ВЪВЕДЕНИЕ

Настоящият доклад за напредъка относно изпълнението на Стратегията на Европейския съюз срещу разпространението на оръжия за масово унищожение (ОМУ), приета от Европейския съвет през декември 2003 г. (док. 15708/03), обхваща дейностите, извършени през 2018 г. Докладът не е всеобхватен, а се спира само на основните събития. Всички дейности се осъществяваха в по-широкия контекст на политиката на ЕС за сигурност и предотвратяването на конфликти. |

Европейската служба за външна дейност (ЕСВД), и по-конкретно специалният пратеник по въпросите на разоръжаването и неразпространението, представляваше ЕС на редица значими международни срещи през 2018 г.:

През 2018 г. работна група „Неразпространение“ на Съвета на ЕС проведе 11 заседания, включително на равнище директори, за обсъждане на позициите на ЕС и бъдещите дейности. Делегациите на ЕС във Виена, Женева и Ню Йорк изготвиха и координираха редица изявления на ЕС за многостранните форуми и допринасяха активно за разработването на политики чрез редовни срещи за координация на равнище ЕС. |
ВЪПРОСИ ОТ ЯДРЕНАТА ОБЛАСТ

ЕС е изцяло ангажиран с утвърждаването на универсалното приемане и пълното, цялостно и ефективно прилагане на Договора за неразпространение на ядреното оръжие (ДНЯО), за бързото влизане в сила на Договора за всеобхватна забрана на ядрените опити (ДВЗЯО) и за създаването в Близкия изток на зона, свободна от оръжия за масово унищожение и от системи за тяхната доставка. Започването и бързото приключване на преговорите в рамките на Конференцията по разоръжаването относно договор за забрана на производството на разпадащи се материали за ядрени оръжия или други ядрени взривни устройства продължава да бъде приоритет за ЕС. |

Цикълът на преразглеждане на ДНЯО продължи с втората сесия на Подготвителния комитет за Конференцията за преглед през 2020 г. на страните по ДНЯО, която се състоя в Женева от 23 април до 4 май 2018 г. ЕС направи четири изявления: едно по общия дебат и три изявления съответно по дебатите за ядреното разоръжаване, неразпространението и използването за мирни цели; беше направено и специално изявление в подкрепа на създаването на зона, свободна от ОМУ, в Близкия изток. Освен това ЕС организира две съпътстващи прояви във връзка с подкрепата на ЕС за Договора за всеобхватна забрана на ядрените опити и организацията към него, и друга проява относно ползите от ДНЯО с акцент върху международното сътрудничество в областта на радиоактивните източници през техния жизнен цикъл. Освен това ЕС представи работни документи относно проверката на ядреното разоръжаване и договора за забрана на разпадащите се материали. Всички държави – членки на ЕС, подкрепиха изявлението относно ядрените провокации на Северна Корея. На 73-тата сесия на Първи комитет на Общото събрание на ООН относно разоръжаването и международната сигурност ЕС взе участие във всички дебати, включително в тематичния дебат относно ядреното оръжие. |

ЕС продължи да подкрепя основните отговорности на МААЕ по отношение на неразпространението, ядрената енергетика, ядрената безопасност, ядрената сигурност и техническото сътрудничество. |

ЕС допринася за изпълнението на Плана на МААЕ за ядрената сигурност за периода 2018—2021 г. посредством Решение (ОВППС) 2016/2383 на Съвета (1), с което се финансират дейности на МААЕ, насочени към универсалното приемане на международните инструменти за неразпространение и ядрена сигурност; подпомагане на държавите в изграждането на технически, научен и човешки капацитет на място, необходим за ефективната и устойчива ядрена сигурност; укрепване на капацитета за предотвратяване, откриване и реагиране и за защита на хората, имуществото, околната среда и обществото от престъпни действия или умишлени непозволени действия, свързани с ядрени или други радиоактивни материали, необхванати от нормативен контрол; укрепване на разкриването и реагирането на незаконния трафик на ядрени и други радиоактивни материали; принос за компютърната сигурност в ядрената област; укрепване на сигурността на радиоактивните източници, изпращането им в безопасно и сигурно хранилище в държавите, които се нуждаят от подпомагане, включително връщането им в държавата по произход или на доставчика; засилване на физическата защита на ядрени и други радиоактивни материали. |

Съвместният изследователски център (JRC) на Европейската комисия продължи да предоставя подкрепа за базата данни за незаконен трафик и инциденти на МААЕ, като предоставяше обучение и развитие на точките за контакт с тази база данни от държавите – членки на Европейски съюз, и от държавите от региона на Балканите. |

В рамките на 5-ата среща на висшите служители от ЕС и МААЕ (15 февруари 2017 г.) Съвместният изследователски център и МААЕ подписаха „Практически договорености за сътрудничество относно приложенията в ядрената наука“, насочени към разработването на съвместни дейности и избягването на дублирането на усилия. Една от дейностите, включени в тези практически договорености, е наблюдението на околната среда за радиоактивност, измервана в Европа и в редица други места по света под формата на средни дози и максимални стойности на гама облъчване за последните 24 часа. Данните от тези измервания се вземат от около 5 500 места за наблюдение, под ръководството на компетентните национални органи в 39 държави, които докладват актуалните радиологични стойности на Европейската платформа за обмен на радиологични данни (EURDEP). Нотификацията за радиологичен инцидент или извънредна ситуация става посредством мрежи за ранно нотифициране като ECURIE или EMERCON, управлявани съответно от Европейската комисия и от МААЕ, след консултация с компетентните национални органи. Дейностите, проведени през 2018 г., включват развитие на хармонизирани процедури за готовност за извънредни ситуации и способност за реагиране, участие в учения (ConvEx, ECUREX), подкрепа за системата за международен мониторинг и информация за радиацията (тестване на обмена на данни с неевропейски държави, регионален обмен на данни от мониторинга). |

