CHARTER OF FUNDAMENTAL RIGHTS OF THE EUROPEAN UNION	CARTA DOS DIREITOS FUNDAMENTAIS DA UNIÃO EUROPEIA
The European Parliament, the Council and the Commission solemnly proclaim the following text as the Charter of Fundamental Rights of the European Union. CHARTER OF FUNDAMENTAL RIGHTS OF THE EUROPEAN UNION	CARTA DOS DIREITOS FUNDAMENTAIS DA UNIÃO EUROPEIA
The peoples of Europe, in creating an ever closer union among them, are resolved to share a peaceful future based on common values.	Os povos da Europa, estabelecendo entre si uma união cada vez mais estreita, decidiram partilhar um futuro de paz, assente em valores comuns.
Conscious of its spiritual and moral heritage, the Union is founded on the indivisible, universal values of human dignity, freedom, equality and solidarity; it is based on the principles of democracy and the rule of law. It places the individual at the heart of its activities, by establishing the citizenship of the Union and by creating an area of freedom, security and justice.	Consciente do seu património espiritual e moral, a União baseia-se nos valores indivisíveis e universais da dignidade do ser humano, da liberdade, da igualdade e da solidariedade; assenta nos princípios da democracia e do Estado de direito. Ao instituir a cidadania da União e ao criar um espaço de liberdade, segurança e justiça, coloca o ser humano no cerne da sua ação.
The Union contributes to the preservation and to the development of these common values while respecting the diversity of the cultures and traditions of the peoples of Europe as well as the national identities of the Member States and the organisation of their public authorities at national, regional and local levels; it seeks to promote balanced and sustainable development and ensures free movement of persons, services, goods and capital, and the freedom of establishment.	A União contribui para a preservação e o desenvolvimento destes valores comuns, no respeito pela diversidade das culturas e tradições dos povos da Europa, bem como da identidade nacional dos Estados-Membros e da organização dos seus poderes públicos aos níveis nacional, regional e local; procura promover um desenvolvimento equilibrado e duradouro e assegura a livre circulação das pessoas, dos serviços, dos bens e dos capitais, bem como a liberdade de estabelecimento.
To this end, it is necessary to strengthen the protection of fundamental rights in the light of changes in society, social progress and scientific and technological developments by making those rights more visible in a Charter.	Para o efeito, é necessário, conferindo-lhes maior visibilidade por meio de uma Carta, reforçar a proteção dos direitos fundamentais, à luz da evolução da sociedade, do progresso social e da evolução científica e tecnológica.
This Charter reaffirms, with due regard for the powers and tasks of the Union and for the principle of subsidiarity, the rights as they result, in particular, from the constitutional traditions and international obligations common to the Member States, the European Convention for the Protection of Human Rights and Fundamental Freedoms, the Social Charters adopted by the Union and by the Council of Europe and the case-law of the Court of Justice of the European Union and of the European Court of Human Rights. In this context the Charter will be interpreted by the courts of the Union and the Member States with due regard to the explanations prepared under the authority of the Praesidium of the Convention which drafted the Charter and updated under the responsibility of the Praesidium of the European Convention.	A presente Carta reafirma, no respeito pelas atribuições e competências da União e na observância do princípio da subsidiariedade, os direitos que decorrem, nomeadamente, das tradições constitucionais e das obrigações internacionais comuns aos Estados-Membros, da Convenção Europeia para a Proteção dos Direitos do Homem e das Liberdades Fundamentais, das Cartas Sociais aprovadas pela União e pelo Conselho da Europa, bem como da jurisprudência do Tribunal de Justiça da União Europeia e do Tribunal Europeu dos Direitos do Homem. Neste contexto, a Carta será interpretada pelos órgãos jurisdicionais da União e dos Estados-Membros tendo na devida conta as anotações elaboradas sob a autoridade do Praesidium da Convenção que redigiu a Carta e atualizadas sob a responsabilidade do Praesidium da Convenção Europeia.
Enjoyment of these rights entails responsibilities and duties with regard to other persons, to the human community and to future generations.	O gozo destes direitos implica responsabilidades e deveres, tanto para com as outras pessoas individualmente consideradas, como para com a comunidade humana e as gerações futuras.
The Union therefore recognises the rights, freedoms and principles set out hereafter.	Assim sendo, a União reconhece os direitos, liberdades e princípios a seguir enunciados.
TITLE I	TÍTULO I
DIGNITY	DIGNIDADE
Article 1	Artigo 1.o
Human dignity	Dignidade do ser humano
Human dignity is inviolable. It must be respected and protected.	A dignidade do ser humano é inviolável. Deve ser respeitada e protegida.
