COUNCIL COMMON POSITION 2005/689/CFSP

of 6 October 2005

extending Common Position 2004/694/CFSP on further measures in support of the effective implementation of the mandate of the International Criminal Tribunal for the former Yugoslavia (ICTY)

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union, and in particular Article 15 thereof,

Whereas:

(1)

On 11 October 2004, the Council adopted Common Position 2004/694/CFSP (1), in order to freeze all funds and economic resources belonging to Radovan KARADZIC, Ratko MLADIC and Ante GOTOVINA. By Council Decision 2004/767/CFSP (2), these measures were extended to all persons publicly indicted by the ICTY for war crimes who are not in custody of the Tribunal.

Common Position 2004/694/CFSP applies until 11 October 2005.

The Council considers it necessary to renew Common Position 2004/694/CFSP for another 12 months. The list contained in the Annex to that Common Position should be updated.

(4)

Following the transfer of Mr Sredoje LUKIC to ICTY detention units, his name should be removed from the list contained in the Annex to that Common Position.

(5)

Action by the Community is needed in order to implement these measures,

HAS ADOPTED THIS COMMON POSITION:

Article 1

Common Position 2004/694/CFSP is hereby extended for a further period of 12 months.

Article 2

The list set out in the Annex to Common Position 2004/694/CFSP shall be replaced by the list set out in the Annex to this Common Position.

Article 3

This Common Position shall take effect on 11 October 2005. It shall be kept under constant review. It shall be renewed, or amended as appropriate, if the Council deems that its objectives have not been met.

Article 4

This Common Position shall be published in the Official Journal of the European Union.
