1. EINLEITUNG

Die Herausforderungen, vor denen Europa steht, sind klar, und sie erfordern rasches Handeln. Die Globalisierung hat neue Chancen und neue Anforderungen mit sich gebracht. Modernisierung ist unerlässlich, wollen wir Europas von jeher hohes Niveau an Wohlstand, sozialem Zusammenhalt, Umweltschutz und Lebensqualität sichern und die Arbeitsplätze schaffen, die wir brauchen. Die beste Antwort Europas besteht darin, das Potenzial seiner Bürger voll auszuschöpfen und seine gemeinsamen Werte im Inneren zu bewahren und nach außen hin zu propagieren. Die Kommission wird diese Herausforderungen in ihrem Programm für 2006 annehmen.

Zu Beginn ihrer Amtszeit hat die Kommission ihre strategischen Kernziele bis zum Ende des Jahrzehnts dargelegt: Wohlstand, Solidarität, Sicherheit, Europa als Partner in der Welt. Diese Ziele sind nach wie vor gültig und werden daher als Kern der Arbeit der Kommission bestätigt. Sie verweisen auf das Gleichgewicht, das in der Tätigkeit der Union notwendig ist: ein Politikmix, der es Europa ermöglicht, sich um Wettbewerbsfähigkeit und soziale Gerechtigkeit zu bemühen, seine Bürger zu schützen und ihre Freiheiten zu fördern, innerhalb Europas zu handeln und Europas Werte in der Welt draußen zu propagieren. Konkrete Schritte zur Realisierung dieser Ziele zu unternehmen ist der beste Weg, die Europäer davon zu überzeugen, dass die Union ein wesentlicher Teil der Lösung der Probleme ist, denen sich Europa gegenübersieht.

Das Legislativ- und Arbeitsprogramm der Kommission (nachstehend „Arbeitsprogramm“ genannt) für 2006 wird den derzeitigen wirtschaftlichen und politischen Trends und der Position Europas in verschiedenen grundlegenden strategischen Dossiers voll Rechnung getragen. Fortschritte in diesem Bereich werden sich entscheidend auf die Fähigkeit der Europäischen Union auswirken, 2006 auf dem Weg zu ihren Zielen wirklich voranzukommen.

Die Europäische Kommission hat sich mit Nachdruck für die Ratifizierung der Verfassung eingesetzt und allen Mitgliedstaaten bei ihren Informationskampagnen Unterstützung angeboten. Die Verfassung wäre ein wichtiger Schritt auf dem Weg zu einer demokratischeren, transparenteren, effektiveren und nach außen stärkeren Europäischen Union. Daher nimmt die Kommission mit Bedauern zur Kenntnis, dass die Verfassung wahrscheinlich nicht in absehbarer Zukunft ratifiziert wird. Wenn es aber gelingt, die Debatte über die Zukunft Europas aktiv und effektiv fortzusetzen, wird dadurch eine große Lücke gefüllt und ein starkes Fundament errichtet, auf dem wir in Zukunft aufbauen können. Durch ihren „Plan D“ für Demokratie, Dialog und Diskussion wird die Kommission aktiv an den nationalen Debatten teilnehmen und dabei jede nur denkbare Unterstützung leisten. Und in der Zwischenzeit kann die Europäische Union ihren Wert am besten dadurch unter Beweis stellen, dass sie die Politik betreibt, die die Europäer brauchen.

Eine Einigung über die Finanzielle Vorausschau – wozu es bis Ende 2005 kommen sollte – wird sich entscheidend auf die Arbeit der Kommission für das erweiterte Europa auswirken. 2006 sollte geprägt sein durch intensive Vorarbeiten, die sicherstellen, dass alle Finanzierungsprogramme vom 1. Januar 2007 an voll funktionsfähig sind.

Die Tatsache, dass diese Themen heftig diskutiert werden, darf uns nicht davon ablenken, dass Handeln auf europäischer Ebene dringend gefragt ist. Wir können am besten zeigen, was Europa leisten kann, wenn wir handeln und den Bürgern greifbare Nachweise für die Möglichkeiten Europas bieten.

Im Arbeitsprogramm wird dargelegt, was die Kommission tun wird, um diese Ziele im Jahr 2006 zu verwirklichen:

- Für den Wohlstand wird 2006 ein entscheidendes Jahr sein, da im Kontext der Lissabon-Strategie für Wachstum und Beschäftigung auf die Worte nun Taten folgen müssen. Europa muss für ein Klima sorgen, in dem Bürger und Unternehmen ihr Potenzial voll ausschöpfen können.

- Solidarität bedeutet, eine Union mit starkem Zusammenhalt zu entwickeln, die sich der gemeinsamen Verantwortlichkeiten bewusst ist und den Wohlstand aller hebt. Sie zwingt uns auch, langfristige Herausforderungen wie die demografischen Verschiebungen und den Klimawandel gemeinsam anzunehmen.

- Der Forderung der Bürger, Bedrohungen der Sicherheit abzuwehren, kann Europa nur dadurch entsprechen, dass es zusammenarbeitet im Kampf gegen Kriminalität und Terrorismus, bei der Förderung der Gesundheit und bei der Minimierung der Risiken.

- In den Außenbeziehungen muss sich die Union auch weiterhin weltweit mit einer Stimme zu Wort melden, ganz besonders bei der Vorbereitung künftiger Erweiterungen, in den benachbarten Weltregionen und in Afrika. Sie muss ihr Gewicht in der globalen Wirtschaft dazu nutzen, die Globalisierung zu einer Chance für alle zu machen.

