CONVENTION on the conservation of European wildlife and natural habitats

PREAMBLE

THE MEMBER STATES OF THE COUNCIL OF EUROPE AND THE OTHER SIGNATORIES HERETO,

Considering that the aim of the Council of Europe is to achieve greater unity between its members;

Considering the wish of the Council of Europe to cooperate with other States in the field of nature conservation;

Recognizing that wild flora and fauna constitute a natural heritage of aesthetic, scientific, cultural, recreational, economic and intrinsic value that needs to be preserved and handed on to future generations;

Recognizing the essential role played by wild flora and fauna in maintaining biological balances;

Noting that numerous species of wild flora and fauna are being seriously depleted and some of them threatened with extinction;

Aware that the conservation of natural habitats is a vital component of the protection and conservation of wild flora and fauna;

Recognizing that the conservation of wild flora and fauna should be taken into consideration by the governments in their national goals and programmes, and that international cooperation should be established to protect migratory species in particular;

Bearing in mind the widespread requests for common action made by governments or by international bodies, in particular the requests expressed by the United Nations Conference on Human Environment 1972 and the Parliamentary Assembly of the Council of Europe;

Desiring particularly to follow, in the field of wildlife conservation, the recommendations of resolution 2 of the Second European Ministerial Conference on the Environment,

HAVE AGREED AS FOLLOWS:

CHAPTER I

General provisions

Article 1

1. The aims of this Convention are to conserve wild flora and fauna and their natural habitats, especially those species and habitats whose conservation requires the cooperation of several States, and to promote such cooperation.

2. Particular emphasis is given to endangered and vulnerable species, including endangered and vulnerable migratory species.

Article 2

The Contracting Parties shall take requisite measures to maintain the population of wild flora and fauna at, or adapt it to, a level which corresponds in particular to ecological, scientific and cultural requirements, while taking account of economic and recreational requirements and the needs of sub-species, varieties or forms at risk locally.

Article 3

1. Each Contracting Party shall take steps to promote national policies for the conservation of wild flora, wild fauna and natural habitats, with particular attention to endangered and vulnerable species, especially endemic ones, and endangered habitats in accordance with the provisions of this Convention.

2. Each Contracting Party undertakes, in its planning and development policies and in its measures against pollution to have regard to the conservation of wild flora and fauna.

3. Each Contracting Party shall promote education and disseminate general information on the need to conserve species of wild flora and fauna and their habitats.

CHAPTER II

Protection of habitats

Article 4

1. Each Contracting Party shall take appropriate and necessary legislative and administrative measures to ensure the conservation of the habitats of the wild flora and fauna species, especially those specified in the Appendices I and II and the conservation of endangered natural habitats.

2. The Contracting Parties in their planning and development policies shall have regard to the conservation requirements of the areas protected under the preceding paragraph, so as to avoid or minimize as far as possible any deterioration of such areas.

3. The Contracting Parties undertake to give special attention to the protection of areas that are of importance for the migratory species specified in Appendices II and III and which are appropriately situated in relation to migration routes, as wintering, staging, feeding, breeding or moulting areas.

4. The Contracting Parties undertake to coordinate as appropriate their efforts for the protection of the natural habitats referred to in this Article when these are situated in frontier areas.

CHAPTER III

Protection of species

Article 5

Each Contracting Party shall take appropriate and necessary legislative and administrative measures to ensure the special protection of the wild flora species specified in Appendix I. Deliberate picking, collecting, cutting or uprooting of such plants shall be prohibited. Each Contracting Party shall as appropriate, prohibit the possession or sale of these species.

Article 6

Each Contracting Party shall take appropriate and necessary legislative and administrative measures to ensure the special protection of the wild fauna species specified in Appendix II. The following will in particular be prohibited for these species:

(a) all forms of deliberate capture and keeping and deliberate killing;

(b) the deliberate damage to or destruction of breeding or resting sites;

(c) the deliberate disturbance of wild fauna particularly during the period of breeding, rearing and hibernation, in so far as disturbance would be significant in relation to the objectives of this Convention;

(d) the deliberate destruction or taking of eggs from the wild or keeping these eggs even if empty;

(e) the possession of and internal trade in these animals, alive or dead, including stuffed animals and any readily recognizable part or derivative thereof, where this would contribute to the effectiveness of the provisions of this Article.

Article 7

1. Each Contracting Party shall take appropriate and necessary legislative and administrative measures to ensure the protection of the wild fauna species specified in Appendix III.

2. Any exploitation of wild fauna specified in Appendix III shall be regulated in order to keep the populations out of danger, taking into account the requirements of Article 2.

3. Measures to be taken shall include:

(a) closed seasons and/or other procedures regulating the exploitation;

(b) the temporary or local prohibition of exploitation, as appropriate, in order to restore satisfactory population levels;

(c) the regulation as appropriate of sale, keeping for sale, transport for sale or offering for sale of live and dead wild animals.

Article 8

In respect of the capture or killing of wild fauna species specified in Appendix III and in cases where, in accordance with Article 9, exceptions are applied to species specified in Appendix II, Contracting Parties shall prohibit the use of all indiscriminate means of capture and killing and the use of all means capable of causing local disappearance of, or serious disturbance to, populations of a species, and in particular, the means specified in Appendix IV.

Article 9

1. Each Contracting Party may make exceptions from the provisions of Articles 4, 5, 6, 7 and from the prohibition of the use of the means mentioned in Article 8 provided that there is no other satisfactory solution and that the exception will not be detrimental to the survival of the population concerned:

- for the protection of flora and fauna,

- to prevent serious damage to crops, livestock, forests, fisheries, water and other forms of property,

- in the interests of public health and safety, air safety or other overriding public interests,

- for the purposes of research and education, of repopulation, of reintroduction and for the necessary breeding,

- to permit, under strictly supervised conditions, on a selective basis and to a limited extent, the taking, keeping or other judicious exploitation of certain wild animals and plants in small numbers.

2. The Contracting Parties shall report every two years to the Standing Committee on the exceptions made under the preceding paragraph. These reports must specify:

- the populations which are or have been subject to the exceptions and, when practical, the number of specimens involved,

- the means authorized for the killing or capture,

- the conditions of risk and the circumstances of time and place under which such exceptions were granted,

- the authority empowered to declare that these conditions have been fulfilled, and to take decisions in respect of the means that may be used, their limits and the persons instructed to carry them out,

- the controls involved.

CHAPTER IV

Special provisions for migratory species

Article 10

1. The Contracting Parties undertake, in addition to the measures specified in Articles 4, 6, 7 and 8 to coordinate their efforts for the protection of the migratory species specified in Appendices II and III whose range extends into their territories.

2. The Contracting Parties shall take measures to seek to ensure that the closed seasons and/or other procedures regulating the exploitation established under paragraph 3 (a) of Article 7 are adequate and appropriately disposed to meet the requirements of the migratory species specified in Appendix III.

CHAPTER V

Supplementary provisions

Article 11

1. In carrying out the provisions of this Convention, the Contracting Parties undertake:

(a) to cooperate whenever appropriate and in particular where this would enhance the effectiveness of measures taken under other Articles of this Convention;

(b) to encourage and coordinate research related to the purposes of this Convention.

2. Each Contracting Party undertakes:

(a) to encourage the reintroduction of native species of wild flora and fauna when this would contribute to the conservation of an endangered species, provided that a study is first made in the light of the experiences of other Contracting Parties to establish that such reintroduction would be effective and acceptable;

(b) to strictly control the introduction of non-native species.

3. Each Contracting Party shall inform the Standing Committee of the species receiving complete protection on its territory and not included in Appendices I and II.

Article 12

The Contracting Parties may adopt stricter measures for the conservation of wild flora and fauna and their natural habitats than those provided under this Convention.

CHAPTER VI

Standing Committee

Article 13

1. For the purposes of this Convention, a Standing Committee shall be set up.

2. Any Contracting Party may be represented on the Standing Committee by one or more delegates. Each delegation shall have one vote. Within the areas of its competence, the European Economic Community shall exercise its right to vote with a number of votes equal to the number of its Member States which are Contracting Parties to this Convention ; the European Economic Community shall not exercise its right to vote in cases where the Member States concerned exercise theirs, and conversely.

3. Any Member State of the Council of Europe which is not a Contracting Party to the Convention may be represented on the Committee as an observer.

The Standing Committee may, by unanimous decision, invite any non-member State of the Council of Europe which is not a Contracting Party to the Convention to be represented by an observer at one of its meetings.

