COMMISSION IMPLEMENTING REGULATION (EU) 2022/1317
of 27 July 2022
providing for derogations from Regulation (EU) 2021/2115 of the European Parliament and of the Council as regards the application of the standards for good agricultural and environmental conditions of land (GAEC standards) 7 and 8 for claim year 2023
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2021/2115 of the European Parliament and of the Council of 2 December 2021 establishing rules on support for strategic plans to be drawn up by Member States under the common agricultural policy (CAP Strategic Plans) and financed by the European Agricultural Guarantee Fund (EAGF) and by the European Agricultural Fund for Rural Development (EAFRD) and repealing Regulations (EU) No 1305/2013 and (EU) No 1307/2013 (1), and in particular Article 148(1) thereof,

Pursuant to Article 13 of Regulation (EU) 2021/2115 Member States are to ensure that all agricultural areas, including land which is no longer used for production purposes, are maintained in good agricultural and environmental condition and are to set, at national or regional level, minimum standards for farmers and other beneficiaries for each standard of good agricultural and environmental conditions of land (GAEC standard) listed in Annex III to that Regulation in line with the main objective of those standards as referred to in that Annex. GAEC standards are applicable from claim year 2023, except for GAEC 2 which may only be applicable as from claim year 2024 or 2025, if duly justified. |

In its Communication ‘Safeguarding food security and reinforcing the resilience of food systems’ (2) the Commission presented the serious consequences of Russia’s invasion of Ukraine for global food security. Russia’s invasion of Ukraine has triggered a sharp commodity price surge and has an impact on the supply and demand for agricultural products at global level. In particular, global wheat output is at risk both from the supply shock stemming from the size of Ukraine’s and Russia’s share in wheat markets and from the shock in input costs, especially in natural gas, nitrogen fertiliser and oxygen. The level of uncertainties with regard to the global food supply situation is high, which raises concerns about global food security. In order to contribute to addressing this situation in a timely manner by maintaining food supply, the Union’s agricultural food production potential should be maintained, while ensuring the medium- and long-term sustainability of food supply by continuing the transition to sustainable food production as laid out in the Farm to Fork and Biodiversity Strategies. |

Both GAEC standard 7 ‘crop rotation in arable land, except for crops growing under water’ and the first requirement under GAEC standard 8 ‘minimum share of agricultural area devoted to non-productive areas or features’, listed in Annex III to Regulation (EU) 2021/2115, which are applicable as from claim year 2023, impact the use of arable land for production purposes. By setting minimum requirements with regard to the diversity over time and space in the growing of different crops, with a view to preserve soil potential and enhance soil fertility to ensure long-term productivity, GAEC standard 7 potentially impacts the farmers’ choices of crops. By requiring a minimum share of arable land to be devoted to non-productive areas or features in order to improve on-farm biodiversity necessary for healthy and productive ecosystems, pursuant to the first requirement under GAEC standard 8, farmers may, in addition to the presence of landscape features, also leave a certain share of arable land fallow for biodiversity purposes. |

In view of the need to address the food security concerns related to global food availability and affordability dimensions and to maintain the Union food production potential, while contributing to the goals of the EU Green Deal, especially the Farm to Fork and Biodiversity Strategy, it is therefore appropriate to exceptionally allow farmers flexibility to make use of their available arable land for food production, while mitigating the negative impacts of these choices on the environment and climate change. Member States should therefore be authorised to derogate from the application, for claim year 2023, of GAEC standard 7 and the first requirement under GAEC standard 8 listed in Annex III to Regulation (EU) 2021/2115 as defined by them in their CAP Strategic Plan. Given that the derogation aims at contributing to addressing food security concerns in the short-term, it is appropriate to establish that the arable land which would not be devoted to non-productive areas as a result of the derogation from the first requirement under GAEC standard 8 listed in Annex III to Regulation (EU) 2021/2115 as defined by Member States in their CAP Strategic Plan, should not be used for growing maize and soya beans, considering that these crops are mostly not destined for food production. Moreover, Member States making use of any of the derogations from GAEC standards 7 or 8 should, generally, promote the use of crops for food production, as well as the use of eco-schemes and agri-environment-climate measures programmed in their CAP Strategic Plans which have the objective of improving on-farm biodiversity and preserving the soil potential. |