Съвместният всеобхватен план за действие (СВПД) е ключов елемент от глобалната структура за неразпространение на ядреното оръжие и постижение на многостранната дипломация. Продължаващото пълно и ефективно изпълнение на споразумението е от съществено значение за европейската сигурност. ЕС продължава да допринася за изпълнението на СВПД чрез координиране на съвместната комисия и редица експертни работни групи, сформирани по силата на СВПД. Освен това ЕС продължава да подкрепя изцяло дългосрочната мисия на МААЕ за проверка и наблюдение на ангажиментите на Иран в ядрената област. От 2016 г. ЕС е ангажиран с изпълнението на приложение III от СВПД, по-специално чрез проекти за подобряване на ядрената безопасност. Вече са заделени 15 милиона евро за сътрудничеството с Иран в ядрената област за граждански цели и бяха договорени три проекта, подкрепящи както иранския Орган за ядрено регулиране, така и ядрената електроцентрала в Бушехр. |

Сътрудничеството с Иран в ядрената област за граждански цели е основен стълб на СВПД и централен елемент от ангажимента на ЕС към Иран. То способства за по-доброто разбиране на ядрените нужди на Иран за граждански цели и води до постепенното изграждане на доверие в мирния характер на ядрената програма на страната. През 2018 г. сътрудничеството между ЕС и Иран включваше чест обмен на мнения на високо равнище по въпроси на политиката със специален акцент върху ядреното управление; съвместен семинар относно гражданската отговорност в областта на ядрената енергетика и застраховането; проекти, които подкрепят усилията на Иранския орган за ядрено регулиране за съответствие с международните стандарти в законодателната и регулаторната област; научни семинари и технически посещения на ядрени обекти и лаборатории от страна на Съвместния изследователски център на ЕС; международни конференции с участието на заинтересовани страни от областта на ядрената енергетика; проекти в подкрепа на модернизирането на изследователския реактор в Арак (Кхондаб) и преобразуването на съоръжението Фордоу в център за ядрена енергетика, физика и технологии. Иран продължи да бъде основен бенефициент на помощта на ЕС в областта на ядрената безопасност. |

Всеобхватните споразумения за гаранции, наред с допълнителните протоколи, представляват настоящият стандарт за проверка и ЕС продължава да призовава за всеобщо и незабавно присъединяване към тях. Тясното сътрудничество между Евратом и МААЕ дава възможност за ефективни и ефикасни гаранции. ЕС подкрепя активно системата за гаранции на МААЕ по линия на програмата на Европейската комисия за подпомагане на контрола на безопасността, инструмента за сътрудничество в областта на ядрената безопасност и програмите за подкрепа на държавите членки. |

ЕС и неговите държави членки отдават голямо значение на прилагането в световен мащаб и постоянното подобряване на ядрената безопасност. ЕС придаде правна сила на целите на Декларацията от Виена относно ядрената безопасност посредством изменената Директива за ядрената безопасност, която влезе в сила през 2017 г. Ключов елемент от изменената директива е въвеждането на цел за безопасност за всички оператори, за да се предотвратят инциденти и да се избегнат значителни изпускания на радиоактивни вещества. Освен това с изменената директива в правото на Евратом бяха въведени тематични партньорски проверки. Първата европейска тематична партньорска проверка вече премина с успех. Всички държави – членки на ЕС, са транспонирали новите изисквания в своето национално право. |

В подкрепа на използването на ядрената енергия за мирни цели ЕС отпусна 325 млн. евро за периода 2014—2020 г. с цел насърчаване на ядрената безопасност, радиационната защита и прилагането на ефикасни и ефективни гаранции в трети държави. Европейската комисия, в сътрудничество с МААЕ и други партньори, подкрепя прилагането на стратегически генерален план за възстановяване на околната среда в Централна Азия и популяризира, заедно с Киргизката република, провеждането на международна донорска конференция на 8 ноември 2018 г., на която бяха поети ангажименти за над 17 милиона евро от страна на участниците в изпълнението на генералния план. |

ЕС и неговите държави членки продължават да поддържат твърдо програмата на МААЕ за техническо сътрудничество, включително чрез значителен принос за фонда за техническо сътрудничество и инициативата за мирно използване. ЕС и неговите държави членки са на второ място по принос към програмата за техническо сътрудничество, която е важен инструмент за създаването на условия за безопасно и сигурно използване за мирни цели на ядрената технология и за постигане на целите, набелязани в Програмата до 2030 г. за устойчиво развитие. |

ЕС и МААЕ провеждат ежегодно среща на старши служители с цел преглед и планиране на широкообхватното сътрудничество помежду им. Последната среща беше организирана от МААЕ на 8 февруари 2018 г. във Виена. В обсъжданията беше поставен акцент върху укрепването на сътрудничеството в областта на ядрената безопасност, сигурността, гаранциите, устойчивото развитие, ядрената енергия, научните изследвания и иновациите. Върховният представител на ЕС по въпросите на външните работи и политиката на сигурност и заместник-председател на Комисията (ВП/ЗП) проведе обсъждания с генералния директор на МААЕ през март. |
Договор за всеобхватна забрана на ядрените опити (ДВЗЯО)

Бързото влизане в сила и универсалният характер на ДВЗЯО са важни цели на Стратегията на ЕС срещу разпространението на оръжия за масово унищожение. Всички държави – членки на ЕС, засвидетелстваха своята ангажираност към Договора, като го ратифицираха и започнаха да прилагат основните задължения, предвидени в него. ДВЗЯО е стабилна мярка за изграждане на доверие и сигурност. ЕС насърчава последователно ползите и добавената стойност на този договор за мира, сигурността, разоръжаването и неразпространението, включително по отношение на неговите граждански приложения и подкрепя финансово Подготвителния комитет на Организацията на ДВЗЯО (ОДВЗЯО). |

На 26 февруари 2018 г. Съветът прие Решение (ОВППС) 2018/ 298 на Съвета (2) относно подкрепата от страна на Съюза за дейностите на Подготвителната комисия на Организацията на Договора за всеобхватна забрана на ядрените опити (ОДВЗЯО) с оглед укрепване на капацитета ѝ за наблюдение и контрол. Финансовата подкрепа на стойност над 4,5 милиона евро за период от две години е предназначена за: сертифицираните спомагателни сеизмични станции, които са част от международната система на ОДВЗЯО за наблюдение; разработването на системи за вземане на проби от благородни газове чрез проучване на материали за по-добра адсорбция на ксенон; продължаване на кампаниите за измерване на фона на радиоактивния ксенон в различни региони на света; системата за съвкупно прогнозиране с цел количествено измерване на неопределеността и нивото на доверителност в симулациите за моделиране на атмосферния пренос (МАП); научната оценка на повишаването на резолюцията за инструментите за МАП; разработването на нов софтуер; подобряването на обработката и засичането на благородни газове във връзка с инспекциите на място; засилването на капацитета за автоматично обработване и интегриране на сеизмични, хидроакустични и инфразвукови данни в софтуера NDC-in-a-Box; интегрираните дейности за осведомяване и изграждане на капацитет, насочени към подписалите и неподписалите ДВЗЯО държави. ЕС и неговите държави членки допринасят също за поддържането и укрепването на режима на ДВЗЯО за контрол посредством предоставянето на техническа подкрепа и експертни съвети в работна група Б на ОДВЗЯО и на други работни срещи и семинари. |