Any body or agency technically qualified in the protection, conservation or management of wild fauna and flora and their habitats, and belonging to one of the following categories:

(a) international agencies or bodies, either governmental or non-governmental and national governmental agencies or bodies;

(b) national non-governmental agencies or bodies which have been approved for this purpose by the State in which they are located,

may inform the Secretary General of the Council of Europe, at least three months before the meeting of the Committee, of its wish to be represented at that meeting by observers. They shall be admitted unless, at least one month before the meeting, one-third of the Contracting Parties have informed the Secretary General of their objection.

4. The Standing Committee shall be convened by the Secretary General of the Council of Europe. Its first meeting shall be held within one year of the date of the entry into force of the Convention. It shall subsequently meet at least every two years and whenever a majority of the Contracting Parties so request.

5. A majority of the Contracting Parties shall constitute a quorum for holding a meeting of the Standing Committee.

6. Subject to the provisions of this Convention, the Standing Committee shall draw up its own Rules of Procedure.

Article 14

1. The Standing Committee shall be responsible for following the application of this Convention. It may in particular:

- keep under review the provisions of this Convention, including its Appendices, and examine any modifications necessary,

- make recommendations to the Contracting Parties concerning measures to be taken for the purposes of this Convention,

- recommend the appropriate measures to keep the public informed about the activities undertaken within the framework of this Convention,

- make recommendations to the Committee of Ministers concerning non-member States of the Council of Europe to be invited to accede to this Convention,

- make any proposal for improving the effectiveness of this Convention, including proposals for the conclusion, with the States which are not Contracting Parties to the Convention, of agreements that would enhance the effective conservation of species or groups of species.

2. In order to discharge its functions, the Standing Committee may, on its own initiative, arrange for meetings of groups of experts.

Article 15

After each meeting, the Standing Committee shall forward to the Committee of Ministers of the Council of Europe, a report on its work and on the functioning of the Convention.

CHAPTER VII

Amendments

Article 16

1. Any amendment to the Articles of this Convention proposed by a Contracting Party or the Committee of Ministers shall be communicated to the Secretary General of the Council of Europe and forwarded by him at least two months before the meeting of the Standing Committee to the Member States of the Council of Europe, to any signatory, to any Contracting Party, to any State invited to sign this Convention in accordance with the provisions of Article 19 and to any State invited to accede to it in accordance with the provisions of Article 20.

2. Any amendment proposed in accordance with the provisions of the preceding paragraph shall be examined by the Standing Committee which:

(a) for amendments to Articles 1 to 12, submit the text adopted by a three-quarters majority of the votes cast to the Contracting Parties for acceptance;

(b) for amendments to Articles 13 to 24, shall submit the text adopted by a three-quarters majority of the votes cast, to the Committee of Ministers for approval. After its approval, this text shall be forwarded to the Contracting Parties for acceptance.

3. Any amendment shall enter into force on the 30th day after all the Contracting Parties have informed the Secretary General that they have accepted it.

4. The provisions of paragraphs 1, 2 (a) and 3 of this Article shall apply to the adoption of new Appendices to this Convention.

Article 17

1. Any amendment to the Appendices to this Convention proposed by a Contracting Party or the Committee of Ministers, shall be communicated to the Secretary General of the Council of Europe and forwarded by him at least two months before the meeting of the Standing Committee to the Member States of the Council of Europe, to any signatory, to any Contracting Party, to any State invited to sign this Convention in accordance with the provisions of Article 19 and to any State invited to accede to it in accordance with the provisions of Article 20.

2. Any amendment proposed in accordance with the provisions of the preceding paragraph shall be examined by the Standing Committee, which may adopt it by a two-thirds majority of the Contracting Parties. The text adopted shall be forwarded to the Contracting Parties.

3. Three months after its adoption by the Standing Committee and unless one-third of the Contracting Parties have notified objections, any amendment shall enter into force for those Contracting Parties which have not notified objections.

CHAPTER VIII

Settlement of disputes

Article 18

1. The Standing Committee shall use its best endeavours to facilitate a friendly settlement of any difficulty to which the execution of this Convention may give rise.

2. Any dispute between Contracting Parties concerning the interpretation or application of this Convention which has not been settled on the basis of the provisions of the preceding paragraph or by negotiation between the parties concerned shall, unless the said parties agree otherwise, be submitted, at the request of one of them, to arbitration. Each party shall designate an arbitrator and the two arbitrators shall designate a third arbitrator. Subject to the provisions of paragraph 3 of this Article, if one of the parties has not designated its arbitrator within the three months following the request for arbitration, he shall be designated at the request of the other party by the President of the European Court of Human Rights within a further three-month period. The same procedure shall be observed if the arbitrators cannot agree on the choice of the third arbitrator within the three months following the designation of the two first arbitrators.

3. In the event of a dispute between two Contracting Parties one of which is a Member State of the European Economic Community, the latter itself being a Contracting Party, the other Contracting Party shall address the request for arbitration both to the Member State and to the Community ; which jointly shall notify it, within two months of receipt of the request, whether the Member State or the Community, or the member and the Community jointly, shall be party to the dispute. In the absence of such notification within the said time limit, the Member State and the Community shall be considered as being one and the same party to the dispute for the purposes of the application of the provisions governing the constitution and procedure of the arbitration tribunal. The same shall apply when the Member State and the Community jointly present themselves as party to the dispute.

4. The arbitration tribunal shall draw up its own Rules of Procedure. Its decisions shall be taken by majority vote. Its award shall be final and binding.

5. Each party to the dispute shall bear the expenses of the arbitrator designated by it and the parties shall share equally the expenses of the third arbitrator, as well as other costs entailed by the arbitration.

CHAPTER IX

Final provisions

Article 19

1. This Convention shall be open for signature by the Member States of the Council of Europe and non-member States which have participated in its elaboration and by the European Economic Community.

Up until the date when the Convention enters into force, it is also open to signature by any other State so invited by the Committee of Ministers.

The Convention is subject to ratification, acceptance or approval. Instruments of ratification, acceptance or approval shall be deposited with the Secretary General of the Council of Europe.

2. The Convention shall enter into force on the first day of the month following the expiry of a period of three months after the date on which five States, including at least four Member States of the Council of Europe, have expressed their consent to be bound by the Convention in accordance with the provisions of the preceding paragraph.

3. In respect of any signatory State or the European Economic Community which subsequently express their consent to be bound by it, the Convention shall enter into force on the first day of the month following the expiry of a period of three months after the date of the deposit of the instrument of ratification, acceptance or approval.

Article 20

1. After the entry into force of this Convention, the Committee of Ministers of the Council of Europe, after consulting the Contracting Parties, may invite to accede to the Convention any non-member State of the Council which, invited to sign in accordance with the provisions of Article 19, has not yet done so, and any other non-member State.

2. In respect of any acceding State, the Convention shall enter into force on the first day of the month following the expiry of a period of three months after the date of the deposit of the instrument of accession with the Secretary General of the Council of Europe.

Article 21

1. Any State may, at the time of signature or when depositing its instrument of ratification, acceptance, approval or accession, specify the territory or territories to which this Convention shall apply.

2. Any Contracting Party may, when depositing its instrument of ratification, acceptance, approval or accession or at any later date, by declaration addressed to the Secretary General of the Council of Europe, extend the application of this Convention to any other territory specified in the declaration and for whose international relations it is responsible or on whose behalf it is authorized to give undertakings.

3. Any declaration made under the preceding paragraph may, in respect of any territory mentioned in such declaration, be withdrawn by notification addressed to the Secretary General. Such withdrawal shall become effective on the first day of the month following the expiry of a period of six months after the date of receipt of the notification by the Secretary General.

Article 22

1. Any State may, at the time of signature or when depositing its instrument of ratification, acceptance, approval or accession, make one or more reservations regarding certain species specified in Appendices I to III and/or, for certain species mentioned in the reservation or reservations, regarding certain means or methods of killing, capture and other exploitation listed in Appendix IV. No reservations of a general nature may be made.

2. Any Contracting Party which extends the application of this Convention to a territory mentioned in the declaration referred to in paragraph 2 of Article 21 may, in respect of the territory concerned, make one or more reservations in accordance with the provisions of the preceding paragraph.

3. No other reservation may be made.

4. Any Contracting Party which has made a reservation under paragraphs 1 and 2 of this Article may wholly or partly withdraw it by means of a notification adddressed to the Secretary General of the Council of Europe. Such withdrawal shall take effect as from the date of receipt of the notification by the Secretary General.

Article 23

1. Any Contracting Party may, at any time, denounce this Convention by means of a notification addressed to the Secretary General of the Council of Europe.

