on the conclusion, on behalf of the Union, of the Agreement between the European Union and the Republic of Chile pursuant to Article XXVIII of the General Agreement on Tariffs and Trade (GATT) 1994 relating to the modification of concessions on all the tariff rate quotas included in the EU Schedule CLXXV as a consequence of the United Kingdom`s withdrawal from the European Union
THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on the Functioning of the European Union, and in particular Article 207(4), first subparagraph, in conjunction with Article 218(6), second subparagraph, point (a)(v) thereof,
Having regard to the proposal from the European Commission,
Having regard to the consent of the European Parliament (1),
Whereas:

On 15 June 2018, the Council authorised the Commission to open negotiations pursuant to Article XXVIII of the General Agreement on Tariffs and Trade (GATT) 1994 on the apportionment of the tariff rate quotas included in the EU Schedule CLXXV as a consequence of the United Kingdom’s withdrawal from the Union. |

Negotiations with the Republic of Chile were concluded on 1 December 2022 with the initialling of the Agreement between the European Union and the Republic of Chile pursuant to Article XXVIII of the General Agreement on Tariffs and Trade (GATT) 1994 relating to the modification of concessions on all the tariff rate quotas included in the EU Schedule CLXXV as a consequence of the United Kingdom’s withdrawal from the European Union (‘the Agreement’). |

The Agreement was signed on behalf of the Union on 9 June 2023, subject to its conclusion at a later date, in accordance with Council Decision (EU) 2023/676 (2). |

HAS ADOPTED THIS DECISION:
Article 1
The Agreement between the European Union and the Republic of Chile pursuant to Article XXVIII of the General Agreement on Tariffs and Trade (GATT) 1994 relating to the modification of concessions on all the tariff rate quotas included in the EU Schedule CLXXV as a consequence of the United Kingdom’s withdrawal from the European Union is hereby approved on behalf of the Union (3).
Article 2
The President of the Council shall, on behalf of the Union, give the notification provided for in Article 4(1) of the Agreement (4).
Article 3
This Decision shall enter into force on the date of its adoption.

AGREEMENT BETWEEN THE EUROPEAN UNION AND THE REPUBLIC OF CHILE PURSUANT TO ARTICLE XXVIII OF THE GENERAL AGREEMENT ON TARIFFS AND TRADE (GATT) 1994 RELATING TO THE MODIFICATION OF CONCESSIONS ON ALL THE TARIFF RATE QUOTAS INCLUDED IN THE EU SCHEDULE CLXXV AS A CONSEQUENCE OF THE UNITED KINGDOM'S WITHDRAWAL FROM THE EUROPEAN UNION
THE EUROPEAN UNION,
hereinafter referred to as "the Union"
and
THE REPUBLIC OF CHILE,
hereinafter referred to as "Chile"
hereinafter jointly referred to as "the Parties",
HAVING REGARD to the negotiations which took place pursuant to Article XXVIII of the General Agreement on Tariffs and Trade (GATT) 1994 relating to the modification of concessions on tariff rate quotas included in the European Union Tariff Schedule CLXXV as a consequence of the United Kingdom's withdrawal from the Union as communicated to WTO Members in document G/SECRET/42/Add.2;
HAVE AGREED AS FOLLOWS:
Article 1
Objectives
Without prejudice to future negotiations under Article XXVIII of the GATT 1994 and for the purposes of the United Kingdom’s withdrawal from the Union only, the objective of this Agreement is to agree, subject to Article 2, on the modification of concessions as communicated to WTO Members in document G/SECRET/42/Add.2 and the resulting quantitative commitments of the Union that no longer includes the United Kingdom, in respect of the tariff rate quotas for which Chile has negotiating rights under Article XXVIII of the GATT 1994.
Article 2
Tariff rate quotas of the Union that no longer includes the United Kingdom
1. In respect of the tariff rate quotas for which Chile has negotiating rights under Article XXVIII of the GATT 1994, Chile agrees with the proposed tariff rate quota quantity commitments as set out in document G/SECRET/42/Add.2 taken on by the Union after the United Kingdom's withdrawal.
2. Notwithstanding paragraph 1, in respect of tariff rate quota 020 (meat of sheep or goats, fresh, chilled or frozen), Chile and the Union agree to the following change to scheduled commitments: the Union volume of the Chile country specific allocation shall be adjusted to 2 527 tonnes.
Article 3
The Union’s ongoing negotiations under Article XXVIII of the GATT 1994
1. The Parties acknowledge that the Union is continuing to conduct negotiations and consultations with other WTO Members holding negotiating or consultation rights under Article XXVIII of the GATT 1994 as a consequence of the United Kingdom's withdrawal from the Union as communicated to WTO Members.
2. As a result of those negotiations and consultations, the Union may consider a change to the shares and quantities set out in Article 2 or those in document G/SECRET/42/Add.2. In the event of such a change with regard to a prior tariff rate quota commitment of the Union for which Chile has a negotiating right, the Union shall consult Chile with a view to seeking a mutually satisfactory outcome before proceeding to any such change, without prejudice to each party’s rights under Article XXVIII of the GATT 1994.
Article 4
Final provisions
1. This Agreement shall enter into force on the day following the date on which the Parties have notified each other of the completion of their respective internal legal procedures necessary for this purpose.
2. This Agreement constitutes an international agreement between the Union and Chile, including for the purposes of Article XXVIII:3(a) and (b) of the GATT 1994.
3. This Agreement shall be drawn up in duplicate in the Bulgarian, Croatian, Czech, Danish, Dutch, English, Estonian, Finnish, French, German, Greek, Hungarian, Irish, Italian, Latvian, Lithuanian, Maltese, Polish, Portuguese, Romanian, Slovak, Slovenian, Spanish and Swedish languages, each text being equally authentic.
IN WITNESS WHEREOF, the undersigned Plenipotentiaries, duly authorised to this effect, have signed this Agreement.

