Годишен доклад за напредъка относно изпълнението на Стратегията на Европейския съюз срещу разпространението на оръжия за масово унищожение (2019 г.)

ВЪВЕДЕНИЕ

Настоящият доклад за напредъка относно изпълнението на Стратегията на Европейския съюз срещу разпространението на оръжия за масово унищожение (ОМУ), приета от Европейския съвет през декември 2003 г. (док. 15708/03), обхваща дейностите, извършени през 2019 г. Докладът не е всеобхватен, а се спира само на основните събития. Всички дейности се осъществяваха в по-широкия контекст на политиката на ЕС за сигурност и предотвратяването на конфликти. |

През 2019 г. работна група „Неразпространение“ на Съвета на ЕС проведе 11 заседания, включително на равнище директори, за обсъждане на позициите на ЕС и бъдещите дейности. Делегациите на ЕС във Виена, Женева и Ню Йорк изготвяха и координираха редица изявления на ЕС за многостранните форуми и допринасяха активно за разработването на политики чрез редовни координационни срещи на равнище ЕС. |
ВЪПРОСИ ОТ ЯДРЕНАТА ОБЛАСТ

ЕС остава изцяло ангажиран с утвърждаването на универсалното приемане и пълното, цялостно и ефективно прилагане на Договора за неразпространение на ядреното оръжие (ДНЯО), за влизането в сила на Договора за всеобхватна забрана на ядрените опити (ДВЗЯО) и за започването и бързото приключване на преговорите, в рамките на Конференцията за разоръжаване, по договор за забрана на производството на разпадащи се материали за ядрени оръжия или на други ядрени взривни устройства. Създаването в Близкия изток на зона, свободна от оръжия за масово унищожение и системи за тяхната доставка, също продължава да бъде приоритет за ЕС. През 2019 г. Съветът прие Решение (ОВППС) 2019/938 (1), по силата на което да бъдат предоставени 2 856 278 EUR на UNIDIR в подкрепа на процес от мерки за изграждане на доверие, който да доведе до създаването в Близкия изток на зона, свободна от ядрени оръжия и всякакви други оръжия за масово унищожение. |

Цикълът на преразглеждане на ДНЯО продължи с третата сесия на Подготвителния комитет за Конференцията за преглед през 2020 г. на страните по ДНЯО, която се състоя в Ню Йорк от 27 април до 10 май 2019 г. ЕС направи четири изявления: едно по общия дебат и три изявления съответно по дебатите за ядреното разоръжаване, неразпространението и използването за мирни цели; беше направено и специално изявление в подкрепа на създаването на зона, свободна от ОМУ, в Близкия изток. Освен това ЕС организира съпътстваща проява и представи работен документ относно своята оценка на Договора петдесет години след неговото приемане. Всички държави — членки на ЕС, подкрепиха изявлението относно ядрените провокации на Северна Корея. ЕС допринесе за всички съответни дебати, включително за тематичния дебат относно ядрените оръжия, по време на 74-ата сесия на Първи комитет на Общото събрание на ООН по въпросите на разоръжаването и международната сигурност. |

Освен това на 15 април 2019 г. Съветът прие безпрецедентно Решение (ОВППС) 2019/615 (2), насочено към оказването на финансова подкрепа за организирането от Службата на ООН по въпросите на разоръжаването на тематични и регионални консултации за подготовка на Конференцията за преглед на страните по ДНЯО през 2020 г. Основната цел на решението на Съвета е да спомогне за улесняване на успешния резултат от Конференцията за преразглеждане на ДНЯО и за разработването на реалистичен и изпълним набор от действия и препоръки, по които може да бъде постигнат консенсус. Съгласно това решение на Съвета през 2019 г. UNODA организира два регионални семинара: в Адис Абеба на 29 и 30 август и в Банкок на 3 и 4 декември, както и тематичен семинар относно използването на ядрената енергия за мирни цели във Виена на 20 и 21 ноември. Регионалните заседания обхванаха и трите стълба на ДНЯО, разгледани през призмата на регионалните приоритети и опасения. Всички дейности ще имат за цел да подчертаят многобройните ползи, които вече са предоставени от ДНЯО, и необходимостта от тяхното запазване. |

ЕС продължи да подкрепя основните отговорности на МААЕ по отношение на неразпространението, ядрената енергетика, ядрената безопасност, ядрената сигурност и техническото сътрудничество. |

С Решение (ОВППС) 2016/2383 на Съвета (3) ЕС допринася за изпълнението на Плана за ядрена сигурност на МААЕ за периода 2018—2021 г. Продължи финансирането от ЕС в подкрепа на дейностите на МААЕ, насочени към: всеобщото приемане на международните инструменти за неразпространение и ядрена сигурност; помощта за държавите в изграждането на местен технически, научен и човешки капацитет във връзка с ядрената сигурност; укрепване на капацитета за предотвратяване, откриване и реагиране и за защита на хората, имуществото, околната среда и обществото от престъпни действия или умишлени непозволени действия, свързани с ядрени или други радиоактивни материали, необхванати от нормативен контрол; укрепване на разкриването и реагирането на незаконния трафик на ядрени и други радиоактивни материали; принос за компютърната сигурност в ядрената област; укрепване на сигурността на радиоактивните източници, изпращането им в безопасно и сигурно хранилище в държавите, които се нуждаят от подпомагане, включително връщането им в държавата по произход или на доставчика; засилване на физическата защита на ядрени и други радиоактивни материали. |

МААЕ продължи успешно да прилага Решение (ОВППС) 2016/2001 на Съвета (4) от 15 ноември 2016 г. относно приноса на ЕС за създаването и сигурното управление на банка за нискообогатен уран под контрола на Международната агенция за атомна енергия (МААЕ) в рамките на Стратегията на ЕС срещу разпространението на оръжия за масово унищожение. |

През 2019 г. Съвместният изследователски център (JRC) на Европейската комисия финализира подкрепата си за базата данни на МААЕ за инциденти и незаконен трафик. |

В рамките на 5-ата среща на висшите служители от ЕС и МААЕ (15 февруари 2017 г.) Съвместният изследователски център и МААЕ подписаха „Практически договорености за сътрудничество относно приложенията в ядрената наука“, насочени към разработването на съвместни дейности и избягването на дублирането на усилия. Една от дейностите, включени в тези практически договорености, е наблюдението на околната среда за радиоактивност, измервана в Европа и в редица други места по света под формата на средни дози и максимални стойности на гама облъчване за последните 24 часа. Данните от тези измервания се вземат от около 5 500 места за наблюдение, под ръководството на компетентните национални органи в 39 държави, които докладват актуалните радиологични стойности на Европейската платформа за обмен на радиологични данни (EURDEP). Нотификацията за радиологичен инцидент или извънредна ситуация става посредством мрежи за ранно нотифициране като ECURIE или EMERCON, управлявани съответно от Европейската комисия и от МААЕ, след консултация с компетентните национални органи. |

Съвместният всеобхватен план за действие (СВПД) е ключов елемент от глобалната структура за неразпространение на ядреното оръжие и постижение на многостранната дипломация. Продължаващото пълно и ефективно изпълнение на споразумението е от съществено значение за европейската сигурност. ЕС продължава да допринася за изпълнението на СВПД чрез координиране на съвместната комисия и редица експертни работни групи, сформирани по силата на СВПД. Освен това ЕС продължава да подкрепя изцяло дългосрочната мисия на МААЕ за проверка и наблюдение на ангажиментите на Иран в ядрената област. От 2016 г. ЕС е ангажиран с изпълнението на приложение III от СВПД, по-специално чрез проекти за подобряване на ядрената безопасност. Вече са заделени 15 милиона евро за сътрудничеството с Иран в ядрената област за граждански цели и бяха договорени три проекта, подкрепящи както иранския Орган за ядрено регулиране, така и ядрената електроцентрала в Бушехр. През 2018 г. беше одобрен нов проект с бюджет от 5 милиона евро, който обхваща предоставянето на лабораторно оборудване за Центъра за ядрена безопасност на регулаторния орган. През 2020 г. се очаква договорът да бъде възложен за изпълнение. |