Die Kommission verfolgt diese Ziele auf viele unterschiedliche Weisen. Ihre Rolle als Regelungs- und Überwachungsinstanz ist entscheidend für das reibungslose Funktionieren der europäischen Märkte und die Wahrung gleicher Wettbewerbsbedingungen. Dank ihrer Exekutivfunktion kommt ihr eine besondere Verantwortung dafür zu, sicherzustellen, dass ihre Programme, von der Forschung über die Mobilität der Studenten bis zur Entwicklungshilfe, vor Ort gute Ergebnisse zeitigen. Sie führt Verhandlungen außerhalb und erleichtert die Zusammenarbeit innerhalb der Union.

Viele dieser laufenden Maßnahmen werden 2006 eine kritische Phase erreichen. Die Lissabon-Strategie für Wachstum und Beschäftigung wird in eine entscheidende Durchführungsphase eintreten. Es wird der Rahmen vorbereitet für eine neue Generation von Programmen in Bereichen wie Strukturfonds, Entwicklung des ländlichen Raumes, Innovation, Forschung und Bildung. Bei der Doha-Entwicklungsrunde sollte die Abschlussphase beginnen.

Im Rahmen ihrer Agenda leitet die Kommission außerdem neue Konsultationen ein, um Meinungen und frische Ideen darüber einzuholen, wie Europa handeln kann, und sie startet auch neue Initiativen zur Koordinierung derjenigen Politiken, bei denen es einen klaren europäischen Zusatznutzen gibt. Im Anhang zum vorliegenden Arbeitsprogramm findet sich eine Prioritätenliste für 2006. Wie bereits 2005 verpflichtet sich die Kommission, diese vorrangigen Maßnahmen zu realisieren.

Außerdem wird sich die Kommission darauf konzentrieren, die Qualität der Maßnahmen durch rigorose Anwendung einer besseren Rechtsetzungsdisziplin sicherzustellen: Vereinfachung, Modernisierung, Konsultation und sorgfältige Folgenabschätzung sind Kernziele, die die Kommission als Querschnittsaufgaben in ihrer gesamten Arbeit berücksichtigen wird. 2006 wird das erste Jahr der neuen Vereinfachungsstrategie der Kommission sein, mit kontinuierlicher Feineinstellung der Rechtsvorschriften, um den sich verändernden Bedürfnissen der Regulierungsinstanzen und der Benutzer besser zu entsprechen.

Die EU braucht auch eine ehrgeizige Agenda – die von allen europäischen Institutionen, den Mitgliedstaaten und der Zivilgesellschaft aufgestellt und durchgeführt werden muss –, um das Kommunikationsdefizit in europäischen Angelegenheiten zu überwinden. Damit wird das Weißbuch über die Verbesserung der Kommunikation im Laufe des Jahres 2006 in praktische Schritte umgesetzt: Untermauerung der Verpflichtung der Kommission, Kontakte zu den Bürgern herzustellen und das demokratische Fundament des europäischen Projekts zu konsolidieren.

Der Kommission kommt eine Schlüsselrolle zu, wenn es darum geht, das Handeln auf europäischer Ebene anzustoßen. Sie ist aber nur ein Akteur unter vielen. Die Europäische Union wird ihre Ziele nur erreichen, wenn diese von allen ihren Institutionen, den nationalen, regionalen und lokalen Regierungen und von den Bürgern selbst gemeinsam verfolgt werden. Partnerschaft muss bei der Entwicklung und Durchführung der EU-Politik zu einem ganz instinktiven Reflex werden.

Bei der Ausarbeitung ihres Programms für 2006 konnte die Kommission auf die Reaktionen des Europäischen Parlaments und des Rates auf ihre jährliche Strategieplanung für 2006 zurückgreifen. Die entsprechenden Gespräche haben gezeigt, dass den drei Institutionen die politischen Kernziele gemeinsam sind und dass eine weitgehende Übereinstimmung über die grundlegenden Handlungslinien besteht, die zum Erreichen dieser Ziele verfolgt werden müssen. Die neue Rahmenvereinbarung zwischen Europäischem Parlament und Kommission hat insbesondere zu detaillierten Vorschlägen geführt, wie diese Ziele in konkrete Aktionen umgemünzt werden sollten. Die Auffassungen der anderen Institutionen wurden bei der Ausarbeitung des vorliegenden Programms voll berücksichtigt.

2. WOHLSTAND

Ein wesentliches Ziel politischen Handelns besteht darin, die Voraussetzungen zu schaffen, die Wohlstand möglich machen und Bürgern und Unternehmen gleichermaßen zugute kommen. Dies bedeutet stabile Rechtsetzung, angemessene Wirtschaftspolitik, Bereitstellung ökonomischer Chancen und Investitionen in eine gut ausgebildete und unternehmerisch orientierte Bevölkerung. Es bedeutet, dass alle relevanten Aspekte der Arbeit der EU selbst den höchsten Standards besserer Rechtsetzung genügen müssen. Die Weiterarbeit an den Voraussetzungen für Wachstum und Schaffung von mehr und besseren Arbeitsplätzen bildet auch 2006 den Kernpunkt der Aufgaben der Kommission.

