KOMMISSIONENS DIREKTIV 2009/2/EF
af 15. januar 2009
om 31. tilpasning til den tekniske udvikling af Rådets direktiv 67/548/EØF om tilnærmelse af lovgivning om klassificering, emballering og etikettering af farlige stoffer

KOMMISSIONEN FOR DE EUROPÆISKE FÆLLESSKABER HAR —
under henvisning til traktaten om oprettelse af Det Europæiske Fællesskab,
under henvisning til Rådets direktiv 67/548/EØF af 27. juni 1967 om tilnærmelse af lovgivning om klassificering, emballering og etikettering af farlige stoffer (1), særlig artikel 28, og
ud fra følgende betragtninger:

Artikel 4, stk. 3, i direktiv 67/548/EØF fastsætter kriterier og procedurer for harmonisering af klassificering og etikettering af stoffer. Punkt 4.1.3, 4.1.4 og 4.1.5 i bilag VI til direktiv 67/548/EØF pålægger virksomhederne så hurtigt som muligt at indlevere oplysninger til medlemsstaterne med forslag til harmoniseret klassificering og etikettering, når der fremkommer oplysninger, som taler for, at stoffet opfylder kriterierne for klassificering som mutagent, kræftfremkaldende eller reproduktionstoksisk. |

Bilag I til direktiv 67/548/EØF indeholder en liste over farlige stoffer med angivelse af de enkelte stoffers klassificering og etikettering. Der er behov for ajourføring af denne liste ved, at der indsættes anmeldte nye stoffer og yderligere eksisterende stoffer, og at de allerede opførte stoffer tilpasses til den tekniske udvikling. Det er desuden nødvendigt, at visse stoffer udgår af listen. |

I bilag I til direktiv 67/548/EØF er der allerede opført grupper af stoffer, især metalforbindelser, der er vurderet gruppevis og ved analogisering mellem stoffer. |

I bilag I til direktiv 67/548/EØF er der ligeledes en række grupper, hvor de enkelte stoffer i gruppen er beskrevet, og hvor der til klassificeringen er benyttet grupperings- og analogiseringsprincipper, f.eks. mineraloliestrømme og gasser. |

Det anføres i bilag VI til direktiv 67/548/EØF, at data, som er nødvendige for klassificering og etikettering, kan fremskaffes fra en række forskellige kilder, herunder resultaterne af validerede struktur/aktivitet-relationer og ekspertvurderinger. |

Klassificeringen af nikkelforbindelserne i dette direktiv bygger på virkninger, der skyldes Ni2+-ionen, og foreliggende data for nikkelforbindelser. Klassificeringen bygger på en indplacering af nikkelforbindelser i grupper alt efter deres opløselighed i vand (f.eks. de uopløselige, de svagt opløselige og de opløselige nikkelforbindelser i hver sin gruppe). Vandopløseligheden er valgt som det første kriterium for afgrænsning af grupperne ud fra den begrundelse, at nikkelforbindelser med omtrent samme vandopløselighed vil føre til omtrent samme biotilgængelighed for Ni2+-ionerne og omtrent samme systemiske toksicitet. Det begrunder analogiseringen inden for grupperne fra stoffer, som foreliggende fyldestgørende testdata viser har en specifik virkning, til stoffer, der ikke findes sådanne testdata om. For nogle virkningers vedkommende er analogisering mellem grupperne velbegrundet, da omtrent samme virkninger er iagttaget for alle niveauer af vandopløselighed. Eksempelvis har epidemiologiske undersøgelser vist, at både opløselige og uopløselige nikkelforbindelser (i hver sin ende af opløselighedsskalaen) har lokale kræftfremkaldende virkninger i luftvejene. Der er derfor god grund til at konkludere, at svagt opløselige forbindelser (midt på skalaen) har lignende kræftfremkaldende egenskaber. |

Ved den samlede vurdering af alle foreliggende oplysninger om nikkelforbindelser kan vandopløseligheden benyttes som tilnærmelse for Ni2+-ionens systemiske biotilgængelighed for mange virkningers og stoffers vedkommende. |

Klassificeringen og etiketteringen af stoffer, som er opført i dette direktiv, bør tages op til fornyet overvejelse, hvis der fremkommer ny videnskabelig viden. Således bør især nikkelbranchens nylige fremlæggelse af foreløbige, ufuldstændige og ikke-fagfællebedømte oplysninger betyde, at resultaterne af de kommende drøftelser i WHO's Internationale Kræftforskningscenter af nikkelforbindelsers carcinogenicitet og alle nye relevante videnskabelige resultater eller fortolkninger af de data, der ligger til grund for klassificeringen af nikkelforbindelserne i dette direktiv, tillægges særlig betydning. |

De i dette direktiv fastsatte foranstaltninger er i overensstemmelse med udtalelse fra Udvalget for Tilpasning til den Tekniske Udvikling af Direktiverne om Fjernelse af Tekniske Hindringer for Handelen med Farlige Stoffer og Præparater — |
UDSTEDT FØLGENDE DIREKTIV:
Artikel 1
I direktiv 67/548/EØF foretages følgende ændringer. I bilag I foretages følgende ændringer:
a) |
Stofferne, der svarer til stofferne i bilag 1A til dette direktiv, erstattes af stofferne i bilag 1A til dette direktiv. |
b) |
Stofferne i bilag 1B til dette direktiv indføjes i overensstemmelse med den rækkefølge, hvori stofferne er opført i bilag I til direktiv 67/548/EØF. |
c) |
Stofferne på listen i bilag 1C til dette direktiv udgår. |
Artikel 2
Medlemsstaterne sætter de nødvendige love og administrative bestemmelser i kraft for at efterkomme dette direktiv senest den 1. juni 2009. De tilsender straks Kommissionen disse bestemmelser med en sammenligningstabel, som viser sammenhængen mellem de pågældende bestemmelser og dette direktiv.
Disse bestemmelser skal ved vedtagelsen indeholde en henvisning til dette direktiv eller skal ved offentliggørelsen ledsages af en sådan henvisning. De nærmere regler for henvisningen fastsættes af medlemsstaterne.
Medlemsstaterne tilsender Kommissionen de vigtigste nationale bestemmelser, som de udsteder på det område, der er omfattet af dette direktiv.
Artikel 3
Dette direktiv træder i kraft på tyvendedagen efter offentliggørelsen i Den Europæiske Unions Tidende.
Artikel 4
Dette direktiv er rettet til medlemsstaterne.