По покана на групата на приятелите на ДВЗЯО, в която участват Австралия, Канада, Финландия, Германия, Япония и Нидерландия, ВП/ЗП на ЕС взе участие в деветата министерска среща, проведена в Ню Йорк на 27 септември 2018 г., като по този повод направи съгласувано изявление на ЕС. От нейно име специалният пратеник на ЕСВД по въпросите на разоръжаването и неразпространението, заедно с изпълнителния секретар на ОДВЗЯО и външния министър на Белгия, взе участие в конференция на високо равнище „Към свят без ядрени опити: да изпълним обещаното“, организирана от Белгия на 22 май 2018 г. Изпълнителният секретар на ОДВЗЯО д-р Ласина Зербо направи основното изказване на проявата, чийто домакин беше белгийският заместник министър-председател и министър на външните работи и европейските въпроси Дидие Рендерс. ЕС взе участие в Симпозиума за наука и дипломация в рамките на ОДВЗЯО, проведен през май 2018 г. |

ЕС използва всяка възможност да пледира за ратификацията на ДВЗЯО на международни форуми и срещи с държави, които още не са подписали или ратифицирали договора, и продължава да използва дипломатически средства, за да насърчи влизането в сила на ДВЗЯО в тези страни. Експертният опит и средствата на ЕС могат да помогнат на държавите, които нямат ресурс да прилагат разпоредбите на договора. ЕС приветства горещо ратифицирането на договора от Тайланд през 2018 г. Въпросът за ДВЗЯО беше застъпен в двустранния политически диалог и в диалога по въпросите на неразпространението с Индия, Пакистан и САЩ. |
Инициативи, свързани с ядрената сигурност

През 2018 г. ЕС реши да подкрепи финансово и един от основните елементи на глобалната структура за ядрена сигурност и борба с тероризма – Международната конвенция за предотвратяването на актове на ядрен тероризъм (ICSANT). С подкрепата се цели да се увеличи броят на присъединилите се към ICSANT, да се повиши осведомеността сред националните политици и вземащите решения, както и изграждането на капацитет: да се способства за подобряване на националното законодателство и укрепването на капацитета на заинтересованите страни на национално равнище, включително на служителите, работещи в областта на наказателното правосъдие, които се занимават с разследване, наказателно преследване и постановяване на решения по дела във връзка с ядрен тероризъм. На 10 декември Съветът прие Решение (ОВППС) 2018/1939 на Съвета (3) относно подкрепата от Съюза за всеобщото приемане и ефективното прилагане на Международната конвенция за предотвратяването на актове на ядрен тероризъм. ЕС ще предостави почти пет милиона евро за период от три години на Службата на ООН по наркотиците и престъпността и Службата на ООН за борба с тероризма. Решението на Съвета ще утвърждава всеобщото приемане и ефективното прилагане на ICSANT посредством разработването и поддръжката на защитен с парола уебсайт, отнасящ се до всички ресурси на ICSANT, включително примери за национално законодателство; разработването на модул за електронно обучение по ICSANT, който да бъде преведен най-малко на четири от официалните езици на ООН; предоставянето на съответната правна помощ; изграждането на капацитет на съответните заинтересовани страни, включително служители, работещи в областта на наказателното правосъдие, които могат да участват в разследването, наказателното преследване и произнасянето по дела, отнасящи се до ядрени и други радиоактивни материали, обхванати от ICSANT; провеждането на глобални и регионални семинари и посещения по държави и събиране и разпространяване на добри практики. |

ЕС продължи да подкрепя Глобалната инициатива за борба с ядрения тероризъм (ГИБЯТ) и нейната мисия за укрепване на общия капацитет за предотвратяване, откриване и реагиране на ядрения тероризъм. ЕС участва в срещата на групата за прилагане и оценка на ГИБЯТ (11—12 юни 2018 г.), организирана от Финландия; Работната група относно откриването на ядрени материали организира двудневна среща на експерти в Билтховен, Нидерландия, на 25 и 26 януари 2018 г. ЕС и неговите държави членки активно участват в работата на групата за прилагане и оценка по линия на ГИБЯТ във всички области: откриване на ядрени материали, ядрени експертизи и реагиране и ограничаване. ЕС даде своя активен принос за съдържанието на всички свързани с въпроса документи на работните групи към Групата за прилагане и оценка. Европейският съюз и неговите държави членки организират и участват в прояви, за да се спомогне за повишаване на осведомеността и ангажираността в международен план по въпросите на ядрената сигурност, като семинара и експертната среща Blue Lion за възстановяването и управлението на последиците, организирани от Обединеното кралство от 6 до 8 февруари 2018 г.; Fierce Falcon: семинар относно сигурността на радиологичните източници и реакцията при кражби, организиран от Унгария в сътрудничество с ГИБЯТ и Министерството на енергетиката на САЩ на 10 – 12 април 2018 г.; и семинара Sentinel II: разработване на национални програми за учения в областта на ядрената сигурност, организиран от Литва съвместно с Обединеното кралство на 9 – 11 октомври 2018 г. |

Центърът на ЕС за обучение по ядрена сигурност, който има за цел разкриването и реагирането на незаконни действия с ядрени и други радиоактивни материали (EUSECTRA), работи пълноценно от 2013 г. в полза на държавите – членки на Европейския съюз, и държавите партньори, сред които няколко членове на ГИБЯТ. Центърът се управлява от Съвместния изследователски център на ЕО в неговите обекти в Карлсруе (Германия) и Испра (Италия), в тясно сътрудничество с други международни инициативи, популяризирани от Международната агенция за атомна енергия, и няколко страни – партньори на ГИБЯТ. Центърът се използва и за практически упражнения, свързани най-вече с противодействието на контрабандата на ядрени материали. EUSECTRA работи за посрещане на нуждите от обучение на държавите – членки на ЕС, и партньорите на ЕС, включително като предоставя ползващи се с голямо одобрение координирани обучения за делегати на държавите членки в областта на митниците и правоприлагането, които вече са изпълнени и планирани за 2019—2021 г. (в пряко сътрудничество с ГД HOME и ГД TAXUD на ЕК) и изготвя оценка на действието на оборудването по искане на държавите членки. |