Having regard to Regulation (EU) 2019/1700 of the European Parliament and of the Council of 10 October 2019 establishing a common framework for European statistics relating to persons and households, based on data at individual level collected from samples, amending Regulations (EC) No 808/2004, (EC) No 452/2008 and (EC) No 1338/2008 of the European Parliament and of the Council, and repealing Regulation (EC) No 1177/2003 of the European Parliament and of the Council and Council Regulation (EC) No 577/98 (1), and in particular Article 6(1) thereof,
Whereas:
In order to cover the needs in statistics for the relevant detailed topics set out in Annex I to Regulation (EU) 2019/1700, the Commission should specify the number and titles of the variables for the dataset in the use of information and communication technologies domain for reference year 2024,
HAS ADOPTED THIS REGULATION:
Article 1
The number and titles of the variables for the use of information and communication technologies domain for reference year 2024 shall be as set out in the Annex.
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION DELEGATED REGULATION (EU) 2023/1798

amending Delegated Regulation (EU) 2020/689 supplementing Regulation (EU) 2016/429 of the European Parliament and of the Council as regards rules for surveillance, eradication programmes, and disease-free status for certain listed and emerging diseases

THE EUROPEAN COMMISSION,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Article 29, points (a) and (d), Article 37(5), Article 39 and Article 41(3) thereof,
Whereas:

Regulation (EU) 2016/429 lays down rules for the prevention and control of animal diseases which are transmissible to animals or humans, including rules for surveillance, for Union surveillance programmes, for approval by the Commission of disease free-status and for the maintenance of disease-free status. |
(2) |
Commission Delegated Regulation (EU) 2020/689 (2) supplements the rules on surveillance, eradication programmes and disease-free status for certain listed diseases and emerging diseases of terrestrial, aquatic and other animals laid down in Regulation (EU) 2016/429. |
(3) |
In accordance with Delegated Regulation (EU) 2020/689, the competent authorities are required to specify the targeted animal populations relevant for different types of surveillance. In addition, Delegated Regulation (EU) 2020/689 specifies the categories of animals that should be subject to surveillance. In the context of the current highly pathogenic avian influenza (HPAI) epizootics, the scientific report of the European Food Safety Authority on Avian influenza overview December 2022 – March 2023, published on 20 March 2023 (3), recommended to extend and enhance surveillance in both wild mammals, particularly in carnivores, and farmed animals, particularly in American mink, in higher risk areas where HPAI is present in wild birds and poultry. Mammal species are not included in the categories subject to surveillance provided for in Delegated Regulation (EU) 2020/689. Therefore, the existing provisions related to targeted species and avian influenza surveillance should be amended to address this recommendation as regards the risk posed by the current HPAI H5N1 and further enable and support competent authorities to conduct structured surveillance for HPAI in certain mammal species as appropriate. |

