Meddelelse fra formanden i samråd med næstformand Margot Wallström

I INDLEDNING

I 2005 står meget på spil for Den Europæiske Union. EU skal skabe kraftigere vækst og større beskæftigelse ved at puste nyt liv i Lissabon-strategien; det skal tilvejebringe midler til støtte for velstand, solidaritet og sikkerhed ved at nå til enighed om de finansielle overslag; og det skal sikre frihed, sikkerhed og retfærdighed for borgerne på EU-plan ved implementering af Haag-programmet. Der skal træffes centrale afgørelser, som øver direkte indflydelse på det udvidede EU’s fremtid. Samtidig minder forfatningen EU om, hvad det er her for, og i hvilken retning det skal bevæge sig. Europa-Kommissionen spiller en central rolle ved gennemførelsen af denne agenda og vil energisk og beslutsomt søge at føre disse mål ud i livet.

Følgende særtræk ved det politiske klima i 2005 er af særlig betydning:

- Den økonomiske vækst i EU er gået i stå på lidt over 2 %. Dette er ikke nok til at tackle arbejdsløsheden og skyldes generelle svagheder ved EU’s evne til at klare sig i konkurrencen og lade de mest vækstfremmende elementer komme til udfoldelse.

- Ratifikationen af forfatningen vil give anledning til en intens politisk drøftelse overalt i EU’s medlemsstater. Denne drøftelse vil - som det er tilfældet for enhver drøftelse af EU’s fremtid - givetvis give anledning til modstridende synspunkter, men den vil også gøre det muligt at styrke den almindelige forståelse for EU.

- Forhandlingerne om de finansielle overslag gør det muligt for EU at sørge for, at et af dets vigtigste redskaber, EU-budgettet, indrettes således, at det sikrer en så effektiv produktion i Unionen som overhovedet muligt i overensstemmelse med dens mål.

- 2005 vil være et afgørende år i bestræbelserne for at sikre, at det nyligt udvidede EU kommer til at fungere hensigtsmæssigt.

Nærværende lovgivnings- og arbejdsprogram (i det følgende benævnt arbejdsprogrammet) koncentrerer sig om Kommissionens bidrag, fordi det er den, der har ansvaret for klarlæggelsen af den fælleseuropæiske interesse og den politiske målretning af EU’s arbejde. Lige fra det europæiske projekts begyndelse har Kommissionens initiativret været det faste grundlag for EU’s fremdrift hen imod virkeliggørelsen af fælles mål.

Med arbejdsprogrammet følger forslaget til strategiske mål for 2005-2009. Det er den første mulighed, den nye Kommission har for at bistå med at lægge en linje for EU’s arbejde i de kommende fem år. Det slås deri fast, hvordan og hvor Kommissionen i det kommende år vil bestræbe sig på at gennemføre den strategiske prioritering , både hvad angår nye og igangværende foranstaltninger. Til selve teksten er knyttet en liste over vigtige nye foranstaltninger.

Kommissionen har i år lagt sig fast på en ny approach for sit arbejdsprogram:

- Arbejdsprogrammet har en kraftigere politisk fokusering .

- Der lægges særlig stor vægt på implementeringen . Kommissionen har et meget stærkt ønske om at føre de prioriteringsforslag, der findes i bilag I, ud i livet i løbet af året.

- Der bør finde en reel opprioritering sted af en gennemførelse, som foregår ved hjælp af de højeste gennemførelsesstandarder og bedre lovarbejde . I afsnit III i arbejdsprogrammet gøres der mere detaljeret rede for Kommissionens hensigter.

Desuden tjener arbejdsprogrammet det formål at bistå alle EU’s institutioner med at planlægge deres arbejde effektivt. Da det kun omfatter de højest prioriterede af Kommissionens nye foranstaltninger, vil der desuden blive tilstillet de øvrige institutioner en fuldstændig liste over alle andre dokumenter, som i det kommende år efter planen vil blive omfattet af den interinstitutionelle proces. Dette betegner en velkommen udvikling hen imod øget koordination af institutionernes arbejde - hvilket er et spørgsmål, som Europa-Parlamentet fremhævede, da det godkendte den nye Kommission. Forfatningen vil være det næste logiske skridt ved at fastlægge et flerårigt interinstitutionelt program, som tilfører EU en fælles strategisk vision. De strategiske mål 2005-2009, som Kommissionen forelægger Europa-Parlamentet og Rådet sideløbende med dette arbejdsprogram som et fælles grundlag for institutionernes arbejde, er inspireret af forfatningens bestemmelser.

