COMMISSION IMPLEMENTING REGULATION (EU) 2022/1650
of 24 March 2022
amending the implementing technical standards laid down in Implementing Regulation (EU) 2016/1646 as regards the main indices and recognised exchanges in accordance with Regulation (EU) No 575/2013 of the European Parliament and of the Council

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 575/2013 of the European Parliament and of the Council of 26 June 2013 on prudential requirements for credit institutions and amending Regulation (EU) No 648/2012 (1), and in particular Article 197(8) thereof,
Whereas:

Commission Implementing Regulation (EU) 2016/1646 (2) was adopted on the premise that equity indices, to be considered as main indices for the purposes of Regulation (EU) No 575/2013 (and hence allowing institutions to use the equities composing these indices as eligible collateral) should mainly consist of equities that can reasonably be expected to be realisable when an institution needs to liquidate them. It was assumed that that would be the case when at least 90 % of the components of an index have a free float of at least EUR 500 000 000 or, in the absence of information about free float, a market capitalisation of at least EUR 1 000 000 000. That assumption remains unchanged. |

Implementing Regulation (EU) 2016/1646 also specifies that institutions should also have the possibility to recognise as eligible collateral instruments included in main indices that do not meet the abovementioned criteria, but whose components are sufficiently traded, and considers new criteria for the identification of those indices. However, experience has demonstrated that those criteria, defined with respect to the market in which an index is based, are difficult to apply against a main index established in a third country, as they require collecting data for all the shares admitted to trading in that market. That difficulty has inhibited the proper achievement of the objective of Regulation (EU) No 575/2013 to ensure a minimum threshold of liquidity of the index components. It is therefore necessary to lay down new criteria that would address the identified shortcomings. Those new criteria should ensure the adequacy of the instruments as eligible collateral and hence, ensure a sufficient liquidity threshold independently from the market on which an index is based, where two conditions related to standard market liquidity indicators are fulfilled. The first condition should require that at least 80 % of the components of an index have a free float of at least EUR 25 000 000 or, in the absence of information about free float, a market capitalisation of at least EUR 50 000 000. The second condition should require that all components of the index having a market capitalisation smaller than or equal to EUR 10 000 000 000 have a minimum average daily turnover of EUR 500 000 and all components of the index having a market capitalisation greater than EUR 10 000 000 000 have a minimum average daily turnover of EUR 1 000 000. The average daily turnover should be calculated over the 12 months of the calendar year preceding the assessment, or where applicable, the period of the 12 months of the preceding calendar year during which the financial instrument was available for trading. |

The definition of ‘recognised exchange’, laid down in Article 4(1), point (72), of Regulation (EU) No 575/2013, was most recently amended by Regulation (EU) 2019/2033 of the European Parliament and of the Council (3). That amendment consisted of the addition, in point (a) of that point (72), of the words “or a third-country market that is considered to be equivalent to a regulated market in accordance with the procedure set out in point (a) of Article 25(4) of Directive 2014/65/EU of the European Parliament and of the Council”. Due to that amendment, ‘recognised exchanges’ are no longer restricted to ‘regulated markets’ only. That amendment should be reflected in Implementing Regulation (EU) 2016/1646 by including in that Regulation those exchanges for which the Commission has adopted an equivalence decision pursuant to Article 25(4), point (a), of Directive 2014/65/EU of the European Parliament and of the Council (4). |

Following the withdrawal of the United Kingdom from the Union pursuant to Article 50 of the Treaty on European Union, the Treaties have ceased to apply to the United Kingdom from 1 February 2020 and the United Kingdom is now a third country. At present, the Commission has not adopted an equivalence decision in accordance with Article 25(4), point (a), of Directive 2014/65/EU in respect of the United Kingdom. It is therefore necessary to exclude from the list of recognised exchanges those exchanges established in the United Kingdom. |

Certain changes have occurred in the market structure since the entry into force of Implementing Regulation (EU) 2016/1646, particularly as regards the appearance of new exchanges, mergers, name changes or cessation of activities. Those changes should be reflected in Implementing Regulation (EU) 2016/1646. |

