(1) | Marine waters under the sovereignty and jurisdiction of Member States of the European Union include waters in the Mediterranean Sea, the Baltic Sea, the Black Sea and the North-east Atlantic Ocean, including the waters surrounding the Azores, Madeira and the Canary Islands.(1) | Morske vode pod suverenostjo in v pristojnosti držav članic Evropske unije vključujejo vode Sredozemskega, Baltiškega in Črnega morja ter severovzhodnega Atlantskega oceana, vključno z vodami, ki obdajajo Azore, Madeiro in Kanarske otoke.
(2) | It is evident that pressure on natural marine resources and the demand for marine ecological services are often too high and that the Community needs to reduce its impact on marine waters regardless of where their effects occur.(2) | Očitno je, da so obremenitve naravnih morskih virov in povpraševanje po morskih ekoloških storitvah pogosto preveliki in da bi morala Skupnost zmanjšati vpliv na morske vode ne glede na to, kje se pojavijo njihovi učinki.
(3) | The marine environment is a precious heritage that must be protected, preserved and, where practicable, restored with the ultimate aim of maintaining biodiversity and providing diverse and dynamic oceans and seas which are clean, healthy and productive. In that respect, this Directive should, inter alia, promote the integration of environmental considerations into all relevant policy areas and deliver the environmental pillar of the future maritime policy for the European Union.(3) | Morsko okolje je dragocena dediščina, ki jo je treba varovati, ohranjati in – kjer je to mogoče – obnavljati, da bi ohranili biotsko raznovrstnost in zagotovili raznolike in dinamične ter čiste, zdrave in produktivne oceane in morja. V tem pogledu bi ta direktiva morala med drugim spodbujati vključitev okoljskih razmislekov v vse zadevne politike in zagotoviti okoljski steber prihodnje pomorske politike Evropske unije.
(4) | In line with Decision No 1600/2002/EC of the European Parliament and of the Council of 22 July 2002 laying down the Sixth Community Environment Action Programme (4), a thematic strategy for the protection and conservation of the marine environment has been developed with the overall aim of promoting sustainable use of the seas and conserving marine ecosystems.(4) | V skladu s Sklepom št. 1600/2002/ES Evropskega parlamenta in Sveta z dne 22. julija 2002 o šestem okoljskem akcijskem programu Skupnosti (4) je bila oblikovana tematska strategija za varstvo in ohranitev morskega okolja s splošnim ciljem pospeševanja trajnostne rabe morij in ohranitve morskih ekosistemov.
(5) | The development and implementation of the thematic strategy should be aimed at the conservation of the marine ecosystems. This approach should include protected areas and should address all human activities that have an impact on the marine environment.(5) | Razvoj in izvajanje tematske strategije bi morala stremeti k ohranitvi morskih ekosistemov. Ta pristop bi moral vključevati zavarovana območja in obravnavati vse človekove dejavnosti, ki vplivajo na morsko okolje.
(6) | The establishment of marine protected areas, including areas already designated or to be designated under Council Directive 92/43/EEC of 21 May 1992 on the conservation of natural habitats and of wild fauna and flora (5) (hereinafter referred to as the ‘Habitats Directive’), Council Directive 79/409/EEC of 2 April 1979 on the conservation of wild birds (6) (hereinafter referred to as the ‘Birds Directive’), and under international or regional agreements to which the European Community or Member States concerned are Parties, is an important contribution to the achievement of good environmental status under this Directive.(6) | Vzpostavitev zaščitenih morskih območij, vključno z območji, ki so že določena ali še bodo določena v skladu z Direktivo Sveta 92/43/EGS z dne 21. maja 1992 o ohranjanju naravnih habitatov ter prosto živečih živalskih in rastlinskih vrst (5) (v nadaljevanju „Direktiva o habitatih“), Direktivo Sveta 79/409/EGS z dne 2. aprila 1979 o ohranjanju prosto živečih ptic (6) (v nadaljevanju „Direktiva o pticah“) ter v skladu z mednarodnimi ali regionalnimi sporazumi, katerih podpisnice so Evropska skupnost ali države članice, je pomemben prispevek k doseganju dobrega okoljskega stanja v skladu s to direktivo.
(7) | Establishing such protected areas under this Directive will be an important step towards fulfilling the commitments undertaken at the World Summit on Sustainable Development and in the Convention on Biological Diversity, approved by Council Decision 93/626/EEC (7), and will contribute to the creation of coherent and representative networks of such areas.(7) | Vzpostavitev takšnih zaščitenih območij v skladu s to direktivo bo pomemben korak k izpolnitvi obveznosti, sprejetih na svetovnem vrhu o trajnostnem razvoju in v Konvenciji o biološki raznovrstnosti, odobreni s Sklepom Sveta 93/626/EGS (7), ter bo prispevala k razvoju skladnega in reprezentativnega omrežja teh območij.
(8) | By applying an ecosystem-based approach to the management of human activities while enabling a sustainable use of marine goods and services, priority should be given to achieving or maintaining good environmental status in the Community’s marine environment, to continuing its protection and preservation, and to preventing subsequent deterioration.(8) | Z uporabo ekosistemskega pristopa k upravljanju človekovih dejavnosti in ob hkratnem zagotavljanju trajnostne rabe morskega blaga in storitev bi bilo treba prednost nameniti doseganju ali ohranjanju dobrega okoljskega stanja v morskem okolju Skupnosti, nadaljnjemu varstvu in ohranjanju tega okolja ter preprečevanju nadaljnjega slabšanja.
(9) | In order to achieve those objectives, a transparent and coherent legislative framework is required. This framework should contribute to coherence between different policies and foster the integration of environmental concerns into other policies, such as the Common Fisheries Policy, the Common Agricultural Policy and other relevant Community policies. The legislative framework should provide an overall framework for action and enable the action taken to be coordinated, consistent and properly integrated with action under other Community legislation and international agreements.(9) | Za dosego teh ciljev je potreben pregleden in usklajen zakonodajni okvir. Ta okvir bi moral pripomoči k skladnosti različnih politik in spodbujati vključevanje okoljskih vidikov v druge politike, kot so skupna ribiška politika, skupna kmetijska politika in druge ustrezne politike Skupnosti. Zakonodajni okvir bi moral zagotoviti splošen okvir za ukrepe in omogočiti usklajenost in skladnost sprejetih ukrepov ter njihovo primerno povezanost z ukrepi v okviru ostale zakonodaje Skupnosti in z mednarodnimi sporazumi.
(10) | The diverse conditions, problems and needs of the various marine regions or subregions making up the marine environment in the Community require different and specific solutions. That diversity should be taken into account at all stages of the preparation of marine strategies, but especially during the preparation, planning and execution of measures to achieve good environmental status in the Community’s marine environment at the level of marine regions or subregions.(10) | Raznoliki pogoji, težave in potrebe različnih morskih regij ali podregij, ki sestavljajo morsko okolje v Skupnosti, zahtevajo drugačne in posebne rešitve. Ta raznolikost bi se morala upoštevati na vseh ravneh oblikovanja morskih strategij, še zlasti pa pri pripravi, načrtovanju in izvajanju ukrepov na ravni morskih regij in podregij za dosego dobrega okoljskega stanja v morskem okolju Skupnosti.
(11) | Each Member State should therefore develop a marine strategy for its marine waters which, while being specific to its own waters, reflects the overall perspective of the marine region or subregion concerned. Marine strategies should culminate in the execution of programmes of measures designed to achieve or maintain good environmental status. However, Member States should not be required to take specific steps where there is no significant risk to the marine environment, or where the costs would be disproportionate taking account of the risks to the marine environment, provided that any decision not to take action is properly justified.(11) | Vsaka država članica bi morala zato za svoje morske vode oblikovati morsko strategijo, ki bi ob upoštevanju posebnih značilnosti njenih voda odražala celotno perspektivo zadevne morske regije ali podregije. Morske strategije bi morale voditi k izvajanju programov ukrepov za dosego ali ohranitev dobrega okoljskega stanja. Vendar pa od držav članic ne bi smeli zahtevati, da sprejmejo posebne korake, če ni bistvenega tveganja za morsko okolje ali če bi bili ob upoštevanju tveganja za morsko okolje stroški nesorazmerni, pod pogojem, da je vsaka odločitev o neukrepanju ustrezno utemeljena.
(12) | Coastal waters, including their seabed and subsoil, are an integral part of the marine environment, and as such should also be covered by this Directive, in so far as particular aspects of the environmental status of the marine environment are not already addressed through Directive 2000/60/EC of the European Parliament and of the Council of 23 October 2000 establishing a framework for Community action in the field of water policy (8) or other Community legislation, so as to ensure complementarity while avoiding unnecessary overlaps.(12) | Obalne vode, skupaj z morskim dnom in podtaljem, so sestavni del morskega okolja in bi morale biti zajete v tej direktivi, kolikor posamezni vidiki morskega okolja niso obravnavani že v Direktivi 2000/60/ES Evropskega parlamenta in Sveta z dne 23. oktobra 2000 o določitvi okvira za ukrepe Skupnosti na področju vodne politike (8) ali v drugi zakonodaji Skupnosti, da se zagotovi komplementarnost in v izogib nepotrebnemu prekrivanju.
(13) | By reason of the transboundary nature of the marine environment, Member States should cooperate to ensure the coordinated development of marine strategies for each marine region or subregion. Since marine regions or subregions are shared both with other Member States and with third countries, Member States should make every effort to ensure close coordination with all Member States and third countries concerned. Where practical and appropriate, existing institutional structures established in marine regions or subregions, in particular Regional Sea Conventions, should be used to ensure such coordination.(13) | Zaradi čezmejne narave morskega okolja bi morale države članice sodelovati, da bi zagotovile usklajen razvoj morskih strategij za posamezno morsko regijo ali podregijo. Ker si države članice morske regije ali podregije delijo z drugimi državami članicami in tretjimi državami, bi si morale vedno prizadevati za zagotovitev tesnega usklajevanja z vsemi zadevnimi državami članicami in tretjimi državami. Če je to izvedljivo in primerno, bi bilo treba obstoječe institucionalne strukture, vzpostavljene v morskih regijah ali podregijah, predvsem konvencije o regionalnih morjih, uporabiti za zagotovitev takšnega usklajevanja.
(14) | Member States having borders on the same marine region or subregion covered by this Directive, where the status of the sea is critical to the extent that urgent action is needed, should endeavour to agree on a plan of action including the earlier entry into operation of programmes of measures. In such cases, the Commission should be invited to consider providing supportive action to Member States for their enhanced efforts to improve the marine environment by making the region in question a pilot project.(14) | Države članice, ki mejijo na isto morsko regijo ali podregijo, ki jo zajema ta direktiva, bi si morale, če je stanje morja tako kritično, da je ukrepanje nujno potrebno, prizadevati za dosego soglasja o programu dela, ki vključuje zgodnejši začetek izvajanja programov ukrepov. V takih primerih bi bilo treba Komisijo pozvati, naj razmisli o zagotovitvi podpornih ukrepov državam članicam pri njihovih okrepljenih prizadevanjih za izboljšanje morskega okolja, s tem da zadevno regijo označi za pilotni projekt.
(15) | Not all Member States have marine waters as defined in this Directive and, therefore, the effect of the provisions of this Directive which exclusively address Member States which have marine waters should be limited to those Member States.(15) | Vse države članice nimajo morskih voda, kot so opredeljene v tej direktivi, zato bi bilo treba učinek določb te direktive, ki so izključno naslovljene na države članice, ki imajo morske vode, omejiti le na te države članice.
(16) | Since action at international level is indispensable to achieve cooperation and coordination, this Directive should further enhance the coherence of the contribution of the Community and its Member States under international agreements.(16) | Ker je ukrepanje na mednarodni ravni nujno potrebno, da se zagotovi sodelovanje in usklajenost, bi morala ta direktiva povečati koherenco prispevka Skupnosti in njenih držav članic na podlagi mednarodnih sporazumov.