II KOMMISSIONENS PRIORITERING FOR 2005

I februar 2004 fastsattes i den årlige politikstrategi for 2005 prioriteringen af det kommende års foranstaltninger samt de vigtigste initiativer, der var nødvendige for at føre dem ud i livet.

Vedtagelsen af den årlige politikstrategi gør det muligt at sikre en interinstitutionel dialog om prioriteringen for det kommende år. Europa-Parlamentet og Rådet foretager en tilbundsgående undersøgelse af Kommissionens forslag og fremsætter ændringsforslag. Disse reaktioner samles til en helhed, som gør det muligt at foretage eventuelle ændringer i prioriteringen og de vigtigste initiativer og indarbejde disse i arbejdsprogrammet.

Som følge af de institutionelle forandringer i 2004 blev der fastsat en lettere procedure end den sædvanlige for dialogen med Europa-Parlamentet. I april opnåede den af Kommissionen foretagne prioritering almindelig støtte med en forstærket fokusering på sikkerhed efter terrorangrebene i Madrid. I Rådets konklusioner blev prioriteringen hilst velkommen, ligesom man anmodede om, at der blev taget fuldt hensyn til konklusionerne fra Det Europæiske Råds forårsmøde.

I takt med arbejdsprogrammets udarbejdelse er der taget fuldt hensyn til institutionernes synspunkter. Navnlig er Kommission helt enig i det overordnede mål om sikring af velstand og bæredygtig udvikling. Den har noteret sig:

- en kraftig understregning af målet om en reel implementering af Lissabon-strategien

- en særlig fokusering på sikkerhed, hvor det er nødvendigt at forvalte det udvidede EU’s ydre grænser, at sikre en fælles approach for migrationsstrømme og at styrke indsatsen til bekæmpelse af terrorisme

- en stærk opbakning bag en ambitiøs naboskabspolitik og en virkningsfuld udviklingsagenda.

Resultatet af denne dialog og udvekslingerne med de øvrige institutioner siden den nye Kommissions tiltrædelse retter sammen med udarbejdelsen af de strategiske mål søgelyset mod de vigtigste prioriterede opgaver for 2005:

- Det centrale mål er at øge velstanden via nye impulser til vækst og beskæftigelse baseret på en forbedret konkurrenceevne.

- De særskilte mål om solidaritet og sikkerhed vil blive søgt virkeliggjort som vigtige supplementer til velstanden.

- EU’s nye kontinentale legitimitet gør det muligt for EU at udbrede de interne mål til omverdenen via et udvidet eksternt ansvar.

De europæiske borgere forventer med rette, at Den Europæiske Union spiller den rolle, der tilkommer den med hensyn til at forbedre deres livskvalitet.

En central faktor, når det drejer sig om at føre dette perspektiv ud i livet, er det gennemgående mål bæredygtig udvikling. Den europæiske model er baseret på princippet om, at foranstaltninger, som fremmer konkurreenceevne, vækst og beskæftigelse, økonomisk og social samhørighed og et sundt miljø, gensidigt styrker hinanden. Eksempelvis er en tackling af klimaændringen en forhåndsbetingelse for bæredygtig vækst.

Frihed, sikkerhed og retfærdighed står i centrum for borgernes ønsker. Det Europæiske Råd vedtog på sit møde i november 2004 Haag-programmet, som åbner for en ny etape af opbygningen af et område med frihed, sikkerhed og retfærdighed og udgør et detaljeret handlingsprogram.

Endelig skal Den Europæiske Union, dersom den ønsker at komme tættere på sine borgere, også sørge for at kommunikere på en effektiv måde. Dette blev anerkendt af Det Europæiske Råd på mødet i november 2004, hvor det hilste Kommissionens ønske om at fremlægge en omfattende kommunikationsstrategi velkommen.

Vigtigste igangværende tværgående foranstaltninger Forhandlinger om de bidrag, som de kommende finansielle overslag og deres underliggende politikker skal yde til virkeliggørelsen af EU’s mål for 2007-2013. Sikring af et velfungerende udvidet EU og en fuldstændig anvendelse af politikkerne og bestemmelserne i samtlige medlemsstater. |

- I følgende afsnit gives:

- en beskrivelse af de vigtigste delmål under hvert mål

- et resumé af de foranstaltninger, der efter planen skal vedtages under hver prioriteret opgave

- et resumé af andre centrale igangværende aktiviteter i Kommissionen, som vil bidrage til de prioriterede opgaver i 2005.

