EXPLANATORY MEMORANDUM

1.CONTEXT OF THE DELEGATED ACT

Under Article 6 (1) of Regulation (EU) xxxx/xxxx of the European Parliament and Council establishing a common framework for European statistics relating to persons and households, based on data at individual level collected from samples, the Commission is empowered to adopt delegated acts specifying the number and title of variables of the different data sets. According to Article 6 (2), the number of variables laid down in the delegated act shall not exceed by more than 5% the number of variables for each domain of those already required, on a mandatory basis, by the Commission (Eurostat) at the moment of adoption of Regulation (EU) 2019/xxx.

This delegated Regulation covers the number and title of variables for the dataset in the labour force domain. 

The Labour Force Survey (LFS) comprises a core LFS and a system combining, over an eight-year period, six regular modules and two ad hoc subjects. This delegated Regulation includes only the variables of the core LFS, plus the first regular module to be implemented in 2021 (and then repeated every 8 years) on the ‘labour market situation of migrants and their immediate descendants’. The other five regular modules on ‘work organisation and working time arrangements’, ‘accidents at work and work-related health problems’, ‘pensions and labour market situation’, ‘reconciliation of work and family life’ and ‘young people on the labour market’, as well as the ad hoc subjects (especially the ad hoc subject on job skills), will be covered by separate delegated Regulations.

2.CONSULTATIONS PRIOR TO THE ADOPTION OF THE ACT

The Commission has carried out appropriate consultations as part of the preparation of this delegated act.

The Commission consulted national experts invited to expert meetings to discuss the draft delegated act. The consultations took place at the meetings of the European Directors of Social Statistics held on 23-24 May 2019 and 27-28 June 2019.

Finally, the Expert Group 'National Statistical Institutes of the European Statistical System’ was also consulted.

The Commission has kept both the European Parliament and the Council duly informed of the consultations.

3.    LEGAL ELEMENTS OF THE DELEGATED ACT

The objective of this delegated Regulation is to adopt the number and title of the variables for the dataset in the labour force domain, as provided for in Article 6 (1) of Regulation (EU) xxx.

Only the collected variables impact on the burden. The increase in the number of collected variables (quarterly, yearly and two-yearly as well as eight-yearly) fulfils the requirement of Article 6 (2). In particular, the number of variables to be collected does not exceed by more than 5% the number of variables collected for the labour force domain at the time when Regulation (EU) 2019/xxx entered into force.

The delegated act has no implications for the EU budget.

The delegated act concerns a matter relating to the European Economic Area (EEA) and its application should therefore extend to the EEA.

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) xxxx/xxxx of the European Parliament and of the Council of DD/MM/YYYY establishing a common framework for European statistics relating to persons and households, based on data at individual level collected from samples, amending Regulations (EC) No 808/2004, (EC) No 452/2008 and (EC) No 1338/2008 of the European Parliament and of the Council, and repealing Regulation (EC) No 1177/2003 of the European Parliament and of the Council and Council Regulation (EC) No 577/98 1 , and in particular Article 6(1) thereof,

Whereas:

(1)In order to cover the needs identified in the relevant detailed topics, the Commission should specify the number and title of the variables for the data set in the labour force domain.

(2)The number of variables to be collected does not exceed by more than 5% the number of variables collected for the labour force domain at the time when Regulation (EU) 2019/xxx entered into force.

(3)The Commission has carried out appropriate consultations of national experts as part of the preparation of this delegated act.

HAS ADOPTED THIS REGULATION:

Article 1

Member States shall transmit to the Commission (Eurostat) the number and the title of the variables for the data set in the labour force domain as set out in the Annex.

Article 2

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