Европейската комисия и държавите – членки на ЕС, продължиха дейностите си по ядрена криминалистика с цел базово характеризиране на заловените ядрени материали с помощта на усъвършенстваните ядренокриминалистични разследвания на площадката на СИЦ в Карлсруе (Германия). Бяха анализирани ядрени материали, открити и иззети при повече от 50 инцидента, като по този начин беше оказана помощ на компетентните органи на държавите – членки на ЕС, и на държави извън Съюза. |
Инициативи, свързани с ядрената проверка

ЕС и неговите държави членки подкрепиха Резолюция 2016 на Общото събрание на ООН относно проверката на ядреното разоръжаване за създаването на група от правителствени експерти, която да поеме ролята на проверката за постигането на напредък в ядреното разоръжаване, и последвалото решение на Първи комитет през 2017 г. да запази тази точка в дневния ред. ЕС подкрепя работата на по-широки партньорства и договорености за проверка в сътрудничество и участва в работата на Международното партньорство за проверка на ядрено разоръжаване от неговото създаване през 2015 г. Активната ангажираност на ЕС продължи и през Фаза II на Международното партньорство за проверка на ядрено разоръжаване като ЕС (ЕСВД, Европейската комисия, Съвместният изследователски център и DG ENER) взе участие в заседанията на работните групи в Стокхолм на 26—28 март 2018 г. и в Сеул на 10—12 юли, както и на пленарното заседание в Лондон на 3—7 декември. Като основни цели са определени значителната подкрепа за групата от правителствени експерти към ООН за проверка на ядреното разоръжаване и за Конференцията за преглед на Договора за неразпространение на ядреното оръжие през 2020 г. |
Регионални въпроси

Продължаващите дипломатически усилия по отношение на Корейската народнодемократична република (КНДР) са положително развитие, което допринася за намаляване на напрежението на корейския полуостров. ЕС призовава КНДР да се ангажира твърдо в предстоящите преговори и да сложи край на своите програми за ядрено оръжие, оръжия за масово унищожение и балистични ракети по цялостен, подлежащ на проверка и необратим начин, незабавно да преустанови всички свързани с това дейности и да се върне бързо към Договора за неразпространение на ядреното оръжие и гаранциите на МААЕ, както и незабавно да подпише и ратифицира Договора за всеобхватна забрана на ядрените опити. |

Докато КНДР не предприеме конкретни стъпки за премахване на ядреното оръжие, ЕС ще продължи стриктно да прилага действащите санкции и да насърчава всички държави да правят същото. ЕС е транспонирал всички резолюции на Съвета за сигурност на ООН, свързани с КНДР, и освен това е въвел собствен независим режим на санкции спрямо КНДР, който допълва и засилва ограничителните мерки на ООН. Общият брой на лицата, допълнително включени от ЕС в списъка на санкциите, е 59. Като част от собствения си режим на санкции ЕС замрази активите на 9 образувания. Освен това ЕС предприе активни дипломатически усилия, за да подчертае необходимостта от твърдо прилагане на всички съответни резолюции на Съвета за сигурност на ООН от всички държави – членки на ООН. Когато е необходимо, ЕС има готовност да предостави конкретна подкрепа за изграждането на капацитет във връзка със засилването на санкциите. |
Конференция по разоръжаването/Договор за забрана на разпадащи се материали за ядрени оръжия или други ядрени взривни устройства

ЕС продължава да бъде единен и ангажиран по отношение на подлежащото на проверка разоръжаване и контрол над оръжията въз основа на договора и изтъква, че е необходимо да се подновят многостранните усилия и да се съживи работата на органите за многостранни преговори, по-специално Конференцията по разоръжаването. ЕС приветства съществената работа, в съответствие с договорения мандат на спомагателните органи, за постигането на разбирателство в области с общи елементи, задълбочаването на техническите обсъждания и разширяването на областите на съгласие и обмислянето на ефективни мерки, включително правни инструменти за преговори, както и приемането на четири значителни доклада, които биха могли да бъдат солидна база за работа през 2019 г. |

Съгласно документ CD/1299 и съдържащия се в него мандат дългосрочният приоритет на ЕС в рамките на Конференцията по разоръжаването е незабавното започване на преговорите по договор за забрана на разпадащи се материали за ядрени оръжия или други ядрени взривни устройства. ЕС поздравява Канада за постигнатия консенсус в рамките на експертната подготвителна група на високо равнище по Договора за забрана на разпадащи се материали за ядрени оръжия или други ядрени взривни устройства и приветства приобщаващия консултативен процес, започнат с Резолюция 71/259 на Общото събрание на ООН, за да се вземат предвид вижданията на по-голямата част от членовете на ООН. ЕС предоставя значителна финансова помощ на Службата на ООН по въпросите на разоръжаването (UNODA), за да се улесни участието на държавите от Африка, Азия, Латинска Америка и Карибския регион в консултациите и другите дейности, свързани с Договора за забрана на разпадащи се материали за ядрени оръжия или други ядрени взривни устройства. ЕС призовава всички членове на Конференцията по разоръжаване да започнат незабавно преговори по договор за забрана на разпадащи се материали за ядрени оръжия или други ядрени взривни устройства и да работят по останалите въпроси, включени в програмата. ЕС насърчава всички държави, притежаващи ядрено оръжие, които още не са го направили, да обявят и да поддържат непосредствен мораториум върху производството на разпадащи се материали за ядрени оръжия или други ядрени взривни устройства. Двете европейски ядрени държави обявиха съответните мораториуми и унищожиха или преобразуваха тези съоръжения. |
ХИМИЧЕСКО ОРЪЖИЕ

