PROVÁDĚCÍ ROZHODNUTÍ KOMISE (EU) 2026/923
ze dne 24. dubna 2026,
kterým se mění prováděcí rozhodnutí (EU) 2026/582 o některých mimořádných opatřeních v souvislosti se slintavkou a kulhavkou na Kypru

EVROPSKÁ KOMISE,
s ohledem na Smlouvu o fungování Evropské unie,
s ohledem na nařízení Evropského parlamentu a Rady (EU) 2016/429 ze dne 9. března 2016 o nákazách zvířat a o změně a zrušení některých aktů v oblasti zdraví zvířat („právní rámec pro zdraví zvířat“) (1), a zejména na čl. 259 odst. 1 uvedeného nařízení,
vzhledem k těmto důvodům:

Slintavka a kulhavka je infekční virová nákaza postihující savce řádů sudokopytníci a chobotnatci a může mít závažný dopad na dotčenou populaci zvířat a ziskovost chovu, což narušuje přemísťování zásilek uvedených zvířat a produktů z těchto zvířat v rámci Unie, jakož i vývoz do třetích zemí. V případě ohniska slintavky a kulhavky u zvířat existuje vážné riziko šíření uvedené nákazy do jiných zařízení chovajících zvířata druhů uvedených na seznamu, která jsou uvedena v příloze prováděcího nařízení Komise (EU) 2018/1882 (2) (dále jen „druhy uvedené na seznamu“). |

Nařízením Komise v přenesené pravomoci (EU) 2020/687 (3) se doplňují pravidla pro tlumení nákaz uvedených na seznamu podle čl. 9 odst. 1 písm. a), b) a c) nařízení (EU) 2016/429 a klasifikovaných jako nákazy kategorie A, B a C v prováděcím nařízení (EU) 2018/1882. Články 21 a 22 nařízení v přenesené pravomoci (EU) 2020/687 konkrétně stanoví vytvoření uzavřeného pásma v případě ohniska nákazy kategorie A, včetně slintavky a kulhavky, a některá opatření, jež se v tomto pásmu mají provádět. V čl. 21 odst. 1 uvedeného nařízení v přenesené pravomoci se dále stanoví, že uzavřené pásmo zahrnuje ochranné pásmo a pásmo dozoru a v případě potřeby další uzavřená pásma kolem ochranných pásem a pásem dozoru nebo v jejich blízkosti. |

Prováděcí rozhodnutí Komise (EU) 2026/582 (4) bylo přijato na základě nařízení (EU) 2016/429 a stanoví některá mimořádná opatření v souvislosti s ohnisky slintavky a kulhavky v zařízeních chovajících skot v okresech Larnaka a Nikósie na Kypru. Prováděcí rozhodnutí (EU) 2026/582 konkrétně stanoví, že Kypr musí vymezit uzavřená pásma zahrnující ochranná pásma a pásma dozoru, jakož i další uzavřené pásmo v souladu s článkem 21 nařízení v přenesené pravomoci (EU) 2020/687, kde se opatření, která musí být uplatňována v ochranných pásmech a pásmech dozoru, uplatňují alespoň do dat uvedených v příloze zmíněného prováděcího rozhodnutí, a že ochranná pásma a pásma dozoru, jakož i další uzavřené pásmo musí zahrnovat alespoň oblasti uvedené ve zmíněné příloze. Prováděcí rozhodnutí (EU) 2026/582 bylo změněno prováděcím rozhodnutím Komise (EU) 2026/782 (5). |

Od přijetí prováděcího rozhodnutí (EU) 2026/782 byla na základě informací poskytnutých Kyprem přezkoumána mimořádná opatření, která mají být uplatňována v ochranných pásmech a pásmech dozoru a v dalším uzavřeném pásmu uvedených v příloze zmíněného rozhodnutí, a harmonogram jejich uplatňování, zejména pokud jde o data předběžného čištění a dezinfekce postižených zařízení, které musí být provedeny v souladu s nařízením v přenesené pravomoci (EU) 2020/687. V důsledku toho musí být doba trvání mimořádných opatření v uvedených ochranných pásmech a pásmech dozoru přezkoumána. |

Od přijetí prováděcího rozhodnutí (EU) 2026/782 se navíc objevila další ohniska slintavky a kulhavky v zařízeních v okresech Larnaka a Nikósie na Kypru, a to i mimo oblasti uvedené v současnosti jako ochranná pásma a pásma dozoru v příloze prováděcího rozhodnutí (EU) 2026/582. |

Vzhledem k současné epizootologické situaci, pokud jde o slintavku a kulhavku na Kypru, a s cílem zabránit dalšímu šíření uvedené nákazy v daném členském státě, do jiných členských států či do třetích zemí je proto nezbytné urychleně přezkoumat stávající oblasti uvedené jako ochranná pásma, pásma dozoru a další uzavřená pásma na seznamu v příloze prováděcího rozhodnutí (EU) 2026/582, aby byla v případě nutnosti jak prostorově, tak časově upravena, a rovněž vymezit nová ochranná pásma a pásma dozoru s ohledem na nejnovější ohniska na Kypru. To je rovněž nezbytné, aby se předešlo jakémukoli zbytečnému narušení obchodu uvnitř Unie a kladení neopodstatněných překážek obchodu ze strany třetích zemí. |

Prováděcí rozhodnutí (EU) 2026/582 by proto mělo být odpovídajícím způsobem změněno. |

Opatření stanovená tímto rozhodnutím jsou v souladu se stanoviskem Stálého výboru pro rostliny, zvířata, potraviny a krmiva, |
PŘIJALA TOTO ROZHODNUTÍ:
Článek 1
Příloha prováděcího rozhodnutí (EU) 2026/582 se nahrazuje zněním uvedeným v příloze tohoto rozhodnutí.
Článek 2
Toto rozhodnutí je určeno Kyperské republice.