In view of the importance of the aforementioned GAEC standards 7 and 8 for the objectives to preserve soil potential and improve on-farm biodiversity as part of the long term sustainability of the sector and to maintain the food production potential, the derogation shall be limited to claim year 2023, and not affect the rules in years beyond 2023, and should be restricted to what is strictly necessary to address the global food security concerns. Therefore, the other three requirements under GAEC standard 8 listed in Annex III to Regulation (EU) 2021/2115, including the requirement for retention of landscape features, remain applicable for claim year 2023 as a safeguard towards the main objective of the standard to improve on-farm biodiversity. |

The possibility to derogate from the application of those GAEC standards as defined by Member States in their CAP Strategic Plans is without prejudice to the obligation pursuant to Article 109(2), point (a)(i), of Regulation (EU) 2021/2115 for Member States to include in their CAP Strategic Plans the description of the implementation and related elements of each GAEC standard listed in Annex III to that Regulation. |

As GAEC standards are part of the baseline conditions of eco-schemes and agri-environmental, climate-related and other management commitments, it is appropriate to lay down rules on the respect of the baseline where a Member State makes use of the derogations for the application of GAEC standard 7 or the first requirement under GAEC standard 8. In order to ensure the stability of the CAP Strategic plans and to safeguard the ambition of the interventions, which form part of the green architecture of the common agricultural policy (CAP) as from 2023, the baseline should remain unchanged regardless of the application of the derogation. In particular, it is appropriate that baseline requirements of GAEC standard 7 or the first requirement under GAEC standard 8 should still be respected for the sake of receiving support under interventions where the commitments include or build upon these baseline requirements. |

It is essential to monitor the impacts of these derogations on global food security and on the environment and climate change, Member States should thus assess and report to the Commission the implementation of these derogations. |
(9) |
To ensure that the derogations authorised by this Regulation are effective in view of their purpose, and given that farmers take their sowing decisions for the 2023 harvest as from summer 2022, the decision to make use of the derogations should be taken rapidly. Therefore, Member States should take their decisions and notify the Commission thereof within 30 days from the day of entry into force of this Regulation by means of the information-technology-based system made available by the Commission pursuant to Commission Implementing Regulation (EU) 2017/1185 (3). The decisions should be included in the CAP Strategic Plans at the first occasion, either when resubmitting the CAP Strategic Plan in accordance with Article 118(3), second subparagraph, of Regulation (EU) 2021/2115 or in the first request for amendment of the CAP Strategic Plan in accordance with Article 119 of that Regulation. In view of the need to ensure timely implementation, the decisions should not be subject to Commission approval. |
(10) |
Given the need for Member States’ decisions to be taken in due time before sowing decisions of farmers, this Regulation should enter into force as a matter of urgency on the day following that of its publication in the Official Journal of the European Union. |

The measures provided for in this Regulation are in accordance with the opinion of the Common Agricultural Policy Committee, |
HAS ADOPTED THIS REGULATION:
Article 1
Decisions derogating from the application of certain standards for good agricultural and environmental conditions of land for claim year 2023
1. By way of derogation from Article 13(1) of Regulation (EU) 2021/2115, Member States may decide to derogate for claim year 2023 from the application of one or both of the following GAEC standards listed in Annex III to that Regulation as defined by the Member States in their CAP Strategic Plans:
(a) |
GAEC 7 ‘Crop rotation in arable land, except for crops growing under water’; |
(b) |
GAEC 8, the first requirement ‘Minimum share of agricultural area devoted to non-productive areas or features:

Member States making use of the derogation referred to in point (b) of the first subparagraph shall ensure that it applies exclusively to land lying fallow and does not apply to other non-productive features.
Member States shall ensure that the arable land which will not be devoted to non-productive areas as a result of the derogation referred to in the first subparagraph, in point (b) shall not be used to grow maize, soya beans, or short rotation coppice.
Member States making use of any of the derogations referred to in the first subparagraph shall promote the cultivation of crops for food production.
Member States making use of any of the derogations referred to in the first subparagraph shall promote the eco-schemes and agri-environment-climate measures programmed in their CAP Strategic Plans that have the objective of improving on-farm biodiversity and preserving the soil potential.
2. For the purpose of the eco-schemes referred to in Article 31 of Regulation (EU) 2021/2115 and of the agri-environmental, climate-related and other management commitments referred to in Article 70 of that Regulation, and established by Member States in their CAP Strategic Plans, for claim year 2023, the baselines referred to in Articles 31(5), first subparagraph, point (a), and 70(3), first subparagraph, point (a), of that Regulation with regard to GAEC 7 and the first requirement under GAEC 8, shall remain unchanged by the decisions of the Member State referred to in paragraph 1 of this Article.
Article 2
Time limit, notification of decisions and their application
1. Within 30 days from the date of entry into force of this Regulation Member States who decide to make use of the derogations referred to in Article 1(1), shall notify the Commission of the decisions taken pursuant to that paragraph by means of the information-technology-based system made available by the Commission pursuant to Implementing Regulation (EU) 2017/1185.
2. Member States shall include the decisions taken pursuant to Article 1(1) of this Regulation in Section 3.10 on Conditionality and GAEC standard of CAP Strategic Plans either as part of a resubmission of the CAP Strategic Plan in accordance with Article 118(3), second subparagraph, of Regulation (EU) 2021/2115, or as part of the first request of amendment of the CAP Strategic Plan in accordance with Article 119 of that Regulation.
3. The decisions taken pursuant to Article 1(1) of this Regulation shall not be subject to the Commission approval referred to in Article 118(6) or in Article 119(10), respectively, of Regulation (EU) 2021/2115.
4. The decisions taken pursuant to Article 1(1) shall apply for claim year 2023.
5. Member States making use of any of the derogations referred to Article 1(1), shall include in the annual performance report referred to in Article 134 of Regulation (EU) 2021/2115 due on 15 February 2024, an assessment of the effects of the application of such derogations on global food security, on the preservation of the environment and the fight against climate change.
Article 3
Entry into force
This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

appointing a member of the Court of Auditors
THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on the Functioning of the European Union, and in particular Article 286(5) thereof,
Having regard to the proposal by the Kingdom of the Netherlands,
Having regard to the opinion of the European Parliament (1),

By means of Decision (EU) 2019/2173 (2), Mr Alex BRENNINKMEIJER was appointed as a member of the Court of Auditors for the period from 1 January 2020 to 31 December 2025. |
(2) |
By letter of 3 June 2021, Mr Alex BRENNINKMEIJER presented his resignation as a member of the Court of Auditors with effect from 1 January 2022. In accordance with Article 286(5), third subparagraph, of the Treaty, he remained in office pending the appointment of his successor. |
(3) |
On 14 April 2022, Mr Alex BRENNINKMEIJER passed away. |
(4) |
A new member of the Court of Auditors should be appointed to serve for the remainder of Mr Alex BRENNINKMEIJER’s term of office. |

The Kingdom of the Netherlands has proposed the appointment of Mr Stephanus Abraham BLOK as a member of the Court of Auditors from 1 September 2022, |

accepting a request submitted by France pursuant to Article 7(4) of Directive (EU) 2016/797 of the European Parliament and of the Council for the non-application of certain technical specification for interoperability (TSI) provisions for re-configuration of existing rolling stock into 19 TGV P-DUPLEX trainsets