Implementing Regulation (EU) 2016/1646 should therefore be amended accordingly. |
(7) |
This Regulation is based on the draft implementing technical standards submitted to the Commission by the European Securities and Markets Authority (ESMA). |
(8) |
ESMA has conducted open public consultation on the draft implementing technical standards on which this Regulation is based, analysed the potential related costs and benefits and has requested the advice of the Securities and Markets Stakeholder Group established in accordance with Article 37 of Regulation (EU) No 1095/2010 of the European Parliament and of the Council (5). |
HAS ADOPTED THIS REGULATION:
Article 1
Amendments to Implementing Regulation (EU) 2016/1646
Implementing Regulation (EU) 2016/1646 is amended as follows:

Annex I to Implementing Regulation (EU) 2016/1646 is replaced by the text set out in Annex I to this Regulation. |
(2) |
Annex II to Implementing Regulation (EU) 2016/1646 is replaced by the text set out in Annex II to this Regulation. |
Article 2
Entry into force
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

approving non-minor amendments to the specification for a name entered in the register of protected designations of origin and protected geographical indications (‘Carne Arouquesa’ (PDO))
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1151/2012 of the European Parliament and of the Council of 21 November 2012 on quality schemes for agricultural products and foodstuffs (1), and in particular Article 52(2) thereof,
Whereas:

Pursuant to the first subparagraph of Article 53(1) of Regulation (EU) No 1151/2012, the Commission has examined Portugal’s application for the approval of amendments to the specification for the protected designation of origin ‘Carne Arouquesa’, registered under Commission Regulation (EC) No 1107/96 (2). |
(2) |
Since the amendments in question are not minor within the meaning of Article 53(2) of Regulation (EU) No 1151/2012, the Commission published the amendment application in the Official Journal of the European Union (3) as required by Article 50(2)(a) of that Regulation. |
(3) |
As no statement of opposition under Article 51 of Regulation (EU) No 1151/2012 has been received by the Commission, the amendments to the specification should be approved, |
HAS ADOPTED THIS REGULATION:
Article 1
The amendments to the specification published in the Official Journal of the European Union regarding the name ‘Carne Arouquesa’ (PDO) are hereby approved.
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

approving Union amendments to the specification for a Protected Designation of Origin or a Protected Geographical Indication (‘Colli di Rimini’ (PDO))
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Commission Delegated Regulation (EU) 2019/33 of 17 October 2018 supplementing Regulation (EU) No 1308/2013 of the European Parliament and of the Council as regards applications for protection of designations of origin, geographical indications and traditional terms in the wine sector, the objection procedure, restrictions of use, amendments to product specifications, cancellation of protection, and labelling and presentation (1), and in particular Article 15(2) thereof,
Whereas:

The Commission has examined the application for the approval of Union amendments to the product specification for the Protected Designation of Origin ‘Colli di Rimini’, forwarded by Italy in accordance with Article 105 of Regulation (EU) No 1308/2013 of the European Parliament and of the Council (2) in conjunction with Article 15 of Delegated Regulation (EU) 2019/33. The changes include a change of name from ‘Colli di Rimini’ to ‘Rimini’. |
(2) |
The Commission has published the application for the approval of the Union amendments to the product specification in the Official Journal of the European Union (3), as required by Article 97(3) of Regulation (EU) No 1308/2013. |
(3) |
No statement of objection has been received by the Commission under Article 98 of Regulation (EU) No 1308/2013. |
(4) |
The Union amendments to the product specification should therefore be approved in accordance with Article 99 of Regulation (EU) No 1308/2013 in conjunction with Article 15(2) of Delegated Regulation (EU) 2019/33, |
HAS ADOPTED THIS REGULATION:

The amendments to the product specification published in the Official Journal of the European Union regarding the name ‘Colli di Rimini’ (PDO) are hereby approved.
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

adding to the 2022 fishing quotas certain quantities withheld in the year 2021 pursuant to Article 4(2) of Council Regulation (EC) No 847/96

Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EC) No 847/96 of 6 May 1996 introducing additional conditions for year-to-year management of TACs and quotas (1), and in particular Article 4(2) thereof,
Whereas:

According to Article 4(2) of Regulation (EC) No 847/96, for certain stocks subject to an analytical TAC, a Member State to which a relevant quota has been allocated may ask the Commission, before 31 October of the year of application of the quota, to withhold a maximum of 10 % of its quota to be transferred to the following year. |
(2) |
Council Regulations (EU) 2020/1579 (2) and (EU) 2021/92 (3) fix fishing quotas for certain fish stocks for 2021 and specify which fish stocks may be subject to the measures provided for in Regulation (EC) No 847/96. |
(3) |
Council Regulations (EU) 2021/1888 (4) and (EU) 2022/109 (5) fix fishing quotas for certain fish stocks for 2022. |
(4) |
Certain Member States requested, before 31 October 2021, that part of their quotas for 2021 for certain fish stocks be withheld and transferred to 2022. The fish stocks whose transfer is requested and their state of exploitation fulfil the conditions for such transfer laid down in Regulation (EC) No 847/96. Subject to the limits provided for in that Regulation, the quantities withheld should be added to the quotas for 2022. |

In order to avoid excessive flexibility that would undermine the principle of rational and responsible exploitation of living marine biological resources, hinder the achievement of the objectives of the Common Fisheries Policy and deteriorate the biological status of the stocks, where a Member State has already used the year-to-year flexibility provided for under Article 15(9) of Regulation (EU) No 1380/2013 of the European Parliament and of the Council (6) in respect of a particular stock, no carry-over of unused fishing quotas should apply under Article 4 of Council Regulation (EC) No 847/96 and vice versa. |

The carry-over of unused fishing quota for mackerel in United Kingdom and international waters of 2a, 5b, 6, 7, 8d, 8e, 12 and 14 (MAC/*2A6 – special condition to MAC/2A34.) requested by certain Member States should be applied to the quota of mackerel in United Kingdom and international waters of 2a, 5b, 6, 7, 8d, 8e, 12 and 14 (MAC/*2AX14 – special condition to MAC/2A34.) following changes in the stock code set up in Regulation (EU) 2022/109. |

HAS ADOPTED THIS REGULATION:
Article 1
The fishing quotas fixed for 2022 in Regulations (EU) 2021/1888 and (EU) 2022/109 are increased as set out in the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the seventh day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

recognising the report including information on the typical greenhouse gas emissions from the cultivation of soybean in Argentina under Article 31(3) and (4) of Directive (EU) 2018/2001 of the European Parliament and of the Council
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Directive (EU) 2018/2001 of the European Parliament and of the Council of 11 December 2018 on the promotion of the use of energy from renewable sources (1), and in particular Article 31(4) thereof,
Whereas:

Directive (EU) 2018/2001 sets out that biofuels, bioliquids, and biomass fuels have to save significant greenhouse gas emissions compared to fossil fuels so that they can be counted towards the targets set in that Directive. For this purpose, Article 29(10) sets specific emission savings thresholds for those fuels, and Article 31 regulates how to calculate the greenhouse gas emission savings from their use. When making those calculations, it is possible to use the default values set out in Annexes V and VI to Directive (EU) 2018/2001. Instead of the default values of greenhouse gas emissions from the cultivation of agricultural raw materials, it is possible to use typical values under some conditions. These typical values, representing the average value in a specific area, may be reported to the Commission by Member States or third countries. The typical values may only be used if the Commission recognises them to be accurate. |

On 16 February 2022, Argentina sent the Commission the final report with data for the purposes of measuring the greenhouse gas emissions associated with the cultivation of soybean typically produced in regions in Argentina equivalent to NUTS 2 (2) regions of the European Union, asking for the recognition of the accuracy of such data in line with Article 31(4) of Directive (EU) 2018/2001. |
(3) |
The Commission assessed the report and found that it contains accurate data for the purposes of measuring the greenhouse gas emissions associated with the cultivation of soybean typically produced in regions in Argentina equivalent to NUTS 2 regions of the European Union. |

