KOMMISSIONENS GENNEMFØRELSESAFGØRELSE (EU) 2026/782

om ændring af gennemførelsesafgørelse (EU) 2026/582 om visse hasteforanstaltninger vedrørende mund- og klovesyge i Cypern

EUROPA-KOMMISSIONEN HAR –
under henvisning til traktaten om Den Europæiske Unions funktionsmåde,
under henvisning til Europa-Parlamentets og Rådets forordning (EU) 2016/429 af 9. marts 2016 om overførbare dyresygdomme og om ændring og ophævelse af visse retsakter på området for dyresundhed (»dyresundhedsloven«) (1), særlig artikel 259, stk. 1, og
ud fra følgende betragtninger:

Mund- og klovesyge er en infektiøs virussygdom, der rammer dyr i pattedyrsordenerne Artiodactyla og Proboscidea og kan have alvorlige konsekvenser for den pågældende dyrepopulation og landbrugets rentabilitet og forårsage forstyrrelser i flytninger af sendinger af disse dyr og produkter heraf inden for Unionen og eksporten til tredjelande. I tilfælde af et udbrud af mund- og klovesyge hos dyr er der alvorlig risiko for spredning af sygdommen til andre virksomheder, hvor der holdes dyr af listeopførte arter, jf. bilaget til Kommissionens gennemførelsesforordning (EU) 2018/1882 (2) (listeopførte arter). |

Kommissionens delegerede forordning (EU) 2020/687 (3) supplerer reglerne om bekæmpelse af de listeopførte sygdomme, der er omhandlet i artikel 9, stk. 1, litra a), b) og c), i forordning (EU) 2016/429, og som er defineret som kategori A-, B- og C-sygdomme i gennemførelsesforordning (EU) 2018/1882. Navnlig indeholder artikel 21 og 22 i delegeret forordning (EU) 2020/687 bestemmelser om oprettelse af en restriktionszone i tilfælde af udbrud af en kategori A-sygdom, herunder mund- og klovesyge, og om anvendelse af visse foranstaltninger deri. Desuden fastsættes det i artikel 21, stk. 1, i nævnte delegerede forordning, at restriktionszonen skal omfatte en beskyttelseszone, en overvågningszone og om nødvendigt supplerende restriktionszoner rundt om eller op til beskyttelses- og overvågningszonerne. |

Kommissionens gennemførelsesafgørelse (EU) 2026/582 (4) blev vedtaget på grundlag af forordning (EU) 2016/429 og fastsætter visse hasteforanstaltninger i forbindelse med udbruddene af mund- og klovesyge på virksomheder, hvor der holdes drøvtyggere i distriktet Larnaca i Cypern. Nærmere bestemt skal Cypern i henhold til gennemførelsesafgørelse (EU) 2026/582 oprette restriktionszoner, der omfatter beskyttelses- og overvågningszoner samt en supplerende restriktionszone, i overensstemmelse med artikel 21 i delegeret forordning (EU) 2020/687, hvor de foranstaltninger, der kræves anvendt i beskyttelses- og overvågningszonerne samt den supplerende restriktionszone, som minimum skal anvendes indtil de datoer, der er opført i bilaget til nævnte gennemførelsesafgørelse, og beskyttelses- og overvågningszonerne samt den supplerende restriktionszone skal som minimum omfatte de områder, der er opført i nævnte bilag. |

I betragtning af den nuværende epidemiologiske situation i Cypern og risikoen for, at infektion med mund- og klovesygevirus kan spredes gennem subklinisk inficerede dyr af listeopførte arter, er det også nødvendigt at forbyde flytning af sådanne dyr fra et hvilket som helst sted i den supplerende restriktionszone til et bestemmelsessted uden for den pågældende supplerende restriktionszone. Gennemførelsesafgørelse (EU) 2026/582 bør derfor ændres for at fastsætte dette forbud. |