(17) | The Community and its Member States are each parties to the United Nations Convention on the Law of the Sea (Unclos) approved by Council Decision 98/392/EC of 23 March 1998 concerning the conclusion by the European Community of the Unclos and the Agreement of 28 July 1994 relating to the implementation of Part XI thereof (9). The obligations of the Community and its Member States under those agreements should therefore be taken fully into account in this Directive. In addition to the provisions applicable to the marine waters of the Parties, the Unclos includes general obligations to ensure that activities under the jurisdiction or control of a Party do not cause damage beyond its marine waters, and to avoid that damage or hazards are transferred from one area to another or that one type of pollution is transformed into another.(17) | Skupnost in njene države članice so pogodbenice Konvencije Združenih narodov o pomorskem pravu (UNCLOS), ki je bila potrjena s Sklepom Sveta 98/392/ES z dne 23. marca 1998 o sklenitvi UNCLOS in Sporazuma o izvajanju dela XI Konvencije z dne 28. julija 1994 s strani Evropske skupnosti (9). Obveznosti Skupnosti in njenih držav članic iz teh sporazumov bi bilo treba zato v celoti upoštevati v tej direktivi. Poleg določb, ki veljajo za morske vode pogodbenic, so v UNCLOS tudi splošne obveznosti za zagotovitev, da dejavnosti pod oblastjo ali nadzorom posamezne pogodbenice ne povzročajo škode onkraj svojih morskih voda, ter v izogib prenosu škode ali tveganja iz enega območja v drugo ali pretvorbe ene vrste onesnaževanja v drugo.
(18) | This Directive should also support the strong position taken by the Community, in the context of the Convention on Biological Diversity, on halting biodiversity loss, ensuring the conservation and sustainable use of marine biodiversity, and on the creation of a global network of marine protected areas by 2012. Additionally, it should contribute to the achievement of the objectives of the Seventh Conference of the Parties to the Convention on Biological Diversity, which adopted an elaborate programme of work on marine and coastal biodiversity with a number of goals, targets and activities aimed at halting the loss of biological diversity nationally, regionally and globally and at securing the capacity of the marine ecosystems to support the provision of goods and services, and a programme of work on protected areas with the objective of establishing and maintaining ecologically representative systems of marine protected areas by 2012. The obligation for Member States to designate Natura 2000 sites under the Birds Directive and the Habitats Directive will make an important contribution to this process.(18) | Ta direktiva bi morala ravno tako podpirati trdno stališče Skupnosti v okviru Konvencije o biološki raznovrstnosti, in sicer o ustavitvi zmanjševanja biotske raznovrstnosti, ohranjevanju in trajnostni rabi morske biotske raznovrstnosti in o ustanovitvi globalnega omrežja zaščitenih morskih območij do leta 2012. Poleg tega bi morala ta direktiva prispevati k doseganju ciljev sedme konference pogodbenic Konvencije o biološki raznovrstnosti, ki je sprejela dovršen program dela o morski in obalni biotski raznovrstnosti s številnimi cilji in dejavnostmi, usmerjenimi k ustavitvi zmanjšanja biotske raznovrstnosti na nacionalni, regionalni ter svetovni ravni in k varovanju zmogljivosti morskih ekosistemov za podporo zagotovitve blaga in storitev ter program dela za zaščitena območja s ciljem ustanovitve in vzdrževanja ekološko reprezentativnih sistemov morskih zaščitenih območij do leta 2012. Obveznost držav članic, da imenujejo območja Natura 2000 v skladu z Direktivo o pticah in Direktivo o habitatih, bo pomemben prispevek k temu procesu.
(19) | This Directive should contribute to the fulfilment of the obligations and important commitments of the Community and the Member States under several relevant international agreements relating to the protection of the marine environment from pollution: the Convention on the Protection of the Marine Environment of the Baltic Sea Area, approved by Council Decision 94/157/EC (10), the Convention for the Protection of the Marine Environment of the North-East Atlantic, approved by Council Decision 98/249/EC (11), including its new Annex V on the Protection and Conservation of the Ecosystems and Biological Diversity of the Maritime Area and the corresponding Appendix 3, approved by Council Decision 2000/340/EC (12), the Convention for the Protection of the Marine Environment and the Coastal Region of the Mediterranean, approved by Council Decision 77/585/EEC (13), and its amendments from 1995, approved by Council Decision 1999/802/EC (14), as well as its Protocol for the Protection of the Mediterranean Sea Against Pollution from Land-Based Sources, approved by Council Decision 83/101/EEC (15), and its amendments from 1996, approved by Council Decision 1999/801/EC (16). This Directive should also contribute to the fulfilment of Member States’ obligations under the Convention on the Protection of the Black Sea Against Pollution, under which they have entered into important commitments relating to the protection of the marine environment from pollution, and to which the Community is not yet a party but in respect of which it has observer status.(19) | Ta direktiva bi morala prispevati k izpolnitvi obveznosti in pomembnih zavez v zvezi z varstvom morskega okolja pred onesnaževanjem, katerim so se Skupnost in države članice zavezale v okviru relevantnih mednarodnih sporazumov: Konvencija o varstvu morskega okolja območja Baltiškega morja, odobrena s Sklepom Sveta 94/157/ES (10), Konvencija o varstvu morskega okolja severovzhodnega Atlantika, odobrena s Sklepom Sveta 98/249/ES (11), vključno z njeno novo Prilogo V o varstvu in ohranjanju ekosistemov in biotske raznovrstnosti morskega območja in ustreznega dodatka 3, odobrena s Sklepom Sveta 2000/340/ES (12), Konvencija o varstvu morskega okolja in obalne regije Sredozemskega morja, odobrena s Sklepom Sveta 77/585/EGS (13), in njene spremembe iz leta 1995, odobrene s Sklepom Sveta 1999/802/ES (14), in njen Protokol o varstvu Sredozemskega morja pred onesnaževanjem iz virov na kopnem, odobren s Sklepom Sveta 83/101/EGS (15), ter njegove spremembe iz leta 1996, odobrene s Sklepom Sveta 1999/801/ES (16). Ta direktiva bi morala pomagati tudi pri izpolnitvi obveznosti držav članic v okviru Konvencije o varstvu Črnega morja pred onesnaževanjem, s katero so se zavezale k pomembnim obveznostim v zvezi z varstvom morskega okolja pred onesnaževanjem in katere Skupnost še ni podpisnica, ampak ima status opazovalke.
(20) | Third countries with waters in the same marine region or subregion as a Member State should be invited to participate in the process laid down in this Directive, thereby facilitating achievement of good environmental status in the marine region or subregion concerned.(20) | K sodelovanju v procesu, določenim v tej direktivi, bi bilo treba povabiti tretje države, ki imajo morske vode v isti morski regiji ali podregiji kot država članica, pri čemer bi na ta način pripomogle k dosegi dobrega okoljskega stanja v zadevni morski regiji ali podregiji.
(21) | It is crucial for the achievement of the objectives of this Directive to ensure the integration of conservation objectives, management measures and monitoring and assessment activities set up for spatial protection measures such as special areas of conservation, special protection areas or marine protected areas.(21) | Za dosego ciljev iz te direktive je bistveno, da se zagotovi vključitev ciljev ohranjanja, ukrepov upravljanja ter dejavnosti spremljanja in ocenjevanja, določenih za prostorske varovalne ukrepe, kakršni so posebna ohranitvena območja, posebna območja varstva in morska zaščitena območja.
(22) | Account should also be taken of biodiversity and the potential for marine research associated with deep-water environments.(22) | Upoštevati bi bilo treba tudi biotsko raznovrstnost in potencial za morske raziskave v zvezi z globokomorskim okoljem.
(23) | Since programmes of measures executed under marine strategies will be effective only if they are devised on the basis of a sound knowledge of the state of the marine environment in a particular area and are tailored as closely as possible to the needs of the waters concerned in the case of each Member State and from the general perspective of the marine region or subregion concerned, provision should be made for the preparation at national level of an appropriate framework, including marine research and monitoring operations, for informed policymaking. At Community level, support for associated research should be continuously enshrined in research and development policies. Recognition of marine issues in the Seventh Framework Programme on Research and Development is an important step in that direction.(23) | Ker bodo programi ukrepov, ki se izvajajo v skladu z morskimi strategijami, učinkoviti le, če bodo oblikovani na podlagi temeljitega poznavanja stanja morskega okolja na določenem območju in bodo ob upoštevanju splošne perspektive zadevne morske regije ali podregije čim bolj prilagojeni potrebam zadevnih vod za vsako državo članico, bi bilo treba oblikovati določbe, s katerimi se na nacionalni ravni zagotovi pripravo ustreznega okvira, vključno z raziskavami morja in postopki spremljanja stanja, za utemeljeno oblikovanje politik. Na ravni Skupnosti bi morala biti podpora s tem povezanim raziskavam nenehno sestavni del raziskovalne in razvojne politike. Pomemben korak v tej smeri je upoštevanje morskih vprašanj v Sedmem okvirnem programu za raziskave in razvoj.
(24) | As a first step in the preparation of programmes of measures, Member States across a marine region or subregion should undertake an analysis of the features or characteristics of, and pressures and impacts on, their marine waters, identifying the predominant pressures and impacts on those waters, and an economic and social analysis of their use and of the cost of degradation of the marine environment. They may use assessments already carried out in the context of regional sea conventions as a basis for their analyses.(24) | Kot prvi korak pri pripravi programov ukrepov bi morale države članice, ki mejijo na morsko regijo ali podregijo, analizirati lastnosti ali značilnosti svojih morskih voda ter obremenitve teh voda in vplive nanje, da bi določile bistvene obremenitve voda in vplive nanje, in opraviti ekonomsko in socialno analizo njihove uporabe in stroškov degradacije morskega okolja. Kot podlago za analize lahko uporabijo ocene, ki so bile že opravljene v okviru konvencij o regionalnih morjih.
(25) | On the basis of such analyses, Member States should then determine for their marine waters a set of characteristics for good environmental status. For those purposes, it is appropriate to make provision for the development of criteria and methodological standards to ensure consistency and to allow for comparison between marine regions or subregions of the extent to which good environmental status is being achieved. These should be developed with the involvement of all interested parties.(25) | Na podlagi teh analiz bi morale nato države članice za svoje morske vode določiti niz značilnosti za dobro okoljsko stanje. V ta namen bi bilo treba sprejeti določbe za oblikovanje meril in metodoloških standardov, da bi zagotovili doslednost in bi lahko primerjali, v kolikšni meri je bilo v različnih morskih regijah ali podregijah doseženo dobro okoljsko stanje. Merila in standarde bi bilo treba oblikovati v sodelovanju z vsemi zainteresiranimi stranmi.
(26) | The next step towards achieving good environmental status should be the establishment of environmental targets and monitoring programmes for ongoing assessment, enabling the state of the marine waters concerned to be evaluated on a regular basis.(26) | Naslednji korak k doseganju dobrega okoljskega stanja bi morala biti določitev okoljskih ciljnih vrednosti in programov spremljanja za stalno presojo, ki omogočajo redno ocenjevanje stanja zadevnih morskih voda.
