VÝROČNÍ ZPRÁVA ZA ROK 2005 O VZTAZÍCH S VNITROSTÁTNÍMI PARLAMENTY

1. Úvod

Komise se v roce 2005 zabývala zásadami svých vztahů s vnitrostátními parlamenty, neboť si přeje „zvýšit stupeň účasti na dialogu o Evropě, na diskuzi a veřejné debatě, ale také zkvalitnit výměnu informací, úvah a názorů na tyto otázky“[1]. Dne 9. února 2005 Margot Wallströmová oznámila členům Komise 10 hlavních cílů pro následující rok (viz dále) a obecnější cíle týkající se vztahů s občany a jejich volenými zástupci, které budou určující pro jejich činnost v dané oblasti.

Tato výroční zpráva splňuje jeden z těchto hlavních cílů. Je stručná, věcná a pokud jde o další podrobnosti, odkazuje na soubor dokumentů a zpráv vypracovaných generálním sekretariátem.

Rok 2005 se dá rozdělit na období před a po referendu . Bylo-li cílem Komise při stanovení „přístupu k vnitrostátním parlamentům“ uplatňování zásad správy věcí veřejných, očekávala též, že po proběhnutí referend Ústava vstoupí v brzké době v platnost. Jak je všeobecně známo, nyní je Ústava pozastavena a Unie vstoupila do období úvah.

Vztahy s vnitrostátními parlamenty se však i nadále intenzivně rozvíjejí.

Komise nemůže zůstat lhostejná ani nečinná vůči zastoupením národních shromáždění 21 členských států v Bruselu. Vzhledem k rozšíření nemůže opomíjet rozšiřování modelů předběžného parlamentního posouzení; nemůže během období úvah omezit výměnu názorů s vnitrostátními parlamenty.

Komise si přeje, aby tento nový postoj k vnitrostátním parlamentům respektoval rovnováhu mezi institucemi. Nezpochybňuje vztahy v rámci takzvaného „institucionálního trojúhelníku“. Pokud jde o zastoupení parlamentů v Evropské unii, je Evropský parlament tím prvním, na nějž se obrací. Stejně tak, jedná-li se o zastoupení členských států, se Komise nejdříve obrací na Radu.

Dalším zásadním prvkem přístupu vůči vnitrostátním parlamentům je respektování rozdílů v ústavách jednotlivých členských států. Ostatně, není snad jedním z hlavních cílů zabránit tomu, aby evropská praxe a postupy byly vnímány jako překážky pro vnitrostátní parlamenty? Evropská komise jakožto strážkyně smluv EU nemůže nerespektovat základní pravidla každého členského státu.

Tato zpráva o činnosti zpětně pojednává o plnění pragmatických a skromných cílů; měla by rovněž umožnit tuto činnost přesněji zaměřit, přizpůsobit plány nebo dokonce stanovit nové cíle pro rok 2006 na základě dvou prvků: potřebného pokračování v dialogu během období úvah, ale také zavedení vnitřního kontrolního mechanismu pro otázky subsidiarity.

2. C ÍLE STANOVENÉ PRO ROK 2005

Dne 9. února 2005 Margot Wallströmová představila v 10 bodech cíle, pokud jde o vztahy s vnitrostátními parlamenty (VP) v nadcházejícím roce.

1. Návštěvy ve vnitrostátních parlamentech, účast na konferenci předsedů parlamentů Evropské unie a na činnosti Konference výborů pro evropské záležitosti parlamentů Evropské unie (COSAC).

2. Vypracování výroční zprávy.

3. Přístup komisařů a úředníků k žádostem výborů VP o pomoc při jejich posouzení.

4. Zvýšená pozornost věnovaná VP, pokud jde o jejich informování a způsob spolupráce, s cílem zabránit tomu, že Komise bude vnímána jako orgán pokoušející se obcházet či nerespektovat VP a občany.

5. Vydávání informačního zpravodaje.

6. Zachování těsných vztahů mezi kabinetem místopředsedkyně a útvary a sítí styčných úředníků (liaison officers) ve VP.

7. Úloha Komise jakožto prostředníka v rámci sítě IPEX[2] (výměna informací mezi parlamenty EU).

8. Zprostředkující úloha při uplatňování hlavních zásad spolupráce mezi vnitrostátními parlamenty, která byla definována na konferenci předsedů parlamentů v Haagu v červenci 2004.

9. Informační schůzky stálých zástupců VP týkající se zvláštních otázek.

10. Generální sekretariát Komise určí útvar nebo kontaktní osobu s cílem koordinovat žádosti přicházející od kanceláří vnitrostátních parlamentů.