Сътрудничеството с Иран в ядрената област за граждански цели е основен стълб на СВПД и централен елемент от ангажимента на ЕС към Иран. То способства за по-доброто разбиране на ядрените нужди на Иран за граждански цели и води до постепенното изграждане на доверие в мирния характер на ядрената програма на страната. През 2019 г. сътрудничеството между ЕС и Иран включваше чест обмен на мнения на високо равнище по въпроси на политиката със специален акцент върху ядреното управление; съвместен семинар относно гражданската отговорност в областта на ядрената енергетика и застраховането; проекти, които подкрепят усилията на иранския орган за ядрено регулиране да постигне съответствие с международните стандарти в законодателната и регулаторната област, както и създаването на център за ядрена безопасност, разработен в рамките на предишен проект, финансиран от ЕС; участие на ирански студенти в лятното училище по извеждане от експлоатация и в семинар относно метрологията за характеризиране и освобождаване от отпадъци в рамките на Съвместния изследователски център на ЕС, съвместен семинар ЕС-Иран за докладване на Съвместната конвенция относно отработеното гориво и радиоактивните отпадъци, съвместен семинар ЕС-Иран относно готовността при извънредни ситуации и реагиране при радиационна или ядрена авария, както и проекти в подкрепа на модернизацията на изследователския реактор в Арак (Хондаб) и конверсията на съоръжението за обогатяване на уран край Фордоу в център за ядрени, физични и технологични изследвания. Иран продължи да бъде основен бенефициент на помощта на ЕС в областта на ядрената безопасност. |

Всеобхватните споразумения за гаранции, наред с допълнителните протоколи, съставляват настоящия стандарт за проверка и ЕС продължава да призовава за всеобщо присъединяване към тях. Тясното сътрудничество между Евратом и МААЕ дава възможност за ефективни и ефикасни гаранции. ЕС подкрепя активно системата за гаранции на МААЕ по линия на програмата на Европейската комисия за подпомагане на контрола на безопасността, инструмента за сътрудничество в областта на ядрената безопасност и програмите за подкрепа на държавите членки. Тази програма на ЕК засилва способностите на МААЕ за ядрени гаранции с оглед на проверката на изпълнението на СВПД и чрез предоставяне на обучение на инспекторите по гаранциите на МААЕ в областта на допълнителния достъп и експлоатирането на COMPUCEA (комбинираната процедура за изследване на концентрирането и обогатяването на уран) за проверка на обогатяването на UF6. |

Европейската комисия продължава да работи и активно да подкрепя Европейската асоциация за научноизследователска и развойна дейност в областта на гаранциите (ESARDA), която през 2019 г. отбеляза своя 50-годишен юбилей с открит симпозиум, привлякъл 250 участници от целия свят, които обсъдиха ядрените гаранции и въпросите, свързани с неразпространението, преди всичко от научна и техническа гледна точка. ESARDA продължава да е отворена и в международен план чрез своите меморандуми за разбирателство с Африканската комисия за ядрена енергия и Азиатската мрежа за предпазни мерки в Тихия океан и в тясно сътрудничество с Института за управление на ядрените материали. Работните групи на ESARDA разработват, изпитват и валидират иновационни гаранции и методи за неразпространение, които са от пряка полза за Дирекцията за ядрени гаранции на ГД „Енергетика“ и Отдел по гаранциите на Международната агенция за атомна енергия. Резултатите от научноизследователската и развойна дейност и инициативите в областта на образованието и обучението засилват европейските и международните способности в областта на ядрените гаранции, както и стратегическия контрол върху търговията, със съпътстващ ефект и за инициативите във връзка с ядрената сигурност и ядреното разоръжаване. |

ЕС и неговите държави членки отдават голямо значение на прилагането в световен мащаб и постоянното подобряване на ядрената безопасност. ЕС придаде правна сила на целите на Декларацията от Виена относно ядрената безопасност посредством изменената Директива за ядрената безопасност, която влезе в сила през 2017 г. Ключов елемент от изменената директива е въвеждането на цел за безопасност за всички оператори, за да се предотвратят инциденти и да се избегнат значителни изпускания на радиоактивни вещества. Освен това с изменената директива в правото на Евратом бяха въведени тематични партньорски проверки. Първата европейска тематична партньорска проверка вече премина с успех. Всички държави — членки на ЕС, са транспонирали новите изисквания в своето национално право. |

В подкрепа на използването на ядрената енергия за мирни цели ЕС отпусна 325 млн. евро за периода 2014—2020 г. с цел насърчаване на ядрената безопасност, радиационната защита и прилагането на ефикасни и ефективни гаранции в трети държави. Европейската комисия, в сътрудничество с МААЕ и други партньори, подкрепя изпълнението на стратегическия генерален план за възстановяване на околната среда в Централна Азия, който се финансира от специалната сметка за възстановяване на околната среда (ERA), управлявана от ЕБВР. Като основен донор, ЕС продължава да работи с държавите бенефициенти (Киргизстан, Таджикистан и Узбекистан) с цел насърчаване на ангажираността и започване на конкретни проекти за почистване и възстановяване. |

През юли 2019 г. новият защитен саркофаг, покриващ разрушения 4-ти реактор на атомната електроцентрала в Чернобил, беше официално предаден на Украйна на церемония с участието на президента Володимир Зеленски, с което приключи дългогодишното международно усилие за екологичното обезопасяване на този обект, което беше лансирано от Г-7. ЕС е най-големият донор на Фонда за изграждане на защитен саркофаг в Чернобил след Европейската банка за възстановяване и развитие, която управлява този фонд. |

ЕС и неговите държави членки продължават да поддържат твърдо програмата на МААЕ за техническо сътрудничество, включително чрез значителен принос за фонда за техническо сътрудничество и инициативата за мирно използване. ЕС и неговите държави членки са сред най-големите донори на програмата за техническо сътрудничество, която е важен инструмент за създаването на условия за безопасно и сигурно използване за мирни цели на ядрената технология и за постигане на целите, набелязани в Програмата до 2030 г. за устойчиво развитие. |

ЕС и МААЕ провеждат ежегодно среща на старши служители с цел преглед и планиране на тяхното широкообхватно сътрудничество. Последната среща беше организирана от МААЕ на 12 февруари 2019 г. в Люксембург. В обсъжданията беше поставен акцент върху укрепването на сътрудничеството в областта на ядрената безопасност, сигурността, гаранциите и научните изследвания, иновациите и обучението в ядрената област. |
Договор за всеобхватна забрана на ядрените опити (ДВЗЯО)

Влизането в сила и универсалният характер на ДВЗЯО са важни цели на Стратегията на ЕС срещу разпространението на оръжия за масово унищожение. Всички държави — членки на ЕС, засвидетелстваха своята ангажираност към Договора, като го ратифицираха и започнаха да прилагат основните задължения, предвидени в него. ДВЗЯО е стабилна мярка за изграждане на доверие и сигурност. През 2019 г. ЕС започна дипломатически контакти с всички останали страни от приложение II и извън него. Целта на тази дейност на ЕС беше да бъдат получени ангажименти за ратифицирането на ДВЗЯО. Насърчаването на влизането в сила на ДВЗЯО беше едно от действията по инициативата на генералния секретар на ООН „Сигурност за нашето общо бъдеще — Програма за разоръжаване“, която ЕС реши да подкрепи. |