(27) | Member States should then establish and implement programmes of measures which are designed to achieve or maintain good environmental status in the waters concerned, while accommodating existing Community and international requirements and the needs of the marine region or subregion concerned. Those measures should be devised on the basis of the precautionary principle and the principles that preventive action should be taken, that environmental damage should, as a priority, be rectified at source and that the polluter should pay.(27) | Države članice bi morale nato oblikovati in izvajati programe ukrepov, ki so oblikovani za doseganje ali ohranjanje dobrega okoljskega stanja v zadevnih vodah, obenem pa so prilagojeni obstoječim zahtevam Skupnosti in mednarodnim zahtevam ter potrebam zadevne morske regije ali podregije. (28) | It is appropriate that Member States take the abovementioned steps, given the precision of focus needed. In order to ensure cohesion of action across the Community as a whole and in relation to commitments at global level, it is essential that Member States notify the Commission of the steps taken, in order to enable the Commission to assess the coherence of action across the marine region or subregion concerned and as appropriate provide guidance on possible necessary modifications.(28) | Primerno je, da države članice zgoraj navedene korake izvajajo s posebnim poudarkom. (29) | Member States should take the necessary measures to achieve or maintain good environmental status in the marine environment. However, it should be recognised that achieving or maintaining good environmental status in every aspect may not be possible in all marine waters by 2020. Therefore, for reasons of fairness and feasibility, it is appropriate to make provision for cases where it would be impossible for a Member State to achieve the level of ambition of the environmental targets set or to achieve or maintain good environmental status.(29) | Države članice bi morale sprejeti potrebne ukrepe za dosego ali ohranitev dobrega okoljskega stanja v morskem okolju. Treba pa bi bilo priznati, da do leta 2020 morda ne bo možno doseči ali ohraniti dobrega okoljskega stanja v vseh vidikih in v vseh morskih vodah. (30) | In that context provision should be made for two special cases. The first special case refers to the situation where it is impossible for a Member State to meet its environmental targets because of action or inaction for which the Member State concerned is not responsible, or because of natural causes or force majeure, or because of actions which that Member State has itself taken for reasons of overriding public interest which outweigh the negative impact on the environment, or because natural conditions do not allow timely improvement in the status of marine waters. The Member State concerned should substantiate why it considers that such a special case has arisen and identify the area concerned, and should take appropriate ad-hoc measures with the aim of continuing to pursue the environmental targets, preventing further deterioration in the status of the marine waters affected and mitigating the adverse impact within the marine region or subregion concerned.(30) | V zvezi s tem bi bilo treba sprejeti določbe za dva posebna primera. Prvi posebni primer zadeva položaj, v katerem država članica ne more izpolniti svojih okoljskih ciljnih vrednosti, in sicer zaradi ukrepanja ali neukrepanja, za katero zadevna država članica ni odgovorna, zaradi naravnih vzrokov ali višje sile ali zaradi ukrepov, ki jih je ta država članica sprejela sama zaradi višjega javnega interesa, ki je prevladal nad negativnimi vplivi na okolje, ali zato, ker naravni pogoji ne omogočajo pravočasnega izboljšanja stanja morskih voda. (31) | The second special case refers to the situation where a Member State identifies an issue which has an impact on the environmental status of its marine waters, perhaps even of the entire marine region or subregion concerned, but which cannot be tackled by measures taken at national level or which is linked to another Community policy or to an international agreement. In such a case, arrangements should be made to inform the Commission of this within the framework of notification of programmes of measures and, where Community action is needed, to make appropriate recommendations to the Commission and the Council.(31) | Drugi posebni primer je položaj, kadar država članica odkrije zadevo, ki vpliva na okoljsko stanje njenih morskih voda, mogoče celo celotne zadevne morske regije ali podregije, vendar je ni mogoče rešiti z ukrepi, sprejetimi na nacionalni ravni ali povezanimi z drugo politiko Skupnosti ali mednarodnim sporazumom. (32) | However, the flexibility introduced for special cases should be subject to control at Community level. As regards the first special case, it is therefore appropriate that due consideration be given to the efficacy of any ad-hoc measures taken. Moreover, in cases where the Member State refers to action taken for overriding reasons of public interest, the Commission should assess whether any modifications or alterations made to the marine environment as a consequence do not permanently preclude or compromise the achievement of good environmental status in the marine region or subregion concerned or across marine waters of other Member States. The Commission should provide guidance on possible necessary modifications if it considers that the measures envisaged are not sufficient or suitable to ensure coherence of action across the marine region.(32) | Vseeno bi bilo treba prožnost, uvedeno za posebne primere, nadzorovati na ravni Skupnosti. V zvezi s prvim posebnim primerom je zato primerno, da se ustrezno upošteva učinkovitost vseh sprejetih ad-hoc ukrepov. Kadar se država članica sklicuje na ukrepe, sprejete zaradi prevladujočih razlogov javnega interesa, bi morala Komisija oceniti, ali katera od sprememb morskega okolja posledično na dolgi rok izključuje ali ogroža doseganje dobrega okoljskega stanja v zadevni morski regiji ali podregiji ali v morskih vodah drugih držav članic. (33) | As regards the second special case, the Commission should consider the issue and respond within a period of six months. The Commission should reflect, as appropriate, the recommendations of the Member State concerned when presenting related proposals to the European Parliament and the Council.(33) | V zvezi z drugim posebnim primerom bi morala Komisija preučiti zadevo in odgovoriti v roku šestih mesecev. (34) | In view of the dynamic nature of marine ecosystems and their natural variability, and given that the pressures and impacts on them may vary with the evolvement of different patterns of human activity and the impact of climate change, it is essential to recognise that the determination of good environmental status may have to be adapted over time. Accordingly, it is appropriate that programmes of measures for the protection and management of the marine environment be flexible and adaptive and take account of scientific and technological developments. Provision should therefore be made for the updating of marine strategies on a regular basis.(34) | Ob upoštevanju dinamične narave morskih ekosistemov ter njihove naravne spremenljivosti in ob upoštevanju, da se lahko obremenitve le-teh in vplivi nanje razlikujejo z razvijanjem različnih vzorcev človekovih dejavnosti in zaradi vpliva podnebnih sprememb, je bistveno priznati, da bo mogoče treba opredelitev dobrega okoljskega stanja sčasoma prilagoditi. (35) | Provision should also be made for the publication of programmes of measures and updates thereof, and for the presentation to the Commission of interim reports describing progress in the implementation of these programmes.(35) | Treba bi bilo tudi sprejeti določbo za objavljanje programov ukrepov in za njihovo posodobitev ter za predstavitev vmesnih poročil Komisiji, ki opisujejo napredek pri izvajanju teh programov.
(36) | To ensure the active involvement of the general public in the establishment, implementation and updating of marine strategies, provision should be made for proper public information on the different elements of marine strategies, or their related updates, as well as, upon request, relevant information used for the development of the marine strategies in accordance with Community legislation on public access to environmental information.(36) | Za zagotovitev dejavne vključenosti širše javnosti pri oblikovanju, izvajanju in posodabljanju morskih strategij bi bilo treba v skladu z zakonodajo Skupnosti o dostopu javnosti do informacij o okolju, predvideti ustrezne določbe o ustreznih javnih informacijah o različnih elementih morskih strategij ali njihovih ustreznih posodobitvah, na zahtevo pa tudi ustrezne informacije, ki se uporabijo za razvoj morskih strategij.
(37) | The Commission should present a first evaluation report on the implementation of this Directive within two years of receiving all programmes of measures and, in any case, by 2019 at the latest. Subsequent Commission reports should be published every six years thereafter.(37) | Komisija mora prvo ocenjevalno poročilo o izvajanju te direktive predložiti v dveh letih po prejemu vseh programov ukrepov, v vsakem primeru pa najpozneje do leta 2019. (38) | Provision should be made for the adoption of methodological standards for the assessment of the status of the marine environment, monitoring, environmental targets and the adoption of technical formats for the purposes of transmission and processing of data in line with Directive 2007/2/EC of the European Parliament and of the Council of 14 March 2007 establishing an Infrastructure for Spatial Information in the European Community (Inspire) (17).(38) | Predvideti bi bilo treba določbe za sprejetje metodoloških standardov za presojo stanja morskega okolja, za spremljanje, določitev okoljskih ciljnih vrednosti in sprejetje tehničnih formatov za prenos in obdelavo podatkov v skladu z Direktivo 2007/2/ES Evropskega parlamenta in Sveta z dne 14. marca 2007 o vzpostavitvi infrastrukture za prostorske informacije v Evropski skupnosti (INSPIRE) (17).
(39) | Measures regulating fisheries management can be taken in the context of the Common Fisheries Policy, as set out in Council Regulation (EC) No 2371/2002 of 20 December 2002 on the conservation and sustainable exploitation of fisheries resources under the Common Fisheries Policy (18), based on scientific advice with a view to supporting the achievement of the objectives addressed by this Directive, including the full closure to fisheries of certain areas, to enable the integrity, structure and functioning of ecosystems to be maintained or restored and, where appropriate, in order to safeguard, inter alia, spawning, nursery and feeding grounds. Articles 30 and 31 of the Euratom Treaty regulate discharges and emissions resulting from the use of radioactive material and this Directive should therefore not address them.(39) | Ukrepi, ki urejajo upravljanje ribištva, se lahko sprejmejo v okviru skupne ribiške politike, kot je določeno v Uredbi Sveta (ES) št. 2371/2002 z dne 20. decembra 2002 o ohranjevanju in trajnostnem izkoriščanju ribolovnih virov v okviru skupne ribiške politike (18), ki temelji na znanstvenem mnenju, za podporo doseganju ciljev iz te direktive, vključno s popolno prepovedjo ribolova na nekaterih območjih, da se omogoči ohranjanje ali ponovna vzpostavitev celovitosti, strukture in delovanja ekosistemov ter, kjer je to potrebno, za varovanje drstišč, območij odraščanja in hranjenja. (40) | The Common Fisheries Policy, including in the future reform, should take into account the environmental impacts of fishing and the objectives of this Directive.(40) | Skupna ribiška politika bi morala tudi v prihodnji reformi upoštevati vplive ribolova na okolje in cilje te direktive.
(41) | In the event that Member States consider that action in the fields mentioned above or other fields linked to another Community policy or to an international agreement is desirable, they should make appropriate recommendations for Community action.(41) | Če države članice menijo, da je ukrepanje na zgoraj omenjenih področjih ali drugih področjih, povezanih z drugo politiko Skupnosti ali mednarodnim sporazumom, zaželeno, bi morale pripraviti ustrezna priporočila o ukrepanju Skupnosti.
(42) | The serious environmental concerns, in particular those due to climate change, relating to the Arctic waters, a neighbouring marine environment of particular importance for the Community, need to be assessed by the Community institutions and may require action to ensure the environmental protection of the Arctic.(42) | Resna okoljska vprašanja, zlasti kot posledica podnebnih sprememb, v zvezi z arktičnimi vodami kot morskim območjem posebnega pomena za Skupnost je treba obravnavati v okviru institucij Skupnosti in lahko zahtevajo ukrepe za varstvo okolja v Arktiki.
(43) | Since the objectives of this Directive, namely protection and preservation of the marine environment, the prevention of its deterioration and where practicable the restoration of that environment in areas where it has been adversely affected, cannot be sufficiently achieved by Member States and can therefore, by reason of the scale and effects of the Directive, be better achieved at Community level, the Community may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty. In accordance with the principle of proportionality, as set out in that Article, this Directive does not go beyond what is necessary in order to achieve those objectives.(43) | Ker ciljev te direktive, in sicer varstvo in ohranjanje morskega okolja, preprečevanje njegovega slabšanja in, kadar je to izvedljivo, obnovo tega okolja na območjih, ki so jih prizadeli škodljivi učinki, države članice ne morejo zadovoljivo doseči in ker te cilje zaradi obsega in učinkov te direktive lažje doseže Skupnost, Skupnost lahko sprejme ukrepe v skladu z načelom subsidiarnosti iz člena 5 Pogodbe. (44) | Programmes of measures and subsequent action by Member States should be based on an ecosystem-based approach to the management of human activities and on the principles referred to in Article 174 of the Treaty, in particular the precautionary principle.(44) | Podlaga za programe ukrepov in nadaljnjih ukrepov držav članic bi moral biti ekosistemski pristop k upravljanju človekovih dejavnosti ter načelo iz člena 174 Pogodbe, zlasti previdnostno načelo.
(45) | This Directive respects the fundamental rights, and observes the principles, recognised by the Charter of Fundamental Rights of the European Union (19), in particular Article 37 thereof which seeks to promote the integration into the policies of the Union of a high level of environmental protection and the improvement of environmental quality in accordance with the principle of sustainable development.(45) | Ta direktiva spoštuje temeljne pravice in upošteva načela, ki jih priznava Listina Evropske unije o temeljnih pravicah (19), zlasti člen 37 Listine, ki spodbuja vključevanje visoke ravni varstva okolja v politike Unije in izboljšanje kakovosti okolja v skladu z načelom trajnostnega razvoja.

