COUNCIL DECISION (EU) 2026/1381

of 15 June 2026

on the conclusion of the Agreement between the European Union and Canada laying down the conditions for the participation of Canadian legal entities and products originating in Canada to procurement under the SAFE Instrument

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 212 in conjunction with Article 218(6), second subparagraph, point (a), thereof,

Having regard to the proposal from the European Commission,

Having regard to the consent of the European Parliament (1),

Whereas:

In accordance with Council Decision (EU) 2026/444 (2), the Agreement between the European Union and Canada laying down the conditions for the participation of Canadian legal entities and products originating in Canada to procurement under the SAFE Instrument (the ‘SAFE Agreement’) was signed on 14 February 2026, subject to its conclusion at a later date, and has been applied on a provisional basis from 13 April 2026, pending its entry into force.

The conclusion of the SAFE Agreement enables increased defence industrial cooperation and reflects the shared desire to deepen the relationship between the European Union and Canada in the security and defence realm and to foster a closer, balanced and mutually beneficial partnership between the European Union and Canada to support practical defence cooperation.

The SAFE Agreement should be approved,

HAS ADOPTED THIS DECISION:

Article 1

The Agreement between the European Union and Canada laying down the conditions for the participation of Canadian legal entities and products originating in Canada to procurement under the SAFE Instrument is hereby approved.

Article 2

This Decision shall enter into force on the date of its adoption (3).