ЕС насърчава последователно ползите и приноса на Договора за мира, сигурността, разоръжаването и неразпространението, включително в своите граждански приложения. ЕС продължи финансовата си подкрепа за Подготвителната комисия на Организацията на ОДВЗЯО, залегнала в Решение (ОВППС) 2018/298 на Съвета (5) относно подкрепата от страна на Съюза за дейностите на Подготвителната комисия на Организацията на ОДВЗЯО с оглед укрепване на капацитета ѝ за наблюдение и контрол. ЕС и неговите държави членки допринесоха и за поддържането и укрепването на контролния режим на ДВЗЯО посредством предоставянето на техническа подкрепа и експертни съвети в работна група Б на ОДВЗЯО и на други работни срещи и семинари. ЕС взе активно участие в заседанията на Подготвителната комисия на ОДВЗЯО и нейните работни групи А и Б. |

По покана на изпълнителния секретар на ОДВЗЯО, ВП/ЗП участва в единадесетата конференция „Улесняване на влизането в сила на ДВЗЯО“, състояла се в седалището на ООН в Ню Йорк на 25 септември 2019 г., на която тя представи съгласувано изявление на ЕС. На 25 юни, по време на научната и технологичната конференция по ДВЗЯО, Делегацията на ЕС във Виена организира проява относно сътрудничеството между ЕС и ОДВЗЯО. |
Инициативи, свързани с ядрената сигурност

ЕС продължи да утвърждава Международната конвенция за предотвратяването на актове на ядрен тероризъм (ICSANT) и изменението на Конвенцията за физическата защита на ядрения материал (ACPPNM) като основни елементи на глобалната структура за ядрена сигурност и борбата с тероризма. Службата на ООН по наркотиците и престъпността и Службата на ООН за борбата с тероризма започнаха да изпълняват Решение (ОВППС) 2018/1939 на Съвета (6) относно подкрепата на Съюза за всеобщото приемане и ефективното прилагане на ICSANT. С ршението на Съвета се цели да се увеличи броят на присъединилите се към ICSANT, да се повиши осведомеността сред националните политици и вземащите решения, както и изграждането на капацитет: да се способства за подобряване на националното законодателство и укрепването на капацитета на заинтересованите страни на национално равнище, включително на служителите, работещи в областта на наказателното правосъдие, които се занимават с разследване, наказателно преследване и постановяване на решения по дела във връзка с ядрен тероризъм. Изпълнението на решението на Съвета започна с проява за даването на неговия старт в Ню Йорк през април 2019 г. и във Виена през май 2019 г. |

ЕС продължи да подкрепя Глобалната инициатива за борба с ядрения тероризъм (ГИБЯТ) и нейната мисия за укрепване на общия капацитет за предотвратяване, откриване и реагиране на ядрения тероризъм. ЕС и неговите държави членки участваха в 11-ата пленарна сесия на ГИБЯТ, проведена в Буенос Айрес на 6 и 7 юни 2019 г. Към съгласуваната декларация на ЕС се присъединиха следните държави: Турция, Северна Македония, Черна гора, Сърбия и Албания, страната от процеса на стабилизиране и асоцииране и потенциална кандидатка Босна и Херцеговина, страните от ЕАСТ Исландия и Норвегия, членуващи в Европейското икономическо пространство, както и Украйна, Република Молдова, Армения и Грузия. |

ЕС и неговите държави членки активно участват в работата на ГИБЯТ във всички области: засичане на ядрени материали, ядрени експертизи и реагиране и ограничаване. Съвместният изследователски център на Европейската комисия беше домакин на проявата „Cunning Karl“: Работен семинар в помощ на дистанционната подкрепа за засичането на ядрени материали, 12—14 февруари 2019 г., Карлсруе, Германия, под егидата на Работната група на ГИБЯТ за засичане на ядрени материали. Въз основа на резултатите на Работния технически уъркшоп за дистанционна подкрепа „Magic Maggiore“, горепосоченият семинар се съсредоточи върху определянето на основните способности, свързани с техническата дистанционна подкрепа за операциите по засичане, и разгледа предизвикателствата и добрите практики за осигуряване на дистанционна подкрепа за отдалечените райони. На 24 и 25 февруари 2019 г. Финландия беше домакин на срещата на експертната група по ядрена криминалистика (NFWG), на която беше обсъден работният план на NFWG за периода 2019—2021 г. Освен това ЕС даде принос по темата за засичането на ядрени материали на семинара и симулационното учение „Сини и зелени граници“, Кралство Мароко, декември 2019 г. |

Центърът на ЕС за обучение по ядрена сигурност, който има за цел разкриването и реагирането на незаконни действия с ядрени и други радиоактивни материали (EUSECTRA), работи пълноценно от 2013 г. в полза на държавите — членки на Европейския съюз, и държавите партньори, сред които няколко членове на ГИБЯТ. Центърът се управлява от Съвместния изследователски център на ЕО в неговите обекти в Карлсруе (Германия) и Испра (Италия), в тясно сътрудничество с други международни инициативи, популяризирани от Международната агенция за атомна енергия, и няколко страни — партньори на ГИБЯТ. Центърът се използва и за практически упражнения, свързани най-вече с противодействието на контрабандата на ядрени материали. EUSECTRA работи за посрещане на нуждите от обучение на държавите — членки на ЕС, и партньорите на ЕС, включително като предоставя ползващи се с голямо одобрение координирани обучения за делегати на държавите членки в областта на митниците и правоприлагането, които вече са изпълнени и планирани за 2019—2021 г. (в пряко сътрудничество с ГД HOME и ГД TAXUD на ЕК) и изготвя оценка на действието на оборудването по искане на държавите — членки на ЕС. През 2019 г. бяха организирани 14 едноседмични обучения и два допълнителни семинара с участието на експерти от държавите — членки на ЕС. |

Европейската комисия и държавите — членки на ЕС, продължиха дейностите си по ядрена криминалистика с цел базово характеризиране на заловените ядрени материали с помощта на усъвършенстваните ядренокриминалистични разследвания на площадката на СИЦ в Карлсруе (Германия). През 2019 г. бяха анализирани проби от три инцидента в две държави — членки на ЕС. Бяха анализирани ядрени материали, открити и иззети при повече от 50 инцидента, като по този начин беше оказана помощ на компетентните органи на държавите — членки на ЕС, и на държави извън Съюза. |
Инициативи, свързани с ядрената проверка

ЕС и неговите държави членки подкрепиха резолюцията на Общото събрание на ООН от 2019 г. за проверката на ядреното разоръжаване относно създаването на втората група правителствени експерти, която да продължи да разглежда ролята на проверката за постигане на напредък в областта на ядреното разоръжаване. ЕС подкрепя работата на по-широки партньорства и договорености за проверка в сътрудничество и участва в работата на Международното партньорство за проверка на ядрено разоръжаване от неговото създаване през 2015 г. Активното участие на ЕС продължи и през Фаза II на Международното партньорство за проверка на ядрено разоръжаване, като ЕС (ЕСВД и Съвместният изследователски център на Европейската комисия) взе участие в заседанията на работните групи в Хелзинки от 4 до 6 март 2019 г. и в Хага от 19 до 21 юни, както и в пленарното заседание в Отава от 2 до 6 декември. Като основни цели са определени значителната подкрепа за групата от правителствени експерти към ООН за проверка на ядреното разоръжаване и за Конференцията за преглед на Договора за неразпространение на ядреното оръжие през 2020 г. Освен това ЕС стана поддръжник на точката за действие, свързана с проверката на ядреното разоръжаване в рамките на инициативата на генералния секретар на ООН „Сигурност за нашето общо бъдеще — Програма за разоръжаване“. |
Регионални въпроси

