Politically exposed person: a natural person exercising or having exercised prominent public functions. This includes in particular:
|
heads of State, heads of government, ministers, deputy ministers and state secretaries; in Austria, this concerns in particular the Federal President, the Federal Chancellor and the members of the Federal Government and the provincial governments; |
|
members of parliament or of similar legislative bodies; in Austria, this concerns in particular the members of the lower house (Nationalrat) and the upper house (Bundesrat) of the Austrian parliament; |
|
members of the governing bodies of political parties; in Austria, this concerns in particular members of the governing bodies of political parties represented in the Nationalrat; |
|
members of supreme courts, of constitutional courts or of other high-level judicial bodies, the decisions of which are not subject to further appeal, except in exceptional circumstances; in Austria, this concerns in particular judges of the Supreme Court, the Constitutional Court and the Supreme Administrative Court; |
|
members of courts of auditors or of the boards of central banks; in Austria, this concerns in particular the President of the Federal Court of Auditors, the directors of the provincial courts of auditors and members of the board of directors of the National Bank of Austria; |
|
ambassadors, chargés d’affaires and high-ranking officers in the armed forces; in Austria, high-ranking officers in the armed forces include military personnel above the rank of Lieutenant General; |

members of the administrative, management or supervisory bodies of State-owned enterprises; in Austria, this applies in particular to undertakings in which the Federal Government holds at least 50 % of the ordinary share capital, principal capital or equity capital, or which the Federal Government operates alone or which the Federal Government effectively controls through financial or other economic or organisational measures; the board of directors or the management of enterprises in which a province owns 50 % or more of its ordinary share capital, principal capital or equity capital, or which a province operates alone or which a province effectively controls through financial or other economic or organisational measures, provided that the total annual turnover of such an enterprise exceeds EUR 1 000 000. Total annual turnover is determined on the basis of the annual revenue from the most recent annual accounts; |

