zur Festsetzung der Orientierungspreise und der gemeinschaftlichen Produktionspreise für bestimmte Fischereierzeugnisse für das Fischwirtschaftsjahr 2005 gemäß der Verordnung (EG) Nr. 104/2000

BEGRÜNDUNG

Gemäß Artikel 18 der Verordnung (EG) Nr. 104/2000 des Rates über die gemeinsame Marktorganisation für Erzeugnisse der Fischerei und der Aquakultur wird vor Beginn des Fischwirtschaftsjahres für jedes der in Anhang I aufgeführten Erzeugnisse und für jedes bzw. jede der in Anhang II aufgeführten Erzeugnisse oder Erzeugnisgruppen ein Orientierungspreis festgesetzt. Die Berechnung erfolgt anhand des Durchschnitts der Notierungen, die auf den Großhandelsmärkten oder in den Häfen während der letzten drei dem Jahr der Festsetzung dieses Preises vorausgegangenen Fischwirtschaftsjahre für einen erheblichen Teil der Gemeinschaftserzeugung festgestellt wurden.

Die voraussichtliche Entwicklung von Erzeugung und Nachfrage wird ebenfalls berücksichtigt. Weitere Kriterien, denen zudem Rechnung getragen wird, sind die Stabilisierung der Marktpreise, ein Beitrag zur Stützung der Erzeugereinkommen und die Verbraucherinteressen.

Während des Zeitraums 2002-2004 sind die Durchschnittspreise für Weißfisch im Vergleich zu 2001-2003 bei den meisten Arten um - 2 % bis - 10 % zurückgegangen. Im ersten Halbjahr 2004 ist im Vergleich zum Vorjahreszeitraum generell ein Preisrückgang zu verzeichnen. Unter Berücksichtigung dieser ungünstigen Marktlage schlägt die Kommission vor, die Orientierungspreise für die meisten Weißfischarten um - 0,5 % bis - 3 % zu senken. Daneben schlägt die Kommission für Migram und Wittling leichte Anhebungen um + 0,5 % und + 1,5 % vor. Für Katzenhai, Scholle, Seehecht, Scharbe und Flunder wird die Beibehaltung des derzeitigen Preises empfohlen.

Bei den pelagischen Arten lassen sich während des Zeitraums 2002-2004 im Vergleich zu 2001-2003 Änderungen der Durchschnittspreise der meisten Erzeugnisse von - 8 % bis + 10 % feststellen. Während die Preise für Makrele und Sardellen anstiegen, hat sich die Lage bei Hering, spanischer Makrele und Weißem Thun verschlechtert. Deshalb schlägt die Kommission eine Anhebung der Preise um + 1,5 % und + 2 % (Makrele und Sardellen) und Senkungen von - 1 % bis - 3 % (Hering, ganzer Weißer Thun und spanische Makrele) vor. Für Sardinen und ausgenommenen Weißen Thun wird die Beibehaltung der Preise empfohlen.

Bei den anderen Arten, insbesondere Krebstieren, hat sich die jüngste Marktlage als weniger günstig erwiesen; die Kommission schlägt deshalb vor, die Preise für diese Arten entsprechend zu senken.

Die auf den internationalen Märkten verzeichneten Preise für gefrorene Erzeugnisse haben sich nach unten entwickelt, außer bei Seebrassen und Illex, für die die Kommission eine Anhebung des Orientierungspreises um + 1 % bis + 1,5 % vorschlägt. Für Schwarzen Heilbutt, Seehechtfilets, Schwertfisch, Loligo und gewöhnlichen Kalmar wird die Beibehaltung der Preise vorgeschlagen.

Außerdem wird gemäß Artikel 26 der Verordnung (EG) Nr. 104/2000 des Rates für Thunfische, die für die Konservenindustrie bestimmt sind, ein gemeinschaftlicher Produktionspreis festgesetzt. Die Berechnung dieses Preises erfolgt anhand des Durchschnitts der Notierungen, die auf den Großhandelsmärkten oder in den Häfen während der letzten drei dem Jahr der Festsetzung dieses Preises vorausgegangenen Fischwirtschaftsjahre für einen erheblichen Teil der Gemeinschaftserzeugung festgestellt wurden.

Der durchschnittliche Gemeinschaftspreis ist im Zeitraum 2002-2004 gegenüber 2001-2003 gesunken. Der Trend hat auch in den ersten sechs Monaten des Jahres 2004 angehalten. Die Kommission schlägt in Anbetracht der Marktlage eine Senkung des gemeinschaftlichen Produktionspreises für das Fischwirtschaftjahr 2005 um 2 % vor.

zur Festsetzung der Orientierungspreise und der gemeinschaftlichen Produktionspreise für bestimmte Fischereierzeugnisse für das Fischwirtschaftsjahr 2005 gemäß der Verordnung (EG) Nr. 104/2000

DER RAT DER EUROPÄISCHEN UNION -

gestützt auf den Vertrag zur Gründung der Europäischen Gemeinschaft,

gestützt auf die Verordnung (EG) Nr. 104/2000 des Rates vom 17. Dezember 1999 über die gemeinsame Marktorganisation für Erzeugnisse der Fischerei und der Aquakultur[1], insbesondere auf Artikel 18 Absatz 3 und Artikel 26 Absatz 1,

auf Vorschlag der Kommission,

in Erwägung nachstehender Gründe:

Artikel 18 Absatz 1 und Artikel 26 Absatz 1 der Verordnung (EG) Nr. 104/2000 sehen die Festsetzung eines Orientierungspreises und eines gemeinschaftlichen Produktionspreises zur Bestimmung des Preisniveaus zur Marktintervention für bestimmte Fischereierzeugnisse für jedes Fischwirtschaftsjahr vor.

Gemäß Artikel 18 Absatz 1 der Verordnung (EG) Nr. 104/2000 wird für jedes bzw. jede der in den Anhängen I und II aufgeführten Erzeugnisse oder Erzeugnisgruppen ein Orientierungspreis festgesetzt.

Aufgrund der derzeit verfügbaren Preisangaben für die betreffenden Erzeugnisse und der in Artikel 18 Absatz 2 der Verordnung (EG) Nr. 104/2000 festgelegten Kriterien sollten die Orientierungspreise im Fischwirtschaftsjahr 2005 je nach Fischart angehoben, beibehalten oder gesenkt werden.

Gemäß der Verordnung (EG) Nr. 104/2000 wird für jedes der in Anhang III aufgeführten Erzeugnisse der gemeinschaftliche Produktionspreis festgesetzt. Es ist jedoch ausreichend, den gemeinschaftlichen Produktionspreis nur für eines der im Anhang III der Verordnung (EG) Nr. 104/2000 aufgeführten Erzeugnisse festzusetzen, da die Preise der anderen Erzeugnisse mittels der Umrechnungsfaktoren, die durch die Verordnung der Kommission (EWG) Nr. 3510/82[2] festgelegt worden sind, errechnet werden können.

Aufgrund der in Artikel 18 Absatz 2 erster und zweiter Gedankenstrich sowie in Artikel 26 Absatz 1 der Verordnung (EG) Nr. 104/2000 festgelegten Kriterien empfiehlt es sich, den gemeinschaftlichen Produktionspreis für das Fischwirtschaftsjahr 2005 zu senken -

HAT FOLGENDE VERORDNUNG ERLASSEN:

Artikel 1

Für das Fischwirtschaftsjahr vom 1. Januar bis 31. Dezember 2005 werden die Orientierungspreise gemäß Artikel 18 Absatz 1 der Verordnung (EG) Nr. 104/2000 in Anhang I der vorliegenden Verordnung festgesetzt.

Artikel 2

Für das Fischwirtschaftsjahr vom 1. Januar bis 31. Dezember 2005 werden die gemeinschaftlichen Produktionspreise gemäß Artikel 26 Absatz 1 der Verordnung (EG) Nr. 104/2000 in Anhang II der vorliegenden Verordnung festgesetzt.

Artikel 3

Diese Verordnung tritt am 1. Januar 2005 in Kraft.

Diese Verordnung ist in allen ihren Teilen verbindlich und gilt unmittelbar in jedem Mitgliedstaat.

CHARACTERISTICS AND OBJECTIVES

Need to be met in the short or long term

The interventions concerning fishery products are carried out under the Common Fisheries Policy (CFP) in accordance with Article 34 of the Treaty. They aim at providing stability to the Community markets by preventing possible risks of crisis. In this context, appropriate price and supply policies are of utmost importance. The interest of the production and marketing chain and the need to strengthen the competitiveness of the sector in a context of globalisation must be taken into account. The objective of market stability together with the support to producers’ income can essentially be achieved through the different mechanisms of intervention on the markets, e.g. withdrawals, carry-over, compensatory allowance. The interest of the consumers must also be considered.

Value-added of Community involvement and coherence of the proposal with other financial instruments and possible synergy

The question of subsidiarity is not relevant to this proposal since Community intervention falls within the exclusive competence of the Community. The added value of Community intervention is directly related to the underlying arguments of the existence of a common organisation of the markets in fishery and aquaculture products.

Objectives, expected results and related indicators of the proposal in the context of the ABM framework

This proposal aims at the fixation of guide prices and Community producer price by the Council in accordance with Articles 18 and 26 of Council Regulation (EC) No 104/2000. The guide prices provide the basis for the subsequent fixing, by way of Commission Regulations, of the different parameters needed for the operation of the intervention mechanisms for the fishing year concerned. Similarly, the Community producer price forms the basis of the granting of the compensatory allowance for tuna which might be triggered depending on the development of prices on the world markets.

In order to ensure the proper functioning of the common organisation of the markets in 2005, all regulations should be adopted before the end of 2004.

Relevant comments:

Most measures financed under the budget heading 11.02.01 are implemented in shared management with the EU Member States. However, the management of data notified by the Member States in accordance with Commission Regulation (EC) No 80/2001 is the sole responsibility of the Commission.

MONITORING AND EVALUATION

Monitoring system

The monitoring of the envisaged measures is ensured through the collection and the analysis of data notified by the Member States by way of the FIDES system in accordance with Commission Regulation (EC) No 80/2001.

Evaluation

Ex-ante evaluation

Considering the specific nature of the proposal, namely the annual fixation of certain Community prices within the framework of the current common organisation of the markets for fishery and aquaculture products, an ex-ante evaluation as defined in Article 21 (1) of Commission Regulation (EC, Euratom) No 2342/2002 laying down detailed rules for the implementation of the Financial Regulation is not required. Nevertheless, the Commission proposal is based on regular monitoring of interventions in previous fishing years and thorough analysis of the market situation for the relevant products.

Measures taken following an intermediate/ex-post evaluation (lessons learned from similar experiences in the past)

Not relevant since the intervention measures for fishery products have not yet been subject to intermediary or ex-post evaluation.

Terms and frequency of future evaluation

In accordance with Article 41 of Council Regulation (EC) No 104/2000, the Commission shall submit by 31 December 2005 to the Council and to the Parliament an evaluation report on the implementation of this Regulation.

ANTI-FRAUD MEASURES

The anti-fraud measures are in conformity with the provisions laid down in Regulation (CE) No 104/2000 and, in particular, with the provisions laid down in Regulation (EEC) No 595/91 concerning irregularities and the recovery of sums wrongly paid.