2. Such denunciation shall become effective on the first day of the month following the expiry of a period of six months after the date of receipt of the notification by the Secretary General.

Article 24

The Secretary General of the Council of Europe shall notify the Member States of the Council of Europe, any signatory State, the European Economic Community if a signatory of this Convention and any Contracting Party of

(a) any signature;

(b) the deposit of any instrument of ratification, acceptance, approval or accession;

(c) any date of entry into force of this Convention in accordance with Articles 19 and 20;

(d) any information forwarded under the provisions of paragraph 3 of Article 13;

(e) any report established in pursuance of the provisions of Article 15;

(f) any amendment or any new Appendix adopted in accordance with Articles 16 and 17 and the date on which the amendment or new Appendix comes into force;

(g) any declaration made under the provisions of paragraphs 2 and 3 of Article 21;

(h) any reservation made under the provisions of paragraphs 1 and 2 of Article 22;

(i) the withdrawal of any reservation carried out under the provisions of paragraph 4 of Article 22;

(j) any notification made under the provisions of Article 23 and the date on which the denunciation takes effect.

In witness whereof the undersigned, being duly authorized thereto, have signed this Convention.

Done at Bern, this 19 September 1979, in English and French, both texts being equally authentic, in a single copy which shall be deposited in the archives of the Council of Europe. The Secretary General of the Council of Europe shall transmit certified copies to each Member State of the Council of Europe, to any signatory State, to the European Economic Community if a signatory and to any State invited to sign this Convention or to accede thereto.

PRÉAMBULE

LES ÉTATS MEMBRES DU CONSEIL DE L'EUROPE ET LES AUTRES SIGNATAIRES DE LA PRÉSENTE CONVENTION:

considérant que le but du Conseil de l'Europe est de réaliser une union plus étroite entre ses membres;

considérant la volonté du Conseil de l'Europe de coopérer avec d'autres États dans le domaine de la conservation de la nature;

reconnaissant que la flore et la faune sauvages constituent un patrimoine naturel d'une valeur esthétique, scientifique, culturelle, récréative, économique et intrinsèque, qu'il importe de préserver et de transmettre aux générations futures;

reconnaissant le rôle essentiel de la flore et de la faune sauvages dans le maintien des équilibres biologiques;

constatant la raréfaction de nombreuses espèces de la flore et de la faune sauvages et la menace d'extinction qui pèse sur certaines d'entre elles;

conscients de ce que la conservation des habitats naturels est l'un des éléments essentiels de la protection et de la préservation de la flore et de la faune sauvages;

reconnaissant que la conservation de la flore et de la faune sauvages devrait être prise en considération par les gouvernements dans leurs objectifs et programmes nationaux et qu'une coopération internationale devrait s'instaurer pour préserver en particulier les espèces migratrices;

conscients des nombreuses demandes d'action commune émanant des gouvernements ou des instances internationales, notamment celles exprimées par la conférence des Nations unies sur l'environnement de 1972 et l'assemblée parlementaire du Conseil de l'Europe;

désireux en particulier de suivre, dans le domaine de la conservation de la vie sauvage, les recommandations de la résolution n° 2 de la deuxième conférence ministérielle européenne sur l'environnement,

SONT CONVENUS DE CE QUI SUIT:

CHAPITRE PREMIER

Dispositions générales

Article premier

1. La présente convention a pour objet d'assurer la conservation de la flore et de la faune sauvages et de leurs habitats naturels, notamment des espèces et des habitats dont la conservation nécessite la coopération de plusieurs États, et de promouvoir une telle coopération.

2. Une attention particulière est accordée aux espèces, y compris les espèces migratrices, menacées d'extinction et vulnérables.

Article 2

Les parties contractantes prennent les mesures nécessaires pour maintenir ou adapter la population de la flore et de la faune sauvages à un niveau qui correspond notamment aux exigences écologiques, scientifiques et culturelles, tout en tenant compte des exigences économiques et récréationnelles et des besoins des sous-espèces, variétés ou formes menacées sur le plan local.

Article 3

1. Chaque partie contractante prend les mesures nécessaires pour que soient mises en oeuvre des politiques nationales de conservation de la flore et de la faune sauvages et des habitats naturels, en accordant une attention particulière aux espèces menacées d'extinction et vulnérables surtout aux espèces endémiques, et aux habitats menacés, conformément aux dispositions de la présente convention.

2. Chaque partie contractante s'engage, dans sa politique d'aménagement et de développement et dans ses mesures de lutte contre la pollution, à prendre en considération la conservation de la flore et de la faune sauvages.

3. Chaque partie contractante encourage l'éducation et la diffusion d'informations générales concernant la nécessité de conserver des espèces de la flore et de la faune sauvages ainsi que leurs habitats.

CHAPITRE II

Protection des habitats

Article 4

1. Chaque partie contractante prend les mesures législatives et réglementaires appropriées et nécessaires pour protéger les habitats des espèces sauvages de la flore et de la faune, en particulier de celles énumérées dans les annexes I et II et pour sauvegarder les habitats naturels menacés de disparition.

2. Les parties contractantes tiennent compte, dans leurs politiques d'aménagement et de développement, des besoins de la conservation des zones protégées visées au paragraphe précédent, afin d'éviter ou de réduire le plus possible toute détérioration de telles zones.

3. Les parties contractantes s'engagent à accorder une attention particulière à la protection des zones qui ont une importance pour les espèces migratrices énumérées dans les annexes II et III et qui sont situées de manière adéquate par rapport aux voies de migration, comme aires d'hivernage, de rassemblement, d'alimentation, de reproduction ou de mue.

4. Les parties contractantes s'engagent à coordonner autant que de besoin leurs efforts pour protéger les habitats naturels visés au présent article lorsqu'ils sont situés dans des régions qui s'étendent de part et d'autre de frontières.

CHAPITRE III

Conservation des espèces

Article 5

Chaque partie contractante prend les mesures législatives et réglementaires appropriées et nécessaires pour assurer la conservation particulière des espèces de flore sauvage énumérées à l'annexe I. Seront interdits la cueillette, le ramassage, la coupe ou le déracinage intentionnels des plantes visées. Chaque partie contractante interdit, autant que de besoin, la détention ou la commercialisation de ces espèces.

Article 6

Chaque partie contractante prend les mesures législatives et réglementaires appropriées et nécessaires pour assurer la conservation particulière des espèces de faune sauvage énumérées à l'annexe II. Seront notamment interdits, pour ces espèces:

a) toutes formes de capture intentionnelle, de détention et de mise à mort intentionnelle;

b) la détérioration ou la destruction intentionnelles des sites de reproduction ou des aires de repos;

c) la perturbation intentionnelle de la faune sauvage, notamment durant la période de reproduction, de dépendance et d'hibernation, pour autant que la perturbation ait un effet significatif eu égard aux objectifs de la présente convention;

d) la destruction ou le ramassage intentionnels des oeufs dans la nature ou leur détention, même vides;

e) la détention et le commerce interne de ces animaux, vivants ou morts, y compris des animaux naturalisés et de toute partie ou de tout produit, facilement identifiables, obtenus à partir de l'animal, lorsque cette mesure contribue à l'efficacité des dispositions du présent article.

Article 7

1. Chaque partie contractante prend les mesures législatives et réglementaires appropriées et nécessaires pour protéger les espèces de faune sauvage énumérées à l'annexe III.

2. Toute exploitation de la faune sauvage énumérée à l'annexe III est réglementée de manière à maintenir l'existence de ces populations hors de danger, compte tenu des dispositions de l'article 2.

3. Ces mesures comprennent notamment:

a) l'institution de périodes de fermeture et/ou d'autres mesures réglementaires d'exploitation;

b) l'interdiction temporaire ou locale de l'exploitation, s'il y a lieu, afin de permettre aux populations existantes de retrouver un niveau satisfaisant;

c) la réglementation, s'il y a lieu, de la vente, de la détention, du transport ou de l'offre aux fins de vente des animaux sauvages, vivants ou morts.

Article 8

S'agissant de la capture ou de la mise à mort des espèces de faune sauvage énumérées à l'annexe III, et dans les cas où des dérogations conformes à l'article 9 sont faites en ce qui concerne les espèces énumérées à l'annexe II, les parties contractantes interdisent l'utilisation de tous les moyens non sélectifs de capture et de mise à mort et des moyens susceptibles d'entraîner localement la disparition, ou de troubler gravement la tranquillité des populations d'une espèce, en particulier des moyens énumérés à l'annexe IV.