Article 2	Artigo 2.o
Right to life	Direito à vida
1. Everyone has the right to life.	1. Todas as pessoas têm direito à vida.
2. No one shall be condemned to the death penalty, or executed.	2. Ninguém pode ser condenado à pena de morte, nem executado.
Article 3	Artigo 3.o
Right to the integrity of the person	Direito à integridade do ser humano
1. Everyone has the right to respect for his or her physical and mental integrity.	1. Todas as pessoas têm direito ao respeito pela sua integridade física e mental.
2. In the fields of medicine and biology, the following must be respected in particular:	2. No domínio da medicina e da biologia, devem ser respeitados, designadamente:
(a) \| the free and informed consent of the person concerned, according to the procedures laid down by law;	a) \| O consentimento livre e esclarecido da pessoa, nos termos da lei;
(b) \| the prohibition of eugenic practices, in particular those aiming at the selection of persons;	b) \| A proibição das práticas eugénicas, nomeadamente das que têm por finalidade a seleção das pessoas;

Prohibition of torture and inhuman or degrading treatment or punishment	Proibição da tortura e dos tratos ou penas desumanos ou degradantes
No one shall be subjected to torture or to inhuman or degrading treatment or punishment.	Ninguém pode ser submetido a tortura, nem a tratos ou penas desumanos ou degradantes.
Article 5	Artigo 5.o
Prohibition of slavery and forced labour	Proibição da escravidão e do trabalho forçado
1. No one shall be held in slavery or servitude.	1. Ninguém pode ser sujeito a escravidão nem a servidão.
2. No one shall be required to perform forced or compulsory labour.	2. Ninguém pode ser constrangido a realizar trabalho forçado ou obrigatório.
3. Trafficking in human beings is prohibited.	3. É proibido o tráfico de seres humanos.

Right to liberty and security	Direito à liberdade e à segurança
Everyone has the right to liberty and security of person.	Toda a pessoa tem direito à liberdade e segurança.
Article 7	Artigo 7.o
Respect for private and family life	Respeito pela vida privada e familiar
Everyone has the right to respect for his or her private and family life, home and communications.	Todas as pessoas têm direito ao respeito pela sua vida privada e familiar, pelo seu domicílio e pelas suas comunicações.
Article 8	Artigo 8.o
Protection of personal data	Proteção de dados pessoais
1. Everyone has the right to the protection of personal data concerning him or her.	1. Todas as pessoas têm direito à proteção dos dados de caráter pessoal que lhes digam respeito.
2. Such data must be processed fairly for specified purposes and on the basis of the consent of the person concerned or some other legitimate basis laid down by law. Everyone has the right of access to data which has been collected concerning him or her, and the right to have it rectified.	2. Esses dados devem ser objeto de um tratamento leal, para fins específicos e com o consentimento da pessoa interessada ou com outro fundamento legítimo previsto por lei. Todas as pessoas têm o direito de aceder aos dados coligidos que lhes digam respeito e de obter a respetiva retificação.
3. Compliance with these rules shall be subject to control by an independent authority.	3. O cumprimento destas regras fica sujeito a fiscalização por parte de uma autoridade independente.
Article 9	Artigo 9.o
Right to marry and right to found a family	Direito de contrair casamento e de constituir família
The right to marry and the right to found a family shall be guaranteed in accordance with the national laws governing the exercise of these rights.	O direito de contrair casamento e o direito de constituir família são garantidos pelas legislações nacionais que regem o respetivo exercício.
Article 10	Artigo 10.o
Freedom of thought, conscience and religion	Liberdade de pensamento, de consciência e de religião
1. Everyone has the right to freedom of thought, conscience and religion. This right includes freedom to change religion or belief and freedom, either alone or in community with others and in public or in private, to manifest religion or belief, in worship, teaching, practice and observance.	1. Todas as pessoas têm direito à liberdade de pensamento, de consciência e de religião. Este direito implica a liberdade de mudar de religião ou de convicção, bem como a liberdade de manifestar a sua religião ou a sua convicção, individual ou coletivamente, em público ou em privado, através do culto, do ensino, de práticas e da celebração de ritos.
2. The right to conscientious objection is recognised, in accordance with the national laws governing the exercise of this right.	2. O direito à objeção de consciência é reconhecido pelas legislações nacionais que regem o respetivo exercício.
Article 11	Artigo 11.o
Freedom of expression and information	Liberdade de expressão e de informação
1. Everyone has the right to freedom of expression. This right shall include freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers.	1. Qualquer pessoa tem direito à liberdade de expressão. Este direito compreende a liberdade de opinião e a liberdade de receber e de transmitir informações ou ideias, sem que possa haver ingerência de quaisquer poderes públicos e sem consideração de fronteiras.
