DURCHFÜHRUNGSBESCHLUSS (EU) 2026/782 DER KOMMISSION
vom 27. März 2026
zur Änderung des Durchführungsbeschlusses (EU) 2026/582 betreffend bestimmte Sofortmaßnahmen in Bezug auf die Maul- und Klauenseuche in Zypern

DIE EUROPÄISCHE KOMMISSION —
gestützt auf den Vertrag über die Arbeitsweise der Europäischen Union,
gestützt auf die Verordnung (EU) 2016/429 des Europäischen Parlaments und des Rates vom 9. März 2016 zu Tierseuchen und zur Änderung und Aufhebung einiger Rechtsakte im Bereich der Tiergesundheit („Tiergesundheitsrecht“) (1), insbesondere auf Artikel 259 Absatz 1,
in Erwägung nachstehender Gründe:

Die Maul- und Klauenseuche ist eine ansteckende Viruserkrankung, die Säugetiere der Ordnungen Paarhufer und Rüsseltiere befällt und schwerwiegende Auswirkungen auf die betroffene Tierpopulation sowie die Rentabilität der Landwirtschaft haben kann, was zu Störungen bei Verbringungen von Sendungen dieser Tiere und daraus gewonnener Erzeugnisse innerhalb der Union sowie bei Ausfuhren in Drittländer führen kann. Bei einem Ausbruch der Maul- und Klauenseuche bei Tieren besteht ein ernstes Risiko der Ausbreitung dieser Seuche auf andere Betriebe, in denen Tiere der gelisteten Arten gemäß dem Anhang der Durchführungsverordnung (EU) 2018/1882 der Kommission (2) (im Folgenden „gelistete Arten“) gehalten werden. |

Mit der Delegierten Verordnung (EU) 2020/687 der Kommission (3) wurden die Vorschriften zur Bekämpfung der gelisteten Seuchen gemäß Artikel 9 Absatz 1 Buchstaben a, b und c der Verordnung (EU) 2016/429 ergänzt, die in der Durchführungsverordnung (EU) 2018/1882 als Seuchen der Kategorien A, B und C definiert sind. Insbesondere sind in den Artikeln 21 und 22 der Delegierten Verordnung (EU) 2020/687 beim Ausbruch einer Seuche der Kategorie A, unter die auch die Maul- und Klauenseuche fällt, die Einrichtung einer Sperrzone und bestimmte dort durchzuführende Maßnahmen vorgesehen. Darüber hinaus ist in Artikel 21 Absatz 1 der genannten Delegierten Verordnung vorgesehen, dass die Sperrzone eine Schutzzone und eine Überwachungszone sowie erforderlichenfalls weitere Sperrzonen um oder angrenzend an die Schutz- und die Überwachungszonen umfasst. |

Der Durchführungsbeschluss (EU) 2026/582 der Kommission (4) wurde auf der Grundlage der Verordnung (EU) 2016/429 erlassen und enthält bestimmte Sofortmaßnahmen in Bezug auf Ausbrüche der Maul- und Klauenseuche in Wiederkäuerhaltungsbetrieben im Bezirk Larnaka in Zypern. Im Durchführungsbeschluss (EU) 2026/582 ist insbesondere vorgesehen, dass Zypern gemäß Artikel 21 der Delegierten Verordnung (EU) 2020/687 Sperrzonen einrichten muss, die Schutz- und Überwachungszonen sowie eine weitere Sperrzone umfassen, in denen die in den Schutz- und Überwachungszonen sowie in der weiteren Sperrzone anzuwendenden Maßnahmen mindestens bis zu den im Anhang des genannten Durchführungsbeschlusses aufgeführten Zeitpunkten angewandt werden müssen, und dass die Schutz- und Überwachungszonen sowie die weitere Sperrzone mindestens die im genannten Anhang aufgeführten Gebiete umfassen müssen. |

In Anbetracht der aktuellen Seuchenlage in Zypern und des Risikos, dass sich die Infektion mit dem Maul- und Klauenseuche-Virus durch subklinisch infizierte Tiere der gelisteten Arten ausbreiten kann, ist es auch erforderlich, die Verbringung dieser Tiere von jedem Ort innerhalb der weiteren Sperrzone an einen Bestimmungsort außerhalb der Außengrenze der weiteren Sperrzone zu verbieten. Daher sollte der Durchführungsbeschluss (EU) 2026/582 dahin gehend geändert werden, dass ein solches Verbot vorgesehen wird. |

Gemäß der Verordnung (EU) 2016/429, insbesondere Artikel 69, kann die zuständige Behörde eines Mitgliedstaats, sofern dies für die wirksame Kontrolle einer gelisteten Seuche gemäß Artikel 9 Absatz 1 Buchstabe a der genannten Verordnung, für die die Seuchenbekämpfungsmaßnahmen gelten, relevant ist, einen Impfplan ausarbeiten und Impfzonen festlegen. Zu diesem Zweck muss die zuständige Behörde den Impfplan durchführen und Impfzonen einrichten, die den spezifischen Anforderungen gemäß Artikel 6 der Delegierten Verordnung (EU) 2023/361 der Kommission (5), die die Verordnung (EU) 2016/429 ergänzt, entsprechen. |