Article 9

1. À condition qu'il n'existe pas une autre solution satisfaisante et que la dérogation ne nuise pas à la survie de la population concernée, chaque partie contractante peut déroger aux dispositions des articles 4, 5, 6, 7 et à l'interdiction de l'utilisation des moyens visés à l'article 8:

- dans l'intérêt de la protection de la flore et de la faune;

- pour prévenir des dommages importants aux cultures, au bétail, aux forêts, aux pêcheries, aux eaux et aux autres formes de propriété;

- dans l'intérêt de la santé et de la sécurité publiques, de la sécurité aérienne, ou d'autres intérêts publics prioritaires;

- à des fins de recherche et d'éducation, de repeuplement, de réintroduction ainsi que pour l'élevage;

- pour permettre, dans des conditions strictement contrôlées, sur une base sélective et dans une certaine mesure la prise, la détention pour toute autre exploitation judicieuse de certains animaux et plantes sauvages en petites quantités.

2. Les parties contractantes soumettent au comité permanent un rapport biennal sur les dérogations faites en vertu du paragraphe précédent. Ces rapports devront mentionner:

- les populations qui font l'objet ou ont fait l'objet des dérogations, et, si possible, le nombre des spécimens impliqués;

- les moyens de mise à mort ou de capture autorisés;

- les conditions de risque, les circonstances de temps et de lieu dans lesquelles ces dérogations sont intervenues;

- l'autorité habilitée à déclarer que ces conditions ont été réalisées, et habilitée à prendre les décisions relatives aux moyens qui peuvent être mis en oeuvre, à leurs limites, et aux personnes chargées de l'exécution;

- les contrôles opérés.

CHAPITRE IV

Dispositions particulières concernant les espèces migratrices

Article 10

1. En plus des mesures indiquées aux articles 4, 6, 7 et 8, les parties contractantes s'engagent à coordonner leurs efforts pour la conservation des espèces migratrices énumérées aux annexes II et III et dont l'aire de répartition s'étend sur leurs territoires.

2. Les parties contractantes prennent des mesures en vue de s'assurer que les périodes de fermeture et/ou d'autres mesures réglementaires d'exploitation instituées en vertu du paragraphe 3 sous a) de l'article 7 correspondent bien aux besoins des espèces migratrices énumérées à l'annexe III.

CHAPITRE V

Dispositions complémentaires

Article 11

1. Dans l'exécution des dispositions de la présente convention, les parties contractantes s'engagent à

a) coopérer chaque fois qu'il sera utile de le faire, notamment lorsque cette coopération pourrait renforcer l'efficacité des mesures prises conformément aux autres articles de la présente convention;

b) encourager et coordonner les travaux de recherche en rapport avec les finalités de la présente convention.

2. Chaque partie contractante s'engage:

a) à encourager la réintroduction des espèces indigènes de la flore et de la faune sauvages lorsque cette mesure contribuerait à la conservation d'une espèce menacée d'extinction, à condition de procéder au préalable et au regard des expériences d'autres parties contractantes, à une étude en vue de rechercher si une telle réintroduction serait efficace et acceptable;

b) à contrôler strictement l'introduction des espèces non indigènes.

3. Chaque partie contractante fait connaître au comité permanent les espèces bénéficiant d'une protection totale sur son territoire et qui ne figurent pas aux annexes I et II.

Article 12

Les parties contractantes peuvent adopter pour la conservation de la flore et de la faune sauvage et de leurs habitats naturels des mesures plus rigoureuses que celles prévues dans la présente convention.

CHAPITRE VI

Comité permanent

Article 13

1. Il est constitué, aux fins de la présente convention, un comité permanent.

2. Toute partie contractante peut se faire représenter au sein du comité permanent par un ou plusieurs délégues. Chaque délégation dispose d'une voix. Dans les domaines relevant de ses compétences, la Communauté économique européenne exerce son droit de vote avec un nombre de voix égal au nombre de ses États membres qui sont parties contractantes à la présente convention ; la Communauté économique européenne n'exerce pas son droit de vote dans les cas où les États membres concernés exercent le leur et réciproquement.

3. Tout État membre du Conseil de l'Europe qui n'est pas partie contractante à la convention peut se faire représenter au comité par un observateur.

Le comité permanent peut, à l'unanimité, inviter tout État non membre du Conseil de l'Europe qui n'est pas partie contractante à la convention à se faire représenter par un observateur à une de ses réunions.

Tout organisme ou toute institution techniquement qualifié dans le domaine de la protection, de la conservation ou de la gestion de la flore et de la faune sauvages et de leurs habitats, et appartenant à l'une des catégories suivantes:

a) organismes ou institutions internationaux, soit gouvernementaux, soit non gouvernementaux, ou organismes ou institutions nationaux gouvernementaux;

b) organismes ou institutions nationaux non gouvernementaux qui ont été agréés à cette fin par l'État dans lequel ils sont établis, peuvent informer le secrétaire général du Conseil de l'Europe, trois mois au moins avant la réunion du comité, de leur intention de se faire représenter à cette réunion par des observateurs. Ils sont admis sauf si, un mois au moins avant la réunion, un tiers des parties contractantes ont informé le secrétaire général qu'elles s'y opposent.

4. Le comité permanent est convoqué par le secrétaire général du Conseil de l'Europe. Il tient sa première réunion dans le délai d'un an à compter de la date d'entrée en vigueur de la convention. Il se réunit par la suite au moins tous les deux ans et, en outre, lorsque la majorité des parties contractantes en formule la demande.

5. La majorité des parties contractantes constitue le quorum nécessaire pour tenir une réunion du comité permanent.

6. Sous réserve des dispositions de la présente convention, le comité permanent établit son règlement intérieur.

Article 14

1. Le comité permanent est chargé de suivre l'application de la présente convention. Il peut en particulier:

- revoir de manière permanente les dispositions de la présente convention, y compris ses annexes, et examiner les modifications qui pourraient être nécessaires;

- faire des recommandations aux parties contractantes sur les mesures à prendre pour la mise en oeuvre de la présente convention;

- recommander les mesures appropriées pour assurer l'information du public sur les travaux entrepris dans le cadre de la présente convention;

- faire des recommandations au comité des ministres relatives à l'invitation d'États non membres du Conseil de l'Europe à adhérer à la présente convention;

- faire toute proposition tendant à améliorer l'efficacité de la présente convention, et portant notamment sur la conclusion, avec des États qui ne sont pas parties contractantes à la convention, d'accords propres à rendre plus efficace la conservation d'espèces ou de groupes d'espèces.

2. Pour l'accomplissement de sa mission, le comité permanent peut, de sa propre initiative, prévoir des réunions de groupes d'experts.

Article 15

Après chacune de ses réunions, le comité permanent transmet au comité des ministres du Conseil de l'Europe un rapport sur ses travaux et sur le fonctionnement de la convention.

CHAPITRE VII

Amendements

Article 16

1. Tout amendement aux articles de la présente convention, proposé par un partie contractante ou par le comité des ministres est communiqué au secrétaire général du Conseil de l'Europe et transmis par ses soins deux mois au moins avant la réunion du comité permanent aux États membres du Conseil de l'Europe, à tout signataire, à toute partie contractante, à tout État invité à signer la présente convention conformément aux dispositions de l'article 19 et à tout État invité à y adhérer, conformément aux dispositions de l'article 20.

2. Tout amendement proposé conformément aux dispositions du paragraphe précédent est examiné par le comité permanent qui:

a) pour des amendements aux articles 1er à 12, soumet le texte adopté à la majorité des trois quarts des voix exprimées à l'acceptation des parties contractantes;

b) pour des amendements aux articles 13 à 24, soumet le texte adopté à la majorité des trois quarts des voix exprimées à l'approbation du comité des ministres. Ce texte est communiqué après son approbation aux parties contractantes en vue de son acceptation.

3. Tout amendement entre en vigueur le trentième jour après que toutes les parties contractantes ont informé le secrétaire général qu'elles l'ont accepté.

4. Les dispositions des paragraphes 1, 2 sous a) et 3 du présent article sont applicables à l'adoption de nouvelles annexes à la présente convention.

Article 17

1. Tout amendement aux annexes à la présente convention, proposé par une partie contractante ou par le comité des ministres est communiqué au secrétaire général du Conseil de l'Europe et transmis par ses soins deux mois au moins avant la réunion du comité permanent aux États membres du Conseil de l'Europe, à tout signataire, à toute partie contractante, à tout État invité à signer la présente convention, conformément aux dispositions de l'article 19, et à tout État invité à y adhérer, conformément aux dispositions de l'article 20.

2. Tout amendement proposé conformément aux dispositions du paragraphe précédent est examiné par le comité permanent qui peut l'adopter à la majorité des deux tiers des parties contractantes. Le texte adopté est communiqué aux parties contractantes.