Having regard to the Treaty on the Functioning of the European Union,
Having regard to Directive (EU) 2016/797 of the European Parliament and of the Council of 11 May 2016 on the interoperability of the rail system within the European Union (1), and in particular Article 7(4) thereof,
Whereas:

On 10 December 2021, France submitted to the Commission, in accordance with Article 7(4) of Directive (EU) 2016/797, a request for the non-application of certain provisions laid down in the technical specifications for interoperability (‘TSI’) set out in the Annex to Commission Regulation (EU) No 1302/2014 (2) (‘LOC&PAS TSI’), in the TSI set out in the Annex to Commission Regulation (EU) No 1300/2014 (3) (‘PRM TSI’) and in the TSI set out in the Annex to Commission Regulation (EU) No 1304/2014 (4) (‘NOI TSI’), to a rolling stock upgrade project, regarding 19 trainsets designed to operate on the French rail network. |

The request was submitted on the basis of Article 7(1), point (c) of Directive (EU) 2016/797, namely the lack of economic viability of the project when performing the upgrade of the trainsets concerned. |
(3) |
The request concerns reconstructing 19 trainsets whose engines and coaches had been separated when they were produced in 2006. Because of the market demand at that time, the locomotives of those trainsets were operated, and are still currently operated, as co-joined coach type ‘Réseau 1N’ and the coaches of those trainsets were operated as co-joined locomotive type ‘Réseau’. |
(4) |
Today, those trainsets are close to their half-life maintenance stop. A maintenance intervention is planned to ensure their safe operation for another 16 years. The maintenance intervention envisages he rejoining of the original locomotives and coaches. The work phase of the upgrade is to take place between 2022 and 2025 with the first trainsets having entered the workshops in February 2022. The target is to obtain the type authorisation for the 19 trainsets covered by the upgrade by December 2023. It will be followed by authorisations on the conformity to type for each trainset. |

The authorisation strategy for the re-configuration process is based on a ‘new’ authorisation, as a variant of the type TGV Duplex, already previously authorised. Under such conditions, only the modified parts of the coaches will have to be brought into conformity with the TSI. The locomotives are not subject to any changes, but are regarded as new elements to the TGV Duplex type and their authorisation is to be considered a ‘first’ authorisation which requires a demonstration of full compliance with the current TSIs LOC&PAS, NOI and PRM. |
(6) |
The locomotives and coaches of the 19 trainsets subject to upgrade and re-configuration comply with the standards and TSIs applicable at the time of their production. Since 2006, the relevant TSIs were subject to development and enhanced requirements. The non-application is requested in view that where the current TSIs are applied to already existing trainsets, they would imply significant additional upgrade and re-configuration costs, as well as considerable delay in bringing the trainsets back into operations. |

Moreover, the application of points 4.2.3.1, 4.2.8.2.6, 4.2.10.4.4, 4.2.3.3.2, 4.2.3.7. and 4.2.8.2.9 of the Annex to Regulation (EU) No 1302/2014, points 4.2.1, 4.2.2 and 4.2.3 of the Annex to Regulation (EU) No 1304/2014 and point 4.2.2.1. of the Annex to Regulation (EU) No 1300/2014 would require the supplier to undertake major development studies, resource allocation and additional material costs which would call into question the economic viability of the project, in the light that the estimated unit cost of the project would increase by more than 60 %. |
(8) |
The supplementary cost cannot be absorbed by the 19 trainsets without questioning the economic relevance and viability of the upgrading and re-configuration project. |
(9) |
In the framework of the project, compliance with other provisions of the current TSIs will be ensured, including modification of interior lighting, interior platform and passenger spaces, front windows, lamps and control lamps, emergency couplings, audible warning devices, interior signalling, pictograms and tactile information and the cabin sound generator in compliance with points 4.2.9.1.8, 4.2.9.2.1, 4.2.7.1.1 to 4.2.7.1.4, 4.2.7.2.1 and 4.2.2.7.2 of the Annex to Regulation (EU) No 1302/2014 and point 4.2.2.4 of the Annex to Regulation (EU) No 1300/2014. |

