PROVÁDĚCÍ ROZHODNUTÍ KOMISE (EU) 2025/180
ze dne 24. ledna 2025,
kterým se mění prováděcí rozhodnutí (EU) 2024/2207 o některých mimořádných opatřeních v souvislosti s neštovicemi ovcí a neštovicemi koz v Řecku

EVROPSKÁ KOMISE,
s ohledem na Smlouvu o fungování Evropské unie,
s ohledem na nařízení Evropského parlamentu a Rady (EU) 2016/429 ze dne 9. března 2016 o nákazách zvířat a o změně a zrušení některých aktů v oblasti zdraví zvířat („právní rámec pro zdraví zvířat“) (1), a zejména na čl. 259 odst. 1 uvedeného nařízení,
vzhledem k těmto důvodům:

Neštovice ovcí a neštovice koz jsou infekční virová nákaza postihující kozy a ovce a mohou mít závažný dopad na dotčenou populaci zvířat a ziskovost chovu, což narušuje přemísťování zásilek uvedených zvířat a produktů z těchto zvířat v rámci Unie, jakož i vývoz do třetích zemí. |

V případě ohniska neštovic ovcí a neštovic koz u koz nebo ovcí hrozí vážné riziko, že se daná nákaza rozšíří do dalších zařízení pro kozy nebo ovce. |

Nařízením Komise v přenesené pravomoci (EU) 2020/687 (2) se doplňují pravidla pro tlumení nákaz uvedených na seznamu podle čl. 9 odst. 1 písm. a), b) a c) nařízení (EU) 2016/429 a klasifikovaných jako nákazy kategorie A, B a C v prováděcím nařízení Komise (EU) 2018/1882 (3). Články 21 a 22 nařízení v přenesené pravomoci (EU) 2020/687 konkrétně stanoví vytvoření uzavřeného pásma v případě ohniska nákazy kategorie A, včetně neštovic ovcí a neštovic koz, a některá opatření, jež se v tomto pásmu mají provádět. V čl. 21 odst. 1 uvedeného nařízení v přenesené pravomoci se stanoví, že uzavřené pásmo zahrnuje ochranné pásmo, pásmo dozoru a v případě potřeby další uzavřená pásma kolem ochranných pásem a pásem dozoru nebo v jejich blízkosti. |

S cílem řešit ohniska neštovic ovcí a neštovic koz v Řecku přijala Komise prováděcí rozhodnutí (EU) 2024/2207 (4) na základě článku 259 nařízení (EU) 2016/429. Toto rozhodnutí stanoví některá mimořádná opatření v souvislosti s neštovicemi ovcí a neštovicemi koz v Řecku. Prováděcí rozhodnutí (EU) 2024/2207 konkrétně stanoví, že ochranná pásma, pásma dozoru a další uzavřená pásma, jež uvedený členský stát vytvoří v souladu s nařízením v přenesené pravomoci (EU) 2020/687 v návaznosti na ohniska uvedené nákazy, mají zahrnovat alespoň oblasti uvedené v příloze zmíněného prováděcího rozhodnutí. |

Po přijetí prováděcího rozhodnutí (EU) 2024/2207 oznámilo Řecko Komisi další ohniska neštovic ovcí a neštovic koz v zařízeních s chovem ovcí a koz. V důsledku toho byla příloha uvedeného prováděcího rozhodnutí několikrát řádně změněna tak, aby zohledňovala uvedená další ohniska. |

Od poslední změny prováděcího rozhodnutí (EU) 2024/2207 oznámilo Řecko Komisi 19 nových ohnisek neštovic ovcí a neštovic koz v zařízeních s chovem ovcí a koz v regionálních jednotkách Evros, Magnesia, Rodopi, Xanthi, Aitólie-Akarnánie, Iraklio a Fókis. |

Oblasti uvedené jako ochranná pásma, pásma dozoru a další uzavřená pásma pro Řecko v příloze prováděcího rozhodnutí (EU) 2024/2207 by proto měly být dále upraveny, aby se zabránilo dalšímu šíření nákazy v Řecku a ve zbytku Unie nebo do třetích zemí, a měla by být upravena doba trvání opatření, jež se v nich mají uplatňovat. Seznam uzavřených pásem a dobu trvání opatření, jež se v nich mají uplatňovat, stanovené v příloze uvedeného prováděcího rozhodnutí je proto nezbytné změnit. |

Velikost ochranných pásem, pásem dozoru a dalších uzavřených pásem a doba trvání opatření, která se v nich mají použít, jsou založeny na kritériích stanovených v čl. 64 odst. 1 nařízení (EU) 2016/429 a pravidlech stanovených v nařízení v přenesené pravomoci (EU) 2020/687, včetně epizootologické situace, pokud jde o neštovice ovcí a neštovice koz v oblastech postižených uvedenou nákazou, a celkové epizootologické situace, pokud jde o neštovice ovcí a neštovice koz v členském státě dotčeném uvedenou nákazou, jakož i míry rizika dalšího šíření uvedené nákazy. Doba trvání opatření rovněž zohledňuje mezinárodní normy Kodexu zdraví suchozemských živočichů Světové organizace pro zdraví zvířat (WOAH). V současné situaci existuje velmi vysoké riziko dalšího šíření nákazy, zejména z toho důvodu, že podle informací poskytnutých příslušným orgánem je to poprvé, co jsou hlášena ohniska na ostrově Samothraki, v regionální jednotce Evros a v regionální jednotce Iraklio na ostrově Kréta, což naznačuje, že nákaza nadále přetrvává a šíří se, a to navzdory již zavedeným opatřením. |

Navíc s ohledem na výskyt četných nových ohnisek neštovic ovcí a neštovic koz v Řecku během posledních dvou týdnů je rovněž nezbytné prodloužit zákaz přemísťování ovcí a koz z celého území Řecka do místa určení nacházejícího se mimo Řecko, a to do 15. února 2025, aby se zabránilo šíření této nákazy do zbytku Unie a do třetích zemí a rovněž neopodstatněným překážkám obchodu. |

S ohledem na stávající epizootologickou situaci v Unii, pokud jde o neštovice ovcí a neštovice koz, by doba, během níž se musí uplatňovat opatření stanovená prováděcím rozhodnutím (EU) 2024/2207, měla být prodloužena do 31. července 2025. |

Opatření stanovená tímto rozhodnutím jsou v souladu se stanoviskem Stálého výboru pro rostliny, zvířata, potraviny a krmiva, |

Prováděcí rozhodnutí (EU) 2024/2207 se mění takto:
