COMMISSION IMPLEMENTING REGULATION (EU) 2024/917
of 22 March 2024
amending Implementing Regulation (EU) 2022/92 as regards certain reporting requirements for passively fished waste

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Directive (EU) 2019/883 of the European Parliament and of the Council of 17 April 2019 on port reception facilities for the delivery of waste from ships, amending Directive 2010/65/EU and repealing Directive 2000/59/EC (1), and in particular Article 8(7), second subparagraph, thereof,
Whereas:

Reporting requirements play a key role in ensuring proper monitoring and correct enforcement of legislation. However, it is important to streamline those requirements, in order to ensure that they fulfil the purpose for which they were intended and to limit the administrative burden. |

Commission Implementing Regulation (EU) 2022/92 (2) requires Member States to report on data on the volume and mass of passively fished waste each calendar year. |

In certain Member States, schemes have been set up to provide alternative financing of the costs of collecting and managing fishing gear waste or passively fished waste ashore. It is sufficient to report data on passively fished waste once in two years in order to monitor if such schemes are effective and in order to monitor how fishing vessels contribute to reducing waste contamination of the marine environment in the long-term. That requirement should therefore be simplified, in line with the Commission’s Communication on ‘Long-term competitiveness of the EU: looking beyond 2030’ (3). Member States should, in future, be required to provide a report for periods of two calendar years instead. |

Implementing Regulation (EU) 2022/92 should therefore be amended accordingly. |

The measures provided for in this Regulation are in accordance with the opinion of the Committee on Safe Seas and Prevention of Pollution from Ships, |
HAS ADOPTED THIS REGULATION:
Article 1
Article 4 of Implementing Regulation (EU) 2022/92 is replaced by the following:
‘Article 4
From 1 January 2024, Member States shall report the data and information for periods of two calendar years. The reports shall be provided electronically within 12 months of the end of the second year for which they were collected. The first report shall be submitted by 31 December 2026 at the latest.’.
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.