1.   This Directive establishes a framework within which Member States shall take the necessary measures to achieve or maintain good environmental status in the marine environment by the year 2020 at the latest.1.   Ta direktiva določa okvir, znotraj katerega morajo države članice najpozneje do leta 2020 sprejeti potrebne ukrepe za dosego ali ohranitev dobrega okoljskega stanja v morskem okolju.
2.   For that purpose, marine strategies shall be developed and implemented in order to:2.   V ta namen se morske strategije oblikujejo in izvajajo zato, da:
(a) | protect and preserve the marine environment, prevent its deterioration or, where practicable, restore marine ecosystems in areas where they have been adversely affected;(a) | zagotavljajo varstvo in ohranjanje morskega okolja, preprečijo njegovo propadanje ali, če je mogoče, obnovijo morske ekosisteme na območjih, ki so jih prizadeli škodljivi učinki;

3.   Marine strategies shall apply an ecosystem-based approach to the management of human activities, ensuring that the collective pressure of such activities is kept within levels compatible with the achievement of good environmental status and that the capacity of marine ecosystems to respond to human-induced changes is not compromised, while enabling the sustainable use of marine goods and services by present and future generations.3.   Morske strategije pri upravljanju človekovih dejavnosti uporabljajo ekosistemski pristop in tako zagotavljajo, da je skupna obremenitev takšnih dejavnosti skladna z dosego dobrega okoljskega stanja in da ni ogrožena sposobnost morskih ekosistemov, da se odzovejo na spremembe, ki jih povzročajo ljudje, hkrati pa sedanjim in prihodnjim generacijam omogočajo trajnostno rabo morskega blaga in storitev.