The project will also ensure that the 19 trainsets fully comply with Commission Regulation (EU) 2016/919 (5), including an upgrade to ERTMS Baseline 3. |
(11) |
If the non-application request is not accepted, the transport capacity in the area of future use of the 19 trainsets risks being affected to the detriment of rail passengers. The project would be delayed by approximately 3 years. A halt to the project would lead to the removal from service of the trains, affecting the commercial stakes of the operator in 2023, during the post-Covid-19 recovery of the railway sector. That loss of revenue for the operator is estimated to be more than 100 million euro. |

Information on the non-application request was shared by French representatives with the members of the Committee referred to in Article 51(1) of Directive (EU) 2016/797 during its 93rd meeting. |
(13) |
Any potential impact on the safety of the non-application of certain provisions of LOC & PAS, PRM and NOI TSIs are mitigated by the fact that the re-configured 19 trainsets have already demonstrated conformity with the respective safety requirements applicable at the time of their original authorisation in 2006 and were since safely operated. |
(14) |
In the light of the foregoing, the Commission considers that the conditions set out in Article 7(1)(c) and Article 7(4) of Directive (EU) 2016/797 should be considered fulfilled for the engines and coaches of the 19 trainsets concerned. Therefore, the request submitted by France for the non-application of points 4.2.3.1, 4.2.8.2.6, 4.2.10.4.4, 4.2.3.3.2, 4.2.3.7. and 4.2.8.2.9 of the Annex to Regulation (EU) No 1302/2014, points 4.2.1, 4.2.2 and 4.2.3 of the Annex to Regulation (EU) No 1304/2014 and point 4.2.2.1 of the Annex to Regulation (EU) No 1300/2014, while mitigating the non-application of those points by the application of the provisions in force at the time of their original authorisation as alternative provisions, should be accepted. |

The measures provided for in this Decision are in accordance with the opinion of the Committee referred to in Article 51(1) of Directive (EU) 2016/797, |
HAS ADOPTED THIS DECISION:
Article 1
The request by France for the non-application of the technical specifications of interoperability (TSI) provisions set out in the Annexes to Regulation (EU) No 1302/2014, Regulation (EU) No 1300/2014 and Regulation (EU) No 1304/2014, as referred to in Annex I to this Decision, to the 19 re-configured TGV P-DUPLEX trainsets consisting of the vehicles listed in Annex II to this Decision is accepted.
The provisions subject of the non-application request referred to in the first paragraph, together with the alternative provisions that shall be applied are listed in Annex I.
The area of use of the vehicles listed in Annex II shall be France.
Article 2
This Decision is addressed to the French Republic.

COMMISSION IMPLEMENTING DECISION (EU) 2022/1320
of 26 July 2022
amending the Annex to Implementing Decision (EU) 2021/641 concerning emergency measures in relation to outbreaks of highly pathogenic avian influenza in certain Member States
(notified under document C(2022) 5471)

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Article 259(1), point (c), thereof,
Whereas:

Highly pathogenic avian influenza (HPAI) is an infectious viral disease in birds and may have a severe impact on the profitability of poultry farming causing disturbance to trade within the Union and exports to third countries. HPAI viruses can infect migratory birds, which can then spread these viruses over long distances during their autumn and spring migrations. Therefore, the presence of HPAI viruses in wild birds poses a continuous threat for the direct and indirect introduction of these viruses into holdings where poultry or captive birds are kept. In the event of an outbreak of HPAI, there is a risk that the disease agent may spread to other holdings where poultry or captive birds are kept. |

Regulation (EU) 2016/429 establishes a new legislative framework for the prevention and control of diseases that are transmissible to animals or humans. HPAI falls within the definition of a listed disease in that Regulation, and it is subject to the disease prevention and control rules laid down therein. In addition, Commission Delegated Regulation (EU) 2020/687 (2) supplements Regulation (EU) 2016/429 as regards the rules for the prevention and control of certain listed diseases, including disease control measures for HPAI. |

