RÅDETS FORORDNING

om ændring af oversigterne over insolvensbehandling, likvidation og kuratorer i bilag A, B og C til forordning (EF) nr. 1346/2000 om konkurs

RÅDET FOR DEN EUROPÆISKE UNION HAR -

under henvisning til traktaten om oprettelse af Det Europæiske Fællesskab,

under henvisning til Rådets forordning (EF) nr. 1346/2000 af 29. maj 2000 om konkurs([1]), særlig artikel 45,

under henvisning til forslag fra Kommissionen([2]), og

ud fra følgende betragtninger:

(1) I bilagene til forordning (EF) nr. 1346/2000 anføres de betegnelser, der benyttes i medlemsstaternes nationale lovgivning for de bobehandlinger og kuratorer, for hvilke forordningen finder anvendelse. I bilag A til Rådets forordning (EF) nr. 1346/2000 anføres bobehandlinger omhandlet i forordningens artikel 2, litra a). I bilag B anføres bobehandlinger omhandlet i forordningens artikel 2, litra c), og i bilag C anføres kuratorer omhandlet i forordningens artikel 2, litra b).

(2) Bilagene A, B og C til Rådets forordning (EF) nr. 1346/2000 blev ændret ved tiltrædelsesakten fra 2003 for også at omfatte insolvensbehandling, likvidation og kuratorer i de tiltrædende stater.

(3) Belgien, Spanien, Italien, Letland, Litauen, Malta, Ungarn, Østrig, Polen, Portugal og Det Forenede Kongerige har i medfør af artikel 45 i forordning nr. 1346/2000 underrettet Kommissionen om ændringerne af oversigterne i bilag A, B og C.

(4) Forordning (EF) nr. 1346/2000 bør derfor ændres i overensstemmelse hermed -

UDSTEDT FØLGENDE FORORDNING:

Artikel 1

I forordning (EF) nr. 1346/2000 foretages følgende ændringer:

(1) Bilag A erstattes af teksten i bilag A til nærværende forordning.

(2) Bilag B erstattes af teksten i bilag B til nærværende forordning.

(3) Bilag C erstattes af teksten i bilag C til nærværende forordning.

Artikel 2

Denne forordning træder i kraft dagen efter offentliggørelsen i Den Europæiske Unions Tidende.

Denne forordning er bindende i alle enkeltheder og gælder umiddelbart i hver medlemsstat.