2. The freedom and pluralism of the media shall be respected.	2. São respeitados a liberdade e o pluralismo dos meios de comunicação social.
Article 12	Artigo 12.o
Freedom of assembly and of association	Liberdade de reunião e de associação
1. Everyone has the right to freedom of peaceful assembly and to freedom of association at all levels, in particular in political, trade union and civic matters, which implies the right of everyone to form and to join trade unions for the protection of his or her interests.	1. Todas as pessoas têm direito à liberdade de reunião pacífica e à liberdade de associação a todos os níveis, nomeadamente nos domínios político, sindical e cívico, o que implica o direito de, com outrem, fundarem sindicatos e de neles se filiarem para a defesa dos seus interesses.
2. Political parties at Union level contribute to expressing the political will of the citizens of the Union.	2. Os partidos políticos ao nível da União contribuem para a expressão da vontade política dos cidadãos da União.
Article 13	Artigo 13.o
Freedom of the arts and sciences	Liberdade das artes e das ciências
The arts and scientific research shall be free of constraint. Academic freedom shall be respected.	As artes e a investigação científica são livres. É respeitada a liberdade académica.
Article 14	Artigo 14.o
Right to education	Direito à educação
1. Everyone has the right to education and to have access to vocational and continuing training.	1. Todas as pessoas têm direito à educação, bem como ao acesso à formação profissional e contínua.
2. This right includes the possibility to receive free compulsory education.	2. Este direito inclui a possibilidade de frequentar gratuitamente o ensino obrigatório.
3. The freedom to found educational establishments with due respect for democratic principles and the right of parents to ensure the education and teaching of their children in conformity with their religious, philosophical and pedagogical convictions shall be respected, in accordance with the national laws governing the exercise of such freedom and right.	3. São respeitados, segundo as legislações nacionais que regem o respetivo exercício, a liberdade de criação de estabelecimentos de ensino, no respeito pelos princípios democráticos, e o direito dos pais de assegurarem a educação e o ensino dos filhos de acordo com as suas convicções religiosas, filosóficas e pedagógicas.
Article 15	Artigo 15.o
Freedom to choose an occupation and right to engage in work	Liberdade profissional e direito de trabalhar
1. Everyone has the right to engage in work and to pursue a freely chosen or accepted occupation.	1. Todas as pessoas têm o direito de trabalhar e de exercer uma profissão livremente escolhida ou aceite.
2. Every citizen of the Union has the freedom to seek employment, to work, to exercise the right of establishment and to provide services in any Member State.	2. Todos os cidadãos da União têm a liberdade de procurar emprego, de trabalhar, de se estabelecer ou de prestar serviços em qualquer Estado-Membro.
3. Nationals of third countries who are authorised to work in the territories of the Member States are entitled to working conditions equivalent to those of citizens of the Union.	3. Os nacionais de países terceiros que sejam autorizados a trabalhar no território dos Estados-Membros têm direito a condições de trabalho equivalentes àquelas de que beneficiam os cidadãos da União.
Article 16	Artigo 16.o
Freedom to conduct a business	Liberdade de empresa
The freedom to conduct a business in accordance with Union law and national laws and practices is recognised.	É reconhecida a liberdade de empresa, de acordo com o direito da União e as legislações e práticas nacionais.
Article 17	Artigo 17.o
Right to property	Direito de propriedade
1. Everyone has the right to own, use, dispose of and bequeath his or her lawfully acquired possessions. No one may be deprived of his or her possessions, except in the public interest and in the cases and under the conditions provided for by law, subject to fair compensation being paid in good time for their loss. The use of property may be regulated by law in so far as is necessary for the general interest.	1. Todas as pessoas têm o direito de fruir da propriedade dos seus bens legalmente adquiridos, de os utilizar, de dispor deles e de os transmitir em vida ou por morte. Ninguém pode ser privado da sua propriedade, exceto por razões de utilidade pública, nos casos e condições previstos por lei e mediante justa indemnização pela respetiva perda, em tempo útil. A utilização dos bens pode ser regulamentada por lei na medida do necessário ao interesse geral.
2. Intellectual property shall be protected.	2. É protegida a propriedade intelectual.
Article 18	Artigo 18.o
Right to asylum	Direito de asilo
The right to asylum shall be guaranteed with due respect for the rules of the Geneva Convention of 28 July 1951 and the Protocol of 31 January 1967 relating to the status of refugees and in accordance with the Treaty on European Union and the Treaty on the Functioning of the European Union (hereinafter referred to as ‘the Treaties’).	É garantido o direito de asilo, no quadro da Convenção de Genebra de 28 de julho de 1951 e do Protocolo de 31 de janeiro de 1967, relativos ao Estatuto dos Refugiados, e nos termos do Tratado da União Europeia e do Tratado sobre o Funcionamento da União Europeia (a seguir designados «Tratados»).
Article 19	Artigo 19.o
Protection in the event of removal, expulsion or extradition	Proteção em caso de afastamento, expulsão ou extradição
1. Collective expulsions are prohibited.	1. São proibidas as expulsões coletivas.
2. No one may be removed, expelled or extradited to a State where there is a serious risk that he or she would be subjected to the death penalty, torture or other inhuman or degrading treatment or punishment.	2. Ninguém pode ser afastado, expulso ou extraditado para um Estado onde corra sério risco de ser sujeito a pena de morte, a tortura ou a outros tratos ou penas desumanos ou degradantes.
TITLE III	TÍTULO III
EQUALITY	IGUALDADE
Article 20	Artigo 20.o
Equality before the law	Igualdade perante a lei
Everyone is equal before the law.	Todas as pessoas são iguais perante a lei.
Article 21	Artigo 21.o
Non-discrimination	Não discriminação
1. Any discrimination based on any ground such as sex, race, colour, ethnic or social origin, genetic features, language, religion or belief, political or any other opinion, membership of a national minority, property, birth, disability, age or sexual orientation shall be prohibited.	1. É proibida a discriminação em razão, designadamente, do sexo, raça, cor ou origem étnica ou social, características genéticas, língua, religião ou convicções, opiniões políticas ou outras, pertença a uma minoria nacional, riqueza, nascimento, deficiência, idade ou orientação sexual.
2. Within the scope of application of the Treaties and without prejudice to any of their specific provisions, any discrimination on grounds of nationality shall be prohibited.	2. No âmbito de aplicação dos Tratados e sem prejuízo das suas disposições específicas, é proibida toda a discriminação em razão da nacionalidade.
Article 22	Artigo 22.o
Cultural, religious and linguistic diversity	Diversidade cultural, religiosa e linguística
The Union shall respect cultural, religious and linguistic diversity.	A União respeita a diversidade cultural, religiosa e linguística.
Article 23	Artigo 23.o
Equality between women and men	Igualdade entre homens e mulheres
Equality between women and men must be ensured in all areas, including employment, work and pay.	Deve ser garantida a igualdade entre homens e mulheres em todos os domínios, incluindo em matéria de emprego, trabalho e remuneração.
The principle of equality shall not prevent the maintenance or adoption of measures providing for specific advantages in favour of the under-represented sex.	O princípio da igualdade não obsta a que se mantenham ou adotem medidas que prevejam regalias específicas a favor do sexo sub-representado.
Article 24	Artigo 24.o
The rights of the child	Direitos das crianças
1. Children shall have the right to such protection and care as is necessary for their well-being. They may express their views freely. Such views shall be taken into consideration on matters which concern them in accordance with their age and maturity.	1. As crianças têm direito à proteção e aos cuidados necessários ao seu bem-estar. Podem exprimir livremente a sua opinião, que será tomada em consideração nos assuntos que lhes digam respeito, em função da sua idade e maturidade.
2. In all actions relating to children, whether taken by public authorities or private institutions, the child's best interests must be a primary consideration.	2. Todos os atos relativos às crianças, quer praticados por entidades públicas, quer por instituições privadas, terão primacialmente em conta o interesse superior da criança.
3. Every child shall have the right to maintain on a regular basis a personal relationship and direct contact with both his or her parents, unless that is contrary to his or her interests.	3. Todas as crianças têm o direito de manter regularmente relações pessoais e contactos diretos com ambos os progenitores, exceto se isso for contrário aos seus interesses.
Article 25	Artigo 25.o
The rights of the elderly	Direitos das pessoas idosas
The Union recognises and respects the rights of the elderly to lead a life of dignity and independence and to participate in social and cultural life.	A União reconhece e respeita o direito das pessoas idosas a uma existência condigna e independente e à sua participação na vida social e cultural.
Article 26	Artigo 26.o
Integration of persons with disabilities	Integração das pessoas com deficiência
The Union recognises and respects the right of persons with disabilities to benefit from measures designed to ensure their independence, social and occupational integration and participation in the life of the community.	A União reconhece e respeita o direito das pessoas com deficiência a beneficiarem de medidas destinadas a assegurar a sua autonomia, a sua integração social e profissional e a sua participação na vida da comunidade.