Commission Implementing Decision (EU) 2021/641 (3) has been adopted within the framework of Regulation (EU) 2016/429 and it lays down disease control measures in relation to outbreaks of HPAI. |

More particularly, Implementing Decision (EU) 2021/641 provides that the protection, surveillance and further restricted zones established by the Member States following outbreaks of HPAI, in accordance with Delegated Regulation (EU) 2020/687, are to comprise at least the areas listed as protection, surveillance and further restricted zones in the Annex to that Implementing Decision. |

The Annex to Implementing Decision (EU) 2021/641 was recently amended by Commission Implementing Decision (EU) 2022/1200 (4) following outbreaks of HPAI in poultry or captive birds in Belgium and the Netherlands that needed to be reflected in that Annex. |

Since the date of adoption of Implementing Decision (EU) 2022/1200, Germany has notified the Commission of outbreaks of HPAI in establishments where poultry or captive birds were kept, located in the Schleswig-Holstein and Lower Saxony Lander of that Member State. |
(7) |
In addition, Poland has notified the Commission of an outbreak of HPAI in an establishment where poultry or other captive birds were kept, located in the Wielkopolskie voivodship of that Member State. |

Moreover, one of the outbreaks confirmed in Germany is located in close proximity to the border with Denmark and the competent authorities of those Member States have duly collaborated with regard to the establishment of the necessary surveillance zone, in accordance with Delegated Regulation (EU) 2020/687, as the surveillance zone extends into the territory of Denmark. |

The competent authority of Denmark, Germany and Poland have taken the necessary disease control measures required in accordance with Delegated Regulation (EU) 2020/687, including the establishment of protection and surveillance zones around those outbreaks. |

The Commission has examined the disease control measures taken by Denmark, Germany and Poland in collaboration with those Member States and it is satisfied that the boundaries of the protection and surveillances zones in Germany and Poland and of the surveillance zone in Denmark, established by the competent authority of those Member States, are at a sufficient distance from the establishments where the outbreaks of HPAI have been confirmed. |

In the Annex to Implementing Decision (EU) 2021/641, there are currently no areas listed as surveillance zones for Denmark, no areas as protection zones for Germany and no areas as protection and surveillance zones for Poland. |
(12) |
In order to prevent any unnecessary disturbance to trade within the Union and to avoid unjustified barriers to trade being imposed by third countries, it is necessary to rapidly describe at Union level, in collaboration with Denmark, Germany and Poland, the protection and surveillance zones established by Germany and Poland and of the surveillance zone established by Denmark in accordance with Delegated Regulation (EU) 2020/687. |

Therefore, surveillance zone should be listed for Denmark, protection zone should be listed for Germany and protection and surveillance zones should be listed for Poland in the Annex to Implementing Decision (EU) 2021/641. |

In addition, the areas listed as surveillance zones for Germany in the Annex to Implementing Decision (EU) 2021/641 should be amended. |
(15) |
Accordingly, the Annex to Implementing Decision (EU) 2021/641 should be amended to update regionalisation at Union level to take account of the protection and surveillance zones duly established by Germany and Poland and of the surveillance zone duly established by Denmark in accordance with Delegated Regulation (EU) 2020/687, and the duration of the measures applicable therein. |

Implementing Decision (EU) 2021/641 should therefore be amended accordingly. |
(17) |
Given the urgency of the epidemiological situation in the Union as regards the spread of HPAI, it is important that the amendments to be made to Implementing Decision (EU) 2021/641 by this Decision take effect as soon as possible. |

The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS DECISION:
Article 1
The Annex to Implementing Decision (EU) 2021/641 is replaced by the text set out in the Annex to this Decision.
Article 2
This Decision is addressed to the Member States.