ЕС продължи да подкрепя Организацията за забрана на химическото оръжие (ОЗХО), за да се гарантира пълното и ефективно прилагане и всеобщото присъединяване към Конвенцията за забрана на химическото оръжие (КЗХО). На 16 април 2018 г. Съветът прие заключения, в които се изтъква отново категоричната подкрепа на ЕС за химическото разоръжаване и неразпространението и се излагат позициите на ЕС за Четвъртата специална сесия на конференцията на държавите – страни по конвенцията, за преглед на действието на КЗХО на 21–30 ноември 2018 г. В тази рамка ЕС участва активно и конструктивно в подготовката и работата на Четвъртата конференция за преглед на КЗХО с цел да се гарантира значимостта и да се повишат ефективността и капацитетът на конвенцията, включително като се вземат предвид настоящите и бъдещите предизвикателства. Въпреки липсата на консенсус по заключителния документ от конференцията за преглед ЕС запази решимостта си да подкрепя твърдо мандата и работата на ОЗХО. В това отношение ЕС приветства решенията относно програмата и бюджета на ОЗХО за 2019 г., които предоставят на техническия секретариат на ОЗХО ясна и солидна основа за справяне с многобройните задачи и предстоящите предизвикателства. |

Наред с това ЕС категорично подкрепи инициативата за свикване на специалната сесия на конференцията на държавите – страни по КЗХО на 26—27 юни 2018 г. с цел запазване и утвърждаване на КЗХО и на глобалната забрана за употреба на химическо оръжие. Конференцията беше подходящият отговор на многократното използване на такива оръжия от 2012 г. насам в Сирия, Ирак, Малайзия и Обединено кралство Великобритания и Северна Ирландия. Ето защо ЕС приветства приемането на Решение C-SS-4/DEC.3 на ОЗХО от 27 юни 2018 г., озаглавено „Преодоляване на заплахата от химическо оръжие“. В заключенията си от 28 юни Европейският съвет пое ангажимент ЕС да подкрепя прилагането на решението на специалната конференция. В този контекст ЕС проведе демарш пред голям брой държави – страни по КЗХО, като ги прикани да проявят конструктивен подход при прилагането на Решението на ОЗХО и да подкрепят успешното провеждане на четвъртата конференция за преглед на КЗХО. |

На 26 февруари 2018 г. Съветът прие Решение (ОВППС) 2018/294 (4), с което се удължава действието на Решение (ОВППС) 2015/259 на Съвета (5) до края на 2018 г., за да се даде възможност за пълното осъществяване на дейностите след датата, на която се прекратява действието на последното. Успоредно с това Съветът обсъди новия, седми последователен проект за решение на Съвета в подкрепа на ОЗХО с цел то да бъде прието в началото на 2019 г. С новото решение ще се удължи подкрепата на ЕС за основните дейности на ОЗХО (като национално прилагане, международно сътрудничество, универсално прилагане, програмата „Африка“) за периода 2019—2022 г. Освен това то ще допринесе съществено за осъвременяването на лабораторията на ОЗХО в Център за химия и технологии и за изпълнението на Решението на ОЗХО „Преодоляване на заплахата от химическо оръжие“. |

В този контекст ЕС продължи твърдо да подкрепя мисията на ОЗХО за установяване на факти и екипа за оценяване на декларацията при разследването на сведения за употребата на химическо оръжие в Сирия и в усилията за проверка на декларацията на Сирия. Във връзка с това на 10 декември 2018 г. Съветът прие Решение (ОВППС) 2018/1943 (6) за удължаване с дванадесет месеца на периода на прилагане на Решение (ОВППС) 2017/2303 (7) за предоставянето на спътникови изображения в подкрепа на операции на ОЗХО в Сирия. |

През октомври 2018 г. ЕС прие нов режим на ограничителни мерки за борба с употребата и разпространението на химическо оръжие, посредством Решение (ОВППС) 2018/1544 на Съвета (8) и Регламент (ЕС) 2018/1542 на Съвета (9). |
БИОЛОГИЧНО ОРЪЖИЕ

След проведената на 4–8 декември 2017 г. среща на държавите – страни по Конвенцията за биологичните и токсичните оръжия (КБТО), на която бе постигнато споразумение относно междусесийна работна програма, ЕС продължи да оказва силна политическа и финансова подкрепа за пълното и ефективно прилагане и универсалното приемане на конвенцията, включително чрез цялостно изпълнение от звеното за подпомагане на прилагането (ЗПП) на КБТО на четвъртата програма на ЕС за помощ, предвидена в Решение (ОВППС) 2016/51 на Съвета (10). Бяха организирани два регионални семинара в подкрепа на универсалното присъединяване към конвенцията в Африка и четири регионални семинара за насърчаване на диалога в областта на науката и технологиите сред държавите от Латинска Америка, Субсахарска Африка и Близкия изток и Северна Африка. Проведени бяха още седем семинара и обучения в държавите, които се ползват от програми за разширено подпомагане относно прилагането на конвенцията на национално равнище. |

Освен това ЕС взе активно и конструктивно участие в дискусиите по време на срещата на държавите — страни по конвенцията, проведена от 4 до 7 декември 2018 г. Като потвърждава отново твърдата си подкрепа за КБТО като основен стълб на основаната на правила международна система, ЕС изрази дълбокото си безпокойство във връзка с критичното финансово състояние на конвенцията и призова за спешни мерки, за да се гарантира финансовата стабилност и да се осигури правилното прилагане на междусесийната програма. ЕС приветства началото на междусесийния процес и техническите и съществените обсъждания по време на срещите на експерти по КБТО, проведени в периода 7–16 август 2018 г., и подкрепи предприемането на последващи действия от срещата на държавите—страни по конвенцията. Ето защо е окуражително, че на срещата през декември на държавите—страни по КБТО, беше постигнат консенсус относно мерките за гарантиране на финансовата стабилност и предвидимост през следващата година. Независимо от това ЕС ще следи отблизо финансовото състояние на КБТО, което ще бъде обект на преглед от срещата на държавите – страни по конвенцията през 2019 г. Същевременно буди съжаление фактът, че не беше постигнат консенсус по съществени въпроси, за да се отразят резултатите от срещата на експертите по КБТО, проведена през август 2018 г. ЕС подкрепи работата на срещите по КБТО през 2018 г., като представи работен документ и организира няколко съпътстващи прояви. |