ЕС и неговите държави членки продължиха да приканват настойчиво КНДР да демонстрира напредък за пълен, проверим и необратим отказ от своите програми в областта на ОМУ и балистичните ракети. Това беше отразено във всички съответни изявления на ЕС. Позицията на ЕС продължава да е, че многократното изстрелване на балистични ракети от Корейската народнодемократична република (КНДР) в нарушение на многобройните резолюции на Съвета за сигурност на ООН представлява сериозна заплаха за регионалния и международния мир и сигурност и подкопава продължаващите международни усилия за постигане на траен мир и сигурност на Корейския полуостров. ЕС призова КНДР незабавно да прекрати всякакво изстрелване на балистични ракети, да започне съдържателни преговори и да предприеме конкретни и надеждни стъпки за изграждане на доверие и за пълен, проверим и необратим отказ от всичките си програми в областта на ядрените оръжия и балистичните ракети. ЕС продължи да призовава настойчиво КНДР да изпълни изцяло всички съответни резолюции на Съвета за сигурност на ООН и другите си международни задължения и ангажименти, незабавно да подпише и ратифицира ДВЗЯО и да възобнови спазването на задълженията си за гаранции съгласно ДНЯО. ЕС бързо транспонира всички резолюции на Съвета за сигурност в законодателството на ЕС и освен това прие строги автономни санкции, които допълват и подсилват санкциите, приети от ООН. На 10 август, след изстрелването на две балистични ракети с малък обсег на действие, беше публикувано изявление на говорителя на ЕСВД, както и на 2 октомври, след изстрелването от открито море на предполагаема балистична ракета. |
Конференция по разоръжаването/Договор за забрана на разпадащи се материали за ядрени оръжия или други ядрени взривни устройства

ЕС продължава да бъде единен и ангажиран по отношение на подлежащото на проверка разоръжаване и контрол над оръжията въз основа на договора и изтъква, че е необходимо да се подновят многостранните усилия и да се съживи работата на органите за многостранни преговори, по-специално Конференцията по разоръжаването. Дългосрочният приоритет на ЕС в рамките на Конференцията по разоръжаването е незабавното започване на преговорите по договор за забрана на разпадащи се материали за ядрени оръжия или други ядрени взривни устройства (FMCT). ЕС подкрепя започването на такива преговори в съответствие с документ CD/1299 и съдържащия се в него мандат. ЕС призовава всички членове на Конференцията по разоръжаването да започнат незабавно преговори по договор за забрана на разпадащи се материали за ядрени оръжия или други ядрени взривни устройства и да работят по останалите въпроси, включени в програмата. По силата на Решение (ЕС) 2017/2284 на Съвета (7) от 11 декември 2017 г. ЕС предоставя значителна финансова помощ на Службата на ООН по въпросите на разоръжаването (UNODA), за да се улесни участието на държавите от Африка, Азия, Латинска Америка и Карибския регион в консултациите и другите дейности, свързани с FMCT. Освен това ЕС насърчава всички държави, притежаващи ядрено оръжие, които още не са го направили, да обявят и да поддържат непосредствен мораториум върху производството на разпадащи се материали за ядрени оръжия или други ядрени взривни устройства. Държавата — членка на ЕС, притежаваща ядрено оръжие, обяви необходимите мораториуми и демонтира съответните съоръжения. |
ХИМИЧЕСКО ОРЪЖИЕ

Съветът прие Решение (ОВППС) 2019/538 (8), чрез което ЕС оказва подкрепа за основните дейности на ОЗХО (национално прилагане, международно сътрудничество, универсално прилагане, програмата „Африка“) за периода 2019—2022 г. С него се осигурява и значителен принос за преобразуването на Лабораторията на ОЗХО в Център по химия и технологии, както и за прилагането на Решение C-SS-4/DEC.3 „Преодоляване на заплахата от химическо оръжие“, взето на специалната сесия на Конференцията на държавите — страни по КЗХО, на 27 юни 2018 г. |

На 26 юни 2019 г. Съветът прие Решение (ОВППС) 2019/1092 (9) за удължаване на срока за прилагане на Решение (ОВППС) 2017/2302 (10) от 12 декември 2017 г. в подкрепа на дейностите на ОЗХО за подпомагане на операциите по почистване на бившия обект за съхранение на химическо оръжие в Либия в рамките на изпълнението на Стратегията на ЕС срещу разпространението на оръжия за масово унищожение. |

Във връзка с това ЕС продължи твърдо да подкрепя мисията на ОЗХО за установяване на факти и екипа за оценяване на декларацията при разследването на сведения за употребата на химическо оръжие в Сирия и в усилията за преодоляване на установените пропуски и несъответствия в първоначалната сирийска декларация. В този контекст на 9 декември 2019 г. Съветът прие Решение (ОВППС) 2019/2112 (11) за удължаване на срока на прилагане на Решение (ОВППС) 2017/2303 (12) в подкрепа на продължаващото изпълнение на Резолюция 2118 (2013) на Съвета за сигурност на ООН и на Решение ЕС-M-33/DEC.1 на Изпълнителния съвет на ОЗХО относно унищожаването на сирийските химически оръжия чрез предоставяне на сателитни снимки в подкрепа на операциите на ОЗХО в Сирия. |

В съответствие със заключенията на Европейския съвет от 28 юни 2018 г., в които ЕС пое ангажимент да подкрепи прилагането на Решение C-SS-4/DEC.3 от 27 юни 2018 г. на извънредното заседание на НСП към Конвенцията за забрана на химическото оръжие за установяване на механизъм за разпределение в отговор на многократното използване на тези оръжия от 2012 г. насам и с оглед на това да се осигури приемането на проекта на програма и на бюджет на ОЗХО за 2020 г., които да предоставят на техническия секретариат на ОЗХО твърда и солидна основа за справяне с многобройните задачи и предизвикателства, ЕС направи демарш пред голям брой държави — страни по КЗХО, с призив за конструктивен подход към изпълнението на Решение C-SS-4/DEC.3 на ОЗХО и за подкрепа с оглед на постигането на успех на 24-ата конференция на държавите — страни по конвенцията (CSP-24), проведена от 25 до 29 ноември 2019 г. |

С Решение (ОВППС) 2017/1252 на Съвета (13) от 11 юли 2017 г. в полза на укрепването на химическата безопасност и сигурност в Украйна в съответствие с изпълнението на Резолюция 1540 (2004) на Съвета за сигурност на ООН относно неразпространението на оръжия за масово унищожение и средствата за тяхната доставка, ЕС подкрепи изграждането на национален капацитет в Украйна и по-специално създаването на украински национален референтен център за определянето на контролирани и токсични химикали. |

БИОЛОГИЧНО ОРЪЖИЕ

На 21 януари 2019 г. Съветът на ЕС прие петото по ред решение за подкрепа на Конвенцията за забрана на биологични и токсични оръжия. В Решение (ОВППС) 2019/97 на Съвета (15) се предвижда бюджет от 3 милиона евро за Службата на ООН по въпросите на разоръжаването (СВР ООН) за периода 2019—2022 г. Това позволява на звеното за подпомагане на прилагането (ЗПП) на КБТО да подпомогне шест нови проекта в подкрепа на нейното универсализиране; изграждането на капацитет за нейното прилагане на национално равнище, включително три партньорски проверки; насърчаването на биологичната сигурност в южното полукълбо; разработването на инструменти за повишаване на осведомеността, образованието и ангажираността, както и в подкрепа на увеличаването на готовността за реагиране на биологични атаки. През 2019 г. в изпълнение на това решение бяха финансирани три семинара и две други прояви. Сред тези семинари беше първият по рода си семинар относно биологичната сигурност под наслов „Ангажиране на млади учени от южното полукълбо в дипломацията по въпросите на биологичната сигурност“, проведен на 3—5 август 2019 г. в близост до Женева. Семинарът събра заедно 20 млади учени от развиващи се страни, работещи по теми, свързани с КБТО. С Решение (ОВППС) 2019/97 също така ще се подкрепят междусесийната програма на КБТО и подготовката за Деветата конференция за преглед през 2021 г. |

На 31 юли 2019 г. Съветът прие Решение (ОВППС) 2019/1296 (16) в подкрепа на укрепването на биологичната безопасност и сигурност в Украйна в съответствие с изпълнението на Резолюция 1540 (2004) на Съвета за сигурност на ООН относно неразпространението на оръжия за масово унищожение и средствата за доставянето им. В това решение се предвижда подкрепа в размер на 1,9 милиона евро за период от три години. Чрез това решение ЕС подкрепя укрепването на биологичната безопасност и сигурност в Украйна, по-специално чрез подобряване на законодателната и регулаторна основа на Украйна и системите за здравеопазване на хората и животните, както и чрез подобряване осведомеността на специалистите в областта на науките за живота. |

На 9 декември 2019 г. Съветът прие Решение (ОВППС) 2019/2108 (17) в подкрепа на укрепването на биологичната безопасност и сигурност в Латинска Америка в съответствие с изпълнението на Резолюция 1540 (2004) на Съвета за сигурност на ООН относно неразпространението на оръжия за масово унищожение и средствата за доставянето им, което предвижда предоставяне на 2,7 милиона евро за период от три години. |

В резултат от горепосочените решения на Съвета общият размер на подкрепата, предоставена от ЕС за КБТО от 2006 г. насам, се е увеличил до почти 15 милиона евро. |

На срещата на държавите — страни по конвенцията, която се проведе на 3—6 декември 2019 г. в Женева, ЕС направи общо изявление. Потвърждавайки твърдата си подкрепа за КБТО като основен стълб на основаната на правила международна система, ЕС припомни дълготрайните си усилия за укрепване на Конвенцията, насърчаване на нейното универсализиране и подобряване на нейното прилагане. Приоритетите на ЕС в контекста на КБТО включват засилване на нейното прилагане и спазване на национално равнище, насърчаване на мерките за изграждане на доверие и прозрачност, като например партньорски проверки, доброволни посещения и други инициативи, улесняване на сътрудничеството в областта на науката и технологиите, прилагане на практика на разпоредбите на член V относно консултациите и разпоредбите на член VII относно предоставянето на помощ, реакция и готовност, насърчаване на универсалното присъединяване към Конвенцията, както и равенството между половете и овластяването на жените като важен хоризонтален приоритет. Освен това ЕС изрази продължаващата си загриженост във връзка с критичното финансово положение на Конвенцията и призова всички държави, които все още не са направили това, да изпълнят незабавно финансовите си задължения. В този контекст ЕС припомни, че целта на създадения през 2018 г. фонд за оборотен капитал е да осигури краткосрочна финансова ликвидност в началото на календарната година и по никакъв начин да не се използва за компенсиране на неплащане или просрочки. По отношение на дейностите ЕС изтъкна постиженията на сътрудничеството, развито при изпълнението на решението на Съвета на ЕС за подкрепа на КБТО и реализирането на Инициативата на ЕС за създаване на центрове за високи постижения за намаляване на риска от химични, биологични, радиологични и ядрени (ХБРЯ) материали. По време на финансирана от ЕС съпътстваща проява на 4 декември 2019 г. бяха представени свързани с биологичната безопасност дейности в Кавказ в рамките на Инициативата за създаване на центрове за високи постижения за намаляване на риска от химични, биологични, радиологични и ядрени (ХБРЯ) материали. |

ЕС участва активно и в петте срещи на експерти, проведени от 29 юли до 8 август 2019 г. в Женева, а именно срещата на експерти (MX1) относно сътрудничеството и помощта, със специален акцент върху засилването на сътрудничеството и помощта по член Х (29—30 юли), срещата на експерти (MX2) относно прегледа на развитието в областта на науката и технологиите, свързано с Конвенцията (31 юли—2 август), срещата на експерти (MX3) относно засилването на прилагането на национално равнище (5 август 2019 г.), срещата на експерти (MX4) относно помощта, реакцията и готовността (6—7 август 2019 г.) и срещата на експерти (MX5) относно институционалното укрепване на Конвенцията (8 август 2019 г.). ЕС отправи добре фокусирани и актуални ключови послания на всяка от срещите на експерти и изрази позицията си на съпътстващата проява, организирана от Франция, относно доброволните мерки за прозрачност, като насърчи по-структуриран обмен на информация относно партньорските проверки. ЕС насочи вниманието към повишаването на осведомеността сред специалистите от сектора на науката и технологиите чрез модули за електронно обучение и чрез финансиране на семинари на заинтересованите страни. В същия контекст ЕС изтъкна значението на новото решение на Съвета на ЕС за подкрепа на универсализирането и прилагането на Конвенцията. |
БАЛИСТИЧНИ РАКЕТИ
Хагски кодекс за поведение

Хагският кодекс за поведение срещу разпространението на балистични ракети (ХКП) е резултат от усилията на международната общност да регламентира въпросите, свързани с балистичните ракети, способни да служат за носители на оръжия за масово унищожение. ХКП е единственият многостранен инструмент за прозрачност и изграждане на доверие във връзка с разпространението на балистичните ракети. Чрез присъединяването си към ХКП членовете поемат доброволен политически ангажимент да уведомяват преди изстрелването на балистични ракети и космически ракети носители и за изпитателни полети. Присъединилите се държави се ангажират също да представят годишна декларация за своите политики в областта на балистичните ракети и космическите ракети носители. |

От самото начало Европейският съюз категорично подкрепя кодекса. Всички държави — членки на ЕС, се присъединиха към кодекса. От подписването и влизането в сила на политически обвързващия Хагски кодекс за поведение през ноември 2002 г. в Хага, Нидерландия, броят на подписалите държави се е увеличил от 93 на 143. Това се дължи и на дипломатическите усилия, които ЕС положи по отношение на редица неприсъединили се държави, в подкрепа на универсализирането на Кодекса. |

ЕС насърчава последователно универсалния характер, пълното прилагане и по-доброто функциониране на Кодекса. През последното десетилетие Съветът на ЕС прие поредица от решения/съвместни действия в рамките на ОВППС за подкрепа на Хагския кодекс за поведение и на неразпространението на балистични ракети като цяло. Чрез тези решения на Съвета ЕС финансира дейности за популяризиране на ХКП, включително съпътстващи прояви, научи изследвания, срещи на експерти и семинари за повишаване на осведомеността на регионално равнище. Дейностите се провеждат от парижката Фондация за стратегически изследвания (Fondation pour la Recherche Stratégique), обикновено с участието и на ротационния председател на ХКП. |

С Решение (ОВППС) 2017/2370 на Съвета (18) от 18 декември 2017 г. ЕС продължава: да насърчава присъединяването към Кодекса и в крайна сметка неговия универсален характер; да подкрепя пълното прилагане на Кодекса; да насърчава диалога между присъединилите се и неприсъединилите се държави за изграждане на доверие и прозрачност; да насърчава сдържаността и създава повече стабилност и сигурност за всички; да популяризира по-широко Кодекса и да повишава обществената осведоменост за рисковете и заплахите, свързани с разпространението на балистични ракети; и да проучва, по-конкретно в рамките на академични изследвания, възможностите за укрепване на Кодекса и за насърчаване на взаимодействието между Кодекса и други релевантни многостранни инструменти. |
РЕЗОЛЮЦИЯ 1540 НА СЪВЕТА ЗА СИГУРНОСТ НА ООН И НАМАЛЯВАНЕ НА ХБРЯ РИСКОВЕ

