РЕШЕНИЕ ЗА ИЗПЪЛНЕНИЕ (ЕС) 2026/1330 НА КОМИСИЯТА

за изменение на Решение за изпълнение (ЕС) 2026/820 относно определени спешни мерки във връзка със случаите на шап в Гърция

ЕВРОПЕЙСКАТА КОМИСИЯ,

като взе предвид Договора за функционирането на Европейския съюз,

като взе предвид Регламент (ЕС) 2016/429 на Европейския парламент и на Съвета от 9 март 2016 г. за заразните болести по животните и за изменение и отмяна на определени актове в областта на здравеопазването на животните (Законодателство за здравеопазването на животните) (1), и по-специално член 259, параграф 1 от него,

като има предвид, че:

Шапът е инфекциозна вирусна болест, засягаща бозайниците от разред „Чифтокопитни“ и разред „Хоботни“, която може да окаже сериозно въздействие върху съответната популация от животни и върху рентабилността на животновъдството и да причини смущения в движението на пратки с тези животни и с продукти от тях в рамките на Съюза, както и в износа към трети държави. При поява на огнище на шап при животни съществува сериозен риск от разпространение на болестта в други животновъдни обекти, в които се отглеждат животни от видовете от списъка, определен в приложението към Регламент за изпълнение (ЕС) 2018/1882 на Комисията (2) („видовете от списъка“).

С Делегиран регламент (ЕС) 2020/687 на Комисията (3) се допълват правилата за контрол на болестите от списъка, посочени в член 9, параграф 1, букви а), б) и в) от Регламент (ЕС) 2016/429 и определени като болести от категории A, B и C в Регламент за изпълнение (ЕС) 2018/1882. По-специално в членове 21 и 22 от Делегиран регламент (ЕС) 2020/687 се предвиждат определянето на ограничителна зона при появата на огнище на болест от категория А, включително на шап, и прилагането на определени мерки в нея. Освен това в член 21, параграф 1 от посочения делегиран регламент се предвижда, че ограничителната зона включва защитна зона и надзорна зона и, ако е необходимо, допълнителни ограничителни зони около или в непосредствена близост до защитните и надзорните зони.

Решение за изпълнение (ЕС) 2026/820 на Комисията (4) беше прието на основание Регламент (ЕС) 2016/429 и в него се определят някои спешни мерки във връзка с огнищата на шап в животновъдни обекти, в които се отглеждат животни от видовете от списъка в регионалната единица Лесбос в Гърция. В Решение за изпълнение (ЕС) 2026/820 се предвижда по-специално, че в съответствие с член 21 от Делегиран регламент (ЕС) 2020/687 Гърция следва да определи ограничителни зони, които включват защитни и надзорни зони, както и допълнителна ограничителна зона, в които мерките, които се изисква да се прилагат в защитните и надзорните зони, както и в допълнителната ограничителна зона, се прилагат най-малко до датите, посочени в приложението към същото решение за изпълнение, а защитните и надзорните зони, както и допълнителната ограничителна зона, трябва да включват най-малко областите, изброени в същото приложение. Решение за изпълнение (ЕС) 2026/820 беше последно изменено с Решение за изпълнение (ЕС) 2026/1038 на Комисията (5).

След приемането на Решение за изпълнение (ЕС) 2026/1038 спешните мерки, които трябва да се прилагат в защитните и надзорните зони и допълнителната ограничителна зона, вписани в приложението към него, както и сроковете за тяхното прилагане, бяха преразгледани въз основа на предоставената от Гърция информация, по-специално по отношение на датите на извършване на предварителното почистване и дезинфекция на засегнатите животновъдни обекти, изисквани съгласно Делегиран регламент (ЕС) 2020/687. Следователно срокът на прилагане на спешните мерки в посочените защитни и надзорни зони следва да бъде адаптиран.

(5)	Освен това след приемането на Решение за изпълнение (ЕС) 2026/1038 възникнаха нови огнища на шап в животновъдни обекти в регионална единица Лесбос в Гърция, както в областите, вече вписани като защитни и надзорни зони в приложението към Решение за изпълнение (ЕС) 2026/820, така и извън тях.

Съответно, предвид настоящата епизоотична обстановка по отношение на болестта шап в Гърция и с цел да се предотврати по-нататъшното разпространение на болестта в посочената държава членка, в други държави членки или в трети държави, е необходимо спешно да бъдат актуализирани областите, вписани като защитни, надзорни или допълнителни ограничителни зони в приложението към Решение за изпълнение (ЕС) 2026/820, така че те да бъдат адаптирани, по целесъобразност, както в пространствен, така и във времеви аспект, а също така и да се определят нови защитни и надзорни зони, като се вземат предвид новите огнища в Гърция. Това е необходимо и за да се предотвратят ненужни затруднения за търговията в рамките на Съюза и да се избегне налагането на необосновани пречки пред търговията от страна на трети държави.

(7)	Поради това приложението към Решение за изпълнение (ЕС) 2026/820 следва да бъде съответно изменено.

(8)	Мерките, предвидени в настоящото решение, са в съответствие със становището на Постоянния комитет по растенията, животните, храните и фуражите,

ПРИЕ НАСТОЯЩОТО РЕШЕНИЕ:

Член 1

Приложението към Решение за изпълнение (ЕС) 2026/820 се заменя с текста на приложението към настоящото решение.

Член 2

Адресат на настоящото решение е Република Гърция.
