om ændring af bilaget til gennemførelsesafgørelse (EU) 2023/2447 om hasteforanstaltninger over for udbrud af højpatogen aviær influenza i visse medlemsstater

EUROPA-KOMMISSIONEN HAR —
under henvisning til traktaten om Den Europæiske Unions funktionsmåde,
under henvisning til Europa-Parlamentets og Rådets forordning (EU) 2016/429 af 9. marts 2016 om overførbare dyresygdomme og om ændring og ophævelse af visse retsakter på området for dyresundhed (»dyresundhedsloven«) (1), særlig artikel 259, stk. 1, litra c), og
ud fra følgende betragtninger:

Højpatogen aviær influenza (HPAI) er en infektiøs virussygdom hos fugle, og den kan have alvorlige konsekvenser for fjerkræopdrættets rentabilitet og forårsage forstyrrelser i samhandelen inden for Unionen og eksporten til tredjelande. HPAI-virus kan inficere trækfugle, som så kan sprede disse virus over lange afstande under deres efterårs- og forårstræk. Forekomsten af HPAI-virus hos vilde fugle udgør derfor en latent fare for direkte og indirekte indførsel af disse virus på bedrifter, hvor der holdes fjerkræ eller fugle i fangenskab. Ved udbrud af HPAI er der risiko for, at sygdomsagensen spreder sig til andre bedrifter, hvor der holdes fjerkræ eller fugle i fangenskab. |

Ved forordning (EU) 2016/429 fastsættes lovrammen for forebyggelse og bekæmpelse af sygdomme, der kan overføres til dyr eller mennesker. HPAI falder ind under definitionen af en listeopført sygdom i nævnte forordning, og sygdommen er omfattet af de sygdomsforebyggelses- og -bekæmpelsesregler, der er fastsat deri. Kommissionens delegerede forordning (EU) 2020/687 (2) supplerer desuden forordning (EU) 2016/429 for så vidt angår reglerne om forebyggelse og bekæmpelse af visse listeopførte sygdomme, herunder sygdomsbekæmpende foranstaltninger vedrørende HPAI. |

Den 24. oktober 2023 vedtog Kommissionen Kommissionens gennemførelsesafgørelse (EU) 2023/2447 (3) med forordning (EU) 2016/429 som retsgrundlag, og deri fastsættes hasteforanstaltninger på EU-plan over for udbrud af HPAI. |

I henhold til gennemførelsesafgørelse (EU) 2023/2447 skal de beskyttelses- og overvågningszoner og supplerende restriktionszoner, der skal oprettes af de berørte medlemsstater efter udbrud af HPAI i henhold til delegeret forordning (EU) 2020/687, som minimum omfatte de områder, der er angivet som beskyttelses- og overvågningszoner og supplerende restriktionszoner i bilaget til nævnte gennemførelsesafgørelse. |

Bilaget til gennemførelsesafgørelse (EU) 2023/2447 blev for nylig ændret ved Kommissionens gennemførelsesafgørelse (EU) 2025/124 (4) efter yderligere udbrud af HPAI på virksomheder, hvor der blev holdt fjerkræ, i Tyskland, Italien, Ungarn og Polen, som skulle afspejles i bilaget. |

Siden datoen for vedtagelsen af gennemførelsesafgørelse (EU) 2025/124 har Italien, Polen og Portugal underrettet Kommissionen om yderligere udbrud af HPAI på virksomheder, hvor der blev holdt fjerkræ eller fugle i fangenskab, i regionerne Lombardiet og Veneto i Italien, i regionerne Warmińsko-Mazurskie og Podkarpackie i Polen og i distriktet Lissabon i Portugal. |

Italien, Polen og Portugal har gennemført de nødvendige sygdomsbekæmpelsesforanstaltninger i henhold til delegeret forordning (EU) 2020/687, herunder oprettelse af beskyttelses- og overvågningszoner omkring udbruddene. |
|
(8) |
Kommissionen har gennemgået de sygdomsbekæmpelsesforanstaltninger, der er truffet af Italien, Polen og Portugal, og finder det godtgjort, at grænserne for de beskyttelses- og overvågningszoner, som de pågældende medlemsstater har oprettet, ligger tilstrækkelig langt fra de virksomheder, hvor udbruddene af HPAI er blevet bekræftet. |

For at hindre unødvendige forstyrrelser i samhandelen i Unionen og for at undgå, at tredjelande indfører uberettigede handelshindringer, er det nødvendigt, i samarbejde med Italien, Polen og Portugal, hurtigt at fastlægge de beskyttelses- og overvågningszoner, der er oprettet af disse medlemsstater i henhold til delegeret forordning (EU) 2020/687, på EU-plan. |

Derfor bør de områder, der er opført som beskyttelses- og overvågningszoner opført for Italien, Polen og Portugal i bilaget til gennemførelsesafgørelse (EU) 2023/2447, ændres. |
|
(11) |
Bilaget til gennemførelsesafgørelse (EU) 2023/2447 bør således ændres med henblik på at ajourføre regionaliseringen på EU-plan og tage hensyn til de beskyttelses- og overvågningszoner, der er oprettet af de kompetente myndigheder i Italien, Polen og Portugal, i henhold til delegeret forordning (EU) 2020/687, samt varigheden af de foranstaltninger, der gælder heri. |

(12) |
Gennemførelsesafgørelse (EU) 2023/2447 bør derfor ændres. |
|
(13) |
Da den epidemiologiske situation i Unionen med hensyn til spredning af HPAI tilsiger en hurtig indsats, er det vigtigt, at de ændringer, der ved nærværende afgørelse foretages af gennemførelsesafgørelse (EU) 2023/2447, får virkning snarest muligt. |
|
(14) |
Foranstaltningerne i denne afgørelse er i overensstemmelse med udtalelse fra Den Stående Komité for Planter, Dyr, Fødevarer og Foder — |

Artikel 1
Bilaget til gennemførelsesafgørelse (EU) 2023/2447 erstattes af teksten i bilaget til nærværende afgørelse.