II.1 Velstand

Kommissionens centrale politiske mål er at forøge den økonomiske vækst, hvilket forudsætter øget støtte til de mest vækstfremmende elementer som f.eks. forskning og innovation og imødekommelse af behovene i de enkelte sektorer med hovedvægten lagt på tjenesteydelser. Der vil blive tilført konkurrenceevnens europæiske dimension nye impulser via midtvejsrevisionen af Lissabon-strategien . På Det Europæiske Råds forårsmøde i marts vil EU og medlemsstaterne få mulighed for at gøre reelle fremskridt hen imod en forbedring af den europæiske models konkurrenceevne som middel til velstand, beskæftigelse, samhørighed og miljøbeskyttelse. Men uden at resultaterne af denne revision skal foregribes, kan Kommissionens arbejde med at bane vej for en fornyet Lissabon-strategi gøres konkret via en række præcise foranstaltninger, som berører nogle af de vigtigste faktorer til sikring af en vellykket vækstpolitik.

- En sund makroøkonomisk ramme er vigtig for en økonomis sundhedstilstand. En omlægning af stabilitets- og vækstpagten vil bidrage til at sikre, at der opnås stabilitet via en fornyet aftale om pagtens regler.

- Omkostningerne ved en ringe infrastruktur er enorme for den europæiske økonomi. Det transeuropæiske net skal bygge på vækstinitiativet ved at sikre, at de betydelige ekstra midler modsvares af nye foranstaltninger, som gør nettene mere operationelle og bedre koordinerede. En større gennemsigtighed på energimarkedet bør også bidrage til at gøre energiforsyningen mere sikker.

- En ny generation forskningsprogrammer vil sikre et veritabelt løft, som kan indsnævre kløften mellem EU’s og dets vigtigste konkurrenters forskningsindsats. EU-budgettet bør yde et langt større bidrag til det aftalte mål om, at 3 % af BNI afsættes til forskning. Forskningsprogrammerne bør fokusere på områder, hvor EU kan tilbyde en reel nytteværdi: fremme af viden og samarbejde på et europæisk grundlag, sikring af, at EU’s samlede forskningspotentiale udnyttes, og sikring af stordriftsfordele, effektivitet og forenkling. Skabelsen af en videnøkonomi i EU er også ensbetydende med at føre EU’s mål om livslang læring ud i livet.

- Innovation og iværksætterlyst er også afgørende for vækst og jobskabelse. Unionen skal stimulere disse mål ved at føre politikker, som fremmer innovation og iværksætterlyst, og ved at supplere medlemsstaternes indsats. Der skal skabes et innovationsorienteret klima, som strækker sig længere end til teknologisk innovation og omfatter nye veje fremad på områder såsom distribution, marketing og design. EU kan udnytte sin førerstilling på områder som f.eks. økoinnovation til at sikre reelle impulser til fremme af vækst og konkurrenceevne.

- Det europæiske erhvervsmiljø skal i højere grad virke ansporende på virksomheder, der ønsker at udforske nye muligheder. Et velfungerende indre marked er en vigtig forhåndsbetingelse for vækst og konkurrenceevne. Hvis de reelle fordele ved det indre marked skal udnyttes fuldt ud, skal der nedbrydes barrierer i centrale sektorer som f.eks. finansielle tjenesteydelser og energi. Effektive markeder og incitamenter til investering og innovation er helt afgørende, når det drejer sig om vækst og jobskabelse: en effektiv konkurrence er i den henseende et af de mest stimulerende elementer. Miljøteknologier kan puste nyt liv i det europæiske erhvervslivs produktivitet og konkurrenceevne. En mere udbredt anvendelse af informations- og kommunikationsteknologier vil fremme væksten ved at øge produktiviteten, åbne nye markeder og forbedre den offentlige service. Der vil blive fremlagt en ny omfattende strategi for det europæiske informationssamfund indtil 2010. Skattepolitikken skal gøre livet lettere for virksomhederne, og risikoen for dobbeltbeskatning skal bortvejres. Men en sådan indsats vil kun være effektiv, hvis den ledsages af en forbedret implementering af indre marked-lovgivningen og en formindskelse af de forskriftsmæssige byrder. Det er nødvendigt med egnede procedurer og retsmidler til sikring af, at reglerne om offentlige indkøb, ophavsret og industrielle ejendomsrettigheder overholdes.