The measures provided for in this Decision are in accordance with the opinion of the Committee on the Sustainability of Biofuels, Bioliquids and Biomass Fuels, |
HAS ADOPTED THIS DECISION:
Article 1
The report submitted for recognition to the Commission by Argentina on 16 February 2022 contains accurate data for the purposes of measuring the greenhouse gas emissions associated with the cultivation of soybean typically produced in regions in Argentina equivalent to NUTS 2 regions of the European Union, pursuant to Article 31(4) of Directive (EU) 2018/2001. The summary of the report’s data is set out in the Annex.
Article 2
The Decision is valid for a period of five years after the day of its entry into force. If the content of the report, as submitted for recognition to the Commission on 16 February 2022, changes in a way that might affect the basis of this Decision, such changes shall be notified to the Commission immediately. The Commission shall assess the notified changes to determine whether the report still provides accurate data for which it is recognised.
Article 3
The Commission may repeal this Decision if it has been clearly demonstrated that the report no longer contains accurate data for the purposes of measuring the greenhouse gas emissions associated with the cultivation of soybean produced in Argentina.
Article 4
This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

Having regard to Directive (EU) 2018/2001 of the European Parliament and of the Council of 11 December 2018 on the promotion of the use of energy from renewable sources (1), and in particular Article 30(6) thereof,
Whereas:

Directive (EU) 2018/2001 establishes requirements for biofuels, bioliquids, biomass fuels, renewable liquid and gaseous fuels of non-biological origin and recycled carbon fuels, in order to ensure that they can be counted towards the targets set in that Directive only if they have been sustainably produced and save significant greenhouse gas emissions in comparison to fossil fuels. Article 29 of Directive (EU) 2018/2001 lays down sustainability and greenhouse gas emissions saving criteria for biofuels, bioliquids, and biomass fuels, and Article 26 of that Directive and Commission Delegated Regulation (EU) 2019/807 (2) establish the criteria for determining:

Directive (EU) 2018/2001 also provides for rules on how to calculate the contribution from renewable electricity to the transport targets, both when the electricity is directly used to power electric vehicles and when it is used to produce renewable liquid and gaseous fuels of non-biological origin that are used in transport. |

In order to check that compliance with the rules established for biofuels, bioliquids, biomass fuels, renewable liquid and gaseous fuels of non-biological origin and recycled carbon fuels is ensured, Member States may use voluntary schemes or national certification schemes. Both national and voluntary certification schemes have played an important role in providing evidence of compliance with the sustainability and greenhouse gas emissions saving criteria for biofuels and bioliquids under Directive 2009/28/EC of the European Parliament and of the Council (3). Under Directive (EU) 2018/2001, the role of voluntary and national certification schemes has been expanded. First, they can now serve to certify compliance of all fuels produced from biomass, including gaseous and solid fuels, with the sustainability criteria set in Directive (EU) 2018/2001, and provide accurate data on their greenhouse gas emissions saving. Second, they can serve to certify compliance of renewable liquid and gaseous transport fuels of non-biological origin and recycled carbon fuels with their greenhouse gas emissions saving criteria. Third, they can serve to prove compliance with the rules established by Article 27(3) of Directive (EU) 2018/2001 for calculating renewable electricity in transport. Fourth, they can serve to prove that economic operators enter accurate information in Union or national database on renewable fuels and recycled carbon fuels used in transport in accordance with Article 28(4) of Directive (EU) 2018/2001. Fifth, they can be used to certify biofuels, bioliquids and biomass fuels with low indirect land-use change-risk. |

Where an economic operator provides proof or data on compliance with the sustainability and greenhouse gas emissions saving criteria, obtained in accordance with a national or voluntary scheme recognised by the Commission, to the extent covered by the recognition decision, a Member State is not to require that economic operator to provide further evidence as an additional proof for such compliance. Therefore, the positive assessment and formal recognition by the Commission of a national or voluntary certification scheme ensures the mandatory acceptance of their compliance statements by all Members States. |

Austria first submitted a request for recognition under Article 30(6) of Directive (EU) 2018/2001 for the Austrian agricultural certification scheme (AACS) to the Commission on 14 July 2021. That request led to an assessment of the scheme by the Commission, in which some issues requiring modification were identified. The modified scheme resubmitted by Austria on 7 March 2022 correctly addressed those issues. The scheme covers agricultural feedstocks and vegetable oils (including residues) from farm up to initial processing. |