Die Europäische Union hat ihren Fahrplan für Wachstum und Arbeitsplätze in der Lissabon-Strategie festgelegt. 2006 wird ein entscheidendes Jahr für die Realisierung dieses Plans sein. Für die Kommission bedeutet dies eine besondere Rolle bei der Überwachung der Durchführung der überarbeiteten Lissabon-Strategie auf Ebene der Mitgliedstaaten und auf Gemeinschaftsebene. Partnerschaft mit den Mitgliedstaaten ist von ausschlaggebender Bedeutung, wenn sichergestellt werden soll, dass die integrierten Leitlinien für makroökonomische Politik, mikroökonomische Reformen und Beschäftigung ihre Gültigkeit behalten und von allen Schlüsselakteuren nachdrücklich unterstützt werden. Die Kommission wird dem Europäischen Rat auf seiner Frühjahrstagung über die Fortschritte auf nationaler Ebene – im Rahmen der 25 von den Mitgliedstaaten beschlossenen nationalen Reformprogramme – und über den Fortgang der Maßnahmen auf EU- Ebene berichten, die in dem im Juli 2005 angenommenen Lissabon-Programm der Gemeinschaft dargelegt sind.

Wissen und Innovation als Motoren für Wachstum und die Schaffung besserer Arbeitsplätze

Fähigkeiten und Wissen sind wichtige Pluspunkte Europas, wenn es darum geht, Wachstum zu erzeugen und Arbeitsplätze zu schaffen; hier liegt noch viel Potenzial brach.

- Wissen kann durch grundlegende Infrastrukturen stimuliert werden. Ein Europäisches Technologie-Institut (EIT) könnte – auf bestehenden Kapazitäten aufbauend – zu einem Wegbereiter für Wissen und Innovation in Europa werden. Gleichzeitig wird die Kommission die notwendigen Schritte unternehmen, damit das neue Forschungsrahmenprogramm 2007 anlaufen kann. Im Rahmen der Initiative „i 2010“ wird ein Aktionsplan für E-Government sich auf die Verbesserung der Schnittstelle zwischen Behörden, Bürgern und Geschäftswelt konzentrieren.

- Für eine maximale Wirkung benötigt Wissen entsprechende Chancen. Die Kommission wird sich um die Verbesserung der geographischen und beruflichen Mobilität bemühen mit Hilfe des Europäischen Jahres der Mobilität der Arbeitnehmer und durch Unterstützung von Transparenz, Transfer und Anerkennung der Qualifikationen in der EU.

Europa attraktiver für Investitionen und Arbeit machen

- Die Rahmenbedingungen für Europas Wirtschaft hängen stark davon ab, dass der Binnenmarkt ordentlich funktioniert. Dies bedeutet, dass mit Entschlossenheit an Themen wie staatliche Beihilfen, Förderung des Unternehmergeistes und Stärkung der Fähigkeit der KMU zur Expansion und zur Schaffung von Arbeitsplätzen weitergearbeitet werden muss. Die Steuerbestimmungen für grenzüberschreitende Unternehmungen müssen vereinfacht und rationalisiert werden, und außerdem wird es eine neue Generation von Zoll- und Steuerprogrammen geben, mit denen sichergestellt werden soll, dass die nationalen Systeme besser und unkomplizierter zusammenwirken, sowie ferner eine Strategie zur Verschärfung des Kampfes gegen Steuerhinterziehung. Der Wettbewerbsfähigkeit in Schlüsselbranchen wie der Automobil- und Verteidigungsindustrie wie auch den elektronischen Kommunikationsnetzen und -dienstleistungen soll besondere Aufmerksamkeit gelten.

- Weitere zentrale Triebkräfte des Wachstums sind Europas Verkehr sinfrastruktur und Energie markt. Neben der Vorbereitung der neuen Phase der transeuropäischen Netze wird durch eine neue Initiative der Schienenfrachtverkehr europaweit gefördert werden. Parallel zur Realisierung des Energiebinnenmarktes wird auch die Arbeit an der Entwicklung neuer technologischer Lösungen zur Befriedigung des Energiebedarfs – mit Schwerpunkt auf der sauberen Kohletechnologie und der Technologie der erneuerbaren Energiequellen – weitergehen. Das Aushängeschild Galileo wird ebenfalls in eine neue praktische Entwicklungsphase eintreten.

- Was die Freizügigkeit im Binnenmarkt angeht, sollen die bestehenden Rechtsvorschriften auf ihre Wirksamkeit abgeklopft werden: Die Vereinfachung wird weitergeführt, um reibungslosere Abläufe im Binnenmarkt herbeizuführen und das Wachstum anzuregen. In Legislativvorschlägen werden die Grundprinzipien des Binnenmarkts stärker herausgestellt. Außerdem werden sektorbezogene Vorschläge geprüft für den Postdienst, das öffentliche Beschaffungswesen, Wertpapierclearing- und -abrechnungssysteme und den Banksektor, ergänzt durch bereits laufende Analysen in Bereichen wie Investmentfonds, Hypothekenkredite, Solvenz von Versicherungsgesellschaften und öffentlich-private Partnerschaften.

Erweiterung der Eurozone

- Ein stabiles makroökonomisches Klima ist die Voraussetzung für Wachstum. Die Verwaltung der Eurozone durch die Kommission wird in eine neue Phase eintreten, in der der Blick geöffnet wird auf die künftige Erweiterung der Eurozone und die Beurteilung der Bereitschaft der neuen Anwärter, den Euro einzuführen.

3. SOLIDARITÄT

Solidarität und soziale Gerechtigkeit sind für das Funktionieren der EU von grundlegender Bedeutung. Es geht darum, die Gesellschaft aufzubauen, die wir uns für uns selbst und für die künftigen Generationen wünschen. Es geht darum, die Lebensqualität zu fördern und die gemeinsame Verantwortung, etwa für den Umweltschutz, anzuerkennen. Es geht um die Förderung einer gesunden Gesellschaft aus Bürgern, die auch angesichts des Wandels zuversichtlich bleiben, als Fundament für Wohlstand und Sicherheit.