3. À l'expiration d'une période de trois mois après son adoption par le comité permanent, et sauf si un tiers des parties contractantes ont notifié des objections, tout amendement entre en vigueur à l'égard des parties contractantes qui n'ont pas notifié d'objections.

CHAPITRE VIII

Règlements des différends

Article 18

1. Le comité permanent facilite autant que de besoin le règlement amiable de toute difficulté à laquelle l'exécution de la convention donnerait lieu.

2. Tout différend entre parties contractantes concernant l'interprétation ou l'application de la présente convention qui n'a pas été réglé sur la base des dispositions du paragraphe précédent ou par voie de négociation entre les parties au différend et sauf si ces parties en conviennent autrement est, à la requête de l'une d'entre elles, soumis à l'arbitrage. Chacune des parties désigne un arbitre et les deux arbitres désignent un troisième arbitre. Si, sous réserve des dispositions du paragraphe 3 du présent article, dans un délai de trois mois à compter de la requête d'arbitrage, l'une des parties n'a pas désigné son arbitre, le président de la Cour européenne des droits de l'homme procède, à la demande de l'autre partie, à sa désignation dans un nouveau délai de trois mois. La même procédure s'applique au cas où les deux arbitres ne peuvent pas se mettre d'accord sur le choix du troisième arbitre dans un délai de trois mois à compter de la désignation des deux premiers arbitres.

3. En cas de différend entre deux parties contractantes dont l'une est un État membre de la Communauté économique européenne, elle-même partie contractante, l'autre partie contractante adresse la requête d'arbitrage à la fois à cet État membre et à la Communauté, qui lui notifient conjointement, dans un délai de deux mois après la réception de la requête, si l'État membre ou la Communauté, ou l'État membre et la Communauté conjointement, se constituent partie au différend. À défaut d'une telle notification dans ledit délai, l'État membre et la Communauté sont réputés n'être qu'une seule et même partie au différend pour l'application des dispositions régissant la constitution et la procédure du tribunal arbitral. Il en est de même lorsque l'État membre et la Communauté se constituent conjointement parties au différend.

4. Le tribunal arbitral établit ses propres règles de procédure. Les décisions sont prises à la majorité. Sa sentence est définitive et obligatoire.

5. Chaque partie auf différend supporte les frais de l'arbitre qu'elle a désigné et les parties supportent, à parts égales, les frais du troisième arbitre, ainsi que les autres dépenses entraînées par l'arbitrage.

CHAPITRE IX

Dispositions finales

Article 19

1. La présente convention est ouverte à la signature des États membres du Conseil de l'Europe et des États non membres qui ont participé à son élaboration, ainsi qu'à celle de la Communauté économique européenne.

Jusqu'à la date de son entrée en vigueur, elle est aussi ouverte à la signature de tout autre État invité à la signer par le comité des ministres.

La convention sera soumise à ratification, acceptation ou approbation. Les instruments de ratification, d'acceptation ou d'approbation seront déposés près le secrétaire général du Conseil de l'Europe.

2. La convention entera en vigueur le premier jour du mois qui suit l'expiration d'une période de trois mois après la date à laquelle cinq États, dont au moins quatre États membres du Conseil de l'Europe, auront exprimé leur consentement à être liés par la convention conformément aux dispositions du paragraphe précédent.

3. Elle entrera en vigueur à l'égard de tout État signataire ou de la Communauté économique européenne, qui exprimeront ultérieurement leur consentement à être liés par elle, le premier jour du mois qui suit l'expiration d'une période de trois mois après la date du dépôt de l'instrument de ratification, d'acceptation ou d'approbation.

Article 20

1. Après l'entrée en vigueur de la présente convention, le comité des ministres du Conseil de l'Europe pourra, après consultation des parties contractantes, inviter à adhérer à la convention tout État non membre du Conseil qui, invité à la signer conformément aux dispositions de l'article 19, ne l'aura pas encore fait, et tout autre État non membre.

2. Pour tout État adhérent, la convention entrera en vigueur le premier jour du mois qui suit l'expiration d'une période de trois mois après la date du dépôt de l'instrument d'adhésion près le secrétaire général du Conseil de l'Europe.

Article 21

1. Tout État peut, au moment de la signature ou au moment du dépôt de son instrument de ratification, d'acceptation, d'approbation ou d'adhésion, désigner le ou les territoires auxquels s'appliquera la présente convention.

2. Toute partie contractante peut, au moment du dépôt de son instrument de ratification, d'acceptation, d'approbation ou d'adhésion, ou à tout autre moment par la suite, étendre l'application de la présente convention, par déclaration adressée au secrétaire général du Conseil de l'Europe, à tout autre territoire désigné dans la déclaration et dont elle assure les relations internationales ou pour lequel elle est habilitée à stipuler.

3. Toute déclaration faite en vertu du paragraphe précédent pourra être retirée, en ce qui concerne tout territoire désigné dans cette déclaration, par notification adressée au secrétaire général. Le retrait prendra effet le premier jour du mois qui suit l'expiration d'une période de six mois après la date de réception de la notification par le secrétaire général.

Article 22

1. Tout État peut, au moment de la signature ou au moment du dépôt de son instrument de ratification, d'acceptation, d'approbation ou d'adhésion, formuler une ou plusieurs réserves à l'égard de certaines espèces énumérées dans les annexes I à III et/ou, pour certaines de ces espèces qui seront indiquées dans la ou les réserves, à l'égard de certains moyens ou méthodes de chasse et d'autres formes d'exploitation mentionnés à l'annexe IV. Des réserves de caractère général ne sont pas admises.

2. Toute partie contractante qui étend l'application de la présente convention à un territoire désigné dans la déclaration prévue au paragraphe 2 de l'article 21 peut, pour le territoire concerné, formuler une ou plusieurs réserves conformément aux dispositions du paragraphe précédent.

3. Aucune autre réserve n'est admise.

4. Toute partie contractante qui a formulé une réserve en vertu des paragraphes 1 et 2 du présent article peut la retirer en tout ou en partie en adressant une notification au secrétaire général du Conseil de l'Europe. Le retrait prendra effet à la date de réception de la notification par le secrétaire général.

Article 23

1. Toute partie contractante peut, à tout moment, dénoncer la présente convention en adressant une notification au secrétaire général du Conseil de l'Europe.

2. La dénonciation prendra effet le premier jour du mois qui suit l'expiration d'une période de six mois après la date de réception de la notification par le secrétaire général.

Article 24

Le secrétaire général du Conseil de l'Europe notifiera aux États membres du Conseil de l'Europe, à tout État signataire, à la Communauté économique européenne, signataire de la présente convention, et à toute partie contractante:

a) toute signature;

b) le dépôt de tout instrument de ratification, d'acceptation, d'approbation ou d'adhésion;

c) toute date d'entrée en vigueur de la présente convention, conformément à ses articles 19 et 20;

d) toute information communiquée en vertu des dispositions du paragraphe 3 de l'article 13;

e) tout rapport établi en application des dispositions de l'article 15;

f) tout amendement ou toute nouvelle annexe adopté conformément aux articles 16 et 17 et la date à laquelle cet amendement ou cette nouvelle annexe entre en vigueur;

g) toute déclaration faite en vertu des dispositions des paragraphes 2 et 3 de l'article 21;

h) toute réserve formulée en vertu des dispositions des paragraphes 1 et 2 de l'article 22;

i) le retrait de toute réserve effectué en vertu des dispositions du paragraphe 4 de l'article 22;

j) toute notification faite en vertu des dispositions de l'article 23 et la date à laquelle la dénonciation prendra effet.

En foi de quoi, les soussignés, dûment autorisés à cet effet, ont signé la présente convention.

Fait à Berne, le 19 septembre 1979, en français et en anglais, les deux textes faisant également foi, en un seul exemplaire qui sera déposé dans les archives du Conseil de l'Europe.

Le secrétaire général du Conseil de l'Europe en communiquera copie certifiée conforme à chacun des États membres du Conseil de l'Europe, à tout État et à la Communauté économique européenne signataires ainsi qu'à tout État invité à signer la présente convention ou à y adhérer.