In assessing the AACS, the Commission found that it adequately covers the sustainability criteria laid down in Article 29(3) to (5) of Directive (EU) 2018/2001, while it also contains accurate data on greenhouse gas emission savings for the purpose of Article 29(10) of Directive (EU) 2018/2001 and applies a mass balance methodology in accordance with the requirements of Article 30(1) and (2) of Directive (EU) 2018/2001. |

The assessment of the AACS concludes that the scheme meets adequate standards of reliability, transparency and independent auditing and complies with the methodological requirements set out in Annex V to Directive (EU) 2018/2001. |

The recognised scheme should be made available in the section devoted to voluntary schemes on the Commission’s Europa website. |
(9) |
The measures provided for in this Decision are in accordance with the opinion of the Committee on the Sustainability of Biofuels, Bioliquids and Biomass fuels, |
HAS ADOPTED THIS DECISION:
Article 1
The Austrian agricultural certification scheme (‘the scheme’), submitted for recognition to the Commission on 7 March 2022, demonstrates the following, for the fuels audited under the scheme:
(a) |
compliance of the consignments of biofuels, bioliquids and biomass fuels with the sustainability criteria laid down in Article 29(2) to (5) and (10) of Directive (EU) 2018/2001; |
(b) |
economic operators’ compliance with the obligation to enter accurate information into the Union or national database on renewable fuels and recycled carbon fuels used in transport in accordance with Article 28(4) of Directive (EU) 2018/2001. |
The scheme also contains accurate data on greenhouse gas emission savings for the purpose of Article 29(10) of Directive (EU) 2018/2001 in that it ensures that all relevant information from economic operators upstream in the chain of custody is transferred to economic operators downstream in the chain of custody.
Article 2
This Decision shall be valid for a period of 5 years from the day of its entry into force.
Where the content of the scheme, as submitted for recognition to the Commission on 7 March 2022, change in a way that might affect the grounds of this Decision, such changes shall be notified to the Commission without delay.
The Commission shall assess the notified changes with a view to establishing whether the scheme still adequately covers assurance to the sustainability criteria for which it is recognised.
Article 3
The Commission may repeal this Decision in certain circumstance, including:
(a) |
if it has been clearly demonstrated that the scheme has not implemented elements considered to be important for this Decision or has stopped implementing them in a way that constitutes a severe and structural breach; |
(b) |
if the scheme fails to submit annual reports to the Commission, as required by Article 30(5) of Directive (EU) 2018/2001; or |
(c) |
if the scheme fails to meet independent auditing standards or other requirements specified in implementing acts referred to in Article 30(8) of Directive (EU) 2018/2001 or fails to implement improvements to other elements of the scheme considered to be important for continued recognition. |
Article 4
This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

Having regard to Directive (EU) 2018/2001 of the European Parliament and of the Council of 11 December 2018 on the promotion of the use of energy from renewable sources (1), and in particular Article 30(4) and (5) thereof,
Whereas:

Directive (EU) 2018/2001 lays down requirements for certain fuels, namely biofuels, bioliquids, biomass fuels, renewable liquid and gaseous fuels of non-biological origin and recycled carbon fuels to ensure that they can only be counted towards the targets set in that Directive if they have been sustainably produced and save significant greenhouse gas emissions compared to fossil fuels. Article 29 of the Directive lays down sustainability and greenhouse gas emissions saving criteria for biofuels, bioliquids, and biomass fuels. Furthermore, Article 26 of the Directive and Commission Delegated Regulation (EU) 2019/807 (2) lay down the criteria to determine which feedstock for biofuels, bioliquids or biomass fuels has high indirect land-use change risk, on the one hand, and which high indirect land-use change-risk biofuels, bioliquids or biomass fuels that meet certain conditions can be certified as having low indirect land-use change risk, on the other hand. Article 25(2) of the Directive lays down greenhouse gas emissions saving criteria for renewable liquid and gaseous fuels of non-biological origin and recycled carbon fuels used in transport. Article 28(2) of the Directive requires economic operators to enter information in a Union database on the transactions made and the sustainability characteristics of some renewable fuels (biofuels, biogas and renewable liquid and gaseous fuels of non-biological origin) and recycled carbon fuels used in transport. |
(2) |
Directive (EU) 2018/2001 also lays down rules for the calculation of the contribution of renewable electricity to the transport targets. In particular, Article 27(3) of that Directive lays down the rules on how to calculate this contribution, both when the electricity is directly used to power electric vehicles and when it is used to produce renewable liquid and gaseous fuels of non-biological origin that are used in transport. |