This Decree lays down the prominent public functions referred to in Chapter 1, Section 4(11) of Act 444/2017 on preventing money laundering and terrorist financing (hereinafter ‘the Money Laundering Act’), whereby persons entrusted or having been entrusted with such functions should be considered politically exposed persons.
Section 2 – Head of state, head of government, minister, deputy or assistant minister
The functions of a head of state, head of government, minister, or deputy or assistant minister as referred to in Chapter 1, Section 4(11)(a) of the Money Laundering Act consist of:
1) |
the functions of the president of the Republic [tasavalta] and prime minister as well as of the minister referred to in chapter 5 of the Constitution of Finland; |
2) |
the functions of a secretary of state; |
3) |
the functions of a member of the government of Åland [Ahvenanmaan maakunnan hallitus] and the governor of Åland. |
Section 3 – Member of Parliament [parlamentti]
The functions of members of Parliament [parlamentti] as referred to in Chapter 1, Section 4(11)(b) of the Money Laundering Act consist of:
1) |
the functions of a member of the Finnish Parliament; |
2) |
the functions of a member of the Åland Parliament [Ahvenanmaan maakuntapäivät]; |
Section 4 – Member of the governing body [johtoelin] of a political party [poliittinen puolue]
A political party [poliittinen puolue] within the meaning of Chapter 1, Section 4(11)(c) of the Money Laundering Act refers to a party [puolue] entered in the register of parties [puoluerekisteri] on the basis of Section 2 of Act 10/1969 on Political Parties.
The functions of members of the governing body [johtoelin] of a political party [poliittinen puolue] consist of the functions of the chairperson and members of the party committee [puolueen hallitus].
The functions of members of the governing body [johtoelin] of a political party [poliittinen puolue] also consist of the functions of the deputy of a person referred to in Subsection 2.
Section 5 – Member of the supreme court [ylin tuomioistuin], constitutional court [perustuslakituomioistuin] or other corresponding judicial body [oikeuselin]
The functions as referred to in Chapter 1, Section 4(11)(d) of the Money Laundering Act of members of the supreme court [ylin tuomioistuin], constitutional court [perustuslakituomioistuin] or other corresponding judicial body [oikeuselin] whose decisions are not subject to appeal, except in exceptional cases consist of:
1) |
the functions of the president, justice or, in military matters, military member of the supreme court [ylin tuomioistuin]; |
2) |
the functions of the president, justice, environmental expert and senior engineering expert of the supreme administrative court [korkein hallinto-oikeus]; |
3) |
the functions of the president, justice and expert member of the labour court [työtuomioistuin]; |
4) |
the functions of the chief judge, junior insurance judge, senior physician and any other physician who is a member of the insurance court [vakuutusoikeus], and the functions of an expert member of the insurance court [vakuutusoikeus]; |
5) |
the functions of assessors in the labour court [työtuomioistuin] and insurance court [vakuutusoikeus]. |
The functions of members of the supreme court [ylin tuomioistuin], constitutional court [perustuslakituomioistuin] or other corresponding judicial body [oikeuselin] also include the functions of the deputy of a person referred to in Subsection 1.
Section 6 – Member of a court of auditors [tilintarkastustuomioistuin] or of the highest decision-making bodies [ylin päättävä elin] which audit the financial management of the State [valtio] and are equivalent to the National Audit Office of Finland [Valtiontalouden tarkastusvirasto]
The functions as referred to in Chapter 1, Section 4(11)(e) of the Money Laundering Act of members of a court of auditors [tilintarkastustuomioistuin] or of the highest decision-making bodies [ylin päättävä elin] which audit the financial management of the State and are equivalent to the National Audit office [Valtiontalouden tarkastusvirasto] consist of the functions of the auditor-general of the National Audit Office of Finland [Valtiontalouden tarkastusvirasto].
Section 7 – Member of the board of directors [johtokunta] of the central bank [keskuspankki]
The functions of members of the board of directors [johtokunta] of the central bank [keskuspankki] as referred to in Chapter 1, Section 4(11)(f) of the Money Laundering Act consist of the functions of members of the board of directors [johtokunta] of the Bank of Finland [Suomen Pankki].
Section 8 – Ambassador or chargé d’affaires
The functions of ambassadors as referred to in Chapter 1, Section 4(11)(g) of the Money Laundering Act consist of the functions of the head of mission [edustusto] governing an embassy [suurlähetystö], permanent representation [pysyvä edustusto], special mission [erityisedustusto] or consulate-general [pääkonsulaatti].
The functions of chargés d’affaires as referred to in Chapter 1, Section 4(11)(g) of the Money Laundering Act consist of the functions of the chargé d’affaires ad interim acting as deputy ambassador as referred to in Article 19(1) of the Vienna Convention on Diplomatic Relations.
Section 9 – Officer in the armed forces [puolustusvoimat] holding the rank of general or higher
The functions of officers in the armed forces [puolustusvoimat] holding the rank of general or higher as referred to in Chapter 1, Section 4(11)(h) of the Money Laundering Act consist of the functions of the chief of defence, chief of the military headquarters [Pääesikunta], generals and admirals.
Section 10 – Member of the administrative [hallintoelin], management [johtoelin] or supervisory bodies [valvontaelin] of wholly state-owned enterprises [valtion kokonaan omistama yritys]
Wholly state-owned enterprises [valtion kokonaan omistama yritys] as referred to in Chapter 1, Section 4(11)(i) of the Money Laundering Act consist of enterprises [yhtiö] wholly owned by the State [valtio] either directly or indirectly.
The functions of members of the administrative [hallintoelin], management [johtoelin] or supervisory bodies [valvontaelin] of wholly state-owned enterprises [valtion kokonaan omistama yritys] as referred to in Subsection 1 above consist of the functions of the chairperson and members of the board of directors [hallitus], the managing director and the chairperson and members of the administrative board [hallintoneuvosto] of the enterprise [yhtiö].
The functions of members of the administrative [hallintoelin], management [johtoelin] or supervisory bodies [valvontaelin] of wholly state-owned enterprises [valtion kokonaan omistama yritys] also comprise the functions of the deputy of a person referred to in Subsection 2 and of the deputy managing director.
Section 11 – Director, deputy director or member of the board [hallitus] of an international organisation [kansainvälinen yhteisö]
The international organisations [kansainvälinen yhteisö] referred to in Chapter 1, Section 4(11)(j) of the Money Laundering Act are organisations [organisaatio]:
1) |
that were established on the basis of treaties between states [valtio]; |
2) |
that can be recognised in the states [valtio] where they operate; |
3) |
that are not treated by states [valtio]as institutional units [institutionaalinen yksikkö] with financial interests. |
The international organisations [kansainvälinen yhteisö] referred to in Subsection 1 above consist of:
1) |
the United Nations [Yhdistyneet kansakunnat] and the related specialised agencies [erityisjärjestö]; |
2) |
international regional organisations [kansainvälinen alueellinen yhteisö]; |
3) |
international military organisations [kansainvälinen sotilaallinen yhteisö]; |
4) |
international organisations promoting economic cooperation [kansainvälinen taloudellista yhteistyötä edistävä yhteisö]. |
The functions of a director, deputy director or member of the board [hallitus] of an international organisation [kansainvälinen yhteisö] referred to above in this section consist of the functions of the secretary-general, secretary (general), chairperson, and chairperson and members of the board of directors [hallitus] of the international organisation [kansainvälinen yhteisö].
The functions of a director, deputy director or member of the board [hallitus] of an international organisation [kansainvälinen yhteisö] also consist of the functions of the deputy of a person referred to in subsection 3.
Section 12 – Entry into force
This Decree shall enter into force on 15 May 2019.

the need to lay down the duties and responsibilities of those that perform or performed a prominent public function, and the need to regulate more specific matters in that regard; |

the fact that this Decision entails no expenditure under the national budget for the financial year 2021; |
Have decided as follows:
A. |
To compile a national list containing those that perform or performed a prominent public function in Greece in the exercise of their duties and responsibilities, as follows:

B. |
The national list of prominent public functions does not include middle-ranking or more junior officials. The capacity of performing a prominent public function shall be taken into account for the purposes of exercising enhanced due diligence measures for a period of at least one (1) year after the loss of the position or until the liable persons consider that there are grounds for implementing those measures. |
C. |
The national list of prominent public functions shall be posted on the website of the Ministry of Finance and communicated to the European Commission. The national list of important public functions shall be updated following a re-submission of a recommendation from the Parliament’s Special Agency to the Committee for MP and Party Audits. |
D. |
This Decision shall apply from the date of its publication in the Government Gazette. |

For the purposes of this Act, a politically exposed person is a natural person undertaking a prominent public function or who has undertaken such a function within a period of at least one year prior to carrying out customer due diligence measures.