3. P LNěNÍ CÍLů

3.1. NÁVšTěVY VE VNITROSTÁTNÍCH PARLAMENTECH

Margot Wallstromövá se rozhodla navštívit během tohoto volebního období všechny vnitrostátní parlamenty: v roce 2005 navštívila dánský a švédský parlament, španělský kongres, irský, nizozemský, lotyšský (Saeimas), německý a belgický parlament.

Margot Wallströmová se dále zúčastnila zasedání předsedů delegací COSAC, která se konala dne 9. února 2005 v Lucemburku a dne 18. července 2005 v Londýně (viz také pilotní projekt v bodě 4).

Zúčastnila se též konference předsedů parlamentů EU v Budapešti, pořádané dne 6. května 2005.

Rovněž je třeba poznamenat, že v tomto roce navštívili komisaři vnitrostátní parlamenty více než šedesátkrát.

3.2. Vypracování výroční zprávy

Uvedený cíl splňuje tato výroční zpráva.

3.3. Přístup komisařů a úředníků k žádostem parlamentních výborů vnitrostátních parlamentů

Komisaři kladně reagovali na žádosti národních shromáždění, zejména jejich parlamentních výborů, přičemž došlo k přibližně 100 kontaktům nebo návštěvám ve vnitrostátních parlamentech.

Na žádost vnitrostátních parlamentů se úředníci Komise zúčastnili různých druhů zasedání: parlamentních výborů VP (9), stálých zastoupení VP (14) a jednoho zasedání COSAC.

Členové Komise dále dne 9. prosince 2004 požádali, aby každé generální ředitelství jmenovalo úředníka, jenž bude zvláště pověřen sledováním záležitostí VP a otevřeným odpovídáním na žádosti VP.

3.4. Větší pozornost věnovaná VP při výkonu jejich institucionálních pravomocí

V průběhu celého roku byly udržovány vztahy jak se stálými zástupci VP, tak se styčnými úředníky. Zde je třeba zdůraznit dvě zásadní otázky:

Pro VP a zejména pro ty, které provádějí předběžná parlamentní posouzení, je důležité mít přístup k dokumentům Komise včas a ve všech jazycích. Týká se to obecně všech dokumentů Komise, obzvláště však programových dokumentů: roční politické strategie a legislativního a pracovního programu. Vzhledem k velkému vytížení překladatelských oddělení mohla Komise vyhovět těmto žádostem pouze částečně. Je třeba vzít v úvahu, že zavádění protokolů týkajících se vnitrostátních parlamentů a subsidiarity připojených k Ústavě by bylo z tohoto hlediska zvlášť obtížné.

Pokud jde o plánování práce Komise, předložili styční úředníci žádost o systematický přístup k pořadům jednání Komise (časový plán zasedání a body pořadu jednání). Odpověď na tuto žádost byla pragmatická.

3.5. Vydávání informačního zpravodaje

Byly vydány tři informační zpravodaje, které byly rozšířeny interně a rovněž v Evropském parlamentu a ve vnitrostátních parlamentech: 28. února, 12. května a 4. října 2005 (viz přílohy).

3.6. Styční úředníci

Dne 18. dubna 2005 se Margot Wallströmová zúčastnila výročního zasedání styčných úředníků vnitrostátních parlamentů členských států a Evropského parlamentu v Bruselu.

Všechna národní shromáždění byla informována dopisem ze dne 24. května 2005, že pan Godts (generální sekretariát Komise) byl jmenován styčným úředníkem pověřeným vztahy s vnitrostátními parlamenty.

3.7. IPEX

Margot Wallströmová pozitivně reagovala jménem Komise na žádost o spolupráci, kterou dne 21. ledna 2005 předložil pan Forsberg, generální tajemník švédského parlamentu (RIKSDAG), pokud jde o spolupráci s IPEX.

Skupina Komise pro vztahy mezi orgány předběžně posoudila tuto žádost a dospěla k závěru, že by se mohlo uvažovat o aktivní účasti útvarů Komise na technické práci sítě IPEX s cílem případného elektronického zasílání dokumentů uvedených v protokolech připojených k Ústavě.

Útvary Komise se zúčastnily čtyř zasedání IPEXu na technické úrovni a pomáhaly při testování elektronického zasílání dokumentů.

3.8. Konference předsedů parlamentů Evropské unie

Margot Wallströmová se zúčastnila konference předsedů parlamentů EU, která se uskutečnila dne 6. května 2005.