Резолюция 1540 (2004) на Съвета за сигурност на ООН продължава да бъде основополагащ елемент на международната система за неразпространение. Тя е първият международен правен инструмент за решаване по интегриран и всеобхватен начин на проблема с оръжията за масово унищожение, средствата за доставянето им и свързаните с тях материали. С Резолюция 1540 (2004) на СС на ООН се установяват обвързващи задължения за всички държави. Те целят предотвратяване и възпиране на достъпа на недържавни участници до такива оръжия, до средства за тяхната доставка и до свързани с тях материали. Приета съгласно глава VII от Устава на ООН, резолюцията изисква от всички държави да приемат необходимото законодателство, с което на недържавни участници се забранява да се сдобиват с ядрени, химически или биологични оръжия и да създадат подходящи национални механизми за контрол на свързаните с тези оръжия материали с цел предотвратяване на техния незаконен трафик. Процесът на комплексен преглед от 2016 г. на Резолюция 1540 на СС на ООН отново потвърди нейната централна роля, значимост и авторитет, както е отразено в Резолюция 2325 на СС на ООН. |

За да се помогне за внедряването на резултатите от комплексния преглед от 2016 г. и да се подкрепи пълното прилагане на Резолюция 1540 на СС на ООН, на 11 май 2017 г., Съветът на ЕС прие Решение (ОВППС) 2017/809 на Съвета (19) в подкрепа на изпълнението на Резолюция 1540 (2004) на Съвета за сигурност на ООН относно неразпространението на оръжия за масово унищожение и средствата за тяхното доставяне. Решението на Съвета обхваща период от 36 месеца и се изпълнява от Службата на ООН по въпросите на разоръжаването (СВР на ООН) в Ню Йорк, която е възложила част от изпълнението на ОССЕ във Виена като подизпълнител. Средствата на ЕС служат за подпомагане на държавите при определяне на конкретната техническа помощ, подобряване на осведомеността за съответните програми за техническа помощ, както и за засилване на сътрудничеството с международните и регионалните организации в подкрепа на усилията за изграждане на национален капацитет. |

Инициативата на ЕС за създаване на центрове за високи постижения за намаляване на риска от химични, биологични, радиологични и ядрени (ХБРЯ) материали е програма за изграждане на капацитет със световен обхват, в която понастоящем участват 61 държави партньори, групирани около 8 регионални секретариата, разположени в следните региони: Африканското крайбрежие на Атлантическия океан; Централна Азия; Източна и Централна Африка; държавите от Съвета за сътрудничество в Персийския залив; Близкия изток; Северна Африка и Сахела; Югоизточна Азия; Югоизточна и Източна Европа. |

Центровете за високи постижения в областта на ХБРЯ се финансират по линия на Инструмента, допринасящ за стабилността и мира (IcSP), и тяхната цел е да се намаляват рисковете, свързани с ХБРЯ материали, да се укрепи готовността на държавите партньори и да се утвърждава култура на сигурност и управление. Участващите държави получават подкрепа в своите усилия за създаване на национални и регионални координационни и управленски структури на доброволна основа и съобразно основан на търсене регионален подход. Тези платформи разработват и подкрепят национални политики относно ХБРЯ материалите и изграждат капацитет въз основа на оценки на конкретните потребности и национални планове за действие. Те се подпомагат по няколко регионални проекта за сътрудничество, финансирани по инициативата и отворени за други инструменти за финансиране. От 2010 г. до днес са финансирани 82 регионални проекта. Бюджетът на инициативата за 10-годишния период, считано от 2010 г., възлиза на приблизително 250 млн. евро. |

Мрежата от центрове за високи постижения вече е добре развита и това позволи на ЕС да организира симулационни и полеви трансгранични учения, в т.ч. по въпроси, свързани с гражданската защита, реакцията при инциденти, биологичната сигурност и управлението на отпадъците в рамките на проекти на центровете за високи постижения, с цел подобряване на видимостта и конкретно оценяване на тяхното въздействие. Започна разработването на регионални планове за действие в областта на ХБРЯ материалите, както и междурегионално сътрудничество. Освен това инициативата е в достатъчно напреднал етап, за да подкрепи по-нататъшните действия за решаване на свързаните с управлението на сигурността въпроси от областта на киберпрестъпността, тероризма, критичните инфраструктури, фалшифицираните лекарствени продукти, хибридните заплахи и взривните вещества, както и да задълбочи сътрудничеството в сферата на ядрената криминалистика, граничния контрол и контрола върху износа на изделия с двойна употреба. През 2019 г., в рамките на инициираната от ЕС мрежа от центрове за високи постижения за намаляване на риска от химични, биологични, радиологични и ядрени (ХБРЯ) материали, Съвместният изследователски център на ЕС в сътрудничество с Министерството на енергетиката на САЩ и Института за ядрени изследвания в Киев осъществи дейности за образование и обучение в областта на ядрената сигурност за участници от Грузия, Украйна, Азербайджан и Молдова с цел повишаване на ядрената сигурност в Черноморския регион. |

Продължи изпълнението на Плана за действие за подобряване на готовността за действие срещу химически, биологични, радиологични и ядрени рискове за сигурността, представен от Комисията през октомври 2017 г. като част от по-обхватния пакет от мерки за борба с тероризма. Настоящият план за действие, който се основава на постиженията на плана за действие на ЕС в областта на ХБРЯ материалите за периода 2010—2015 г., въведе широк кръг от мерки за подобряване на готовността, устойчивостта и координацията на равнище ЕС. Той предлага създаването на ХБРЯ архитектура на равнището на ЕС с по-голяма насоченост към сигурността, като набляга на необходимостта от по-добро използване на съществуващите ресурси и от обединяване на наличните експертни познания. В плана за действие се призовава също така за укрепване на готовността и реакцията на ЕС при ХБРЯ рискове чрез трансгранични и междусекторни обучения и учения. В него се подчертава необходимостта от включване по целесъобразност на гранични и митнически органи и военни партньори. В плана за действие се подчертава също така значението на тесните връзки между вътрешните и външните дейности, свързани със сигурността в областта на ХБРЯ материалите, както и на сътрудничеството със специализираните многостранни организации като МААЕ, ОЗХО или Интерпол. Изпълнението на плана за действие бе финансово подкрепено чрез фонд „Вътрешна сигурност — полиция“. |

Планът за действие в областта на ХБРЯ материалите е получил научна и техническа подкрепа от редица научноизследователски проекти, финансирани по програмата „Сигурно общество“ по линия на Седмата рамкова програма. Научните изследвания обхващат целия цикъл на управлението на кризи от превенцията до възстановяването. Дейностите по набелязване на нуждите от стандартизация биха могли да доведат до изработването на европейски стандарти. Програмата „Хоризонт 2020“ ще засили текущата научноизследователска работа в областта на ХБРЯ материалите чрез специализирани теми. |
ЕКСПЕРТНИ ЦЕНТРОВЕ

Въз основа на Решение 2010/430/ОВППС на Съвета (20) от 26 юли 2010 г. изпълнението на Стратегията на ЕС срещу разпространението на оръжия за масово унищожение получи активна подкрепа от Консорциума на ЕС за неразпространение на оръжия и разоръжаване, който започна работа през януари 2011 г. На 26 февруари 2018 г. Съветът прие Решение (ОВППС) 2018/299 (21), с което допълнително разширява подкрепата на ЕС за дейностите на консорциума за периода 2018—2021 г. чрез доразвиване на досегашните постижения и добавянето на нови проекти. |

Дейностите на консорциума осигуриха по-голяма видимост на ЕС по отношение на трети държави и гражданското общество и допринесоха значително за оформянето на политиката на ЕС в областта на неразпространението и разоръжаването. Консорциумът предоставя платформа за неформални контакти между специалистите и насърчава диалога между различните заинтересовани страни. Неговите дейности подпомогнаха повишаването на осведомеността относно предизвикателствата, произтичащи от оръжията за масово унищожение и конвенционалните оръжия, а също включваха и търсене на решения за преодоляване на тези предизвикателства. Той използва обширна мрежа от 90 експертни центъра и научноизследователски центъра в цяла Европа, която включва членове от всички държави — членки на ЕС, както и от партньорски държави като Швейцария и Украйна. През 2019 г. към мрежата се присъединиха 14 института. |

