KOMMISSIONENS GENNEMFØRELSESAFGØRELSE (EU) 2026/582
af 11. marts 2026
om visse hasteforanstaltninger vedrørende mund- og klovesyge i Cypern og om ophævelse af gennemførelsesafgørelse (EU) 2026/484

under henvisning til traktaten om Den Europæiske Unions funktionsmåde,
under henvisning til Europa-Parlamentets og Rådets forordning (EU) 2016/429 af 9. marts 2016 om overførbare dyresygdomme og om ændring og ophævelse af visse retsakter på området for dyresundhed (»dyresundhedsloven«) (1), særlig artikel 259, stk. 1, og
ud fra følgende betragtninger:

Mund- og klovesyge er en infektiøs virussygdom, der rammer dyr i pattedyrsordenen Artiodactyla og kan have alvorlige konsekvenser for den pågældende dyrepopulation og landbrugets rentabilitet og forårsage forstyrrelser i flytninger af sendinger af disse dyr og produkter heraf inden for Unionen og eksporten til tredjelande. I tilfælde af et udbrud af mund- og klovesyge hos dyr i pattedyrsordenen Artiodactyla er der alvorlig risiko for spredning af sygdommen til andre virksomheder, hvor der holdes modtagelige dyr. |

Kommissionens delegerede forordning (EU) 2020/687 (2) supplerer reglerne om bekæmpelse af de listeopførte sygdomme, der er omhandlet i artikel 9, stk. 1, litra a), b) og c), i forordning (EU) 2016/429, og som er defineret som kategori A-, B- og C-sygdomme i Kommissionens gennemførelsesforordning (EU) 2018/1882 (3). Navnlig indeholder artikel 21 og 22 i delegeret forordning (EU) 2020/687 bestemmelser om oprettelse af en restriktionszone i tilfælde af udbrud af en kategori A-sygdom, herunder mund- og klovesyge, og om anvendelse af visse foranstaltninger deri. Desuden fastsættes det i artikel 21, stk. 1, i nævnte delegerede forordning, at restriktionszonen skal omfatte en beskyttelseszone, en overvågningszone og om nødvendigt supplerende restriktionszoner rundt om eller op til beskyttelses- og overvågningszonerne. |

Kommissionens gennemførelsesafgørelse (EU) 2026/484 (4) blev vedtaget på grundlag af forordning (EU) 2016/429 og fastsætter visse midlertidige hasteforanstaltninger i forbindelse med udbruddene af mund- og klovesyge på virksomheder, hvor der holdes kvæg i distriktet Larnaca i Cypern, som blev bekræftet den 20. februar 2026. Nærmere bestemt skal Cypern i henhold til gennemførelsesafgørelse (EU) 2026/484 oprette restriktionszoner, der omfatter beskyttelses- og overvågningszoner, i overensstemmelse med artikel 21 i delegeret forordning (EU) 2020/687, hvor de foranstaltninger, der kræves anvendt i beskyttelses- og overvågningszoner, som minimum anvendes indtil de datoer, der er opført i bilaget til nævnte gennemførelsesafgørelse, og beskyttelses- og overvågningszonerne skal som minimum omfatte de områder, der er opført i nævnte bilag. |

Siden vedtagelsen af gennemførelsesafgørelse (EU) 2026/484 er de nødforanstaltninger, der kræves anvendt i de beskyttelses- og overvågningszoner, der er opført i bilaget hertil, og tidsplanen for deres anvendelse blevet revideret, navnlig med hensyn til den foreløbige rengøring og desinfektion af de angrebne virksomheder, jf. delegeret forordning (EU) 2020/687. Som følge heraf skal varigheden af hasteforanstaltningerne i disse beskyttelses- og overvågningszoner forlænges midlertidigt. |

Siden vedtagelsen af gennemførelsesafgørelse (EU) 2026/484 har der desuden været yderligere udbrud af mund- og klovesyge på virksomheder i distriktet Larnaca i Cypern, som blev bekræftet mellem den 21. februar og den 4. marts 2026, herunder uden for de områder, der er opført som beskyttelses- og overvågningszoner i bilaget til gennemførelsesafgørelse (EU) 2026/484. Det er derfor nødvendigt hurtigst muligt at oprette restriktionszoner på EU-plan for at tage hensyn til disse yderligere udbrud. |

I betragtning af den nuværende epidemiologiske situation med hensyn til mund- og klovesyge i Cypern og med henblik på at forhindre yderligere spredning af sygdommen i denne medlemsstat eller til andre medlemsstater eller til tredjelande er det derfor nødvendigt hurtigst muligt at gennemgå de nuværende områder, der er opført som beskyttelses- og overvågningszoner i bilaget til gennemførelsesafgørelse (EU) 2026/484, både geografisk og tidsmæssigt, og også at oprette nye beskyttelses- og overvågningszoner under hensyntagen til de nye udbrud i Cypern samt at oprette en supplerende restriktionszone. Dette er også nødvendigt for at hindre unødvendige forstyrrelser i samhandelen i Unionen og for at undgå, at tredjelande indfører uberettigede handelshindringer. |

Regionaliseringen bør derfor ajourføres på EU-plan, og de områder, der er oprettet som beskyttelses- og overvågningszoner samt supplerende restriktionszoner i Cypern, bør fastsættes i bilaget til nærværende afgørelse, og varigheden af disse foranstaltninger bør fastsættes i samarbejde med den pågældende medlemsstat. |

Desuden bør gennemførelsesafgørelse (EU) 2026/484 ophæves, idet den erstattes af nærværende afgørelse. |

Foranstaltningerne i denne afgørelse er i overensstemmelse med udtalelse fra Den Stående Komité for Planter, Dyr, Fødevarer og Foder — |
VEDTAGET DENNE AFGØRELSE:
Artikel 1
Cypern opretter restriktionszoner, der omfatter beskyttelses- og overvågningszoner samt en supplerende restriktionszone, i overensstemmelse med artikel 21 i delegeret forordning (EU) 2020/687, hvor de foranstaltninger, der anvendes i disse zoner i overensstemmelse med nævnte delegerede forordning, som minimum anvendes indtil de datoer, der er anført i bilaget til denne afgørelse.
Disse beskyttelses- og overvågningszoner samt supplerende restriktionszoner skal som minimum omfatte de områder, der er angivet i bilaget.
Artikel 2
Gennemførelsesafgørelse (EU) 2026/484 ophæves.
Artikel 3
Denne afgørelse er rettet til Republikken Cypern.