Pokud jde o uplatňování hlavních směrů spolupráce mezi parlamenty, jak byla definována v Haagu v červenci 2004, viz zejména body vztahující se ke COSAC a IPEX.

3.9. Stálí zástupci

Komise se zúčastnila 14 zasedání stálých zástupců vnitrostátních parlamentů v Bruselu (viz přílohy). Rovněž je třeba upozornit na účast Komise na třech zasedáních, která se uskutečnila v roce 2004.

3.10. Kontaktní osoba

Jak je uvedeno výše, pan Godts byl jmenován styčným úředníkem pro vnitrostátní parlamenty.

4. PILOTNÍ PROJEKT TÝKAJÍCÍ SE ZÁSADY SUBSIDIARITY

Na Konferenci výborů pro evropské záležitosti parlamentů EU (COSAC) dne 23. listopadu 2004 v Haagu bylo rozhodnuto, že bude zahájen pilotní projekt týkající se posuzování subsidiarity podle protokolu o subsidiaritě připojeném k Ústavě. COSAC si přála, aby se toto posouzení týkalo „třetího železničního balíčku“. Pravidla pro tento projekt byla aktualizována dne 9. února 2005 v Lucemburku.

Ve snaze nepředbíhat Ústavu si Komise nepřála, aby její návrhy byly přímo zasílány národním shromážděním. Svoji snahu a dobrou spolupráci však projevila tím, že tyto texty přeposlala sekretariátu COSAC.

5. Ú čAST NA ZASEDÁNÍCH ORGANIZOVANÝCH EVROPSKÝM PARLAMENTEM

KOMISE POZITIVNě REAGOVALA NA čETNÉ žÁDOSTI O ÚčAST NA ZASEDÁNÍCH S VNITROSTÁTNÍMI PARLAMENTY, KTERÁ ORGANIZOVAL EP JAK NA ÚROVNI SVÝCH VÝBORů, TAK AD HOC.

Různých zasedání se mimo jiné zúčastnili:

- předseda José Manuel Barroso a místopředseda Günter Verheugen byli přítomni na zasedání o lisabonské strategii, které se konalo ve dnech 16. a 17. března 2005;

- Dalia Grybauskaitė se zúčastnila zasedání ohledně budoucího víceletého finančního rámce EU, které se konalo 4. a 5. dubna 2005;

- Joaquín Almunia se zúčastnil zasedání o hlavních směrech evropské hospodářské politiky, které se konalo 25. dubna 2005.

Rovněž je třeba uvést pravidelná zasedání výboru pro občanské svobody, spravedlnost a vnitřní věci s vnitrostátními parlamenty, kterých se účastnil místopředseda Franco Frattini.

6. CÍLE PRO ROK 2006

V roce 2006 budou zachovány obecné i konkrétní cíle z února 2005 a současně se budou zkoumat způsoby realizace těch, které nebyly zcela splněny (návštěvy, stanovení požadavků ohledně druhů informací a způsobů spolupráce, elektronická výměna informací, systematická politická účast na zasedáních COSAC), a to zejména s ohledem na zvláštní povinnosti Komise v období pro úvahu.

Zvláštní pozornost bude věnována dobré interinstitucionální spolupráci, která se projevila již v roce 2005, obzvláště s Evropským parlamentem, který je hlavním partnerem Komise.

Komise v úzké spolupráci s Evropským parlamentem a vnitrostátními parlamenty posoudí prostředky pro zajištění řádného informování o roční politické strategii, ročním pracovním programu a ročním legislativním programu. Bude také brát na vědomí příspěvky vnitrostátních parlamentů v předlegislativní fázi iniciativ na základě platných smluv.

Komise bude pokračovat ve svém úsilí a zlepší vnitřní koordinaci v oblasti návštěv vnitrostátních parlamentů (a návštěv z těchto parlamentů) a meziparlamentních setkání a více zviditelní pokrok dosažený v této oblasti.

Komise se bude zabývat možnostmi, jak aktivněji využívat svých zastoupení jako styčného místa pro vnitrostátní parlamenty.

LIAISON OFFICERS

Vice-President WALLSTRÖM presented the new Commission’s approach to the National Parliaments. (NPs). It focused on active networking and continuous and open dialogue. Vice-President WALLSTRÖM listed a series of goals/actions already kicked off by the Commission. She answered the questions concerning i.a. the subsidiarity check after the possible entry into force of the Constitutional Treaty and the scenarios in case of non-ratification. |
