om ændring af gennemførelsesafgørelse (EU) 2024/2207 om visse hasteforanstaltninger vedrørende fåre- og gedekopper i Grækenland

under henvisning til traktaten om Den Europæiske Unions funktionsmåde,
under henvisning til Europa-Parlamentets og Rådets forordning (EU) 2016/429 af 9. marts 2016 om overførbare dyresygdomme og om ændring og ophævelse af visse retsakter på området for dyresundhed (»dyresundhedsloven«) (1), særlig artikel 259, stk. 1, og
ud fra følgende betragtninger:

Fåre- og gedekopper er en infektiøs virussygdom, der rammer får og geder, og den kan have alvorlige konsekvenser for den pågældende dyrepopulation og landbrugets rentabilitet og forårsage forstyrrelser i flytninger af sendinger af disse dyr og produkter heraf inden for Unionen og eksporten til tredjelande. |

I tilfælde af et udbrud af fåre- og gedekopper hos får eller geder er der alvorlig risiko for spredning af sygdommen til andre virksomheder med får eller geder. |

(3) |
Kommissionens delegerede forordning (EU) 2020/687 (2) supplerer reglerne om bekæmpelse af de listeopførte sygdomme, der er omhandlet i artikel 9, stk. 1, litra a), b) og c), i forordning (EU) 2016/429, og som er defineret som kategori A-, B- og C-sygdomme i Kommissionens gennemførelsesforordning (EU) 2018/1882 (3). Navnlig indeholder artikel 21 og 22 i delegeret forordning (EU) 2020/687 bestemmelser om oprettelse af en restriktionszone i tilfælde af udbrud af en kategori A-sygdom, herunder fåre- og gedekopper, og om anvendelse af visse foranstaltninger deri. Desuden fastsættes det i artikel 21, stk. 1, i nævnte delegerede forordning, at restriktionszonen skal omfatte en beskyttelseszone, en overvågningszone og om nødvendigt supplerende restriktionszoner rundt om eller op til beskyttelses- og overvågningszonerne. |

For at adressere udbrud af fåre- og gedekopper i Grækenland vedtog Kommissionen gennemførelsesafgørelse (EU) 2024/2207 (4) med artikel 259 i forordning (EU) 2016/429 som retsgrundlag. Ved nævnte afgørelse fastsættes visse hasteforanstaltninger vedrørende fåre- og gedekopper i Grækenland I henhold til gennemførelsesafgørelse (EU) 2024/2207 skal de beskyttelses- og overvågningszoner og supplerende restriktionszoner, der skal oprettes af denne medlemsstat efter udbrud af sygdommen i henhold til delegeret forordning (EU) 2020/687, som minimum omfatte de områder, der er opført i bilaget til nævnte gennemførelsesafgørelse. |

Efter vedtagelsen af gennemførelsesafgørelse (EU) 2024/2207 underrettede Grækenland Kommissionen om yderligere udbrud af fåre- og gedekopper på virksomheder, hvor der blev holdt får og geder. Som følge heraf blev bilaget til nævnte gennemførelsesafgørelse behørigt ændret flere gange for at tage hensyn til disse yderligere udbrud. |

Siden den seneste ændring af gennemførelsesafgørelse (EU) 2024/2207 har Grækenland underrettet Kommissionen om 29 nye udbrud af fåre- og gedekopper på virksomheder, hvor der blev holdt får og geder, i de regionale enheder Etoloakarnania, Khalkidikí, Evvia, Evros, Kavala, Lemnos, Magnisia, Fokis, Rodopi og Xanthi. |

De områder, der er opført som beskyttelses- og overvågningszoner og supplerende restriktionszoner for Grækenland i bilaget til gennemførelsesafgørelse (EU) 2024/2207, bør derfor ændres yderligere for at forhindre yderligere spredning af sygdommen i Grækenland og resten af Unionen eller til tredjelande, og varigheden af de foranstaltninger, der skal anvendes deri, bør tilpasses. Det er derfor nødvendigt at ændre listen over restriktionszoner og varigheden af de foranstaltninger, der skal anvendes deri, i bilaget til nævnte gennemførelsesafgørelse. |

Størrelsen af beskyttelses- og overvågningszonerne og de supplerende restriktionszoner og varigheden af de foranstaltninger, der skal anvendes i dem, er baseret på kriterierne i artikel 64, stk. 1, i forordning (EU) 2016/429 og reglerne i delegeret forordning (EU) 2020/687, herunder den epidemiologiske situation med hensyn til fåre- og gedekopper i de områder, der er berørt af sygdommen, og den generelle epidemiologiske situation med hensyn til fåre- og gedekopper i den berørte medlemsstat samt risikoniveauet for yderligere spredning af sygdommen. Foranstaltningernes varighed tager også hensyn til de internationale standarder i Verdensorganisationen for Dyresundheds (WOAH) sundhedskodeks for terrestriske dyr. I den nuværende situation er der en meget høj risiko for yderligere spredning af sygdommen, navnlig fordi sygdommen ifølge oplysningerne fra den kompetente myndighed fortsat varer ved på trods af de foranstaltninger, der allerede er truffet. |

I betragtning af forekomsten af talrige nye udbrud af fåre- og gedekopper i Grækenland i de seneste uger er det endvidere nødvendigt at forlænge forbuddet mod flytning af får og geder fra hele Grækenlands område til et bestemmelsessted uden for Grækenland, i det mindste indtil den 31. januar 2025, for at undgå spredning af sygdommen til resten af Unionen og til tredjelande samt uberettigede handelshindringer. |

I betragtning af den nuværende epidemiologiske situation i Unionen med hensyn til fåre- og gedekopper bør den periode, hvor foranstaltningerne fastsat i gennemførelsesafgørelse (EU) 2024/2207 skal finde anvendelse, forlænges indtil den 30. juni 2025. |