So weit sind wir allerdings noch nicht. Heute steht Europa vor einer Reihe von Herausforderungen, die nur bewältigt werden können durch konzertiertes und entschlossenes Vorgehen. Hier kann das Handeln der Union einen klaren Zusatznutzen bedeuten. Wirksame Maßnahmen für Kohäsion und zur Entwicklung des ländlichen Raums sind im Einklang mit der Lissabon-Strategie für Wachstum und Beschäftigung. 2006 wird hier ein entscheidendes Jahr sein, in dem Programme zur effektiven Ausrichtung der Ausgaben auf Konvergenz und Wettbewerbsfähigkeit für die nächsten sieben Jahre aufgelegt werden sollen. Reformen im Agrar- und Fischereisektor haben bereits den Weg bereitet für Nachhaltigkeit und höhere Wettbewerbsfähigkeit. Leistungen der Daseinsvorsorge sind für die europäischen Bürger von größter Bedeutung, und die Kommission wird ihre Arbeit fortsetzen, mit der sie sicherstellen will, dass der Nachfrage nach derartigen Dienstleistungen in den Maßnahmen der EU voll Rechnung getragen wird. Die Bedrohungen für die Umwelt Europas haben eine übernationale und globale Dimension und benötigen eine starke leitende Hand auf EU-Ebene.

Langfristige Probleme jetzt angehen

- Die Alterung von Europas Bevölkerung wird spürbare Folgen für Wohlstand, Lebensstandard und Generationenbeziehungen haben. Zwar fallen viele dieser Fragen in den Zuständigkeitsbereich der Mitgliedstaaten, aber die EU muss ebenfalls handeln. Im Anschluss an die 2005 eingeleitete Debatte wird die Kommission Vorstellungen darlegen, wie die EU zur Bewältigung des Problems der demografischen Alterung Europas beitragen kann.

- Eine wirksame Steuerung der Migrationsströme ist eines der drängendsten Probleme, die Europa zu bewältigen hat. Dabei geht es um Arbeitsmarkterfordernisse, aber auch um die Bekämpfung der illegalen Einwanderung. Die Antwort Europas muss umfassend und ausgewogen sein und in Einklang stehen mit seiner humanitären Tradition.

- Eine weitere langfristige Herausforderung ist der Klimawandel . Naturkatastrophen, die immer häufiger auftreten und immer größere Schäden verursachen, haben bereits den Preis der Tatenlosigkeit deutlich gemacht. 2006 wird ein entscheidendes Jahr für die multilateralen Klimaverhandlungen sein, wobei es um Verpflichtungen im Rahmen des Kioto-Protokolls für die Zeit nach 2012 geht. Die EU muss sich auch weiterhin um Maßnahmen im Zusammenhang mit dem Klimawandel bemühen, um ihre Ziele zu erreichen, durch nationale Zuteilungspläne und beispielsweise Schritte, um den Luftfahrtsektor in den Emissionshandel aufzunehmen. Es ist auch an der Zeit, Bilanz zu ziehen über die bisherigen freiwilligen Vereinbarungen mit der Industrie, die CO2-Emissionen von Autos zu reduzieren, um zu sehen, wie man darauf aufbauen kann.

Nachhaltiges Ressourcenmanagement

- Das nachhaltige Management unserer natürlichen Ressourcen entspricht langfristigen sozialen, wirtschaftlichen und ökologischen Interessen. Mit der Reform des Wein-, Obst- und Gemüse- sowie Bananensektors wird der laufende Reformprozess in der Landwirtschaft in seine letzte Phase eintreten, wobei das Streben nach mehr Wettbewerbsfähigkeit fortgeführt wird.

- Die in letzter Zeit emporschnellenden Ölpreise haben vor Augen geführt, wie wichtig eine sichere, wettbewerbsfähige und nachhaltige Energie versorgung für Europa ist. Die Bemühungen um einen besseren Umgang mit den Versorgungsrisiken und ihre Reduzierung sollen intensiviert werden, insbesondere durch Förderung der Energieeffizienz und der erneuerbaren Energiequellen und durch Auslotung des gesamten Potenzials der Entwicklung von Biokraftstoffen.

- Beim Ressourcenmanagement geht es auch um den Schutz unseres Naturerbes. Europaweit und weltweit geht die Biodiversität unter dem steigenden Druck des Menschen weiter zurück: es sind neue Maßnahmen erforderlich, damit das Ziel erreicht werden kann, den Verlust an Biodiversität in Europa bis 2010 zu stoppen. Gehandelt werden muss auch, um die Gefährdung von Gesundheit und Umwelt durch Pestizide zu verringern und den Kampf gegen die Luftverschmutzung zu intensivieren.

Europas Zusammenhalt verbessern

- Es besteht immer die Gefahr, dass Politiken isoliert entwickelt und dabei die Wechselwirkungen zwischen einzelnen Politikbereichen nicht voll berücksichtigt werden. Die neue Seeverkehrsstrategie wird den Weg bahnen für ein neues integriertes Konzept zur Entwicklung einer prosperierenden maritimen Wirtschaft in ökologisch nachhaltiger Weise, gestützt durch Exzellenz in meereswissenschaftlicher Forschung und Technologie.

- Zusammenhalt setzt als Aufgabe der EU voraus, gemeinsame Standards sicherzustellen, die offene Grenzen, Mobilität und Binnenmarkt begleiten müssen. Das geltende Arbeitsrecht sollte unter Berücksichtigung der wichtigsten Trends und zentralen Fragen der nächsten Jahre überprüft werden, und die Maßnahmen für die Gleichstellung von Mann und Frau sowie für Gesundheit und Sicherheit am Arbeitsplatz sollten intensiviert und modernisiert werden.

- Mit der Straffung der offenen Koordinierungsmethoden im sozialen Bereich und der Einleitung der Zusammenarbeit in der Gesundheitsversorgung und der Langzeitpflege unterstützt die EU die Mitgliedstaaten stärker in deren Bemühungen, die sozialen Sicherungssysteme zu modernisieren und die soziale Ausgrenzung zu bekämpfen.

- Je mobiler Europas Bürger werden, desto mehr erwarten sie von der Union, dass sie Lösungen für neue grenzübergreifende Fragen im zivilrechtlichen Bereich anbietet: dazu gehören Themen wie Scheidung und ehelicher Güterstand sowie grenzüberschreitende Durchsetzung von Entschädigungsansprüchen und anderen zivilrechtlichen Beschlüssen. Besondere Aufmerksamkeit sollte den Rechten des Kindes etwa in den Bereichen Familienzusammenführung, elterliche Verantwortung und Menschenhandel gelten.

4. SICHERHEIT

Es vergeht kaum ein Tag, an dem wir nicht an die Gefahren für die Sicherheit der Bürger erinnert werden. Ereignisse der letzten Zeit haben dies erneut nachdrücklich vor Augen geführt. Die Bombenattentate in Madrid und London, Naturkatastrophen in Europa und weltweit, die Bedrohung durch die Vogelgrippe und eine mögliche Grippepandemie beim Menschen, durch Energie- und Transportkrisen: dies sind nur die offenkundigsten Beispiele für Ereignisse, durch die das Alltagsleben aus seinen Bahnen geworfen wird oder das Risiko aus dem Bereich des Möglichen in den Bereich des Wahrscheinlichen übergeht.

Zu Recht erwarten die Bürger, dass gehandelt und auf die Herausforderungen in Europa und weltweit reagiert wird. In all diesen Fällen erwarten die Bürger von der EU wirksames gemeinsames Handeln: dies wurde kürzlich von den Mitgliedstaaten mit dem Haager Aktionsplan anerkannt. Für ein effizientes und realistisches Konzept muss auf mehreren verschiedenen Ebenen und auf viele unterschiedliche Weisen gehandelt werden; dazu gehören Prävention, Schutz und Reaktion.

Mehr Sicherheit in Europa für einen besseren Schutz der Europäer vor Kriminalität

- Der Terrorismus stellt in Europa eine ständige Bedrohung dar. Terroristen können überall in Europa brutal zuschlagen. Eine bessere Koordinierung zwischen den Mitgliedstaaten wird dazu beitragen, dass sie erfolgreicher aufgespürt und leichter vor Gericht gestellt werden können. Nach den Bombenanschlägen in London wurde hier die Arbeit beschleunigt, und dies wird 2006 fortgesetzt. Europa muss zusammenarbeiten im Kampf gegen die Finanzierung des Terrors, bei der Unterstützung der Opfer und zur besseren Koordinierung zwischen den Vollzugsbehörden. Die grenzüberschreitende Vernetzung zur Bekämpfung des Terrorismus an seinen Wurzeln muss effizienter gestaltet werden.

- Wegen der grenzüberschreitenden Dimension des organisierten Verbrechens und der hochmodernen Ausstattung der heutigen Kriminellen ist konzentriertes und der heutigen Zeit angepasstes europaweites Handeln notwendig. Dazu sollten ein kohärentes Strafregister-Informationssystem der zuständigen Behörden und eine umfassende Überprüfung der Cybersicherheit gehören.

- In einem Europa ohne Grenzen ist die Sicherheit der Außengrenzen von entscheidender Bedeutung: man ist sich einig, dass hier gemeinsames Handeln und einheitliche hohe Standards bei der Überwachung von Gütern und Personen notwendig sind. Maßnahmen zur Unterstützung der Mitgliedstaaten mit Außengrenzen sowie die Konsolidierung und Aktualisierung des derzeitigen Acquis bei der Visapolitik und den Zollverfahren werden dazu beitragen, dass wirksamere Kontrollen möglich sind.

- Europa bietet Möglichkeiten zur Unterstützung der Arbeit der Vollstreckungsbehörden . Die justitielle und polizeiliche Zusammenarbeit sollte intensiviert werden, um rechtliche Hindernisse zu reduzieren, die Rechte der Bürger zu garantieren und den Austausch von wichtigen Informationen und Best Practice zu erleichtern.

Besserer Schutz für die Bürger im Alltag

- Die Verbesserung der Gesundheit und des Verbrauchervertrauens sowie die Bekämpfung der Gesundheitsgefahren wirken sich eindeutig positiv auch auf die europäische Wirtschaft und auf das Wohlbefinden der Bürger aus. Ein geeigneter Rahmen aus Regeln und Maßnahmen für den Verbraucherschutz ist auf europäischer Ebene von grundlegender Bedeutung. Besondere Initiativen auf dem Gebiet der Lebensmittelsicherheit werden darauf abzielen, koordinierte grenzüberschreitende Maßnahmen für einen effektiven europaweiten Umgang mit Bedrohungen zu gewährleisten. Es muss auch konsequent und wirksam gehandelt werden: mit einem besonderen Ausbildungsprogramm zum Thema Lebensmittelsicherheit soll eine Aufwärtsspirale hoher Standards bei der Durchführung von Kontrollen sichergestellt werden.