Vigtigste igangværende foranstaltninger Omsættelse af vækstinitiativet i konkrete foranstaltninger, navnlig på infrastrukturområdet. Fremskyndelse af forberedelserne til det internationale initiativ på området fusionsenergi (ITER). Det afsluttende år for handlingsplanen for finansielle tjenesteydelser 2000-05. Udvikling af en europæisk rumpolitik. Videreudbygning af politikken på centrale indre marked-områder som f.eks. offentlige indkøb (forsvar og offentligt/private partnerskaber), intellektuelle ejendomsrettigheder og finansielle tjenesteydelser (clearing og afvikling). Forbedring af den økonomiske styring og udbygning af overvågningskapaciteten vedrørende den makroøkonomiske og statsfinansielle situation. |

- II.2 Solidaritet

Solidaritet er en af EU-borgerskabets hjørnesten :

- Den sociale dimension ved målet om at skabe flere og bedre job skal fremmes via en ny social- og arbejdsmarkedspolitisk agenda for de kommende fem år. Det er også nødvendigt med en specifik indsats for at bekæmpe forskelsbehandling, fremme lighed mellem kønnene, anspore til øget arbejdskraftmobilitet, foregribe de problemer, der knytter sig til omstrukturering, og tage initiativ til en drøftelse af, hvorledes problemet med EU’s aldrende befolkning skal tackles.

- De fordele, som væksten fører med sig, skal komme alle dele af Unionen til gode, hvis de skal være effektive. Dette er ensbetydende med, at samhørighedspolitikken skal nyorienteres og omlægges for at sikre, at midlerne ikke kun går til de regioner, der har det største behov, men også til de sektorer, som kan tilbyde det bedste vækstpotentiale til fremme af konkurrenceevnen på regionalt plan. Samtidig kan politikkerne på områder som f.eks. informationsteknologi bidrage til at forhindre udelukkelse ved at sikre øget adgang.

- At være EU-borger er det samme som at deltage i et partnerskab. Borgerskabet forudsætter foranstaltninger til fremme af interkulturel diversitet i og uden for EU og ansporing til aktiv medvirken fra borgernes side inden for Unionen. En særlig fokusering på ungdommen vil afspejle denne gruppes forskelligartede interesser. Desuden er det ifølge den seneste høring nødvendigt at ajourføre reglerne for den audiovisuelle sektor .

Vort miljøs og vore naturressourcers bæredygtighed har længe været anerkendt som en prioriteret opgave for EU og er en del af solidariteten mellem generationerne:

- De miljømæssige udfordringer, som EU står over for, kræver en koordineret reaktion fra hele EU’s side. Tematiske strategier er en ny approach for miljøpolitikken, som har til formål at gøre sammenkædningerne både inden for og mellem miljøpolitikken og andre sektorpolitikker så omfattende som muligt. Formålet dermed er at sikre, at der tages hensyn til alle aspekter ved politikkerne, og at der kan benyttes en bred vifte af reaktioner på områderne ressourceanvendelse, affald, pesticider, luft, jord samt by- og havmiljø. EU skal også påse, at de miljømæssige og sociale omkostninger ved forskellige valg af transportformer gøres mere gennemsigtige, og anspore yderligere til brug af vedvarende energi. Men det skal også se fremad: vi bør allerede nu overveje, hvilke strategier der vil være nødvendige for at tackle klimaændringen i det kommende årti. En planlægning nu for at sikre en tilpasning til klimaændringen, herunder nye initiativer til fremme af energieffektiviteten, vil bistå erhvervsliv og borgere med at tilpasse sig og gøre fremtidige farer mindre.

- Reformerne af den fælles landbrugspolitik og den fælles fiskeripolitik har allerede banet vej for en mere bæredygtig forvaltning af naturressourcer, forbedret konkurrenceevne via mere udtalt markedsorientering i overensstemmelse med Lissabon-strategien og mere støtte til udsatte lokalsamfund. Dette arbejde skal udvides til nye områder såsom en ny etape af sukkerreformen og en tilpasning af lovgivningen om bananer. En ny strategi vil sikre en sammenhængende udvikling af landdistrikter i hele EU og fremme vækst og velstand i landdistrikterne. Den forenklede og forbedrede styring af fiskeripolitikken bør foregå via en samling af indsatsen på ét instrument.