In der Delegierten Verordnung (EU) 2023/361 sind unter anderem die spezifischen Vorschriften festgelegt, die von den Mitgliedstaaten bei der Durchführung von Notschutzimpfungen bei Tieren zur Prävention oder Bekämpfung einer gelisteten Seuche anzuwenden sind. Außerdem sind in der genannten Delegierten Verordnung die Bedingungen festgelegt, unter denen die Verbringung geimpfter Tiere und aus diesen gewonnener Erzeugnisse zulässig ist. Besondere Bedingungen für die Notschutzimpfung gegen die Infektion mit der Maul- und Klauenseuche sind in Anhang VII der genannten Delegierten Verordnung festgelegt. |

Am 2. März 2026 übermittelte Zypern der Kommission seinen amtlichen Impfplan für Notschutzimpfungen gegen die Infektion mit der Maul- und Klauenseuche. Der Plan enthält Informationen über den geografischen und administrativen Geltungsbereich der Impfzone und die Zahl der zu impfenden Tiere. Daher sollte der Durchführungsbeschluss (EU) 2026/582 geändert werden, um dem von Zypern vorgelegten Impfplan und dem räumlichen Geltungsbereich der Impfzone Rechnung zu tragen. |

Seit dem Erlass des Durchführungsbeschlusses (EU) 2026/582 wurden die in den im Anhang des genannten Beschlusses aufgeführten Schutz- und Überwachungszonen sowie in der weiteren Sperrzone anzuwendenden Sofortmaßnahmen und der Zeitplan für ihre Umsetzung überprüft, insbesondere im Hinblick auf die vorläufige Reinigung und Desinfektion der betroffenen Betriebe, die gemäß der Delegierten Verordnung (EU) 2020/687 durchzuführen ist. Folglich muss die Dauer der Sofortmaßnahmen in den genannten Schutz- und Überwachungszonen angepasst werden. |

Seit dem Erlass des Durchführungsbeschlusses (EU) 2026/582 sind zudem weitere Ausbrüche der Maul- und Klauenseuche in Betrieben in den Bezirken Larnaka und Nikosia in Zypern aufgetreten, darunter auch Ausbrüche außerhalb der Gebiete, die im Anhang des Durchführungsbeschlusses (EU) 2026/582 derzeit als Schutz- und Überwachungszonen aufgeführt sind. |

Angesichts der derzeitigen Seuchenlage in Bezug auf die Maul- und Klauenseuche in Zypern und zur Verhinderung der weiteren Ausbreitung dieser Seuche in dem genannten Mitgliedstaat oder auf andere Mitgliedstaaten oder auf Drittländer müssen die Gebiete, die im Anhang des Durchführungsbeschlusses (EU) 2026/582 derzeit als Schutz- und Überwachungszonen oder weitere Sperrzonen aufgeführt sind, erforderlichenfalls sowohl in räumlicher als auch in zeitlicher Hinsicht dringend angepasst werden, und es müssen neue Schutz- und Überwachungszonen eingerichtet werden, die den jüngsten Ausbrüchen in Zypern Rechnung tragen. Dies ist außerdem erforderlich, um unnötige Störungen des Handels innerhalb der Union zu verhindern und von Drittländern auferlegte ungerechtfertigte Hemmnisse für den Handel zu vermeiden. |

Der Durchführungsbeschluss (EU) 2026/582 sollte daher entsprechend geändert werden. |

Die in diesem Beschluss vorgesehenen Maßnahmen entsprechen der Stellungnahme des Ständigen Ausschusses für Pflanzen, Tiere, Lebensmittel und Futtermittel — |
HAT FOLGENDEN BESCHLUSS ERLASSEN:
Artikel 1
Der Durchführungsbeschluss (EU) 2026/582 wird wie folgt geändert:

Die folgenden Artikel 1a und 1b werden eingefügt: „Artikel 1a Verbringungen von Tieren gelisteter Arten gemäß dem Anhang der Durchführungsverordnung (EU) 2018/1882 aus der weiteren Sperrzone gemäß dem Anhang dieses Beschlusses an einen Bestimmungsort außerhalb der Außengrenze dieser weiteren Sperrzone sind bis zu den im Anhang aufgeführten Zeitpunkten verboten. Artikel 1b Gemäß Anhang VII Teil 1 der Delegierten Verordnung (EU) 2023/361 und unter den in dem genannten Anhang VII festgelegten Bedingungen richtet die zuständige Behörde unverzüglich eine Impfzone gemäß dem Anhang dieses Beschlusses ein.“ |

Der Anhang wird durch den Anhang des vorliegenden Beschlusses ersetzt. |