TITLE IV	TÍTULO IV
SOLIDARITY	SOLIDARIEDADE
Article 27	Artigo 27.o
Workers' right to information and consultation within the undertaking	Direito à informação e à consulta dos trabalhadores na empresa
Workers or their representatives must, at the appropriate levels, be guaranteed information and consultation in good time in the cases and under the conditions provided for by Union law and national laws and practices.	Deve ser garantida aos níveis apropriados, aos trabalhadores ou aos seus representantes, a informação e consulta, em tempo útil, nos casos e nas condições previstos pelo direito da União e pelas legislações e práticas nacionais.
Article 28	Artigo 28.o
Right of collective bargaining and action	Direito de negociação e de ação coletiva
Workers and employers, or their respective organisations, have, in accordance with Union law and national laws and practices, the right to negotiate and conclude collective agreements at the appropriate levels and, in cases of conflicts of interest, to take collective action to defend their interests, including strike action.	Os trabalhadores e as entidades patronais, ou as respetivas organizações, têm, de acordo com o direito da União e as legislações e práticas nacionais, o direito de negociar e de celebrar convenções coletivas aos níveis apropriados, bem como de recorrer, em caso de conflito de interesses, a ações coletivas para a defesa dos seus interesses, incluindo a greve.
Article 29	Artigo 29.o
Right of access to placement services	Direito de acesso aos serviços de emprego
Everyone has the right of access to a free placement service.	Todas as pessoas têm direito de acesso gratuito a um serviço de emprego.
Article 30	Artigo 30.o
Protection in the event of unjustified dismissal	Proteção em caso de despedimento sem justa causa
Every worker has the right to protection against unjustified dismissal, in accordance with Union law and national laws and practices.	Todos os trabalhadores têm direito a proteção contra os despedimentos sem justa causa, de acordo com o direito da União e com as legislações e práticas nacionais.
Article 31	Artigo 31.o
Fair and just working conditions	Condições de trabalho justas e equitativas
1. Every worker has the right to working conditions which respect his or her health, safety and dignity.	1. Todos os trabalhadores têm direito a condições de trabalho saudáveis, seguras e dignas.
2. Every worker has the right to limitation of maximum working hours, to daily and weekly rest periods and to an annual period of paid leave.	2. Todos os trabalhadores têm direito a uma limitação da duração máxima do trabalho e a períodos de descanso diário e semanal, bem como a um período anual de férias pagas.
Article 32	Artigo 32.o
Prohibition of child labour and protection of young people at work	Proibição do trabalho infantil e proteção dos jovens no trabalho
The employment of children is prohibited. The minimum age of admission to employment may not be lower than the minimum school-leaving age, without prejudice to such rules as may be more favourable to young people and except for limited derogations.	É proibido o trabalho infantil. A idade mínima de admissão ao trabalho não pode ser inferior à idade em que cessa a escolaridade obrigatória, sem prejuízo de disposições mais favoráveis aos jovens e salvo derrogações bem delimitadas.
Young people admitted to work must have working conditions appropriate to their age and be protected against economic exploitation and any work likely to harm their safety, health or physical, mental, moral or social development or to interfere with their education.	Os jovens admitidos ao trabalho devem beneficiar de condições de trabalho adaptadas à sua idade e de proteção contra a exploração económica e contra todas as atividades suscetíveis de prejudicar a sua segurança, saúde ou desenvolvimento físico, mental, moral ou social, ou ainda de pôr em causa a sua educação.
Article 33	Artigo 33.o
Family and professional life	Vida familiar e vida profissional
1. The family shall enjoy legal, economic and social protection.	1. É assegurada a proteção da família nos planos jurídico, económico e social.
2. To reconcile family and professional life, everyone shall have the right to protection from dismissal for a reason connected with maternity and the right to paid maternity leave and to parental leave following the birth or adoption of a child.	2. A fim de poderem conciliar a vida familiar e a vida profissional, todas as pessoas têm direito a proteção contra o despedimento por motivos ligados à maternidade, bem como a uma licença por maternidade paga e a uma licença parental pelo nascimento ou adoção de um filho.
Article 34	Artigo 34.o
Social security and social assistance	Segurança social e assistência social
1. The Union recognises and respects the entitlement to social security benefits and social services providing protection in cases such as maternity, illness, industrial accidents, dependency or old age, and in the case of loss of employment, in accordance with the rules laid down by Union law and national laws and practices.	1. A União reconhece e respeita o direito de acesso às prestações de segurança social e aos serviços sociais que concedem proteção em casos como a maternidade, doença, acidentes de trabalho, dependência ou velhice, bem como em caso de perda de emprego, de acordo com o direito da União e com as legislações e práticas nacionais.
