the financial year, and when a letter of amendment is submitted, the Commission informs the budgetary authority of any changes which are likely to be made, or have been made, to the budget of the agencies, in accordance with the provisions on transparency contained in the Interinstitutional Agreement of 17 November 1995 and implemented as a code of conduct agreed by the European Parliament, the Commission and the agencies.

    The estimated revenue and expenditure for the financial year are as follows:

    In Kosovo and in Bosnia-Herzegovina, the international community has set up bodies to take charge of the interim civilian administration and to implement peace agreements, namely the interim UN mission in Kosovo (UNMIK) and the Office of the High Representative in Bosnia-Herzegovina (OHR). The timely establishment and proper functioning of these bodies constitute important factors in maximising the effectiveness of Community aid under this policy. A legal framework must therefore be laid down to cover Community financial assistance towards the operating costs of the two bodies. The financing takes the form of a grant to the OHR's budget.

    The adoption of a specific legal basis warrants an appropriate additional budget allocation:

    - an amount of EUR 5000000 is allocated to the Office of the High Representative in Bosnia and Herzegovina (OHR),

    Proposal for a Council Regulation, concerning the creation of a Rapid Reaction Facility (COM (2000) 119, adopted by the Commission on 11 April 2000).

    This Regulation is intended to provide the legal framework to act in order to prevent crises from spreading or escalating into armed conflicts in order to foster sustainable economic and social development.

    The appropriations are intended to cover notably:

    - Funding of all non-military activities aimed at counteracting or resolving emerging crisis situations and serious threats or outbreaks of conflict;

    - All logistical measures necessary for the planning, implementation, monitoring and auditing of such interventions, including information and communication management, technical assistance and training, the purchase and/or delivery of essential products and equipment, safe transport and all administrative expenditure related to such measures;

    - Measures necessary to strengthen the Community's co-ordination with Member States and other donor countries, international organisations, non-government organisations and their representatives.

    If the above actions are eligible for funding under the Council regulation n1257/96 of 20 June 1996 concerning humanitarian aid, they shall be financed under this Regulation. In specific security and crisis management circumstances, the Commission may decide that intervention under the Rapid Reaction Facility is more appropriate if combined with action under the Council regulation concerning humanitarian aid.

    This appropriation is intended to cover the financing of various measures to encourage Community investment in the developing countries in Asia, Latin America and the Mediterranean linked to the Community by economic cooperation and trade agreements.

    It also covers the financing of similar measures in South Africa in line with, inter alia, the provisions of the Interim Agreement between the European Union and South Africa.

    Part of the appropriation should be made available as a matter of priority for joint ventures in the field of appropriate environmental technology and for capacity-building initiatives to train local specialists in the field of environmental technology.

    Funding from this budget line shall be available primarily for those initiatives in which women's development forms an integral element.

    Irrespective of the beneficiary, no administrative expenditure against this heading is authorised.