- Unfälle im See-, Flug- und Straßenverkehr haben gezeigt, wie sich Mängel in der Verkehrssicherheit unmittelbar auf diejenigen, die Transportsysteme nutzen und im Transportwesen arbeiten, und auf die Umwelt auswirken. Dies kann zu erheblichen wirtschaftlichen Belastungen führen. Durch den Ausbau der Rolle der Europäischen Agentur für Flugsicherheit und der Europäischen Eisenbahnagentur wird ein echter Beitrag zur Sicherheit in ganz Europa geleistet.

- Als wichtige Voraussetzung für die Inanspruchnahme konvergierender digitaler Dienstleistungen müssen auch vertrauenswürdige, sichere und zuverlässige Kommunikationsnetze und Informationssysteme gewährleistet werden.

- Die Kommission wird auch ihre Zivilschutzmöglichkeiten ausbauen und Europas Krisenreaktionsfähigkeit verstärken, die im Falle einer größeren Krise zum Tragen kommt.

5. EUROPA ALS PARTNER IN DER WELT

Wenn Europa seine strategischen Ziele erreichen will, kann es nicht allein handeln. Die jüngsten Verhandlungen mit China im Textilbereich, die Hungersnot in Niger, die Sicherheitssituation im Irak, der Friedensprozess im Mittleren Osten: außereuropäische Ereignisse erinnern uns ständig daran, dass Wohlstand, Solidarität und Sicherheit wohl europäische Ziele sein mögen, aber nicht allein von dem abhängen, was wir bei uns erreichen. Europa muss mehr tun, als einfach nur auf die Außenwelt zu reagieren: es muss auch in stärkerem Maße proaktiv zur Gestaltung dieser Außenwelt beitragen.

Stabilität und Wohlstand an unseren Grenzen

- Was unsere unmittelbaren Nachbarregionen angeht, so müssen die Erweiterungsverhandlungen sowie der Stabilisierungs- und Assoziierungsprozess für die Bewerberstaaten und angehenden Bewerberstaaten weitergehen. Durch die Monitoring-Berichte über Bulgarien und Rumänien, die im Frühjahr veröffentlicht werden sollen, kommt die letzte Phase des Beitrittsprozesses ins Zentrum der Aufmerksamkeit. Die Beitrittsverhandlungen mit der Türkei und Kroatien werden fortgesetzt, ebenso das Monitoring der Fortschritte in allen Bewerberstaaten und angehenden Bewerberstaaten. Was die ehemalige jugoslawische Republik Mazedonien angeht, werden weitere Entwicklungen von der Stellungnahme der Kommission zu dem Beitrittsgesuch abhängen. Die Verhandlungen über ein Stabilisierungs- und Assoziierungsabkommen (SAA) mit Serbien und Montenegro und auch mit Bosnien-Herzegowina werden mit dem Ziel eines Abschlusses vor Ende 2006 weitergeführt.

- In unserer Nachbarschaft werden Kommission und Partnerstaaten die bestehenden Aktionspläne umsetzen. Die Ergebnisse werden Ende 2006 analysiert. Die Nachbarschaftspolitik ist eine Schlüsselpriorität für die Außenbeziehungen. Sie wird verstärkt und ergänzt durch neue Aktionspläne zur Zusammenarbeit mit Anrainerstaaten des Mittelmeers und des Kaspischen Meers, mit denen das Engagement für Stabilität und Wohlstand auf neue Partner ausgedehnt wird. Besondere Aufmerksamkeit wird der Entwicklung eines integrierten Energiemarktes mit Nachbarländern gelten. Die Kommission wird außerdem den Boden bereiten für eine erneuerte institutionelle Vereinbarung mit Russland und Ukraine, einschließlich der Möglichkeit einer Freihandelsvereinbarung mit Ukraine.

Globale Verantwortung

Gegenüber den Entwicklungsländern muss die Europäische Union ihren neuen, ehrgeizigen Verpflichtungen gerecht werden: war 2005 das Jahr, in dem Verpflichtungen für die Entwicklung eingegangen wurden, so muss 2006 das Jahr werden, in dem die entsprechenden Taten folgen. Im Gefolge des G8-Gipfels und des erneuerten Engagements für die Millenniums-Entwicklungsziele muss sich die EU jetzt an die Arbeit machen, um unsere Ziele größerer finanzieller Anstrengungen (zusätzliche 20 Milliarden € jährlich bis 2010) zu erreichen und die Kohärenz und Wirksamkeit der Hilfe der EU-Geber als Gruppe zu verbessern auf der Basis einer neuen Erklärung über die Entwicklungspolitik, die im Juli 2005 von der Kommission vorgeschlagen wurde. Zu diesem Zweck wird die Kommission ihr Konzept durch Bedarfsermittlung im Hinblick auf EU-Hilfen, durch Harmonisierung der Verfahren und mit Hilfe sowohl geografischer Strategien für AKP-Partner als auch von Schlüsselthemen wie Menschenrechten und Demokratie weiterverfolgen.

- Das Hauptzielgebiet für unser Handeln ist Afrika . Auf der neuen Strategie für Afrika und der neuen Erklärung über die Entwicklungspolitik der EU aufbauend wird die Kommission vorschlagen, ihre Partnerschaft mit Afrika in zwei vorrangigen Bereichen zu intensivieren, nämlich Governance und Infrastruktur. Wie im Rahmen des überarbeiteten Cotonou-Abkommens vorgeschlagen, muss der Dialog über Sicherheitsfragen verstärkt werden. Die Verhandlungen über Wirtschaftspartnerschaftsabkommen (EPA) werden in die entscheidende Phase eintreten, in der auch eine umfassende Überprüfung der Vereinbarungen vorgenommen wird.