Voluntary schemes have played an important role in providing evidence of compliance with the sustainability and greenhouse gas emissions saving criteria for biofuels and bioliquids. Under Directive (EU) 2018/2001, voluntary schemes can be used to certify compliance of all fuels produced from biomass, including gaseous and solid fuels, with the sustainability criteria laid down in that Directive, and provide accurate data on their greenhouse gas emissions savings, as well as to certify compliance of renewable liquid and gaseous transport fuels of non-biological origin and recycled carbon fuels with their greenhouse gas emissions saving criteria and to prove compliance with the provisions of Article 27(3) of that Directive regarding the calculation of the share of renewable electricity in transport. Voluntary schemes can also be used to prove that economic operators enter accurate information into the Union or national database on some renewable fuels and recycled carbon fuels used in transport in accordance with Article 28(4) of Directive (EU) 2018/2001. Furthermore, voluntary schemes can be used to certify biofuels, bioliquids and biomass fuels with low indirect land-use change-risk. The Commission may decide that voluntary national or international schemes can serve all or some of these purposes. |

Pursuant to Article 30(9) of Directive (EU) 2018/2001, where an economic operator provides proof of or data on compliance with the sustainability and greenhouse gas emissions saving criteria, obtained in accordance with a voluntary scheme that has been recognised by the Commission, to the extent covered by the recognition decision, a Member State is not to require the supplier to provide further evidence. |

The Sustainable Biomass Program voluntary scheme (‘SBP scheme’) submitted a request to the Commission, for recognition pursuant to Article 30(4) of Directive (EU) 2018/2001 on 15 October 2020. The request led to an assessment of that scheme by the Commission, in which some issues requiring modification were identified. The SBP scheme re-submitted its request on 2 December 2021, addressing the issues which had been identified. |
(6) |
The SBP scheme covers the following types of feedstock(s): (a) ligno-cellulosic material derived from forest and non-forest land; (b) processing residues from forest and agriculture related industries (outside forest and agricultural land). Agricultural residues from agricultural land are excluded. The SBP scheme covers biomass fuels (pellets and wood chips) produced from forest and non-forest ligno-cellulosic material and forest and agriculture related industry processing residues for heat and electricity production. ‘Bioliquids’, ‘biofuels’, ‘biogas’, ‘renewable liquid and gaseous transport fuels of non-biological origin’ and ‘recycled carbon fuels’ are outside of the scope of the SBP scheme. The SBP scheme has a global geographic coverage and encompasses the entire chain of custody. |

In assessing the SBP scheme, the Commission found that it covers adequately the sustainability criteria laid down in Article 29(6) to (7) of Directive (EU) 2018/2001, contains accurate data on greenhouse gas emission savings for the purposes of Article 29(10) of that Directive and applies a mass balance methodology in accordance with the requirements of Article 30(1) and (2) of that Directive. This assessment does not take into account the forthcoming implementing acts, to be adopted in accordance with Article 29(8) and Article 30(8) of Directive (EU) 2018/2001, on providing guidance for demonstrating compliance with the sustainability criteria laid down in Article 29(6) and (7) of that Directive and on rules to verify sustainability and greenhouse gas emissions saving criteria and low indirect land-use change-risk criteria. The SBP scheme will therefore be re-assessed when such implementing acts will be adopted |
(8) |
The assessment of the SBP scheme found that it meets adequate standards of reliability, transparency and independent auditing and complies with the methodological requirements set out in Annex VI to Directive (EU) 2018/2001. |
(9) |
The recognised SBP scheme should be made available in the section devoted to voluntary schemes on the Commission’s Europa website. |
(10) |
In order to allow for prompt application of the measures provided for in this Decision, this Decision should enter into force on the day following that of its publication in the Official Journal of the European Union. |
(11) |
The measures provided for in this Decision are in accordance with the opinion of the Committee on the Sustainability of Biofuels, Bioliquids and Biomass fuels established by Article 34(2) of Directive (EU) 2018/2001. |
HAS ADOPTED THIS DECISION:
Article 1
The Sustainable Biomass Program voluntary scheme, submitted for recognition to the Commission on 2 December 2021, demonstrates, for the fuels audited under the scheme, the following elements:

