    DECISION OF THE EEA JOINT COMMITTEE No 13/2021

    of 5 February 2021

    amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2024/18]

    THE EEA JOINT COMMITTEE,

    Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

    Whereas:

    (1)

    Commission Implementing Regulation (EU) 2020/992 of 9 July 2020 concerning the authorisation of a preparation of 6-phytase, produced by Aspergillus niger (DSM 25770) as feed additive for all avian species for laying (holder of the authorisation BASF SE) (1) is to be incorporated into the EEA Agreement.

    (2)

    Commission Implementing Regulation (EU) 2020/1033 of 15 July 2020 concerning the renewal of the authorisation of L-arginine produced by Corynebacterium glutamicum ATCC 13870 and the authorisation of L-arginine produced by Corynebacterium glutamicum KCCM 80182 as feed additives for all animal species, and repealing Regulation (EC) No 1139/2007 (2) is to be incorporated into the EEA Agreement.

    (3)

    Implementing Regulation (EU) 2020/1033 repeals Commission Regulation (EC) No 1139/2007 (3), which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

    (4)

    This Decision concerns legislation regarding feedingstuffs. Legislation regarding feedingstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

    Annex I to the EEA Agreement should therefore be amended accordingly,

    HAS ADOPTED THIS DECISION:

    Article 1

    Chapter II of Annex I to the EEA Agreement shall be amended as follows:

    1.

    The text of point 1zzzza (Commission Regulation (EC) No 1139/2007) is deleted.

    2.

    The following points are inserted after point 347 (Commission Implementing Regulation (EU) 2020/180):

    ‘348.

    32020 R 0992: Commission Implementing Regulation (EU) 2020/992 of 9 July 2020 concerning the authorisation of a preparation of 6-phytase, produced by Aspergillus niger (DSM 25770) as feed additive for all avian species for laying (holder of the authorisation BASF SE) (OJ L 221, 10.7.2020, p. 73).

    349.

    32020 R 1033: Commission Implementing Regulation (EU) 2020/1033 of 15 July 2020 concerning the renewal of the authorisation of L-arginine produced by Corynebacterium glutamicum ATCC 13870 and the authorisation of L-arginine produced by Corynebacterium glutamicum KCCM 80182 as feed additives for all animal species, and repealing Regulation (EC) No 1139/2007 (OJ L 227, 16.7.2020, p. 27).’

    Article 2

    The texts of Implementing Regulations (EU) 2020/992 and (EU) 2020/1033 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

    Article 3

    This Decision shall enter into force on 6 February 2021, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).

    Article 4

    This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