От 2006 г. ЕС е предоставил значителна подкрепа за основни дейности по КБТО посредством четири последователни програми за помощ. Пето решение в подкрепа на КБТО, обхващащо периода 2019—2022 г., беше прието от Съвета през януари 2019 г. С това цялостната сума на подкрепата на ЕС за КБТО ще нарасне на почти 10 милиона евро. Това включва също финансиране на UNSGM, което позволява на Службата на ООН по въпросите на разоръжаването да изпраща разпределени квалифицирани експерти на курсове за обучение, организирани от държавите членки. |
БАЛИСТИЧНИ РАКЕТИ
Хагски кодекс за поведение

Хагският кодекс за поведение срещу разпространението на балистични ракети (ХКП) е резултат от усилията на международната общност да регламентира въпросите, свързани с балистичните ракети, способни да служат за носители на оръжия за масово унищожение. ХКП е единственият многостранен инструмент за прозрачност и изграждане на доверие във връзка с разпространението на балистичните ракети. От самото начало Европейският съюз категорично подкрепя кодекса. Всички държави – членки на ЕС, се присъединиха към кодекса. |

Чрез присъединяването си към ХКП членовете поемат доброволен политически ангажимент да уведомяват преди изстрелването на балистични ракети и космически ракети носители и за изпитателни полети. Присъединилите се държави се ангажират също да представят годишна декларация за своите политики в областта на балистичните ракети и космическите ракети носители. |

От подписването и влизането в сила на политически обвързващия Хагски кодекс за поведение през ноември 2002 г. в Хага, Нидерландия, броят на подписалите държави се е увеличил от 93 на 139. |

ЕС играе водеща роля в насърчаването и подкрепянето на универсалния характер, пълното прилагане и по-доброто функциониране, които са трите основни цели на кодекса. В продължение на повече от десетилетие Съветът на ЕС е приел поредица от решения/съвместни действия в рамките на ОВППС, които са предоставили средствата за продължаване на подкрепата на ЕС за Хагския кодекс за поведение и за неразпространението на балистични ракети като цяло. Чрез тези решения на Съвета ЕС финансира дейности за популяризиране на ХКП, включително съпътстващи прояви, научи изследвания, срещи на експерти и семинари за повишаване на осведомеността на регионално равнище. Дейностите се провеждат от парижката Фондация за стратегически изследвания (Fondation pour la Recherche Stratégique), обикновено с участието и на ротационния председател на ХКП. |

С новоприетото Решение (ОВППС) 2017/2370 на Съвета (11) от 18 декември 2017 г. ЕС ще продължи да насърчава присъединяването към Кодекса и в крайна сметка неговия универсален характер; да подкрепя пълното прилагане на Кодекса; да насърчава диалога между присъединилите се и неприсъединилите се държави, с оглед да се допринесе за изграждането на доверие и прозрачност, да се насърчава сдържаността и да се създаде по-голяма стабилност и сигурност за всички; да популяризира по-широко Кодекса и да повишава обществената осведоменост за рисковете и заплахите, свързани с разпространението на балистични ракети; и да проучва, по-специално чрез научни изследвания, възможностите за подобряване на Кодекса и за насърчаване на сътрудничеството между Кодекса и други имащи отношение многостранни инструменти. |
Режим за контрол на ракетните технологии

Режимът за контрол на ракетните технологии (РКРТ) е неформално политическо споразумение между държавите, които се стремят към ограничаване на разпространението на ракети и ракетни технологии, включително категоризирането на тези от тях, за които като цяло се смята, че са способни да пренасят ОМУ. Насоките и контролните списъци на РКРТ съставляват най-добрите международни практики за контрол на износа на свързани с ракети изделия и технологии. |

ЕС подкрепя приемането на едно по-категорично публично изявление, което да отразява загрижеността на международната общност във връзка с изстрелването на балистични ракети и значителното разработване на ракетни технологии от Иран и КНДР. Важен въпрос за ЕС в контекста на РКРТ продължава да бъде блокираното присъединяване на Естония, Кипър, Латвия, Литва, Малта, Румъния, Словакия, Словения и Хърватия към режима. Нещо повече, продължителната липса на председателство на режима е въпрос, който буди сериозно безпокойство. |
РЕЗОЛЮЦИЯ 1540 (2004) НА СЪВЕТА ЗА СИГУРНОСТ НА ООН И НАМАЛЯВАНЕ НА ХБРЯ РИСКОВЕ

Резолюция 1540 (2004) на Съвета за сигурност на ООН продължава да бъде основополагащ елемент на международната система за неразпространение. Тя е първият международен правен инструмент за решаване по интегриран и всеобхватен начин на проблема с оръжията за масово унищожение, средствата за доставянето им и свързаните с тях материали. С Резолюция 1540 (2004) на СС на ООН се установяват обвързващи задължения за всички държави. Те целят предотвратяване и възпиране на достъпа на недържавни субекти до такива оръжия и свързаните с тях материали. Приета съгласно глава VII от Устава на ООН, резолюцията изисква от всички държави да приемат необходимото законодателство, с което на недържавни участници се забранява да се сдобиват с ядрени, химически или биологични оръжия и да създадат подходящи национални механизми за контрол на свързаните с тези оръжия материали с цел предотвратяване на техния незаконен трафик. Процесът на комплексен преглед от 2016 г. на Резолюция 1540 на СС на ООН отново потвърди нейната централна роля, значимост и авторитет, както е отразено в Резолюция 2325 на СС на ООН. |

За да се помогне за внедряването на резултатите от комплексния преглед от 2016 г. и да се подкрепи пълното прилагане на Резолюция 1540 на СС на ООН, на 11 май 2017 г., Съветът на ЕС прие Решение (ОВППС) 2017/809 на Съвета (12) в подкрепа на изпълнението на Резолюция 1540 (2004) на Съвета за сигурност на ООН относно неразпространението на оръжия за масово унищожение и средствата за тяхното доставяне. Решението на Съвета обхваща период от 36 месеца и се изпълнява от Службата на ООН по въпросите на разоръжаването (СВР на ООН) в Ню Йорк, която е възложила част от изпълнението на ОССЕ във Виена като подизпълнител. ЕС споделя целите за подпомагане на държавите при определянето на конкретната техническа помощ, подобряването на осведомеността за съответните програми за техническа помощ, както и за засилване на сътрудничеството с международните и регионалните организации в подкрепа на усилията за изграждане на национален капацитет. |