PRÆAMBEL

EUROPARÅDETS MEDLEMSSTATER OG DE ANDRE STATER, SOM HAR UNDERSKREVET DENNE KONVENTION -

- som tager i betragtning, at det er Europarådets formål at skabe større enhed blandt dets medlemmer,

- som tager i betragtning, at det er Europarådets ønske at samarbejde med andre stater om naturbeskyttelse,

- som erkender, at vilde dyr og planter udgør en naturarv af æstetisk, videnskabelig, kulturel, rekreativ, økonomisk og selvstændig værdi, som bør bevares og overleveres til fremtidige generationer,

- som erkender den væsentlige rolle, vilde dyr og planter spiller i opretholdelsen af biologisk balance,

- som bemærker sig, at talrige vilde dyre- og plantearter er i stærk tilbagegang, og nogle af dem trues af udryddelse,

- som er klar over, at beskyttelse af naturlige levesteder er et uundværligt element i beskyttelsen af vilde dyr og planter,

- som erkender, at beskyttelsen af det vilde dyre- og planteliv bør indgå i regeringernes overvejelser omkring deres nationale målsætninger og programmer, og at der bør tilvejebringes et internationalt samarbejde for især at beskytte de migrerende arter,

- som erindrer sig de omfattende opfordringer til fælles handling, som er blevet fremsat af regeringer eller af internationale organer, navnlig de opfordringer som blev fremsat på De forenede Nationers konference om det menneskelige miljø i 1972, og af Europarådets parlamentariske forsamling,

- som på området beskyttelse af vilde dyr og planter navnlig ønsker at følge de rekommandationer som gives i resolution nr. 2 fra den anden europæiske ministerkonference om miljøet,

ER BLEVET ENIGE OM FØLGENDE:

KAPITEL I

Almindelige bestemmelser

Artikel 1

1. Formålet med denne konvention er at beskytte vilde dyr og planter samt naturlige levesteder, navnlig de arter og levesteder, hvis beskyttelse nødvendiggør flere staters samarbejde, og at fremme et sådant samarbejde.

2. Særlig vægt er lagt på truede og sårbare arter, herunder truede og sårbare migrerende arter.

Artikel 2

De kontraherende parter skal træffe de nødvendige foranstaltninger for at opretholde bestanden af vilde dyr og planter på, eller at tilpasse den til, et niveau, som svarer til de særlige økologiske, videnskabelige og kulturelle behov, idet der samtidig tages hensyn til de økonomiske og rekreative behov og behov hos underarter, geografiske racer eller former, som trues lokalt.

Artikel 3

1. Hver kontraherende part skal i overensstemmelse med bestemmelserne i denne konvention træffe foranstaltninger for at fremme den nationale politik vedrørende beskyttelse af vilde dyr, vilde planter og naturlige levesteder, under særlig hensyntagen til truede og sårbare arter, navnlig arter som er endemiske, og til truede levesteder.

2. Hver kontraherende part forpligter sig til i sin planlægnings- og egnsudviklingspolitik og i sine foranstaltninger mod forurening, at tage hensyn til beskyttelsen af vilde dyr og planter.

3. Hver kontraherende part skal fremme undervisning og udbrede almindelig oplysning om nødvendigheden af at beskytte arter af vilde dyr og planter, samt deres levesteder.

KAPITEL II

Beskyttelse af levesteder

Artikel 4

1. Hver kontraherende part skal træffe passende og nødvendige lovgivningsmæssige og administrative foranstaltninger for at sikre beskyttelsen af levesteder for vilde dyre- og plantearter, navnlig dem, der er anført i liste I og II, og beskyttelse af truede naturlige levesteder.

2. De kontraherende parter skal i deres planlægnings- og egnsudviklingspolitik tage hensyn til beskyttelsesbehovene i de områder, som skal beskyttes i henhold til stk. 1, således at man undgår eller så vidt muligt begrænser en hvilken som helst forringelse af sådanne områder.

3. De kontraherende parter forpligter sig til at tage særligt hensyn til beskyttelsen af områder, som er af betydning for de migrerende arter, der er anført i liste II og III, og som har en passende beliggenhed i forhold til migrationsruter som overvintringsområder, rastepladser, fourageringspladser, yngleområder eller fældningsområder.

4. De kontraherende parter påtager sig i passende grad at samordne deres bestræbelser for at beskytte de naturlige levesteder, som er omtalt i denne artikel, når de er beliggende i grænseområder.

KAPITEL III

Beskyttelse af arter

Artikel 5

Hver kontraherende part skal træffe passande og nødvendige lovgivningsmæssige og administrative foranstaltninger for at sikre en særlig beskyttels af de vilde plantearter, som er anført i liste I. Forsætlig plukning, indsamling, afskæring eller oprivning af sådanne planter skal forbydes. Hver kontraherende part skal, når det er hensigtsmæssigt, forbyde besiddelse eller salg af disse arter.

Artikel 6

Hver kontraherende part skal træffe passande og nødvendige lovgivningsmæssige og administrative foranstaltninger for at sikre en særlig beskyttelse af de vilde dyrearter, som er anført i liste II. Navnlig skal der i forbindelse med disse arter være forbud mod:

a) alle former for forsætlig indfangning og fangenskabshold samt forsætlig ihjelslagning,

b) forsætlig skade på eller ødelæggelse af yngle- og rastepladser,

c) forsætlig forstyrrelse af vilde dyr, i særdeleshed i perioder, hvor de yngler, udviser ynglepleje og overvintrer, for så vidt som forstyrrelse måtte være væsentlig i forbindelse med denne konventions målsætninger,

d) forsætlig ødelæggelse eller fjernelse af æg i naturen, eller opbevaring af disse æg, også når de er tomme,

e) besiddelse af og indenlandsk handel med disse dyr, levende eller døde, herunder udstoppede dyr og enhver rimelig let erkendelig del eller produkt heraf, for så vidt som dette kan bidrage til effektiviteten af bestemmelserne i denne artikel.

Artikel 7

1. Hver kontraherende part skal træffe passande og nødvendige lovgivningsmæssige og administrative foranstaltninger for at sikre beskyttelse af de vilde dyrearter, som er anført i liste III.

2. Enhver udnyttelse af de vilde dyrearter, som er anført i liste III, skal under hensyntagen til bestemmelserne i artikel 2 reguleres med henblik på at forebygge, at bestandene bliver truet.

3. De foranstaltninger, som træffes, skal omfatte:

a) fredningstider og/eller andre fremgangsmåder til regulering af udnyttelsen,

b) i egnede tilfælde midlertidigt eller lokalt forbud mod udnyttelse med henblik på at genoprette tilfredsstillende bestandstørrelser,

c) passende regulering af salg, opbevaring, transport eller udbud med salg for øje af levende og døde vilde dyr.

Artikel 8

I forbindelse med indfangning eller ihjelslagning af de vilde dyrearter, som er anført i liste III, og i tilfælde af benyttelsen af undtagelser i medfør af artikel 9 på de arter, som er anført i liste II, skal de kontraherende parter forbyde anvendelsen af ikke-selektive fangst- og drabsmetoder og af alle midler, som vil kunne medføre, at bestande af en art forsvinder i et lokalt område eller forstyrres alvorligt, samt navnlig anvendelsen af de midler, som er opregnet i liste IV.

Artikel 9

1. Hver kontraherende part kan gøre undtagelser fra bestemmelserne i artiklerne 4, 5, 6 og 7, og fra forbudet mod anvendelse af de midler, der er nævnt i artikel 8, hvis der ikke findes andre tilfredsstillende løsninger, og hvis undtagelsen ikke er til skade for den berørte bestands overlevelse:

- for at beskytte dyr og planter,

- for at forhindre alvorlig skade på afgrøder, besætning, skove, fiskeri, vand og andre former for ejendom,

- af hensyn til den offentlige sundhed og sikkerhed, sikkerheden for luftfarten eller andre offentlige interesser, der må gå forud,

- med henblik på forskning og undervisning, genoprettelse af en bestand og for det nødvendige opdræt,

- for på strengt kontrollerede betingelser og i selektivt og begrænset omfang at tillade indsamling, fangenskabshold eller anden fornuftig udnyttelse af visse vilde dyr og planter i mindre antal.

2. De kontraherende parter skal hvert andet år aflægge rapport til Det stående Udvalg om de undtagelser, de har fastsat i henhold til stk. 1. Disse rapporter skal indeholde oplysninger om:

- de bestande, som har været eller er genstand for undtagelser, og hvis det er praktisk muligt, antallet af berørte individer,

- de midler, som er tilladt anvendt ved ihjelslagning eller fangst,

- de risikovilkår, samt de omstændigheder med hensyn til tid og sted, hvorunder sådanne undtagelser blev meddelt,

- den myndighed, som er bemyndiget til at erklære, at disse betingelser er opfyldt, og til at træffe beslutning med hensyn til de midler, der må anvendes og grænserne herfor, samt de personer, som pålægges at anvende dem,

- de kontrolmetoder, der er benyttet.

