    Prior notification of a concentration

    (Case COMP/M.6595 — AXA/BNP Paribas/Immeuble Cergy-Pontoise)

    1.

    On 5 June 2012, the Commission received notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which AXA France Vie SA (France) and BNP Paribas (France), acquire within the meaning of Article 3(1)(b) of the Merger Regulation indirect joint control of commercial premises in Cergy-Pontoise (France), by way of purchase of shares.

    The business activities of the undertakings concerned are:

    AXA France Vie SA: The AXA group is active in the field of financial protection services,

    BNP Paribas: BNP Paribas is a bank with a presence in 80 countries and active in three major areas of activity — retail banking, corporate and investment banking and investment solutions,

    The premises are located in the department of Val d'Oise, in the communes of Eragny-sur-Oise and Saint-Ouen l'Aumône (France), which lie within the urban area of Cergy-Pontoise. The premises currently operate under the name Boulanger.

    3.

    On preliminary examination, the Commission finds that the notified transaction could fall within the scope of the EC Merger Regulation. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under the EC Merger Regulation (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

    The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.