Vigtigste igangværende foranstaltninger Iværksættelse af den nye ordning for handel med udledninger og implementering af Kyoto-aftalen. Første års implementering af reformen af den fælles landbrugspolitik med indførelse af enkeltbetalingen pr. bedrift. Forberedelse af en maritim politik for Unionen. Implementering af EU’s plan til sikring af biodiversitet. |

- II.3 De europæiske borgeres sikkerhed

Sikkerhed er et af de områder, hvor EU's borgere har de største forventninger. Foranstaltningerne på området frihed, sikkerhed og retfærdighed kræver udtalt konsensus. Risiciene for sundheds- eller miljømæssige kriser forudsætter i stadig højere grad en paneuropæisk dimension. Foranstaltningerne vil blive fordelt over de forskellige politikområder:

- Den frie bevægelighed for personer i EU forudsætter en fælles approach for grænsekontrol, asyl og indvandring . Fælles procedureregler for lovlig indvandring og tilbagesendelse vil sikre lige vilkår for potentielle indvandrere; og det er nødvendigt at tilvejebringe de data, der er nødvendige til en effektiv målretning af politikken. Men grænsekontrol er udgiftskrævende, og byrderne for de medlemsstater, der kan imødese urimeligt store forpligtelser, bør lempes ved hjælp af et system for omkostningsdeling.

- Truslerne mod sikkerheden i et EU uden indre grænser skal imødegås på koordineret vis . Et operationelt samarbejde mod terrorisme og organiseret kriminalitet og en forbedret brug af efterretningsvirksomhed vil antagelig udfylde nogle af lakunerne. Kommunikationen bør også forbedres ved oprettelse af bedre net mellem nationale myndigheder og ved sikring af fælles adgang til strafferegistre. Et samarbejde mellem politimyndigheder på transportområdet følger også logisk af det forhold, at der kun er ét fælles transportnet. Unionen har også på visse områder såsom effektiv toldkontrol og kontrol med varer med dobbelt anvendelse et sikkerhedsmæssigt ansvar med virkninger ud over EU’s grænser.

- Adgangen til retsvæsenet bør forbedres . Dette spørgsmål kan tackles ved hjælp af et samarbejde mellem retsmyndigheder og ved at udvide retsområdet til at omfatte spørgsmål som f.eks. skilsmisse, underholdspligt, arv og testamente. Samtidig skal de personlige rettigheder beskyttes, og Unionen bør træffe forberedelser til den foreslåede optagelse af charteret om grundlæggende rettigheder i forfatningen.

- EU har brug for mekanismer, som kan sikre en hurtig reaktion på kriser og forbedre dets borgeres sikkerhed. S ikkerheden til søs, på landevej og i fly kræver en reaktion på EU-plan. Radioaktivt affald skal forvaltes hensigtsmæssigt. Sundhed er også et område, hvor koordination og udveksling af bedste praksis direkte kan komme borgeren til gode. De fleste regler på området fødevaresikkerhed er allerede vedtaget, men anvendelsen deraf skal forbedres ved hjælp af uddannelse og bedre kontrol, ligesom de skal ajourføres på grundlag af den videnskabelige udvikling og forbrugernes behov. Forbrugerne har både behov for passende beskyttelse på områder som f.eks. tilsætningsstoffer og passende information om velfærdsstandarder i forbindelse med produktion af fødevarer. Reglerne om dyresundhed og -velfærd skal også ajourføres for at afspejle ny videnskabelig viden og øge beskyttelsen af velfærd og sundhed.

- Sikkerheden i energiforsyningen bør fremmes ved på lang sigt at nedbringe afhængigheden af importeret olie og gas.