2. Everyone residing and moving legally within the European Union is entitled to social security benefits and social advantages in accordance with Union law and national laws and practices.	2. Todas as pessoas que residam e se desloquem legalmente no interior da União têm direito às prestações de segurança social e às regalias sociais nos termos do direito da União e das legislações e práticas nacionais.
3. In order to combat social exclusion and poverty, the Union recognises and respects the right to social and housing assistance so as to ensure a decent existence for all those who lack sufficient resources, in accordance with the rules laid down by Union law and national laws and practices.	3. Everyone has the right of access to preventive health care and the right to benefit from medical treatment under the conditions established by national laws and practices. A high level of human health protection shall be ensured in the definition and implementation of all the Union's policies and activities.	Todas as pessoas têm o direito de aceder à prevenção em matéria de saúde e de beneficiar de cuidados médicos, de acordo com as legislações e práticas nacionais. The Union recognises and respects access to services of general economic interest as provided for in national laws and practices, in accordance with the Treaties, in order to promote the social and territorial cohesion of the Union. 1. Every citizen of the Union has the right to vote and to stand as a candidate at elections to the European Parliament in the Member State in which he or she resides, under the same conditions as nationals of that State.	1. Every citizen of the Union has the right to vote and to stand as a candidate at municipal elections in the Member State in which he or she resides under the same conditions as nationals of that State. 1. Every person has the right to have his or her affairs handled impartially, fairly and within a reasonable time by the institutions, bodies, offices and agencies of the Union.	1. Todas as pessoas têm direito a que os seus assuntos sejam tratados pelas instituições, órgãos e organismos da União de forma imparcial, equitativa e num prazo razoável.

Every person has the right to have the Union make good any damage caused by its institutions or by its servants in the performance of their duties, in accordance with the general principles common to the laws of the Member States.	3. Right of access to documents	Direito de acesso aos documentos
Any citizen of the Union, and any natural or legal person residing or having its registered office in a Member State, has a right of access to documents of the institutions, bodies, offices and agencies of the Union, whatever their medium.	Qualquer cidadão da União, bem como qualquer pessoa singular ou coletiva com residência ou sede social num Estado-Membro, tem direito de acesso aos documentos das instituições, órgãos e organismos da União, seja qual for o suporte desses documentos.
Article 43	Artigo 43.o
European Ombudsman	Provedor de Justiça Europeu
Any citizen of the Union and any natural or legal person residing or having its registered office in a Member State has the right to refer to the European Ombudsman cases of maladministration in the activities of the institutions, bodies, offices or agencies of the Union, with the exception of the Court of Justice of the European Union acting in its judicial role.	Qualquer cidadão da União, bem como qualquer pessoa singular ou coletiva com residência ou sede social num Estado-Membro, tem o direito de apresentar petições ao Provedor de Justiça Europeu, respeitantes a casos de má administração na atuação das instituições, órgãos ou organismos da União, com exceção do Tribunal de Justiça da União Europeia no exercício das respetivas funções jurisdicionais.
Article 44	Artigo 44.o
Right to petition	Direito de petição
Any citizen of the Union and any natural or legal person residing or having its registered office in a Member State has the right to petition the European Parliament.	Qualquer cidadão da União, bem como qualquer pessoa singular ou coletiva com residência ou sede social num Estado-Membro, goza do direito de petição ao Parlamento Europeu.

Freedom of movement and of residence	Liberdade de circulação e de permanência
1. Every citizen of the Union has the right to move and reside freely within the territory of the Member States.	1. Qualquer cidadão da União goza do direito de circular e permanecer livremente no território dos Estados-Membros.
2. Freedom of movement and residence may be granted, in accordance with the Treaties, to nationals of third countries legally resident in the territory of a Member State.	2. Pode ser concedida liberdade de circulação e de permanência, de acordo com os Tratados, aos nacionais de países terceiros que residam legalmente no território de um Estado-Membro.
Article 46	Artigo 46.o
Diplomatic and consular protection	Proteção diplomática e consular
Every citizen of the Union shall, in the territory of a third country in which the Member State of which he or she is a national is not represented, be entitled to protection by the diplomatic or consular authorities of any Member State, on the same conditions as the nationals of that Member State.	Todos os cidadãos da União beneficiam, no território de países terceiros em que o Estado-Membro de que são nacionais não se encontre representado, de proteção por parte das autoridades diplomáticas e consulares de qualquer Estado-Membro, nas mesmas condições que os nacionais desse Estado.