The Decision shall apply until 28 September 2027.
Article 3
The Commission may repeal this Decision, inter alia, under the following circumstances:
(a) |
if it has been clearly demonstrated that the Sustainable Biomass Program voluntary scheme has not implemented elements considered to be important for this Decision or if a severe and structural breach of those elements has occurred; |
(b) |
if the Sustainable Biomass Program voluntary scheme fails to submit annual reports to the Commission pursuant to Article 30(5) of Directive (EU) 2018/2001; |
(c) |
if the Sustainable Biomass Program voluntary scheme fails to implement standards of independent auditing and other requirements specified in implementing acts referred to in Article 29(8) or Article 30(8) of Directive (EU) 2018/2001 or improvements to other elements of the scheme considered to be important for a continued recognition. |
Article 4
This Decision shall enter into force on the day following that of its publication in the Official Journal of the European Union.

Whereas:

African swine fever is an infectious viral disease affecting kept and wild porcine animals and can have a severe impact on the concerned animal population and the profitability of farming causing disturbance to movements of consignments of those animals and products thereof within the Union and exports to third countries. |
(2) |
In the event of an outbreak of African swine fever in kept porcine animals, there is a serious risk of the spread of that disease to other establishments of kept porcine animals. |
(3) |
Commission Delegated Regulation (EU) 2020/687 (2) supplements the rules for the control of the listed diseases referred to in Article 9(1), points (a), (b) and (c) of Regulation (EU) 2016/429, and defined as category A, B and C diseases in Commission Implementing Regulation (EU) 2018/1882 (3). In particular, Articles 21 and 22 of Delegated Regulation (EU) 2020/687 provide for the establishment of a restricted zone in the event of an outbreak of a category A disease, including African swine fever, and for certain measures to be applied therein. In addition, Article 21(1) of that Delegated Regulation provides that the restricted zone is to comprise a protection zone, a surveillance zone, and, if necessary, further restricted zones around or adjacent to the protection and surveillance zones. |

Following an outbreak of African swine fever in kept porcine animals in the state of Lower Saxony in Germany, which was confirmed on 2 July 2022, and the information received from that Member State of the disease situation on its territory, Commission Implementing Decision (EU) 2022/1189 (4) was adopted. That Implementing Decision provides that Germany is to ensure that the restricted zone, where the measures for protection and surveillance zones provided for in Delegated Regulation (EU) 2020/687 apply, comprises at least the areas listed in the Annex to that Implementing Decision. |

Implementing Decision (EU) 2022/1189 applies until 14 October 2022. The period of applicability of Implementing Decision (EU) 2022/1189 was laid down taking account of the date of the outbreak, the epidemiology of the disease and the time needed to carry out an epidemiological investigation ensuring absence of the disease and in line with the World Organisation for Animal Health (WOAH, founded as OIE) international standards (5) on the recovery of disease-free status in a previously disease-free area and with the Commission guidelines on ASF regionalisation (6). |

At the end of August 2022, Germany informed the Commission of the current favourable African swine fever situation in kept porcine animals in the restricted zone in the state of Lower Saxony and that the measures for protection and surveillance zones have been duly implemented in accordance with Delegated Regulation (EU) 2020/687, in order to prevent the further spread of that disease. |

Based on that information and justifications received, in particular taking account of the completion of the preliminary cleaning and disinfection measures in the affected establishment on 5 July 2022, and taking account of the current favourable African swine fever situation in kept porcine animals in the state of Lower Saxony and the measures duly implemented by Germany, and in order to prevent any unnecessary disturbance to trade, it is appropriate to repeal Implementing Decision (EU) 2022/1189 with effect from 5 October 2022. |

HAS ADOPTED THIS DECISION:
Article 1
Implementing Decision (EU) 2022/1189 is repealed with effect from 5 October 2022.

This Decision is addressed to the Federal Republic of Germany.