I henhold til forordning (EU) 2016/429, særlig artikel 69, kan en medlemsstats kompetente myndighed, hvis det er relevant for en effektiv bekæmpelse af en listeopført sygdom, jf. samme forordnings artikel 9, stk. 1, litra a), for hvilken der gælder sygdomsbekæmpelsesforanstaltninger, udarbejde en vaccinationsplan og oprette vaccinationszoner. Med henblik herpå skal den kompetente myndighed gennemføre vaccinationsplanen og oprette vaccinationszoner, der opfylder de specifikke krav i artikel 6 i Kommissionens delegerede forordning (EU) 2023/361 (5), som supplerer forordning (EU) 2016/429. |

I delegeret forordning (EU) 2023/361 fastsættes bl.a. de særlige regler, som medlemsstaterne skal gennemføre, når de anvender beskyttende nødvaccination af dyr med henblik på at forebygge eller bekæmpe en listeopført sygdom. I nævnte delegerede forordning fastsættes også de betingelser, hvorunder flytning af vaccinerede dyr og produkter heraf kan tillades. De særlige betingelser for beskyttende nødvaccination mod infektion med mund- og klovesyge er fastsat i bilag VII til nævnte delegerede forordning. |

Den 2. marts 2026 indsendte Cypern en officiel vaccinationsplan for beskyttende nødvaccination mod infektion med mund- og klovesyge til Kommissionen. Planen indeholder oplysninger om vaccinationszonens geografiske og administrative anvendelsesområde og antallet af dyr, der skal vaccineres. Gennemførelsesafgørelse (EU) 2026/582 bør derfor ændres for at tage hensyn til Cyperns vaccinationsplan og vaccinationszonens territoriale anvendelsesområde. |

Siden vedtagelsen af gennemførelsesafgørelse (EU) 2026/582 er de nødforanstaltninger, der kræves anvendt i de beskyttelses- og overvågningszoner samt den supplerende restriktionszone, der er opført i bilaget hertil, og tidsplanen for deres anvendelse blevet revideret, navnlig med hensyn til den foreløbige rengøring og desinfektion af de angrebne virksomheder, jf. delegeret forordning (EU) 2020/687. Som følge heraf skal varigheden af hasteforanstaltningerne i disse beskyttelses- og overvågningszoner tilpasses. |

Siden vedtagelsen af gennemførelsesafgørelse (EU) 2026/582 har der desuden været yderligere udbrud af mund- og klovesyge på virksomheder i distrikterne Larnaca og Nicosia i Cypern, herunder uden for de områder, der for øjeblikket er opført som beskyttelses- og overvågningszoner i bilaget til gennemførelsesafgørelse (EU) 2026/582. |

I betragtning af den nuværende epidemiologiske situation med hensyn til mund- og klovesyge i Cypern og med henblik på at forhindre yderligere spredning af sygdommen i denne medlemsstat eller til andre medlemsstater eller til tredjelande er det derfor nødvendigt hurtigst muligt at gennemgå de nuværende områder, der er opført som beskyttelses- og overvågningszoner eller supplerende restriktionszoner i bilaget til gennemførelsesafgørelse (EU) 2026/582, for om nødvendigt at afgrænse dem geografisk og tidsmæssigt, og også at oprette nye beskyttelses- og overvågningszoner under hensyntagen til de nyeste udbrud i Cypern. Dette er også nødvendigt for at hindre unødvendige forstyrrelser i samhandelen i Unionen og for at undgå, at tredjelande indfører uberettigede handelshindringer. |

Gennemførelsesafgørelse (EU) 2026/582 bør derfor ændres. |

VEDTAGET DENNE AFGØRELSE:
Artikel 1
I gennemførelsesafgørelse (EU) 2026/582 foretages følgende ændringer:

Følgende indsættes som artikel 1a og 1b: »Artikel 1a Flytning af dyr af listeopførte arter, jf. bilaget til gennemførelsesforordning (EU) 2018/1882, fra den supplerende restriktionszone, der er fastsat i bilaget til nærværende afgørelse, til et bestemmelsessted uden for den supplerende restriktionszone skal forbydes indtil de datoer, der er opført i nævnte bilag. Artikel 1b Den kompetente myndighed opretter øjeblikkelig en vaccinationszone som beskrevet i bilaget til denne afgørelse i overensstemmelse med del 1 i bilag VII til delegeret forordning (EU) 2023/361 og på de betingelser, der er fastsat i nævnte bilag VII.« |
