KOMMISSIONENS BESLUTNING

af 19. oktober 2009

om ændring af beslutningerne 2006/679/EF og 2006/860/EF om tekniske specifikationer for interoperabilitet gældende for delsystemer i de transeuropæiske jernbanesystemer for konventionelle tog og højhastighedstog

KOMMISSIONEN FOR DE EUROPÆISKE FÆLLESSKABER HAR —

under henvisning til traktaten om oprettelse af Det Europæiske Fællesskab,

under henvisning til Europa-Parlamentets og Rådets direktiv 2008/57/EF af 17. juni 2008 om interoperabilitet i jernbanesystemet i Fællesskabet (1), særlig artikel 6, stk. 1,

under henvisning til Det Europæiske Jernbaneagenturs henstilling af 24. april 2009 (ERA-REC-38-2009-ERTMS) om ajourføring af bilag A til TSI'en vedrørende togkontrol og signaler for højhastighedstog og konventionelle tog og

ud fra følgende betragtninger:

I Kommissionens beslutning 2006/679/EF af 28. marts 2006 om den tekniske specifikation for interoperabilitet gældende for delsystemet Styringskontrol og signaler i det transeuropæiske jernbanenet for konventionelle tog (2) fastlægges den tekniske specifikation for interoperabilitet (TSI'en) for delsystemet Togkontrol og signaler i det transeuropæiske jernbanesystem for konventionelle tog.

I Kommissionens beslutning 2006/860/EF af 7. november 2006 om den tekniske specifikation for interoperabilitet gældende for delsystemet Togkontrol og signaler i det transeuropæiske jernbanenet for højhastighedstog (3) fastlægges TSI'en for delsystemet Togkontrol og signaler i det transeuropæiske jernbanesystem for højhastighedstog.

Specifikationerne af ETCS bør færdiggøres med ajourførte fælles testspecifikationer, jf. Kommissionens beslutning af 23. april 2008 om ændring af bilag A i beslutning 2006/679/EF om den tekniske specifikation for interoperabilitet vedrørende delsystemet Styringskontrol og signaler i det transeuropæiske jernbanesystem for konventionelle tog og bilag A i beslutning 2006/860/EF om den tekniske specifikation for interoperabilitet vedrørende delsystemet Togkontrol og signaler i det transeuropæiske jernbanesystem for højhastighedstog (4).

Eller række af de tekniske dokumenter, som der henvises til i bilag A til de to beslutninger, 2006/679/EF og 2006/860/EF, må ajourføres som tilpasning til den tekniske udvikling.

Beslutningerne 2006/679/EF og 2006/860/EF bør derfor ændres i overensstemmelse hermed.

Foranstaltningerne i denne beslutning er i overensstemmelse med udtalelse fra Udvalget for Interoperabilitet og Sikkerhed i Jernbanerne, nedsat ved artikel 29 i direktiv 2008/57/EF —

VEDTAGET FØLGENDE BESLUTNING:

Artikel 1

Fortegnelsen over obligatoriske specifikationer og fortegnelsen over vejledende specifikationer i bilag A til beslutning 2006/679/EF og i bilag A til beslutning 2006/860/EF erstattes af fortegnelsen over obligatoriske specifikationer og fortegnelsen over vejledende specifikationer i bilaget til denne beslutning. De fodnoter, der henviser til beslutning 2002/731/EF, i bilag H til den TSI, der er vedføjet beslutning 2006/679/EF, og i bilag H til den TSI, der er vedføjet beslutning 2006/860/EF, udgår.

Artikel 2

Denne beslutning anvendes fra den 1. april 2010.

Artikel 3

Denne beslutning er rettet til medlemsstaterne.

Bemærk:

Type 1-specifikationer viser, hvor langt man er nået med udarbejdelsen af en obligatorisk specifikation, der stadig er »reserveret«.

Type »2«-specifikationer indeholder yderligere information, som underbygger kravene i obligatoriske specifikationer og er en hjælp ved anvendelsen af dem.

Formålet med indeks B32 er at sikre, at referencerne i bilag A-dokumenterne er entydige. Dette indeks bruges til redaktionelle formål og udelukkende til at lette arbejdet med fremtidige ændringer af de dokumenter, der henvises til; derfor er det ikke kategoriseret som en »type« og ikke koblet til et af de bindende dokumenter i bilag A.