Инициативата за центровете на ЕС за високи постижения в областта на намаляване на ХБРЯ рискове е световна програма за изграждане на капацитет, в която участват 61 държави партньори, групирани около 8 регионални секретариата, разположени в следните региони: Африканското крайбрежие на Атлантическия океан; Централна Азия; Източна и Централна Африка; държавите от Съвета за сътрудничество в Персийския залив; Близкия изток; Северна Африка и Сахел; Югоизточна Азия; Югоизточна и Източна Европа. |

Центровете за високи постижения в областта на ХБРЯ се финансират по линия на Инструмента, допринасящ за стабилността и мира (IcSP), и тяхната цел е да се намаляват рисковете, свързани с ХБРЯ материали, да се укрепи готовността на държавите партньори и да се утвърждава култура на сигурност и управление. Участващите държави получават подкрепа в своите усилия за създаване на национални и регионални координационни и управленски структури на доброволна основа и съобразно регионален подход „отдолу-нагоре“. Тези платформи разработват предложения за политики и капацитет въз основа на конкретни оценки на потребностите и национални планове за действие. Те се подпомагат по няколко регионални проекта за сътрудничество, финансирани по тази инициатива и отворени за други инструменти за финансиране. От 2010 г. до днес са финансирани 66 регионални проекта. Бюджетът на инициативата за 10-годишния период, считано от 2010 г., възлиза на 250 млн. евро. |

Мрежата от центрове за високи постижения вече е добре развита и това позволи на ЕС да организира симулационни и полеви трансгранични учения, в т.ч. по въпроси, свързани с гражданската защита, реакцията при инциденти, биологичната сигурност и управлението на отпадъците в рамките на проекти на центровете за високи постижения, с цел подобряване на видимостта и конкретно оценяване на тяхното въздействие. Освен това инициативата е в достатъчно напреднал етап, за да подкрепи по-нататъшните действия за решаване на свързаните с управлението на сигурността въпроси от областта на киберпрестъпността, тероризма, критичните инфраструктури, фалшифицираните лекарствени продукти, хибридните заплахи и взривните вещества, както и да задълбочи сътрудничеството в сферата на ядрената криминалистика, граничния контрол и контрола върху износа на изделия с двойна употреба. Този модел от центрове за високи постижения беше приветстван и от Европейската сметна палата (13), което беше последвано от заключения на Съвета на 26 октомври 2015 г. (14) |

През октомври 2017 г. Комисията представи — като част от по-широк пакет от мерки за борба с тероризма — план за действие за повишаване на готовността срещу рискове, свързани със химичната, биологичната, радиологичната и ядрената сигурност. Новият план за действие, който се основава на постиженията на плана за действие на ЕС в областта на ХБРЯ материалите за периода 2010—2015 г., предлага широк кръг от мерки за подобряване на готовността, устойчивостта и координацията на равнище ЕС. Той предлага създаването на ХБРЯ архитектура на равнището на ЕС с по-голяма насоченост към сигурността, като набляга на необходимостта от по-добро използване на съществуващите ресурси и от обединяване на наличните експертни познания. В плана за действие се призовава също така за укрепване на готовността и реакцията на ЕС при ХБРЯ рискове чрез трансгранични и междусекторни обучения и учения. В него се подчертава необходимостта от включване по целесъобразност на гранични и митнически органи и военни партньори. В плана за действие се подчертава също така значението на тесните връзки между вътрешните и външните дейности, свързани с ХБРЯ сигурност, както и на сътрудничеството със специализираните многостранни организации като МААЕ, ОЗХО или Интерпол. Изпълнението на плана за действие ще бъде финансово подкрепено чрез фонд „Вътрешна сигурност – полиция“. |

Планът за действие в областта на ХБРЯ материали е получил научна и техническа подкрепа от редица научноизследователски проекти, финансирани по програмата „Сигурно общество“ по линия на Седмата рамкова програма,. Научните изследвания обхващат целия цикъл на управлението на кризи от превенцията до възстановяването. Дейностите по набелязване на нуждите от стандартизация биха могли да доведат до изработването на европейски стандарти. Програмата „Хоризонт 2020“ ще засили текущата научноизследователска работа в областта на ХБРЯ материалите чрез специализирани теми. |
ЕКСПЕРТНИ ЦЕНТРОВЕ

Въз основа на Решение 2010/430/ОВППС на Съвета (15) от 26 юли 2010 г. изпълнението на Стратегията на ЕС срещу разпространението на оръжия за масово унищожение получи активна подкрепа от Консорциума на ЕС по неразпространението, който започна работа през януари 2011 г. На 26 февруари 2018 г. Съветът прие Решение (ОВППС) 2018/299 (16), с което допълнително разширява подкрепата на ЕС за дейностите на консорциума за периода 2018—2021 г. чрез доразвиване на досегашните постижения и добавянето на нови проекти. |

Дейностите на консорциума осигуриха по-голяма видимост на ЕС по отношение на трети държави и гражданското общество и допринесоха значително за оформянето на политиката на ЕС в областта на неразпространението и разоръжаването. Консорциумът предоставя платформа за неформални контакти между специалистите и насърчава диалога между различните заинтересовани страни. Неговите дейности подпомогнаха повишаването на осведомеността относно предизвикателствата, произтичащи от оръжията за масово унищожение и конвенционалните оръжия. Консорциумът разполага с обширна мрежа от повече от 70 експертни центъра в цяла Европа. |

На 18—19 декември 2018 г. в Брюксел се проведе седмата конференция на ЕС по въпросите на неразпространението и разоръжаването, организирана от Консорциума на ЕС по неразпространението. |
КОНТРОЛ НА ИЗНОСА

През 2018 г. ЕС продължи редовно да актуализира своите регламенти спрямо промените в многостранните режими за контрол на износа. Във връзка с това на 10 октомври 2018 г. Европейската комисия прие делегиран регламент (17), с който се актуализира контролният списък на ЕС в съответствие с решенията, приети в рамките на многостранните режими за контрол върху износа през 2017 г., и въведе промени, напр. контрол на генетичните елементи и генетично модифицираните организми, системи и оборудване за проверка или снемане на размерите, високо енергийни клетки, софтуер за проникване и космически ракети носители. |

Координационната група по въпросите на изделията с двойна употреба продължи да подпомага ефективното и последователно прилагане на контрола върху износа в ЕС. Бяха въведени нови функции в „Електронната система относно изделията с двойна употреба“, които подобриха обмена на информация и техническия обмен в рамките на ЕС. ЕС постави началото на процес за установяване на насоки за съответствие на отрасъла и проведе публична консултация по въпроса в периода октомври – ноември 2018 г. Освен това ЕС започна проект за „електронно лицензиране“ в подкрепа на използването на системи за електронно лицензиране от компетентните органи. Беше публикуван годишен доклад (18), за да се гарантира прозрачност по отношение на контрола на износа и лицензионните дейности, а на 13 декември 2018 г. беше организиран форум по въпросите на контрола на износа, в който взеха участие заинтересовани страни от държавите членки, промишлеността и гражданското общество (19). |

Продължи прегледът на политиката на ЕС за контрол на износа. Съветът и Европейският парламент активно обсъдиха законодателното предложение на Комисията за модернизиране на контрола на износа в ЕС и адаптирането му към бързо променящите се технологични, икономически и политически условия. Европейският парламент прие позицията си на първо четене на 17 януари 2018 г., като обсъжданията в Съвета продължиха. Освен това на 19 декември 2018 г. Комисията прие законодателно предложение във връзка с несигурността, свързана с Брекзит, за смекчаване на потенциалните последици от него, в случай че не се постигне съгласие по споразумение за оттегляне (COM(2018)891). |

В зависимост от случая бяха съгласувани позиции и изявления на ЕС като част от подготовката за съответните заседания на режимите за контрол на износа: пленарното заседание на Групата на ядрените доставчици в Юрмала (11 – 15 юни 2018 г.) и пленарното заседание на Австралийската група в Париж (7-8 юни 2018 г.). |

Продължи изпълнението на партньорската програма на ЕС за контрол на износа, чиято цел е да се подобри ефективността на системите за контрол на износа на изделия с двойна употреба и свързаните с тях материали, оборудване и технологии. Понастоящем програмата обхваща 36 държави от шест региона. През 2017 г. тя беше разширена, за да се даде възможност за сътрудничество с Ливан. Две нови регионални инициативи – целевите инициативи за контрол на износа – бяха лансирани през 2017 и 2018 г. с Центъра за наука и технологии на Украйна и Международния център за наука и технологии в Казахстан, които обхващат 12 държави. |

Продължи интензивната координация на партньорската програма на ЕС за контрол на износа с програмата на Държавния департамент на САЩ за контрол върху износа и свързаната с него сигурност на границите. Бяха организирани съвместни семинари ЕС—САЩ за определяне на общи показатели за въздействието и координиране на помощта на място. През 2018 г. ЕС организира втория диалог относно управлението на контрола на износа – конференция с участието на четирите режима за контрол на износа с партньорски организации и държави. Организиран бе годишен летен университет в рамките на партньорската програма на ЕС за партньорите по програмите на ЕС по места относно контрола на износа. Порталът на ЕС по партньорската програма на ЕС (https://export-control.jrc.ec.europa.eu/) продължи да служи като платформа за всички европейски програми по места относно контрола на износа на военни изделия и изделия с двойна употреба, с цел да се адаптира обменът на информация спрямо отделните държави – партньори на ЕС. Програмата се финансира по линия на Инструмента, допринасящ за стабилността и мира. |
КОСМИЧЕСКО ПРОСТРАНСТВО

ЕС насърчи продължаването на работата по предотвратяването на надпреварата във въоръжаването в космоса (PAROS), по принципите на отговорно поведение в космоса и по прозрачността и мерките за изграждане на доверие. ЕС подкрепи работата на работната група на Комитета на ООН за мирно използване на космическото пространство (COPUOS) по дългосрочната устойчивост на дейностите в космоса. Тъй като насоките за дългосрочната устойчивост на дейностите в космоса не бяха приети през 2018 г., ЕС ще продължи да работи с всички партньори за приключване на преговорите. |

През юни ЕС участва с успех в заседанието на високо равнище на UNISPACE+50 на COPUOS във Виена. В изявлението си ЕС подчерта важното значение на прозрачността и мерките за изграждане на доверие и за утвърждаване в рамките на ООН на принципите за отговорно поведение в космоса. ЕС изтъкна, че е важно да се постигне съгласие по правно необвързващ инструмент, като начин за постигането на тези цели. Освен това ЕС и неговите държави членки насърчаваха сигурността и безопасността в космоса в групата на правителствените експерти относно предотвратяването на надпреварата във въоръжаването, конференцията за разоръжаването, включително нейния спомагателен орган 3, Комисията на ООН за разоръжаването и Общото събрание на ООН. ЕС ще се стреми да гарантира, че заключенията на Съвета от декември 2017 г. и февруари 2018 г. относно UNISPACE+50 ще бъдат отразени в програмата за космическото пространство до 2030 г. и в плана за изпълнението ѝ, които ще бъдат представени на Общото събрание на ООН през 2020—2021 г. |

В съответствие с политиката си за неразпространение на ОМУ и със заключенията на Съвета от 2003 г. ЕС продължи да работи по интегрирането на ангажиментите за неразпространение на ОМУ в споразумения с трети държави. Във връзка с това през 2018 г. приключиха преговорите с Меркосур по клауза относно ОМУ в новите споразумения с тази група държави. Освен това продължиха преговорите по клаузи за ОМУ за новите споразумения с Азербайджан, Чили и Киргизстан. |

With this Decision, the EU is supporting one of the key elements of the global nuclear security and anti-terrorism architecture, the International Convention for the Suppression of Acts of Nuclear Terrorism (ICSANT). The objectives of the support are to increase the number of adherents to ICSANT, to raise awareness among national policy- and decision-makers, as well as capacity-building: to help improve national legislation and to strengthen the capacity of national stakeholders, including criminal justice officials to investigate, prosecute and adjudicate cases of nuclear terrorism. The Council Decision aims to build synergies with on-going EU projects in support for relevant international legal instruments, such as the Amendment to the Convention on the Physical Protection of Nuclear Material and UN Security Council Resolution 1540. The Council Decision will promote the universalization and effective implementation of ICSANT through the development and maintenance of a password-protected website on all resources on ICSANT including examples of national legislation; the development of an e-learning module on ICSANT, to be translated into at least four UN official languages; the provision of relevant legislative assistance; capacity building of relevant stakeholders including criminal justice officials that could be involved in investigating, prosecuting and adjudicating cases involving nuclear and other radioactive material covered by ICSANT; holding of global and regional workshops and country visits and by the collection and dissemination of good practices.