Article 47	Artigo 47.o
Right to an effective remedy and to a fair trial	Direito à ação e a um tribunal imparcial
Everyone whose rights and freedoms guaranteed by the law of the Union are violated has the right to an effective remedy before a tribunal in compliance with the conditions laid down in this Article.	Toda a pessoa cujos direitos e liberdades garantidos pelo direito da União tenham sido violados tem direito a uma ação perante um tribunal nos termos previstos no presente artigo.
Everyone is entitled to a fair and public hearing within a reasonable time by an independent and impartial tribunal previously established by law. Everyone shall have the possibility of being advised, defended and represented.	Toda a pessoa tem direito a que a sua causa seja julgada de forma equitativa, publicamente e num prazo razoável, por um tribunal independente e imparcial, previamente estabelecido por lei. Toda a pessoa tem a possibilidade de se fazer aconselhar, defender e representar em juízo.
Legal aid shall be made available to those who lack sufficient resources in so far as such aid is necessary to ensure effective access to justice.	É concedida assistência judiciária a quem não disponha de recursos suficientes, na medida em que essa assistência seja necessária para garantir a efetividade do acesso à justiça.
Article 48	Artigo 48.o
Presumption of innocence and right of defence	Presunção de inocência e direitos de defesa
1. Everyone who has been charged shall be presumed innocent until proved guilty according to law.	1. Todo o arguido se presume inocente enquanto não tiver sido legalmente provada a sua culpa.
2. Respect for the rights of the defence of anyone who has been charged shall be guaranteed.	2. É garantido a todo o arguido o respeito dos direitos de defesa.
Article 49	Artigo 49.o
Principles of legality and proportionality of criminal offences and penalties	Princípios da legalidade e da proporcionalidade dos delitos e das penas
1. No one shall be held guilty of any criminal offence on account of any act or omission which did not constitute a criminal offence under national law or international law at the time when it was committed. Nor shall a heavier penalty be imposed than the one that was applicable at the time the criminal offence was committed. If, subsequent to the commission of a criminal offence, the law provides for a lighter penalty, that penalty shall be applicable.	1. Ninguém pode ser condenado por uma ação ou por uma omissão que, no momento da sua prática, não constituía infração perante o direito nacional ou o direito internacional. Igualmente não pode ser imposta uma pena mais grave do que a aplicável no momento em que a infração foi cometida. Se, posteriormente à infração, a lei previr uma pena mais leve, deve ser essa a pena aplicada.
2. This Article shall not prejudice the trial and punishment of any person for any act or omission which, at the time when it was committed, was criminal according to the general principles recognised by the community of nations.	2. O presente artigo não prejudica a sentença ou a pena a que uma pessoa tenha sido condenada por uma ação ou por uma omissão que, no momento da sua prática, constituía crime segundo os princípios gerais reconhecidos por todas as nações.
3. The severity of penalties must not be disproportionate to the criminal offence.	3. As penas não devem ser desproporcionadas em relação à infração.
Article 50	Artigo 50.o
Right not to be tried or punished twice in criminal proceedings for the same criminal offence	Direito a não ser julgado ou punido penalmente mais do que uma vez pelo mesmo delito
No one shall be liable to be tried or punished again in criminal proceedings for an offence for which he or she has already been finally acquitted or convicted within the Union in accordance with the law.	Ninguém pode ser julgado ou punido penalmente por um delito do qual já tenha sido absolvido ou pelo qual já tenha sido condenado na União por sentença transitada em julgado, nos termos da lei.
TITLE VII	TÍTULO VII
GENERAL PROVISIONS GOVERNING THE INTERPRETATION AND APPLICATION OF THE CHARTER	DISPOSIÇÕES GERAIS QUE REGEM A INTERPRETAÇÃO E A APLICAÇÃO DA CARTA
Article 51	Artigo 51.o
Field of application	Âmbito de aplicação
1. The provisions of this Charter are addressed to the institutions, bodies, offices and agencies of the Union with due regard for the principle of subsidiarity and to the Member States only when they are implementing Union law. They shall therefore respect the rights, observe the principles and promote the application thereof in accordance with their respective powers and respecting the limits of the powers of the Union as conferred on it in the Treaties.	1. As disposições da presente Carta têm por destinatários as instituições, órgãos e organismos da União, na observância do princípio da subsidiariedade, bem como os Estados-Membros, apenas quando apliquem o direito da União. Assim sendo, devem respeitar os direitos, observar os princípios e promover a sua aplicação, de acordo com as respetivas competências e observando os limites das competências conferidas à União pelos Tratados.
2. The Charter does not extend the field of application of Union law beyond the powers of the Union or establish any new power or task for the Union, or modify powers and tasks as defined in the Treaties.	2. A presente Carta não torna o âmbito de aplicação do direito da União extensivo a competências que não sejam as da União, não cria quaisquer novas atribuições ou competências para a União, nem modifica as atribuições e competências definidas pelos Tratados.