KAPITEL IV

Særlige bestemmelser vedrørende migrerende arter

Artikel 10

1. De kontraherende parter forpligter sig til ud over de foranstaltninger, der er anført i artiklerne 4, 6, 7 og 8, at samordne deres bestræbelser for at beskytte de migrerende arter, som er anført i liste II og III, og hvis udbredelsesområde strækker sig ind over deres landegrænser.

2. De kontraherende parter skal træffe foranstaltninger for at sikre, at fredningstiderne og/eller de øvrige fremgangsmåder vedrørende regulering af udnyttelse, som er fastsat i henhold til artikel 7, stk. 3, litra a), er tilrettelagt på fyldestgørende og passende måde med henblik på at tilgodese kravene for de migrerende arter, der er anført i liste III.

KAPITEL V

Tillægsbestemmelser

Artikel 11

1. Ved gennemførelse af bestemmelserne i denne konvention påtager de kontraherende parter sig:

a) at samarbejde, når som helst det er hensigtsmæssigt, og navnlig hvor det kan forbedre effektiviteten af foranstaltninger, der er truffet i medfør af andre artikler i denne konvention,

b) at støtte og samordne forskning, som har forbindelse med denne konventions formål.

2. Hver kontraherende part forpligter sig til:

a) at støtte genindførelsen af naturligt hjemmehørende arter af vilde dyr og planter, når dette vil bidrage til bevaringen af en truet art, forudsat at der først gennemføres en undersøgelse i lyset af de erfaringer, der er gjort af andre kontraherende parter, for at fastslå, om en sådan genindførelse vil være effektiv og acceptabel,

b) at føre streng kontrol med indførelsen af ikke naturligt hjemmehørende arter.

3. Hver kontraherende part skal give Det stående Udvalg oplysning om de arter, som er totalt fredede indenfor landets grænser, og som ikke er anført i liste I og II.

Artikel 12

De kontraherende parter kan indføre strengere foranstaltninger til beskyttelse af vilde dyr og planter samt deres naturlige levesteder, end dem, der er fastlagt i denne konvention.

KAPITEL VI

Stående udvalg

Artikel 13

1. Med henblik på denne konvention skal der nedsættes et stående udvalg.

2. Enhver af de kontraherende parter kan være repræsenteret i Det stående Udvalg ved en eller flere delegater. Hver delegation skal have en stemme. På de områder, hvor Det europæiske økonomiske Fællesskab har kompetence, udøver dette sin stemmeret med et antal stemmer, der svarer til det antal af dets medlemsstater, der har tiltrådt denne konvention. Det europæiske økonomiske Fællesskab udøver ikke sin stemmeret i tilfælde, hvor vedkommende medlemsstater udøver deres, og omvendt.

3. Enhver stat, som er medlem af Europarådet, men som ikke deltager i konventionen, kan være repræsenteret i udvalget ved en observatør.

Det stående Udvalg kan ved enstemming beslutning indbyde en stat, som ikke er medlem af Europarådet, og som ikke deltager i konventionen, til at blive repræsenteret ved en observatør på et af dets møder.

Ethvert organ eller organisation, som er teknisk kvalificeret i forbindelse med beskyttelse eller forvaltning af de vilde dyr og planter samt deres levesteder, og som tilhører en af følgende kategorier:

a) internationale organisationer eller organer, enten statslige eller ikke-statslige, og nationale statslige organisationer eller organer,

b) nationale ikke-statslige organisationer eller organer, som med henblik på dette formål er godkendt af regeringen i den stat, hvor de er beliggende,

kan mindst tre måneder inden udvalgets møde give Europarådets generalsekretær meddelelse om deres ønske om at blive repræsenteret på mødet ved observatører. De skal gives adgang til mødet, med mindre en tredjedel af de kontraherende parter mindst en måned inden mødet har givet generalsekretæren meddelelse om deres indsigelse.

4. Det stående Udvalg skal sammenkaldes til møde af Europarådets generalsekretær. Dets første møde skal afholdes senest et år efter datoen for konventionens ikrafttræden. Det skal derefter holde møde mindst hvert andet år, og når som helst et flertal af de kontraherende parter anmoder derom.

5. Det stående Udvalg er beslutningsdygtigt, når et flertal af de kontraherende parter deltager i det.

6. Det stående Udvalg fastsætter under iagttagelse af bestemmelserne i denne konvention selv sin forretningsorden.

Artikel 14

1. Det stående Udvalg er ansvarligt for at følge anvendelsen af denne konvention. Det kan især:

- løbende gennemgå bestemmelserne i denne konvention, herunder dens lister, og undersøge de ændringer, som måtte være nødvendige,

- fremkomme med anbefalinger til de kontraherende parter vedrørende foranstaltninger, som bør træffes, for at nå denne konventions målsætninger,

- anbefale de foranstaltninger, som er hensigtsmæssige med henblik på at holde offentligheden underrettet om de aktiviteter, som er gennemført inden for rammerne af denne konvention,

- fremkomme med anbefalinger til ministerudvalget om indbydelse af stater, som ikke er medlemmer af Europarådet til at tiltræde denne konvention,

- fremkomme med et hvilket som helst forslag til forbedring af konventionens effektivitet, herunder forslag om, at der med stater, der ikke deltager i denne konvention, indgås aftaler, som vil fremme en effektiv beskyttelse af arter eller grupper af arter.

2. For at udføre sine opgaver kan Det stående Udvalg på eget initiativ arrangere møder for ekspertgrupper.

Artikel 15

Efter hvert møde skal Det stående Udvalg til Europarådets ministerudvalg fremsende en rapport om sit arbejde og om konventionens funktion.

KAPITEL VII

Ændringer

Artikel 16

1. Enhver ændring af denne konventions artikler, som foreslås af en kontraherende part eller af ministerudvalget, skal meddeles til Europarådets generalsekretær og af denne, mindst to måneder inden Det stående Udvalgs møde, fremsendes til Europarådets medlemsstater, til alle signatarstater, til alle kontraherende parter, til alle stater, som er indbudt til at undertegne denne konvention i overensstemmelse med bestemmelserne i artikel 19 og til alle stater, som i overensstemmelse med bestemmelserne i artikel 20 er indbudt til at tiltræde den.

2. Enhver ændring, som foreslås i overenstemmelse med bestemmelserne i stk. 1, skal undersøges af Det stående Udvalg, som:

a) når det drejer sig om ændringer af artiklerne 1 til 12, skal forelægge den tekst, som er vedtaget med 3/4 flertal af de afgivne stemmer for de kontraherende parter til disses accept,

b) når det drejer sig om ændringer af artiklerne 13 til 24, skal forelægge den ekst, som er vedtæget med 3/4 flertal af de afgivne stemmer, for ministerudvalget til godkendelse. Efter godkendelsen af teksten, skal denne fremsendes til de kontraherende parter til disses accept.

3. Enhver ændring træder i kraft på den 30. dag efter, at alle de kontraherende parter har meddelt generalsekretæren, at de har accepteret den.

4. Bestemmelserne i denne artikel stk. 1, 2, litra a) og 3, finder tilsvarende anvendelse ved vedtagelse af nye lister til denne konvention.

Artikel 17

1. Enhver ændring af listerne til denne konvention, som foreslas af en kontraherende part eller af ministerudvalget, skal meddeles til Europarådets generalsekretær og af denne, mindst to måneder inden Det stående Udvalgs møde, fremsendes til Europarådets medlemsstater, til alle signatarstater, til alle kontraherende parter, til alle stater, som er indbudt til at undertegne denne konvention i overensstemmelse med bestemmelserne i artikel 19 og til alle stater, som i overensstemmelse med bestemmelserne i artikel 20 er indbudt til at tiltræde den.

2. Enhver ændring, som foreslås i overensstemmelse med bestemmelserne i stk. 1, skal undersøges af Det stående Udvalg, som kan vedtage den med 2/3 flertal af de kontraherende parter. Den vedtagne tekst skal fremsendes til de kontraherende parter.

3. Tre måneder efter, at en ændring er vedtaget af Det stående Udvalg, og forudsat at der ikke fra 1/3 af de kontraherende parter er meddelt indsigelser, skal den træde i kraft for de kontraherende parter, som ikke har meddelt indsigelser.

KAPITEL VIII

Bilæggelse af tvister

Artikel 18

1. Det stående Udvalg skal bestræbe sig på at gøre sit bedste for at fremme en mindelig løsning af alle vanskeligheder, som måtte blive foranlediget af gennemførelsen af denne konvention.

