Beschluss des Rates

vom 10. Februar 2004

zur Änderung des Beschlusses 2001/264/EG über die Annahme der Sicherheitsvorschriften des Rates

(2004/194/EG)

DER RAT DER EUROPÄISCHEN UNION -

gestützt auf den Vertrag zur Gründung der Europäischen Gemeinschaft, insbesondere auf Artikel 207 Absatz 3,

gestützt auf den Beschluss 2002/682/EG, Euratom des Rates vom 22. Juli 2002 zur Festlegung seiner Geschäftsordnung(1), insbesondere auf Artikel 24,

in Erwägung nachstehender Gründe:

(1) Anhang 1 der Sicherheitsvorschriften des Rates der Europäischen Union im Anhang zum Beschluss 2001/264/EG(2) enthält ein Verzeichnis nationaler Sicherheitsbehörden, Anhang 2 eine Vergleichstabelle nationaler Sicherheitseinstufungen.

(2) Die Tschechische Republik, die Republik Estland, die Republik Zypern, die Republik Lettland, die Republik Litauen, die Republik Ungarn, die Republik Malta, die Republik Polen, die Republik Slowenien und die Slowakische Republik haben am 16. April 2003 den Vertrag über ihren Beitritt zur Europäischen Union(3) unterzeichnet.

(3) Nach Artikel 2 Absatz 2 des Beschlusses 2001/264/EG müssen diese Staaten geeignete Maßnahmen treffen, um dafür zu sorgen, dass beim Umgang mit EU-Verschlusssachen die Sicherheitsvorschriften des Rates eingehalten werden.

(4) Um diese Staaten in die genannten Anhänge aufnehmen zu können, sind im Beschluss 2001/264/EG entsprechende technische Änderungen erforderlich.

(5) Anhang 2 des Beschlusses 2001/264/EG sieht vor, dass die Übereinstimmung mit den Einstufungskategorien der NATO bei der Aushandlung des Sicherheitsabkommens zwischen der Europäischen Union und der NATO hergestellt wird.

(6) Am 14. März 2003 wurde zwischen der Europäischen Union und der NATO ein Abkommen über den Geheimschutz(4) unterzeichnet.

(7) In Anhang 2 des genannten Beschlusses ist daher Übereinstimmung mit den Einstufungskategorien der NATO herzustellen -

BESCHLIESST:

Artikel 1

Der Beschluss 2001/264/EG wird wie folgt geändert:

a) Anhang 1 wird durch das Dokument in Anhang I dieses Beschlusses ersetzt.

b) Anhang 2 wird durch das Dokument in Anhang II dieses Beschlusses ersetzt.

Artikel 2

(1) Dieser Beschluss wird am Tag seiner Veröffentlichung wirksam.

(2) Er gilt vorbehaltlich des Inkrafttretens des am 16. April 2003 in Athen unterzeichneten Beitrittsvertrags von 2003 ab dem Tag des Inkrafttretens dieses Vertrags.