През 2019 г. Консорциумът публикува месечен информационен бюлетин, както и пет документа на ЕС по въпросите на неразпространението и разоръжаването (22). Обучителните дейности включваха курс за електронно обучение по въпросите на неразпространението и разоръжаването и свързаните с тях политики на ЕС, както и подкрепата за 36 стажа по въпросите на неразпространението и разоръжаването в европейски експертни центрове между 2018 и 2021 г. в изпълнение на Решение (ОВППС) 2018/299 на Съвета от 26 февруари 2018 г. |
КОНТРОЛ НА ИЗНОСА

През 2019 г. работна група „Износ на конвенционално оръжие“ приключи прегледа на Обща позиция 2008/944/ ОВППС (23) относно контрола върху износа на оръжие. Съветът прие решение за изменение на Общата позиция на Съвета, както и преработено ръководство на потребителя. Освен това той прие заключения относно прегледа на Общата позиция. |

В решението на Съвета са взети предвид редица промени на европейско и международно равнище, които доведоха до нови задължения и ангажименти за държавите членки след приемането на Общата позиция от 2008 г. Тези промени включват по-специално влизането в сила на 24 декември 2014 г. на Договора за търговията с оръжие (ДТО), който урежда международната търговия с конвенционално оръжие. Всички държави членки са страни по ДТО. Целта на ДТО е установяването на възможно най-строги общовалидни международни стандарти, с които да се регламентира или да се усъвършенства нормативната уредба в областта на международната търговия с конвенционално оръжие, както и да се предотврати и пресече незаконната търговия с конвенционално оръжие и да се попречи на неговото пренасочване. |

В своите заключения Съветът припомня ангажимента си за засилване на контрола върху износа на военни технологии и оборудване и за укрепване на сътрудничеството и насърчаване на сближаването в областта на износа на военни технологии и оборудване. Това се постига това чрез установяване, поддържане и прилагане от всички държави членки на високи общи стандарти за управление на трансфера на военни технологии и оборудване. |

През 2019 г. ЕС продължи и дейностите си по осведомяване в подкрепа на трети държави за създаване на система за контрол върху износа на оръжие и за насърчаване на универсализирането на ДТО. Съгласно Решение (ОВППС) 2018/101 на Съвета (24) от 22 януари 2018 г., чието изпълнение се осъществява от германската Федерална служба по икономика и контрол върху износа (BAFA), бяха проведени редица регионални семинари, учебни посещения и индивидуални мероприятия за подпомагане. Освен това съгласно Решение (ОВППС) 2017/915 на Съвета (25), чието изпълнение се осъществява от BAFA и Expertise France, бяха проведени допълнителни регионални дейности по осведомяване, адаптирани национални програми за подпомагане и ad hoc индивидуални работни срещи за подпомагане в подкрепа на ефективното и всеобщо прилагане на Договора за търговията с оръжие. |

През 2018 г. и 2019 г. в рамките на политическия диалог по въпросите, свързани с контрола върху износа на оръжие, се проведоха срещи с Норвегия, Канада, САЩ и Украйна. Този политически диалог представлява форум за ползотворни обсъждания по въпроси от взаимен интерес като политиките, свързани с износа за конкретни местоназначения, въпросите, засягащи съответствието и контрола, и процеса по Договора за търговията с оръжие. |

През 2019 г. ЕС продължи редовно да актуализира своите регламенти спрямо промените в многостранните режими за контрол на износа. Във връзка с това на 17 октомври 2019 г. Европейската комисия прие Делегиран регламент (ЕС) 2019/2199 (26), с който се актуализира контролният списък на ЕС в съответствие с решенията, приети в рамките на многостранните режими за контрол върху износа през 2018 г., и въведе нови проверки, напр. за установки за запуск във въздуха, усилватели с „монолитни микровълнови интегрални схеми“, дискретни микровълнови транзистори и спускаеми подводни апарати без екипаж. |

Координационната група по въпросите на изделията с двойна употреба продължи да подпомага ефективното и последователно прилагане на контрола върху износа в ЕС. Бяха въведени нови функции в „Електронната система относно изделията с двойна употреба“, които подобриха обмена на информация и техническия обмен в рамките на ЕС. Приемайки Препоръка (ЕС) 2019/1318 на Комисията (27) от 30 юли 2019 г., ЕС приключи процеса на определяне на насоки за съответствие, предназначени за промишлеността. Освен това ЕС напредна с работата по разработването на „платформа за електронно лицензиране“, която да бъде използвана от компетентните органи на доброволна основа. Беше публикуван годишен доклад (28), за да се гарантира прозрачност по отношение на контрола на износа и лицензионните дейности, а на 13 декември 2019 г. беше организиран форум по въпросите на контрола на износа, в който взеха участие заинтересовани страни от държавите членки, промишлеността и гражданското общество (29). |

Продължи прегледът на политиката на ЕС за контрол на износа. Съветът и Европейският парламент активно обсъдиха предложението на Комисията за модернизиране на контрола върху износа на изделия с двойна употреба. През юни 2019 г. Съветът прие мандат за преговори с Европейския парламент и преговорите между съзаконодателите в рамките на триалозите започнаха през есента. |

В зависимост от случая бяха съгласувани позиции и изявления на ЕС като част от подготовката за съответните заседания на режимите за контрол на износа: пленарното заседание на Групата на ядрените доставчици в Нур Султан (20—21 юни 2019 г.), пленарното заседание на Австралийската група в Париж (3—7 юни 2019 г.) и на Режима за контрол на ракетните технологии в Окланд (7—11 октомври 2019 г.). |

Режимът за контрол на ракетните технологии (РКРТ) е неформална и доброволна асоциация на държави, които споделят целите за неразпространение на безпилотни системи за доставка, способни да доставят оръжия за масово унищожение, и които се стремят да координират националните усилия за лицензиране на износа, насочени към предотвратяване на разпространението им. Правителствата на държавите, участващи в РКРТ, са поели ангажимент да спазват общи насоки на политиката по износа (Насоките на РКРТ), които се прилагат за един неразделен общ списък на подлежащи на контрол изделия (Приложение към РКРТ относно оборудване, софтуер и технологии). Партньорите от РКРТ редовно обменят информация относно съответни национални въпроси, свързани с лицензирането на износа. Насоките и контролните списъци на РКРТ съставляват най-добрите международни практики за контрол на износа на свързани с ракети изделия и технологии. |

Важен въпрос за ЕС в контекста на РКРТ продължава да бъде блокираното присъединяване на Естония, Кипър, Латвия, Литва, Малта, Румъния, Словакия, Словения и Хърватия към режима. Последователността и предвидимостта при председателството на режими за контрол на износа като РКРТ са от ключово значение за функционирането и надеждността на тези режими. През октомври 2019 г. държавите — членки на ЕС, които членуват в РКРТ, представиха неофициален документ, озаглавен „Относно въпроси, свързани с председателството“, за разглеждане на пленарното заседание, в който се анализират възможностите за насърчаване и подкрепа на устойчиво председателство на Режима. ЕС ще продължи да обсъжда с членовете различните възможности. В контекста на Режима ЕС винаги е подкрепял приемането на категорични публични изявления на РКРТ, отразяващи загрижеността на международната общност във връзка с изстрелването на балистични ракети и значителното разработване на ракетни технологии от Иран и КНДР. |

Продължи изпълнението в шест региона на партньорската програма на ЕС за контрол на износа, чиято цел е да се подобри ефективността на системите за контрол на износа на изделия с двойна употреба и свързаните с тях материали, оборудване и технологии. През 2019 г. програмата беше разширена, за да се даде възможност за сътрудничество с Ирак, и понастоящем обхваща общо 37 държави, включително тези, участващи в целевите инициативи за контрол на износа с Центъра за наука и технологии на Украйна и Международния център за наука и технологии в Казахстан, които обхващат 13 държави. |