1.   This Directive shall apply to all marine waters as defined in Article 3(1), and shall take account of the transboundary effects on the quality of the marine environment of third States in the same marine region or subregion.1.   Ta direktiva se uporablja za vse morske vode, kakor so opredeljene v členu 3(1), in upošteva učinke prenašanja čez meje na kakovost morskega okolja tretjih držav v isti morski regiji ali podregiji.
2.   This Directive shall not apply to activities the sole purpose of which is defence or national security. 5. | ‘good environmental status’ means the environmental status of marine waters where these provide ecologically diverse and dynamic oceans and seas which are clean, healthy and productive within their intrinsic conditions, and the use of the marine environment is at a level that is sustainable, thus safeguarding the potential for uses and activities by current and future generations, i.e.: | (a) | the structure, functions and processes of the constituent marine ecosystems, together with the associated physiographic, geographic, geological and climatic factors, allow those ecosystems to function fully and to maintain their resilience to human-induced environmental change. Marine species and habitats are protected, human-induced decline of biodiversity is prevented and diverse biological components function in balance; | (b) | hydro-morphological, physical and chemical properties of the ecosystems, including those properties which result from human activities in the area concerned, support the ecosystems as described above. Anthropogenic inputs of substances and energy, including noise, into the marine environment do not cause pollution effects; | Good environmental status shall be determined at the level of the marine region or subregion as referred to in Article 4, on the basis of the qualitative descriptors in Annex I. Marine regions or subregionsMorske regije in podregije
1.   Member States shall, when implementing their obligations under this Directive, take due account of the fact that marine waters covered by their sovereignty or jurisdiction form an integral part of the following marine regions:1.   Države članice pri izvajanju obveznosti iz te direktive ustrezno upoštevajo dejstvo, da so morske vode, ki so pod njihovo suverenostjo ali pristojnostjo, sestavni del naslednjih morskih regij:

Member States shall inform the Commission of any subdivisions by the date specified in the first subparagraph of Article 26(1) but may revise these upon completion of the initial assessment referred in Article 5(2), point (a)(i).Države članice Komisijo obvestijo o vsaki razdelitvi na pododdelke do datuma, določenega v prvem pododstavku člena 26(1), vendar lahko te pododdelke revidirajo ob dokončanju začetne presoje iz točke (a)(i) člena 5(2).

1.   Each Member State shall, in respect of each marine region or subregion concerned, develop a marine strategy for its marine waters in accordance with the plan of action set out in points (a) and (b) of paragraph 2.1.   Vsaka država članica v zvezi z vsako zadevno morsko regijo ali podregijo razvije morsko strategijo za svoje morske vode v skladu s programom dela iz točk (a) in (b) odstavka 2.
2.   Member States sharing a marine region or subregion shall cooperate to ensure that, within each marine region or subregion, the measures required to achieve the objectives of this Directive, in particular the different elements of the marine strategies referred to in points (a) and (b), are coherent and coordinated across the marine region or subregion concerned, in accordance with the following plan of action for which Member States concerned endeavour to follow a common approach:2.   Države članice, ki si delijo morsko regijo ali podregijo, sodelujejo pri zagotavljanju, da so ukrepi v vsaki morski regiji ali podregiji, ki so potrebni za dosego ciljev te direktive, zlasti različnih elementov morskih strategij iz točk (a) in (b), usklajeni v zadevni morski regiji ali podregiji v skladu z naslednjim načrtom dejavnosti, pri katerem si zadevne države članice prizadevajo za skupen pristop:

3.   Member States having borders on the same marine region or subregion covered by this Directive should, where the status of the sea is so critical as to necessitate urgent action, devise a plan of action in accordance with paragraph 1 which includes an earlier entry into operation of programmes of measures as well as possible stricter protective measures, provided that this does not prevent good environmental status from being achieved or maintained in another marine region or subregion. Regional cooperationRegionalno sodelovanje
1.   In order to achieve the coordination referred to in Article 5(2), Member States shall, where practical and appropriate, use existing regional institutional cooperation structures, including those under Regional Sea Conventions, covering that marine region or subregion.1.   Za dosego usklajenosti iz člena 5(2) države članice, kjer je praktično in primerno, uporabljajo obstoječe regionalne institucionalne strukture sodelovanja, vključno s tistimi, ki jih določajo konvencije o regionalnih morjih, ki zajemajo tisto morsko regijo ali podregijo.
2.   For the purpose of establishing and implementing marine strategies, Member States shall, within each marine region or subregion, make every effort, using relevant international forums, including mechanisms and structures of Regional Sea Conventions, to coordinate their actions with third countries having sovereignty or jurisdiction over waters in the same marine region or subregion.2.   Za vzpostavitev in izvajanje morskih strategij si države članice znotraj posamezne morske regije ali podregije prizadevajo v okviru ustreznih mednarodnih forumov, vključno z uporabo mehanizmov in struktur, določenih v konvencijah o regionalnih morjih, za uskladitev svojih ukrepov s tretjimi državami, ki imajo suverenost ali pristojnost nad vodami iste morske regije ali podregije.

Competent authoritiesPristojni organi
1.   Member States shall, by 15 July 2010, for each marine region or subregion concerned, designate the authority or authorities competent for the implementation of this Directive with respect to their marine waters.1.   Države članice do 15. julija 2010 imenujejo za vsako zadevno morsko regijo ali podregijo organ oz. organe, pristojne za izvajanje te direktive v zvezi z njihovimi morskimi vodami.
By 15 January 2011, Member States shall provide the Commission with a list of the competent authorities designated, together with the items of information listed in Annex II.Države članice do 15. januarja 2011 predložijo Komisiji seznam imenovanih pristojnih organov skupaj z informacijami, navedenimi v Prilogi II.
At the same time, Member States shall send to the Commission a list of their competent authorities as regards those international bodies in which they participate and which are relevant for the implementation of this Directive.Države članice istočasno pošljejo Komisiji seznam svojih pristojnih organov glede tistih mednarodnih teles v katerih sodelujejo in ki so pomembna za izvajanje te direktive.
Member States within the catchment area of each marine region or subregion shall also designate the authority or authorities competent for cooperation and coordination as referred to in Article 6.Države članice v prispevnem območju vsake morske regije ali podregije določijo tudi organ ali organe, pristojne za sodelovanje in usklajevanje, kakor je navedeno v členu 6.

AssessmentPresoja
1.   In respect of each marine region or subregion, Member States shall make an initial assessment of their marine waters, taking account of existing data where available and comprising the following:1.   Države članice v zvezi z vsako morsko regijo in podregijo izvedejo začetno presojo svojih morskih voda, ki upošteva obstoječe podatke, v kolikor so ti na voljo, in zajema:
(a) | an analysis of the essential features and characteristics, and current environmental status of those waters, based on the indicative lists of elements set out in Table 1 of Annex III, and covering the physical and chemical features, the habitat types, the biological features and the hydro-morphology;(a) | analizo bistvenih lastnosti in značilnosti in sedanjega okoljskega stanja zadevnih voda, ki temelji na okvirnem seznamu elementov, določenih v tabeli 1 Priloge III, in zajema fizikalno-kemijske lastnosti, tipe habitatov, biološke lastnosti in hidromorfologijo;

2.   The analyses referred to in paragraph 1 shall take into account elements regarding coastal, transitional and territorial waters covered by relevant provisions of existing Community legislation, in particular Directive 2000/60/EC. They shall also take into account, or use as their basis, other relevant assessments such as those carried out jointly in the context of Regional Sea Conventions, so as to produce a comprehensive assessment of the status of the marine environment.2.   Analize iz odstavka 1 upoštevajo elemente v zvezi z obalnimi in teritorialnimi vodami ter somornicami, ki jih zajemajo ustrezne določbe iz obstoječe zakonodaje Skupnosti, zlasti iz Direktive 2000/60/ES. 3.   In preparing assessments pursuant to paragraph 1, Member States shall, by means of the coordination established pursuant to Articles 5 and 6, make every effort to ensure that:3.   Države članice skušajo pri pripravi presoj v skladu z odstavkom 1 z usklajevanjem na podlagi členov 5 in 6 po svojih najboljših močeh zagotoviti, da:

Determination of good environmental statusDoločanje dobrega okoljskega stanja
1.   By reference to the initial assessment made pursuant to Article 8(1), Member States shall, in respect of each marine region or subregion concerned, determine, for the marine waters, a set of characteristics for good environmental status, on the basis of the qualitative descriptors listed in Annex I.1.   Države članice s sklicevanjem na začetno presojo, ki se izvede v skladu s členom 8(1), v zvezi z vsako zadevno morsko regijo ali podregijo na podlagi generičnih deskriptorjev iz Priloge I za morske vode določijo vrsto značilnosti za dobro okoljsko stanje.
Member States shall take into account the indicative lists of elements set out in Table 1 of Annex III and, in particular, physical and chemical features, habitat types, biological features and hydro-morphology.Države članice pri tem upoštevajo okvirne sezname elementov iz tabele 1 Priloge III in še zlasti fizikalno-kemijske lastnosti, tipe habitatov, biološke lastnosti in hidromorfologijo.
Member States shall also take into account the pressures or impacts of human activities in each marine region or subregion, having regard to the indicative lists set out in Table 2 of Annex III.Države članice prav tako upoštevajo pritiske ali vplive človekovih dejavnosti v vsaki morski regiji ali podregiji, ob upoštevanju okvirnega seznama iz tabele 2 Priloge III.
2.   Member States shall notify the Commission of the assessment made pursuant to Article 8(1) and of the determination made pursuant to paragraph 1 of this Article within three months of completion of the latter.2.   Države članice obvestijo Komisijo o presoji, izvedeni v skladu s členom 8(1), in določanju v skladu z odstavkom 1 tega člena v treh mesecih po zaključku določanja.
3.   Criteria and methodological standards to be used by the Member States, which are designed to amend non-essential elements of this Directive by supplementing it, shall be laid down, on the basis of Annexes I and III, in accordance with the regulatory procedure with scrutiny referred to in Article 25(3) by 15 July 2010 in such a way as to ensure consistency and to allow for comparison between marine regions or subregions of the extent to which good environmental status is being achieved. Before proposing such criteria and standards the Commission shall consult all interested parties, including Regional Sea Conventions.3.   Merila in metodološki standardi, ki jih bodo uporabile države članice in ki so oblikovani za spremembo nebistvenih določb te direktive z njenim dopolnjevanjem, se določijo v skladu z regulativnim postopkom s pregledom iz člena 25(3) na podlagi prilog I in III do 15. julija 2010 na način, da se zagotovi doslednost in omogoči primerjava med morskimi regijami ali podregijami, v kolikšni meri je bilo doseženo dobro okoljsko stanje. Establishment of environmental targetsOblikovanje okoljskih ciljnih vrednosti
1.   On the basis of the initial assessment made pursuant to Article 8(1), Member States shall, in respect of each marine region or subregion, establish a comprehensive set of environmental targets and associated indicators for their marine waters so as to guide progress towards achieving good environmental status in the marine environment, taking into account the indicative lists of pressures and impacts set out in Table 2 of Annex III, and of characteristics set out in Annex IV.1.   Države članice na podlagi začetne presoje, izvedene v skladu s členom 8(1), v zvezi s posamezno morsko regijo ali podregijo oblikujejo celovit sklop okoljskih ciljnih vrednosti in s tem povezanih kazalcev za svoje morske vode za vodenje napredovanja v smeri doseganja dobrega okoljskega stanja v morskem okolju, ob upoštevanju okvirnih seznamov pritiskov in vplivov iz tabele 2 Priloge III ter značilnosti iz Priloge IV.
When devising those targets and indicators, Member States shall take into account the continuing application of relevant existing environmental targets laid down at national, Community or international level in respect of the same waters, ensuring that these targets are mutually compatible and that relevant transboundary impacts and transboundary features are also taken into account, to the extent possible.Države članice pri oblikovanju teh ciljnih vrednosti in kazalcev upoštevajo nenehno uporabo ustreznih obstoječih okoljskih ciljnih vrednosti, ki so za iste vode določeni na nacionalni in mednarodni ravni ter ravni Skupnosti, in zagotovijo, da so ti cilji medsebojno združljivi ter da se, kolikor je le mogoče, upoštevajo tudi ustrezni čezmejni vplivi in čezmejne lastnosti.

1.   On the basis of the initial assessment made pursuant to Article 8(1), Member States shall establish and implement coordinated monitoring programmes for the ongoing assessment of the environmental status of their marine waters on the basis of the indicative lists of elements set out in Annex III and the list set out in Annex V, and by reference to the environmental targets established pursuant to Article 10.1.   Države članice na podlagi začetne presoje, izvedene v skladu s členom 8(1), izdelajo in izvajajo usklajene programe spremljanja za stalno presojo okoljskega stanja svojih morskih voda na podlagi okvirnega seznama iz Prilog III in seznama iz Priloge V ter s sklicevanjem na okoljske ciljne vrednosti, oblikovane v skladu s členom 10.

1.   Member States shall, in respect of each marine region or subregion concerned, identify the measures which need to be taken in order to achieve or maintain good environmental status, as determined pursuant to Article 9(1), in their marine waters.1.   Države članice za vsako zadevno morsko regijo ali podregijo določijo ukrepe, ki jih je treba sprejeti za dosego ali ohranitev dobrega okoljskega stanja v njihovih morskih vodah, določenega v skladu s členom 9(1).