Vigtigste igangværende foranstaltninger Sikring af fødevaresikkerhed, plantesundhedskontrol, harmoniseret sundhedskontrol af importerede dyr og importerede fødevarers og foderstoffers sikkerhed. Forberedelse af et nyt initiativ på området sikkerhedsforskning. Forberedelse af det fælles asylsystems anden fase (inkl. implementeringen af Den Europæiske Flygtningefond II). Styrkelse af den fælles visumpolitik og af rejsedokumenters sikkerhed. Styrkelse af terrorbekæmpelsen ved udbygning af EU’s net og kapaciteter. |

- II.4 Eksterne prioriterede opgaver

Som følge af Unionens nye dimension efter udvidelsen synes der at være et presserende behov for sammen med nabolandene mod syd og øst at oprette en stabil omfattende politisk ramme: virkeliggørelsen af dette andet samarbejdsområde kendetegnet af velstand og stabilitet er den centrale eksterne prioriterede opgave. Dette kræver fuldstændig implementering af Unionens nye naboskabspolitik. Samtidig bør stabiliserings- og associeringsprocessen vedblivende være den politiske hjørnesten i forholdet til landene på Vestbalkan, og tiltrædelsesprocessen vil blive videreført med førtiltrædelsesstrategien for og indledningen af forhandlinger med Tyrkiet og en fase med aktive forhandlinger med Kroatien.

Desuden kan og skal den udvidede Union påtage sig et større globalt ansvar . Kommissionen skal nødvendigvis spille en større rolle med hensyn til fremme af bæredygtig udvikling på verdensplan, navnlig via millennium-udviklingsmålene, og indtage en førerstilling på områderne multilateral styring og reform af FN. EU’s integrerede handelspolitik og dets store betydning, når det drejer sig om at fremme udvikling, vil føre til, at det påtager sig et større ansvar i multilaterale institutioner såsom Verdenshandelsorganisationen. Et sammenhængende sæt instrumenter og en forbedret koordination deraf vil styrke EU’s muligheder for at reagere effektivt på civile kriser eller efterkonfliktsituationer. Den hurtige ydelse af humanitær bistand efter tsunami-katastrofen viste, i hvor høj grad en effektiv og hurtig ydelse af humanitær bistand fra EU og andre donorer kan bidrage til, at EU lever op til sit globale ansvar. En anden metode til opnåelse af maksimal gennemslagskraft for EU’s indsats på verdensplan er at gøre størst mulig brug af dets interne politikkers eksterne dimension.

I tilknytning til de mere langsigtede delmål, der er fastsat i de strategiske mål, agter Kommissionen i 2005 at lægge særlig vægt på indsatsen på følgende to områder: forbindelserne med EU’s umiddelbare naboer og det bydende nødvendige i en udvikling eksemplificeret ved Afrika .

- Via den europæiske naboskabspolitik vil de fordele, der er forbundet med EU’s udvidelse, også komme nabolandene til gode i form af øget stabilitet, sikkerhed og velstand. I 2005 vil Kommissionen udvide de skræddersyede handlingsplaner, i hvilke der fastsættes mål for hele viften af politiske, økonomiske og sociale spørgsmål, til de nye nabolande, og vil dermed optræde som katalysator for økonomisk og politisk reform. For Middelhavsområdets vedkommende vil Barcelona-processen blive revideret og omarbejdet med henblik på at sikre, at den vedblivende er det mest effektive instrument for partnerskab og dialog og tilbyder et regionalt perspektiv inden for den overordnede approach for naboskab.

- Udvidelsesprocessen vil blive videreført med den almindelige strategi til sikring af fremskridt i udvidelsesprocessen (overvågningsrapporter for Bulgarien og Rumænien, situationsrapporter for Kroatien og Tyrkiet). Der vil også blive aflagt rapport om fremskridtet i stabiliserings- og associeringsprocessen for Vestbalkan. Endelig vil det blive vurderet, om det skal anbefales, at der indledes tiltrædelsesforhandlinger med Den Tidligere Jugoslaviske Republik Makedonien.

- EU vil afgive en ny udviklingspolitisk erklæring for at forberede en effektivisering af sin udviklingsindsats og vil forberede FN’s globale revision af millennium-udviklingsmålene i september 2005 ved at foretage sin egen evaluering og udarbejde forslag til, hvorledes processen videre bør forløbe. Dette vil antagelig omfatte en særlig fokusering på bæredygtig udviklingsfinansiering og effektiv multilateralisme. Desuden bør EU gøre effektiv brug af sine bilaterale forbindelser , f.eks. ved udnyttelse af de transatlantiske forbindelsers fulde potentiale.

