om ændring af gennemførelsesafgørelse (EU) 2026/820 om visse hasteforanstaltninger vedrørende mund- og klovesyge i Grækenland

EUROPA-KOMMISSIONEN HAR –

under henvisning til traktaten om Den Europæiske Unions funktionsmåde,

under henvisning til Europa-Parlamentets og Rådets forordning (EU) 2016/429 af 9. marts 2016 om overførbare dyresygdomme og om ændring og ophævelse af visse retsakter på området for dyresundhed (»dyresundhedsloven«) (1), særlig artikel 259, stk. 1, og

ud fra følgende betragtninger:

Mund- og klovesyge er en infektiøs virussygdom, der rammer dyr i pattedyrsordenerne Artiodactyla og Proboscidea og kan have alvorlige konsekvenser for den pågældende dyrepopulation og landbrugets rentabilitet og forårsage forstyrrelser i flytninger af sendinger af disse dyr og produkter heraf inden for Unionen og eksporten til tredjelande. I tilfælde af et udbrud af mund- og klovesyge hos dyr er der alvorlig risiko for spredning af sygdommen til andre virksomheder, hvor der holdes dyr af listeopførte arter, jf. bilaget til Kommissionens gennemførelsesforordning (EU) 2018/1882 (2) (listeopførte arter).

Kommissionens delegerede forordning (EU) 2020/687 (3) supplerer reglerne om bekæmpelse af de listeopførte sygdomme, der er omhandlet i artikel 9, stk. 1, litra a), b) og c), i forordning (EU) 2016/429, og som er defineret som kategori A-, B- og C-sygdomme i gennemførelsesforordning (EU) 2018/1882. Navnlig indeholder artikel 21 og 22 i delegeret forordning (EU) 2020/687 bestemmelser om oprettelse af en restriktionszone i tilfælde af udbrud af en kategori A-sygdom, herunder mund- og klovesyge, og om anvendelse af visse foranstaltninger deri. Desuden fastsættes det i artikel 21, stk. 1, i nævnte delegerede forordning, at restriktionszonen skal omfatte en beskyttelseszone, en overvågningszone og om nødvendigt supplerende restriktionszoner rundt om eller op til beskyttelses- og overvågningszonerne.

Kommissionens gennemførelsesafgørelse (EU) 2026/820 (4) blev vedtaget på grundlag af forordning (EU) 2016/429 og fastsætter visse hasteforanstaltninger i forbindelse med udbruddene af mund- og klovesyge på virksomheder, hvor der holdes dyr af listeopførte arter, i den regionale enhed Lesvos i Grækenland. Navnlig skal Grækenland i henhold til gennemførelsesafgørelse (EU) 2026/820 oprette restriktionszoner, der omfatter beskyttelses- og overvågningszoner samt en supplerende restriktionszone, i overensstemmelse med artikel 21 i delegeret forordning (EU) 2020/687, hvor de foranstaltninger, der kræves anvendt i beskyttelses- og overvågningszonerne samt i den supplerende restriktionszone, som minimum skal anvendes indtil de datoer, der er opført i bilaget til nævnte gennemførelsesafgørelse, og beskyttelses- og overvågningszonerne samt den supplerende restriktionszone skal som minimum omfatte de områder, der er opført i nævnte bilag. Gennemførelsesafgørelse (EU) 2026/820 blev senest ændret ved Kommissionens gennemførelsesafgørelse (EU) 2026/1038 (5).

Siden vedtagelsen af gennemførelsesafgørelse (EU) 2026/1038 er de nødforanstaltninger, der kræves anvendt i de beskyttelses- og overvågningszoner samt den supplerende restriktionszone, der er opført i bilaget hertil, og tidsplanen for deres anvendelse blevet revideret på baggrund af oplysninger fra Grækenland, navnlig med hensyn til datoerne for den foreløbige rengøring og desinfektion af de angrebne virksomheder, jf. delegeret forordning (EU) 2020/687. Som følge heraf skal varigheden af hasteforanstaltningerne i disse beskyttelses- og overvågningszoner tilpasses.

Siden vedtagelsen af gennemførelsesafgørelse (EU) 2026/1038 har der desuden været yderligere udbrud af mund- og klovesyge på virksomheder i den regionale enhed Lesvos i Grækenland, både inden for de områder, der for øjeblikket er opført som beskyttelses- og overvågningszoner i bilaget til gennemførelsesafgørelse (EU) 2026/820, og uden for disse områder.

I betragtning af den nuværende epidemiologiske situation med hensyn til mund- og klovesyge i Grækenland og med henblik på at forhindre yderligere spredning af sygdommen i denne medlemsstat eller til andre medlemsstater eller til tredjelande er det derfor nødvendigt hurtigst muligt at ajourføre de områder, der er opført som beskyttelses- og overvågningszoner eller supplerende restriktionszoner i bilaget til gennemførelsesafgørelse (EU) 2026/820, for om nødvendigt at afgrænse dem geografisk og tidsmæssigt, og også at oprette nye beskyttelses- og overvågningszoner under hensyntagen til de nyeste udbrud i Grækenland. Dette er også nødvendigt for at hindre unødvendige forstyrrelser i samhandelen i Unionen og for at undgå, at tredjelande indfører uberettigede handelshindringer.

Bilaget til gennemførelsesafgørelse (EU) 2026/820 bør derfor ændres.
