DURCHFÜHRUNGSVERORDNUNG (EU) 2024/1748 DER KOMMISSION

vom 21. Juni 2024

zur Änderung der Durchführungsverordnung (EU) 2021/1378 der Kommission in Bezug auf die Anerkennung bestimmter Kontrollstellen, die für die Durchführung von Kontrollen und die Ausstellung von Öko-/Bio-Zertifikaten in Drittländern für die Zwecke der Einfuhr ökologischer/biologischer Erzeugnisse in die Union zuständig sind, gemäß Artikel 46 der Verordnung (EU) 2018/848 des Europäischen Parlaments und des Rates

DIE EUROPÄISCHE KOMMISSION —

gestützt auf den Vertrag über die Arbeitsweise der Europäischen Union,

gestützt auf die Verordnung (EU) 2018/848 des Europäischen Parlaments und des Rates vom 30. Mai 2018 über die ökologische/biologische Produktion und die Kennzeichnung von ökologischen/biologischen Erzeugnissen sowie zur Aufhebung der Verordnung (EG) Nr. 834/2007 des Rates (1), insbesondere auf Artikel 46 Absatz 1,

in Erwägung nachstehender Gründe:

Anhang II der Durchführungsverordnung (EU) 2021/1378 der Kommission (2) wurde angenommen, um ein Verzeichnis der Kontrollbehörden und Kontrollstellen bereitzustellen, die gemäß Artikel 46 Absatz 1 der Verordnung (EU) 2018/848 als zuständig anerkannt wurden, für die Zwecke der Einfuhr ökologischer/biologischer Erzeugnisse gemäß Artikel 45 Absatz 1 Buchstabe b Ziffer i derselben Verordnung in Drittländern Kontrollen durchzuführen und Öko-/Bio-Zertifikate auszustellen.

In Artikel 46 Absatz 2 der Verordnung (EU) 2018/848 sind die Kriterien festgelegt, die die Kontrollbehörden und Kontrollstellen erfüllen müssen, um nach Artikel 46 Absatz 1 derselben Verordnung anerkannt zu werden. In der Delegierten Verordnung (EU) 2021/1698 der Kommission (3) sind die Verfahrensvorschriften festgelegt, die diese Kontrollbehörden und Kontrollstellen einhalten müssen, wenn sie ihren Antrag auf Anerkennung stellen, der aus einem technischen Dossier besteht.

Seit dem Erlass der Durchführungsverordnung (EU) 2021/1378 sind bei der Kommission von etlichen Kontrollstellen Anträge auf Anerkennung eingegangen, die gemäß Artikel 46 Absatz 4 der Verordnung (EU) 2018/848 gestellt wurden.

Die Kommission hat die von „bio.inspecta AG“, „Caucascert LLC“, „CCPB Srl“, „CERES Certification of Environmental Standards GmbH“, „CERTIMEX, Certificadora Mexicana de Productos y Procesos Ecologicos S.C.“, „Control Union Certifications B.V.“, „Ecocert SAS“, „ECOGLOBE LLC“, „FOOD SAFETY S.A.“, „IMO Control Private Limited“, „Kiwa BCS Öko-Garantie GmbH“, „Mayacert S.A.“, „Organic Control System LLC Subotica“, „Organic Standard LLC“, „Servicio de Certificación CAAE S.L.U.“, „Southern Cross Certified Australia Pty Ltd“ und „Tse-Xin Organic Certification Corporation“ übermittelten Anträge auf Anerkennung im Einklang mit Artikel 1 der Delegierten Verordnung (EU) 2021/1698 erhalten und geprüft. Auf der Grundlage der Angaben in den technischen Dossiers ist die Kommission zu dem Ergebnis gelangt, dass es gerechtfertigt ist, diese Kontrollstellen auf unbestimmte Zeit für bestimmte Kategorien von Erzeugnissen in bestimmten Drittländern anzuerkennen.

Die Durchführungsverordnung (EU) 2021/1378 sollte daher entsprechend geändert werden.

Die in dieser Verordnung vorgesehenen Maßnahmen entsprechen der Stellungnahme des Ausschusses für ökologische/biologische Produktion —

HAT FOLGENDE VERORDNUNG ERLASSEN:

Artikel 1

Anhang II der Durchführungsverordnung (EU) 2021/1378 wird gemäß dem Anhang dieser Verordnung geändert.

Artikel 2

Diese Verordnung tritt am dritten Tag nach ihrer Veröffentlichung im Amtsblatt der Europäischen Union in Kraft.

Diese Verordnung ist in allen ihren Teilen verbindlich und gilt unmittelbar in jedem Mitgliedstaat.