- EU vil også videreføre sin indsats for at sikre et godt resultat af Doha-udviklingsrunden, navnlig ved at arbejde for et mærkbart fremskridt på ministermødet i Hongkong og ved at føre politikker, som fremmer virkeliggørelsen af udviklingsmål.

- Den nye udviklingspolitiske erklæring og den generelle revision af Unionens fremskridt hen imod virkeliggørelsen af millennium-udviklingsmålene bør suppleres med en særlig strategi for Afrika . De særlige problemer i Afrika, navnlig Afrika syd for Sahara, skal anerkendes ved iværksættelse af en særlig foranstaltning. En målrettet strategi vil bidrage til, at EU kan sikre et veritabelt kvantitativt og kvalitativt løft i bistanden til Afrika. Den skal tage sigte på et reelt partnerskab på grundlag af veludviklede handelsforbindelser og politiske forbindelser.

Vigtigste igangværende foranstaltninger Implementering af en ny EU-naboskabspolitik i henhold til allerede vedtagne handlingsplaner. Stabilisering og associering på det vestlige Balkan. Forberedelse af Rumæniens og Bulgariens tiltrædelse. Implementering af førtiltrædelsesstrategien og tiltrædelsesforhandlinger med Tyrkiet og Kroatien. Forhandlinger om en moderniseret pakke instrumenter for eksterne forbindelser inden for rammerne af de samlede finansielle overslag. Samarbejde med USA om fredsprocessen i Mellemøsten. Videreførelse af igangværende regionale eller bilaterale forhandlinger (Mercosur, Samarbejdsrådet for Golfstaterne) og andre initiativer, som kan udbygge handelsforbindelserne (De Forenede Stater, Canada, ASEAN). Implementering af den europæiske sikkerhedsstrategi og videreudbygning af den europæiske sikkerheds- og forsvarspolitik. Bistand til AVS-partnerne med at absorbere konsekvenserne af EU's sukkerreform. De igangværende forhandlinger om multilaterale miljøaftaler, bl.a. vedrørende klimaændringer. |

- III. GENNEMFØRELSE OG BEDRE LOVARBEJDE

Høje standarder for EU’s styring og lovarbejde er vigtige forudsætninger for troværdigheden og legitimititeten af EU’s gennemførelse af politikkerne. Navnlig bidrager bedre lovarbejde og forbedret lovgivningskvalitet direkte til at stimulere vækst, konkurrenceevne og beskæftigelse, samtidig med at der sikres borgerne og miljøet en passende beskyttelse. I erkendelse af betydningen af et bedre lovarbejde vil Kommissionen i første kvartal 2005 på ny iværksætte sin strategi til forenkling og forbedring af de lovgivningsmæssige rammer.

- Subsidiaritet og proportionalitet. Kommissionens arbejde vil blive vurderet på grundlag af subsidiaritets- og proportionalitetskravene: EU bør kun træffe foranstaltninger, når det er nødvendigt, og da i den lettest mulige form. Kommissionen noterer sig den særlige rolle, som forfatningen tillægger de nationale parlamenter med hensyn til subsidiaritet.

- Udbytte af midlerne og ansvarlighed. EU-budgettet bør kun tages i anvendelse, når det kan give et større udbytte af midlerne end budgetudgifter på nationalt plan. Der skal også være en klar ansvarlighed for udgifterne med effektive interinstitutionelle mekanismer for dette arbejde. Der skal indføres passende revisions- og kontrolsystemer med en køreplan til sikring af en positiv revisionserklæring fra Den Europæiske Revisionsret. For at beskytte EU’s finansielle interesser bør bekæmpelse af svig fremmes ved hjælp af større gennemsigtighed og mere samarbejde.

- Høring. Det skal bemærkes, at adskillige af de forslag, der skal vedtages i år, giver anledning til høringer. Kommissionen er overbevist om, at civilsamfundets og andre interesserede parters fulde medvirken ved politikkernes forberedelse øver reel indflydelse på politikkernes kvalitet og effektivitet. Ved høringen af interesserede parter vil Kommissionen i videst mulig udstrækning anvende minimumsstandarderne for høring[1].