Продължи интензивната координация на партньорската програма на ЕС за контрол на износа с програмата на Държавния департамент на САЩ за контрол върху износа и свързаната с него сигурност на границите. Бяха организирани съвместни семинари ЕС—САЩ за обмен на методики за оценка на заплахите, за определяне на общи показатели за въздействието и за координиране на помощта на място. През август 2019 г. ЕС организира във Финландия за държавите партньори по партньорската програма на ЕС за контрол на износа годишното издание на летния университет за стратегически контрол на търговията. Порталът на ЕС по партньорската програма на ЕС беше прехвърлен на официалната интернет среда на ЕС (https://europa.eu/cbrn-risk-mitigation/eu-p2p_en), а визуалните модернизации и тези, свързани със съдържанието, ще бъдат приключени през 2020 г. Той ще продължи да служи като платформа за всички европейски програми по места относно контрола на износа на военни изделия и изделия с двойна употреба, с цел да се адаптира обменът на информация спрямо отделните държави — партньори на ЕС. Програмата се финансира по линия на Инструмента, допринасящ за стабилността и мира. |
КОСМИЧЕСКО ПРОСТРАНСТВО

ЕС и неговите държави членки продължиха да насърчават запазването на безопасна, сигурна и устойчива космическа среда и мирното използване на космическото пространство на справедлива и взаимноприемлива основа. Продължихме да изтъкваме важното значение на прозрачността и мерките за изграждане на доверие и необходимостта от защита в рамките на ООН на отговорното поведение в космоса. Във връзка с това ЕС излезе с декларации, свързани с космическото пространство, пред Общото събрание на ООН, Конференцията на ООН за разоръжаването, Комисията на ООН за разоръжаването и Комитета на ООН за мирно използване на космическото пространство (COPUOS). |

На 9 декември Консорциумът на ЕС за неразпространение на оръжия и разоръжаване, в сътрудничество с работната група на ЕСВД по въпросите на космическото пространство, организира семинара на тема „Сигурност, безопасност, устойчивост: насърчаване на добро поведение в космическото пространство“. Целта на семинара беше да се осъществи обмен на мнения и информация относно национални, регионални и световни инициативи за насърчаване на запазването на безопасна, сигурна и устойчива космическа среда и мирното използване на космическото пространство на справедлива и взаимноприемлива основа. В семинара участваха правителствени служители и представители на академичните среди и частния сектор. Участниците оцениха ползотворната дискусия сред космическата общност и общността за неразпространение и разоръжаване по теми, свързани със сигурността, безопасността и устойчивостта на космическото пространство. |
КЛАУЗИ ОТНОСНО НЕРАЗПРОСТРАНЕНИЕТО НА ОМУ

В съответствие с политиката си за неразпространение на ОМУ и със заключенията на Съвета от 2003 г. ЕС продължи да работи по интегрирането на ангажиментите за неразпространение на ОМУ в споразумения с държави партньори. Продължиха преговорите по клауза за ОМУ за ново споразумение с Азербайджан, а тези с Чили и Киргизстан приключиха. Освен това, в съответствие със съвместното решение на ЕС и Куба относно временното прилагане на някои части от новото споразумение между ЕС и Куба, първият по рода си диалог между ЕС и Куба относно неразпространението се състоя в Брюксел през март въз основа на клаузата относно ОМУ в новото споразумение. ЕС присъства като наблюдател на първата сесия на Конференцията за установяването на Близък изток, свободен от ядрени оръжия и други оръжия за масово унищожение, проведена в Ню Йорк от 18 до 22 ноември 2019 г. |

ЕС продължи да участва активно в срещите на Групата на директорите по въпросите на неразпространението от Г-7. През 2019 г. ЕС взе участие в срещите под председателството на Франция, в които беше отделено централно място на въпросите на неразпространението и въоръжаването, както и на постигането на по-нататъшен напредък в координирането на работата на Групата на директорите по въпросите на неразпространението от Г-7 и Глобалното партньорство срещу разпространението на оръжия и материали за масово унищожаване, по-специално чрез установяване на по-тясна връзка между политическите приоритети и дейностите по проектите. |

ЕС продължава да е ангажиран с Глобалното партньорство срещу разпространението на оръжия и материали за масово унищожение, по-специално чрез техническата помощ (оценка на заплахи, национални планове за действие), предоставяна в световен мащаб по линия на инициативата на ЕС за центрове за високи постижения за намаляване на химическите, биологичните, радиологичните и ядрените рискове. В декларацията на Г-7 по въпросите на неразпространението и разоръжаването от 6 април 2019 г. се потвърждава актуалната необходимост от ръководеното от Г-7 Глобално партньорство, което понастоящем включва 30 активни членове и ЕС. |

Специалният пратеник на ЕСВД по въпросите на разоръжаването и неразпространението проведе срещи в рамките на диалога в областта на неразпространението и разоръжаването с Китай, Индия, Украйна и САЩ. Той проведе голям брой двустранни консултации с различни заинтересовани страни в рамките на значими форуми като Първи комитет на ОС на ООН, заседанието на Втория подготвителен комитет на Конференцията през 2020 г. за преглед на Договора за неразпространение, Генералната конференция на МААЕ. The Council Decision supports the organisation of a series of consultations: three thematic seminars for all States Parties on nuclear disarmament (Geneva), nuclear non-proliferation (New York) and peaceful uses of nuclear energy (Vienna), targeted at practitioners/diplomats, academia and civil society, as well as four regional meetings: Asia-Pacific, Africa, Latin America and the Caribbean, and the Middle East. The regional meetings will cover all three of the NPT pillars viewed through the lens of regional priorities and concerns. Council Decision (CFSP) 2018/1939 of 10 December 2018 on Union support for the universalisation and effective implementation of the International Convention for the Suppression of Acts of Nuclear Terrorism |
With this Decision, the EU is supporting one of the key elements of the global nuclear security and anti-terrorism architecture, the International Convention for the Suppression of Acts of Nuclear Terrorism (ICSANT). The objectives of the support are to increase the number of adherents to ICSANT, to raise awareness among national policy- and decision-makers, as well as capacity-building: to help improve national legislation and to strengthen the capacity of national stakeholders, including criminal justice officials to investigate, prosecute and adjudicate cases of nuclear terrorism. The Council Decision aims to build synergies with on-going EU projects in support for relevant international legal instruments, such as the Amendment to the Convention on the Physical Protection of Nuclear Material and UN Security Council Resolution 1540. The Council Decision will promote the universalization and effective implementation of ICSANT through the development and maintenance of a password-protected website on all resources on ICSANT including examples of national legislation; the development of an e-learning module on ICSANT, to be translated into at least four UN official languages; the provision of relevant legislative assistance; capacity building of relevant stakeholders including criminal justice officials that could be involved in investigating, prosecuting and adjudicating cases involving nuclear and other radioactive material covered by ICSANT; holding of global and regional workshops and country visits and by the collection and dissemination of good practices. With a view to fighting the illicit trade in firearms and SALW in the Western Balkans, support is provided for the implementation of the ‘Regional Roadmap for a sustainable solution to the illegal possession, misuse and trafficking of SALW/firearms and their ammunition in the Western Balkans by 2024’. The main responsibility in cases of CBRN emergencies falls upon first responders. It is therefore essential that countries build upon their national resources to mitigate and respond to the consequences of an emergency situation. Best-practices should thus be exchanged amongst these first responders at MIE regional level and CBRN risk mitigation knowledge developed. It should also result in increased awareness of stocks of hazardous chemical agents, their pre-cursors as this is one of the means of targeting illicit use and/or trafficking of WMD. |