2. Enhver tvist mellem kontraherende parter vedrørende fortolkningen eller anvendelsen af denne konvention, som ikke er bilagt på grundlag af bestemmelserne i stk. 1, eller efter forhandling mellem de berørte parter, skal, medmindre disse parter træffer anden beslutning, på en af parternes anmodning overgives til voldgift. Hver af parterne skal udpege en voldgiftsmand, og de to voldgiftsmænd skal udpege en tredje voldgiftsmand. Hvis en af parterne, under henvisning til bestemmelserne i stk. 3 i denne artikel, ikke inden tre måneder efter anmodningen om voldgift har udpeget sin voldgiftsmand, skal denne på den anden parts anmodning udpeges af formanden for Den europæiske Menneskerettighedsdomstol inden for en frist på yderligere tre måneder. Samme fremgangsmåde skal følges, hvis voldgiftsmændene ikke senest tre måneder efter udpegelsen af de første to voldgiftsmænd kan blive enige om valget af den tredje voldgiftsmand.

3. I tilfælde af tvist mellem to kontraherende parter, hvoraf den ene er en medlemsstat af Det europæiske økonomiske Fællesskab, og sidstnævnte selv er en kontraherende part, skal den anden kontraherende part rette anmodning om voldgift både til medlemsstaten og til Fællesskabet, der sammen, inden to måneder efter modtagelsen af anmodningen, skal oplyse, om medlemsstaten eller Fællesskabet eller medlemsstaten sammen med Fællesskabet skal betragtes som part i tvisten. Såfremt sådan meddelelse ikke gives inden for den nævnte frist, betragtes medlemsstaten og Fællesskabet som en og samme part i tvisten, for så vidt angår anvendelsen af bestemmelserne om voldgiftsrettens nedsættelse og forretningsorden. Det samme gælder, når medlemsstaten og Fællesskabet sammen optræder som part i tvisten.

4. Voldgiftsdomstolen fastsætter selv sin forretningsorden. Dens afgørelser træffes ved stemmeflertal. Dens kendelser er endelige og bindende.

5. Hver af tvistens parter skal udrede omkostningerne i forbindelse med den voldgiftsmand, de har udpeget, og parterne skal dele omkostningerne i forbindelse med den tredje voldgiftsmand, samt andre omkostninger ved voldgiften ligeligt imellem sig.

KAPITEL IX

Afsluttende bestemmelser

Artikel 19

1. Denne konvention står áben for undertegnelse af Europarådets medlemsstater og af ikke-medlemsstater, som har deltaget i dens udarbejdelse og af Det europæiske økonomiske Fællesskab.

Indtil den dato, hvor konventionen træder i kraft, skal den endvidere stå áben for undertegnelse af enhver anden stat, som opfordres hertil af ministerudvalget.

Denne konvention skal ratificeres, accepteres eller godkendes. Ratifikations-, accept- eller godkendelsesinstrumenterne skal deponeres hos Europarådets generalsekretær.

2. Denne konvention træder i kraft på den første dag i en manad efter udløbet af en periode på tre maneder efter den dato, hvor fem stater, herunder mindst fire af Europarådets medlemsstater, har samtykket i at blive forpligtet af konventionen i overensstemmelse med bestemmelserne i stk. 1.

3. For enhver signatarstat eller Det europæiske økonomiske Fællesskab, som derefter samtykker i at blive forpligtet af konventionen, træder den i kraft på den første dag i en maned efter udløbet af en periode på tre måneder efter datoen for deponeringen af ratifikations-, accept- eller godkendelsesinstrumentet.

Artikel 20

1. Efter konventionens ikrafttræden kan Europarådets ministerudvalg efter samråd med de kontraherende parter opfordre enhver stat, som ikke er medlem af Rådet, og som efter at være opfordret til undertegnelse i overensstemmelse med bestemmelserne i artikel 19, endnu ikke har gjort dette, samt enhver anden ikke-medlemsstat, til at tiltræde konventionen.

2. For enhver tiltrædende stat træder konventionen i kraft på den første dag i en måned efter udløbet af en periode på tre måneder efter datoen for deponeringen af tiltrædelsesinstrumentet hos Europarådets generalsekretær.

Artikel 21

1. Enhver stat kan ved undertegnelsen eller ved deponeringen af sit ratifikations-, accept-, godkendelses- eller tiltrædelsesinstrument nærmere angive det område eller de områder, hvor konventionen skal gælde.

2. Enhver kontraherende part kan ved deponeringen af sit ratifikations-, accept-, godkendelses- eller tiltrædelsesinstrument eller på et hvilket som helst senere tidspunkt ved hjælp af en erklæring stilet til Europarådets generalsekretær udvide denne konventions anvendelse til ethvert andet område, som er nærmere angivet i erklæringen, og for hvis internationale forbindelser den er ansvarlig, eller på hvis vegne den er bemyndiget til at indgå forpligtelser.

3. Enhver erklæring, som er fremsat i henhold til stk. 2, kan ved meddelelse stilet til generalsekretæren tilbagekaldes, for så vidt angår ethvert område, der er nævnt i en sådan erklæring. En sådan tilbagekaldelse træder i kraft den første dag i en måned efter udløbet af en periode på seks måneder efter den dato, hvor generalsekretæren har modtaget meddelelsen.

Artikel 22

1. Enhver stat kan på tidspunktet for undertegnelse eller ved deponeringen af sit ratifikations-, accept-, godkendelses- eller tiltrædelsesinstrument tage et eller flere forbehold vedrørende bestemte arter, som er anført i liste I til III, og/eller for så vidt angår bestemte arter, som er nævnt i forbeholdet eller forbeholdene, vedrørende bestemte midler eller metoder til ihjelslagning, indfangning og anden udnyttelse, der er opregnet i liste IV. Der kan ikke tages forbehold af generel karakter.

2. Enhver kontraherende part, som udvider anvendelsen af denne konvention til et område, der er angivet i den i artikel 21, stk. 2, nævnte erklæring, kan for vedkommende område tage et eller flere forbehold i overensstemmelse med bestemmelserne i stk. 1.

3. Der kan ikke tages andre forbehold.

4. Enhver kontraherende part, som har taget forbehold i henhold til stk. 1 og 2 i denne artikel, kan helt eller delvis tilbagekalde dette ved en meddelelse stilet til Europarådets generalsekretær. En såden ophævelse træder i kraft på den dato, hvor generalsekretæren modtager meddelelsen.

Artikel 23

1. Enhver kontraherende part kan til enhver tid opsige denne konvention ved en meddelelse stilet til Europarådets generalsekretær.

2. En sådan opsigelse træder i kraft på den første dag i en måned efter udløbet af en periode på seks måneder efter den dato, hvor generalsekretæren har modtaget meddelelsen.

Artikel 24

Europarådets generalsekretær skal underrette Europarådets medlemsstater, enhver signatarstat, Det europæiske økonomiske Fællesskab, hvis det har undertegnet denne konvention, og enhver kontraherende part om:

a) enhver undertegnelse,

b) deponeringen af ethvert ratifikations-, accept-, godkendelses- eller tiltrædelsesinstrument,

c) enhver ikrafttrædelsesdato for denne konvention i overensstemmelse med artiklerne 19 og 20,

d) alle oplysninger, som er fremsendt i henhold til bestemmelserne i artikel 13, stk. 3,

e) enhver rapport, som er udarbejdet i henhold til bestemmelserne i artikel 15,

f) enhver ændring eller ny liste, som er vedtaget i overensstemmelse med artiklerne 16 og 17, og datoen for ændringens eller den ny listes ikrafttræden,

g) enhver erklæring fremsat i henhold til bestemmelserne i artikel 21, stk. 2 og 3,

h) ethvert forbehold i henhold til bestemmelserne i artikel 22, stk. 1 og 2,

i) ophævelse af ethvert forbehold, som er gennemført i henhold til bestemmelserne i artikel 22, stk. 4,

j) enhver meddelelse, som er givet i henhold til bestemmelserne i artikel 23, og datoen for opsigelsens ikrafttræden.

Til bekræftelse heraf har undertegnede, der er behørigt bemyndiget dertil, undertegnet denne konvention.

Udfærdiget i Bern, den 19. september 1979 på engelsk og fransk, idet begge tekster har lige gyldighed, i et eksemplar, som deponeres i Europarådets arkiver. Europarådets generalsekretær skal fremsende bekræftede genparter til hver af Europarådets medlemsstater, til hver af signatarstaterne, til Det europæiske Fællesskab, hvis det har undertegnet, og til hver af de stater, som er opfordret til at undertegne eller tiltræde denne konvention.