- Konsekvensanalyse. Efter Kommissionens opfattelse er konsekvensanalyse et vitalt hjælpemiddel, når det drejer sig om at sikre, at politikkerne føres med fuld viden om de faktiske forhold, og den vedbliver med at udbygge sin praksis i dette øjemed[2]. Processen med konsekvensanalyser udstikker retningslinjer for politikkerne via en åben analyse af mulighederne og lægger grunden til en disciplin, som sikrer, at der tages fuldt hensyn til de økonomiske, sociale og miljømæssige faktorer. Desuden giver den en klar og tilgængelig offentlig forklaring på, hvorfor et givet forslag fremsættes. Konsekvensanalyse er derfor gjort til en fast bestanddel af alle forslag i arbejdsprogrammet. I den sammenhæng vil Kommissionen påse, at der i konsekvensanalyserne tages behørigt hensyn til konkurrenceevnen. De eneste tilfælde, hvor det ikke er nødvendigt med en konsekvensanalyse, er grønbøger og høringer af arbejdsmarkedets parter. I disse tilfælde vil en konsekvensanalyse blive foretaget senere, dersom initiativet følges op.

- Gennemførelse og implementering. Kommissionen vil beskytte lovarbejdet som helhed. Den vil forstærke sin indsats for at følge den nye approach for gennemførelse af fællesskabsretten[3], navnlig ved hjælp af forebyggende foranstaltninger og streng behandling af overtrædelser, når dette er nødvendigt.

- Forenkling. I sammenhæng med sin handlingsplan fra juni 2002 om “bedre og enklere lovgivningsmæssige rammer”[4] foreslog Kommissionen i februar 2003 en rammeforanstaltning for “ajourføring og forenkling af fællesskabsretten”[5] med det formål at sikre en klar, forståelig, ajourført og brugervenlig afledt EF-ret til gavn for borgere, økonomiske beslutningstagere og offentlige forvaltninger. I begyndelsen af 2005 vil Kommissionen gøre udførligt rede for implementeringen af 2003-forenklingsrammen og for sine planer for det fremtidige arbejde med forenkling af gældende lovgivning og ajourføre sit rullende forenklingsprogram. Rådet bifaldt i november 2004 en liste over prioriterede forenklingsopgaver baseret på forslag fra medlemsstaterne og opfordrede Kommissionen til at træffe alle egnede foranstaltninger[6]. Kommissionen har afgivet tilsagn om senest i marts 2005 at svare på den af Rådet foreslåede prioritering, men nærværende arbejdsprogram for 2005 indeholder allerede Kommissionens svar vedrørende nogle af Rådets prioriterede opgaver[7].Implementeringen af Kommissionens kodifikationsprogram blev i 2004 forsinket af flaskehalse i oversættelsen i de nye medlemsstater, men der vil efter planen i løbet af 2005 blive tale om en kraftig forøgelse af antallet af nye lovgivningsforslag til kodifikation.I bilag 3 er angivet en række planlagte forslag med betydelige forenklingsmæssige virkninger.

Council decision creating a European Law Enforcement Network in the fight against terrorism (LEN) | Pursuant to the Communication of the European Commission on Preparedness and the Consequence Management in the Fight against Terrorism the Commission proposes additional measures to strengthen the existing instruments on civil protection and consequence management. Terrorist attack responses require that the protection of public health and safety must also include traditional law enforcement besides the present civil protection systems. Law enforcement authorities in Member States should therefore have access to alerts produced by the different European alert systems managed by the Commission and should also be able to input relevant information thereto. The intention of the Commission is therefore to establish a law enforcement alert mechanism (the Law Enforcement Network, LEN) to be hosted by Europol and connected with other European rapid alert and rapid response systems managed by the Commission (notably ARGUS) whilst respecting national competences. [8] In February 2003, the Commission presented an ambitious Simplification Programme (COM(2003) 71) designed to simplify and up-date the content of existing EU legislation, and reduce its volume. This initiative resulted in a rolling programme for simplification which has been updated by the Commission on regular basis. Some of the initiatives listed in the present annex implement this simplification programme. It should be recalled also that the Council endorsed in November 2004 a list of priorities for simplification based on suggestions from Member States and invited the Commission to take any appropriate action. The Council list of proposals include the following items: Plant protection products; Annual accounts; Twelfth company law directive; Waste oils; Waste directive; Hazardous waste; Incineration of waste; Food labelling; International vs. EU motor vehicles rules; Construction products; Medical devices; Pressure vessels; Health and safety at work; Structural business statistics. The present work programme for 2005 already contains the Commission’s response on some of Council’s priorities and it should be noted that the pursuit of Council’s simplification priorities do not always require legislative initiatives from the Commission.