Article 52	Artigo 52.o
Scope and interpretation of rights and principles	Âmbito e interpretação dos direitos e dos princípios
1. Any limitation on the exercise of the rights and freedoms recognised by this Charter must be provided for by law and respect the essence of those rights and freedoms. Subject to the principle of proportionality, limitations may be made only if they are necessary and genuinely meet objectives of general interest recognised by the Union or the need to protect the rights and freedoms of others.	1. Qualquer restrição ao exercício dos direitos e liberdades reconhecidos pela presente Carta deve ser prevista por lei e respeitar o conteúdo essencial desses direitos e liberdades. Na observância do princípio da proporcionalidade, essas restrições só podem ser introduzidas se forem necessárias e corresponderem efetivamente a objetivos de interesse geral reconhecidos pela União, ou à necessidade de proteção dos direitos e liberdades de terceiros.
2. Rights recognised by this Charter for which provision is made in the Treaties shall be exercised under the conditions and within the limits defined by those Treaties.	2. Os direitos reconhecidos pela presente Carta que se regem por disposições constantes dos Tratados são exercidos de acordo com as condições e limites por eles definidos.
3. In so far as this Charter contains rights which correspond to rights guaranteed by the Convention for the Protection of Human Rights and Fundamental Freedoms, the meaning and scope of those rights shall be the same as those laid down by the said Convention. This provision shall not prevent Union law providing more extensive protection.	3. Na medida em que a presente Carta contenha direitos correspondentes aos direitos garantidos pela Convenção Europeia para a Proteção dos Direitos do Homem e das Liberdades Fundamentais, o sentido e o âmbito desses direitos são iguais aos conferidos por essa Convenção. 4. In so far as this Charter recognises fundamental rights as they result from the constitutional traditions common to the Member States, those rights shall be interpreted in harmony with those traditions.	4. Na medida em que a presente Carta reconheça direitos fundamentais decorrentes das tradições constitucionais comuns aos Estados-Membros, tais direitos devem ser interpretados de harmonia com essas tradições.
5. The provisions of this Charter which contain principles may be implemented by legislative and executive acts taken by institutions, bodies, offices and agencies of the Union, and by acts of Member States when they are implementing Union law, in the exercise of their respective powers. They shall be judicially cognisable only in the interpretation of such acts and in the ruling on their legality.	5. As disposições da presente Carta que contenham princípios podem ser aplicadas através de atos legislativos e executivos tomados pelas instituições, órgãos e organismos da União e por atos dos Estados-Membros quando estes apliquem o direito da União, no exercício das respetivas competências. Só serão invocadas perante o juiz tendo em vista a interpretação desses atos e a fiscalização da sua legalidade.
6. Full account shall be taken of national laws and practices as specified in this Charter.	6. As legislações e práticas nacionais devem ser plenamente tidas em conta tal como precisado na presente Carta.
7. The explanations drawn up as a way of providing guidance in the interpretation of this Charter shall be given due regard by the courts of the Union and of the Member States.	7. Os órgãos jurisdicionais da União e dos Estados-Membros têm em devida conta as anotações destinadas a orientar a interpretação da presente Carta.
Article 53	Artigo 53.o
Level of protection	Nível de proteção
Nothing in this Charter shall be interpreted as restricting or adversely affecting human rights and fundamental freedoms as recognised, in their respective fields of application, by Union law and international law and by international agreements to which the Union or all the Member States are party, including the European Convention for the Protection of Human Rights and Fundamental Freedoms, and by the Member States' constitutions.	Nenhuma disposição da presente Carta deve ser interpretada no sentido de restringir ou lesar os direitos do Homem e as liberdades fundamentais reconhecidos, nos respetivos âmbitos de aplicação, pelo direito da União, o direito internacional e as Convenções internacionais em que são Partes a União ou todos os Estados-Membros, nomeadamente a Convenção Europeia para a Proteção dos Direitos do Homem e das Liberdades Fundamentais, bem como pelas Constituições dos Estados-Membros.
Article 54	Artigo 54.o
Prohibition of abuse of rights	Proibição do abuso de direito
Nothing in this Charter shall be interpreted as implying any right to engage in any activity or to perform any act aimed at the destruction of any of the rights and freedoms recognised in this Charter or at their limitation to a greater extent than is provided for herein.	Nenhuma disposição da presente Carta deve ser interpretada no sentido de implicar qualquer direito de exercer atividades ou praticar atos que visem a destruição dos direitos ou liberdades por ela reconhecidos ou restrições desses direitos e liberdades maiores do que as previstas na presente Carta.