- Durch verstärkte Zusammenarbeit im Irak wird die Unterstützung des Wiederaufbaus und des politischen Übergangs in eine neue Phase eintreten, was auch der Fall ist bei der Unterstützung für die Entwicklung in Gaza und im Westjordanland, der Arbeit in Afghanistan und in den vom Tsunami betroffenen Gebieten. Europa wird auch weiterhin humanitäre Hilfe für Krisenopfer in aller Welt bereitstellen.

- Eng damit verbunden ist die Sicherheit : neue Initiativen zur Nichtweitergabe von Atomwaffen, zu Abrüstung und Sicherheit sowie gegen Terrorismus in Einklang mit der Europäischen Sicherheitsstrategie.

Eine globalisierte Wirtschaft

- Die Globalisierung ist eine Realität, die wir annehmen müssen, wenn wir in Europa wieder ein dynamisches Wachstum und die Schaffung hochwertiger Arbeitsplätze erreichen wollen. Außenhandel und Auslandsinvestitionen gehen Hand in Hand mit der wirtschaftlichen Integration innerhalb Europas. Es ist an der Zeit, die Außendimension der Wettbewerbsfähigkeit durch Empfehlungen zur Handelspolitik und zu verwandten Politiken hervorzuheben. Auf der Ministertagung in Hongkong im Dezember 2005 sollte der Boden für ein sehr gutes Ergebnis der Doha-Entwicklungsrunde 2006 bereitet werden, einschließlich konkreter Ergebnisse für arme Entwicklungsländer. China bietet uns als unser zweitwichtigster Handelspartner sowohl Herausforderungen als auch Chancen; eine umfassende Überprüfung wird 5 Jahre nach Chinas Beitritt zur WTO stattfinden.

- Europa wird einen Beitrag leisten zu einem wirksamen multilateralen Konzept für die nachhaltige Entwicklung weltweit, insbesondere durch die Ausarbeitung eines Maßnahmenrahmens für globale öffentliche Güter, etwa was die Abholzung der Wälder und das Wassermanagement angeht. Die europäische Erfahrung im Umweltbereich wird, zusammen mit innovativen Formen der Kombination öffentlicher Entwicklungshilfe und privater Investitionen, in einen Fonds für erneuerbare Energie eingehen, der die Entwicklungsländer beim Erreichen der Millenniums-Entwicklungsziele in den Bereichen Abwasserentsorgung und Energie unterstützen soll.

- In allen Bereichen ist eine echte Partnerschaft zwischen den europäischen Institutionen der einzige Weg, um sicherzustellen, dass sich Europa in der Welt mit einer Stimme Gehör verschafft. Die Union sollte sich um mehr Kohärenz und Effizienz von Europas Handeln nach außen bemühen, sei es in Brüssel, in New York oder in aller Welt, insbesondere durch den Austausch von Beamten.

6. POLITISCHES HANDELN UND BESSERE RECHTSETZUNG

Wirksames politisches Handeln ist von zentraler Bedeutung für die Glaubwürdigkeit und Legitimierung der Europäischen Union. Es geht nicht nur darum, für welche Politiken man sich entscheidet: wie Politiken entwickelt und wie sie umgesetzt werden, ist genauso wichtig.

Im Jahr 2005 hat die Kommission ihre bereits eingeleitete Arbeit zur Verbesserung der Rechtsetzung intensiviert, um sicherzustellen, dass der Rechtsrahmen der EU den heutigen Anforderungen entspricht. Damit soll der Beitrag einer besseren Rechtsetzung zu Wachstum und Schaffung von Arbeitsplätzen verstärkt werden, während die sozialen und ökologischen Ziele und Good Governance weiterhin Berücksichtigung finden.

Die Folgenabschätzung wurde als Standardverfahren für auf dem Arbeitsprogramm stehende prioritäre Angelegenheiten eingeführt, und es wurden dazu neue Leitlinien vereinbart[1]. Die Kommission unternahm eine gründliche Prüfung der bereits dem Parlament und dem Rat vorliegenden Vorschläge auf ihre Vereinbarkeit mit den Grundsätzen der besseren Rechtsetzung, mit dem Ergebnis, dass 68 Vorschläge zurückgezogen werden sollen[2]. Damit wurde die Kommission in diesem Kontext bei einem Drittel ihrer schwebenden Vorschläge, die aus der Zeit vor 2004 stammen, tätig. Daran schließen sich nun intensive Bemühungen um Vereinfachung der geltenden Vorschriften an. Das Ergebnis sollte ein wichtiger Schritt vorwärts in unseren Bemühungen sein, mit denen wir erreichen wollen, dass Bürger und Wirtschaft der EU mit dem, was wir auf EU-Ebene tun, viel leichter umgehen können und es besser verstehen. In dieser neuen operationellen Phase wird die Kommission intern eine eigene Struktur einrichten, dank der die Umsetzung der Prinzipien der besseren Rechtsetzung intensiviert und so politische Kohärenz, Qualitätskontrolle und vorgelagerte Abschätzung von Rechtsetzungsfragen sichergestellt werden.

- Subsidiarität und Verhältnismäßigkeit. Die gesamte Arbeit der Kommission wird auf ihre Übereinstimmung mit den Grundsätzen der Subsidiarität und der Verhältnismäßigkeit geprüft (die EU handelt nur, wenn dies notwendig ist, und ihre Aktionen dürfen nicht über das für das Erreichen der angestrebten Ziele erforderliche Mindestmaß hinausgehen). Die Kommission wird besonders darauf achten, dass Subsidiarität und Verhältnismäßigkeit unbedingt respektiert werden.