3.   When drawing up the programme of measures pursuant to paragraph 2, Member States shall give due consideration to sustainable development and, in particular, to the social and economic impacts of the measures envisaged. To assist the competent authority or authorities referred to in Article 7 to pursue their objectives in an integrated manner, Member States may identify or establish administrative frameworks in order to benefit from such interaction.3.   Pri oblikovanju programa ukrepov v skladu z odstavkom 2 države članice upoštevajo trajnostni razvoj ter še zlasti socialne in gospodarske vplive predvidenih ukrepov. Member States shall ensure that measures are cost-effective and technically feasible, and shall carry out impact assessments, including cost-benefit analyses, prior to the introduction of any new measure.Države članice zagotovijo, da so ukrepi stroškovno učinkoviti in tehnično izvedljivi, ter pred uvedbo novega ukrepa izvajajo presoje vplivov, vključno z analizo stroškov in koristi.

5.   Where Member States consider that the management of a human activity at Community or international level is likely to have a significant impact on the marine environment, particularly in the areas addressed in paragraph 4, they shall, individually or jointly, address the competent authority or international organisation concerned with a view to the consideration and possible adoption of measures that may be necessary in order to achieve the objectives of this Directive, so as to enable the integrity, structure and functioning of ecosystems to be maintained or, where appropriate, restored.5.   Države članice se, če menijo, da bo upravljanje človekove dejavnosti na ravni Skupnosti ali mednarodni ravni po vsej verjetnosti imelo velik vpliv na morsko okolje, zlasti na območjih, ki jih obravnava člen 4, posamezno ali skupaj obrnejo na pristojni organ ali zadevno mednarodno organizacijo, da bi prišlo do obravnave in morebitnega sprejetja ukrepov, ki bi lahko bili potrebni za doseganje ciljev te direktive, da se s tem omogoči ohranjanje ali, kjer je to primerno, ponovna vzpostavitev celovitosti, strukture in delovanja ekosistemov.
6.   By 2013 at the latest, Member States shall make publicly available, in respect of each marine region or subregion, relevant information on the areas referred to in paragraphs 4 and 5.6.   Države članice najkasneje do leta 2013 za vsako morsko regijo ali podregijo objavijo ustrezne informacije o območjih iz odstavkov 4 in 5.

ExceptionsIzjeme

The Member State concerned shall identify such instances clearly in its programme of measures and shall substantiate its view to the Commission. In identifying instances a Member State shall consider the consequences for Member States in the marine region or subregion concerned.Zadevna država članica v svojem programu ukrepov te primere jasno opredeli in Komisiji predloži utemeljitev svojega mnenja. However, the Member State concerned shall take appropriate ad-hoc measures aiming to continue pursuing the environmental targets, to prevent further deterioration in the status of the marine waters affected for reasons identified under points (b), (c) or (d) and to mitigate the adverse impact at the level of the marine region or subregion concerned or in the marine waters of other Member States.Zadevna država članica sprejme ustrezne ad-hoc ukrepe za nadaljevanje prizadevanj za dosego okoljskih ciljnih vrednosti in preprečevanje nadaljnjega poslabšanja stanja prizadetih morskih voda zaradi razlogov, opredeljenih v točki (b), (c) ali (d), in ublažitev škodljivega vpliva na ravni zadevne morske regije ali podregije ali v morskih vodah drugih držav članic.

1.   Where a Member State identifies an issue which has an impact on the environmental status of its marine waters and which cannot be tackled by measures adopted at national level, or which is linked to another Community policy or international agreement, it shall inform the Commission accordingly and provide a justification to substantiate its view.1.   Kadar država članica opredeli zadevo, ki ima vpliv na okoljsko stanje njenih morskih voda in je ni mogoče rešiti z ukrepi, sprejetimi na nacionalni ravni, ali ki je povezana z drugo politiko Skupnosti ali mednarodnim sporazumom, o tem obvesti Komisijo in predloži utemeljitev za svoja mnenja.
The Commission shall respond within a period of six months.Komisija odgovori v šestih mesecih.
2.   Where action by Community institutions is needed, Member States shall make appropriate recommendations to the Commission and the Council for measures regarding the issues referred to in paragraph 1. Unless otherwise specified in relevant Community legislation, the Commission shall respond to any such recommendation within a period of six months and, as appropriate, reflect the recommendations when presenting related proposals to the European Parliament and to the Council.2.   Kjer je potrebno ukrepanje institucij Skupnosti, države članice Komisiji in Svetu predložijo ustrezna priporočila glede ukrepov v zvezi s primeri iz odstavka 1. 1.   The Commission shall publish a first evaluation report on the implementation of this Directive within two years of receiving all programmes of measures and, in any case, by 2019 at the latest.1.   Komisija objavi prvo poročilo o oceni izvajana te direktive v dveh letih po prejemu vseh programov ukrepov in v vsakem primeru najpozneje do leta 2019.
The Commission shall publish further reports every six years thereafter. It shall submit the reports to the European Parliament and to the Council.Komisija potem vsakih šest let objavi nadaljnja poročila. Poročila predloži Evropskemu parlamentu in Svetu.
2.   By 15 July 2012 at the latest, the Commission shall publish a report assessing the contribution of this Directive to the implementation of existing obligations, commitments and initiatives of the Member States or the Community at Community or international level in the sphere of environmental protection in marine waters.2.   Komisija najpozneje do 15. julija 2012 objavi poročilo, v katerem je podana ocena prispevka te direktive k izvajanju obstoječih obveznosti in pobud držav članic ali Skupnosti na ravni Skupnosti ali mednarodni ravni na področju varstva okolja v morskih vodah.
That report shall be submitted to the European Parliament and to the Council.To poročilo se posreduje Evropskemu parlamentu in Svetu.
3.   The reports provided for in paragraph 1 shall include the following:3.   Poročila iz odstavka 1 vključujejo:

On the basis of the information provided by the Member States by 2013, the Commission shall report by 2014 on progress in the establishment of marine protected areas, having regard to existing obligations under applicable Community law and international commitments of the Community and the Member States.Na podlagi informacij, ki jih posredujejo države članice do leta 2013, Komisija do leta 2014 poroča o napredku pri ustanavljanju zaščitenih morskih območij ob upoštevanju obstoječih obveznosti v skladu z veljavno zakonodajo Skupnosti ter mednarodnih obveznosti Skupnosti in držav članic.

1.   Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by 15 July 2010 at the latest. When Member States adopt those measures, they shall contain a reference to this Directive or shall be accompanied by such a reference on the occasion of their official publication. To determine the characteristics of good environmental status in a marine region or subregion as provided for in Article 9(1), Member States shall consider each of the qualitative descriptors listed in this Annex in order to identify those descriptors which are to be used to determine good environmental status for that marine region or subregion. When a Member State considers that it is not appropriate to use one or more of those descriptors, it shall provide the Commission with a justification in the framework of the notification made pursuant to Article 9(2).Države članice za določitev značilnosti dobrega okoljskega stanja v morski regiji ali podregiji, kakor je predvideno v členu 9(1), preučijo vsakega od kakovostnih deskriptorjev, navedenih v tej prilogi, da bi opredelile tiste deskriptorje, ki se uporabijo za določitev dobrega okoljskega stanja morske regije ali podregije.