- Kosteneffizienz, Transparenz und Verantwortlichkeit. Es sollten nur dann Mittel aus dem EU-Haushalt zum Einsatz kommen, wenn dies effizienter ist als Ausgaben auf nationaler Ebene. Die Verantwortlichkeit für Ausgaben muss zudem klar geregelt sein, wofür wirksame interinstitutionelle Mechanismen benötigt werden. Angemessene Audit- und Kontrollsysteme müssen gewährleistet werden, und der Fahrplan für das Erreichen einer positiven Zuverlässigkeitserklärung des Europäischen Rechnungshofes muss eingehalten werden. Der Schutz der finanziellen Interessen der Union bleibt ein Hauptanliegen. Ebenso wird die Kommission ihre Europäische Transparenzinitiative 2006 fortführen.

- Konsultation. Politische Initiativen müssen gut vorbereitet und präzise ausgerichtet werden, damit sie den tatsächlichen Bedürfnissen der heutigen Europäer entsprechen. Konsultation ist daher ein zentrales Element politischer Initiativen der Kommission. Viele der im Anhang zu diesem Arbeitsprogramm vorgebrachten Vorschläge sind das Ergebnis von Konsultationen; zu anderen werden neue Konsultationen eingeleitet. Die Kommission wird auch weiterhin die vorhandenen Instrumente zur Einbindung der Bürger in den Entscheidungsprozess intensivst nutzen und neue Konsultationsformen, etwa Bürgergremien, fördern.

- Folgenabschätzung. Die Folgenabschätzung gewährleistet, dass politische Maßnahmen in voller Kenntnis der Fakten und im Bewusstsein der Konsequenzen getroffen werden. Sie gibt durch eine offene Analyse der Optionen auch den Rahmen für den politischen Entscheidungsprozess vor und gewährleistet, dass die wirtschaftlichen, sozialen und ökologischen Faktoren, einschließlich der Auswirkungen für die Wettbewerbsfähigkeit, volle Berücksichtigung finden. Die Folgenabschätzung sollte auch den interinstitutionellen Entscheidungsprozess lenken; aus ihr ergibt sich eine klare und allgemein verständliche Begründung dafür, weshalb ein Vorschlag vorgelegt wird. Die Folgenabschätzung wird daher ein Standardelement aller legislativen und grundsatzpolitischen Vorschläge im Arbeitsprogramm für 2006 sein[3]: In bestimmten Fällen kann sie zu der Entscheidung führen, dass die Ziele besser auf anderem Weg realisiert werden oder dass das betreffende Vorhaben eingestellt wird. Darüber hinaus wird das Programm für 2007 durch 2006 durchgeführte Folgenabschätzungen vorbereitet. Das Gegenstück zur Folgenabschätzung ist die Ex-Post-Evaluierung, also die in regelmäßigen Abständen erfolgende Prüfung, ob die EU-Politiken und -Programme ihre Ziele erreicht haben.

- Umsetzung und Durchsetzung. Die Kommission wird sich verstärkt darum bemühen, dass das neue Konzept auf die Durchführung des Gemeinschaftsrechts angewandt wird[4], insbesondere durch effektivere Zusammenarbeit mit den Mitgliedstaaten, durch Präventivmaßnahmen und, erforderlichenfalls, durch rigoroses Vorgehen gegen Vertragsverletzungen.

- Vereinfachung. Bei den Vorschriften und Verfahren der EU muss übermäßige Komplexität vermieden werden, da sie mit echten Kosten für Bürger und Wirtschaft verbunden ist. Vorschläge für neue Rechtsvorschriften werden rigoros überprüft und auch bereits geltende Rechtsvorschriften sind einer unvoreingenommen Neubewertung zu unterziehen. Im Oktober 2005 leitet die Kommission bei der Vereinfachung der Rechtsvorschriften eine neue Phase ein (mit einem sektoralen Ansatz und einer systematischeren Anhörung der Betroffenen) und stellt ein auf drei Jahre angelegtes fortlaufendes Arbeitsprogramm auf, um zu prüfen, welche Rechtsvorschriften für Bürger und Wirtschaft der EU unverhältnismäßig belastend sein könnten[5]. Damit wird das von der Kommission 2003 aufgestellte Rahmenprogramm für die Vereinfachung der Rechtsvorschriften weitergeführt und verstärkt. Die erste Phase wird sich auf den Automobil-, den Bau- und den Abfallsektor konzentrieren.

- Administrative Vereinfachung: Die Kommission hat mit einer Überprüfung ihrer internen Verfahren begonnen, mit dem Ziel einer deutlichen internen Vereinfachung: das Jahr 2006 wird die ersten Ergebnisse dieser Vereinfachungsinitiative zeitigen, insbesondere bei Verwaltung, Finanzmanagement sowie Ausschreibungen und öffentlichem Auftragswesen.

Bei der Weiterarbeit an den im Anhang aufgeführten prioritären Initiativen und an anderen politischen Initiativen werden diese Prinzipien einer besseren Rechtsetzung ein zentrales Element der Tätigkeit der Kommission sein. Eine Halbzeitüberprüfung des Arbeitsprogramms im Sommer 2006 wird der Kommission die Gelegenheit bieten, eine Bestandsaufnahme dieser Änderungen vorzunehmen und gegebenenfalls ihre Prioritätenliste abzuändern.