Delegated Regulation (EU) 2020/689 provides for different pathways to obtain disease-free status. For several diseases, it is not possible to obtain that status without having previously implemented an approved eradication programme, as Member States cannot follow the pathway based on historical and surveillance data, due to certain limitations which apply concerning the diseases which may be subject to that pathway, as well as the limited timeframe within which such applications to obtain the status should be made. The experience gained since the date of application of Delegated Regulation (EU) 2020/689 has shown that this approach is not adequate as it does not necessarily provide additional reassurances for the granting of the disease-free status. Therefore, Delegated Regulation (EU) 2020/689 should be amended to provide the possibility for a Member State to obtain the disease-free status for all relevant diseases based on historical and surveillance data and without a time limitation. |
(5) |
Delegated Regulation (EU) 2020/689 provides for several requirements to maintain the status free from infection with Newcastle disease virus without vaccination. The experience gained since the date of application of Delegated Regulation (EU) 2020/689 has shown that the relevant provisions require further clarification as regards the applicable criteria. |
(6) |
Therefore, for the sake of legal certainty and clarity, Delegated Regulation (EU) 2020/689 should be amended accordingly, |
HAS ADOPTED THIS REGULATION:
Article 1
Amendments to Delegated Regulation (EU) 2020/689
Delegated Regulation (EU) 2020/689 is amended as follows:

in Article 4, the following paragraph 3 is added: ‘3. The competent authority shall include in the targeted animal population kept or wild animals of species that are not listed for the purpose of the relevant listed disease when the competent authority considers that they constitute a risk for animal and human health.’ |

in Article 70 paragraphs 4, 5 and 6 are deleted. |
(3) |
in Article 76, paragraphs 3 and 4 are deleted. |
(4) |
Annexes II and V to Delegated Regulation (EU) 2020/689 are amended in accordance with the Annex to this Regulation. |
Article 2
Entry into force
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION IMPLEMENTING REGULATION (EU) 2023/1799

amending Annexes I and II to Implementing Regulation (EU) 2023/594 laying down special control measures for African swine fever

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Articles 71(3) and 259(1) thereof,
Whereas:

African swine fever is an infectious viral disease affecting kept and wild porcine animals and can have a severe impact on the concerned animal population and the profitability of farming causing disturbance to movements of consignments of those animals and products thereof within the Union and their exports to third countries. |
(2) |
Commission Delegated Regulation (EU) 2020/687 (2) supplements the rules for the control of the listed diseases referred to in Article 9(1), points (a), (b), and (c), of Regulation (EU) 2016/429, and defined as category A, B and C diseases in Commission Implementing Regulation (EU) 2018/1882 (3). In particular, Articles 21 and 22 of Delegated Regulation (EU) 2020/687 provide for the establishment of a restricted zone in the event of an outbreak of a category A disease, including African swine fever, and for certain measures to be applied therein. In addition, Article 21(1) of that Delegated Regulation provides that the restricted zone is to comprise a protection zone, a surveillance zone, and if necessary, further restricted zones around or adjacent to the protection and surveillance zones. |
(3) |
Also, Articles 63 to 66 of Delegated Regulation (EU) 2020/687 provide for certain measures to be taken in the event of an official confirmation of an outbreak of a category A disease in wild animals, including African swine fever in wild porcine animals. |
(4) |
Commission Implementing Regulation (EU) 2023/594 (4) lays down special disease control measures regarding African swine fever to be applied for a limited period of time by the Member States, which are listed or which have areas listed in Annexes I and II thereto (the Member States concerned). Annex I to that Implementing Regulation lists restricted zones I, II and III following outbreaks of that disease. |
(5) |
The areas listed as restricted zones I, II and III in Annex I to Implementing Regulation (EU) 2023/594 are based on the epidemiological situation of African swine fever in the Union. Annexes I and II to Implementing Regulation (EU) 2023/594 were last amended by Commission Implementing Regulation (EU) 2023/1677 (5) following changes in the epidemiological situation as regards that disease in Latvia and Poland. Since the date of adoption of that Implementing Regulation, the epidemiological situation as regards that disease in certain Member States concerned has evolved. |
(6) |
Any amendments to the restricted zones I, II and III in Annex I to Implementing Regulation (EU) 2023/594 should be based on the epidemiological situation as regards African swine fever in the areas affected by that disease and the overall epidemiological situation of African swine fever in the Member State concerned, the level of risk for the further spread of that disease, as well as scientifically based principles and criteria for geographically defining zoning due to African swine fever and the Union’s guidelines agreed with the Member States at the Standing Committee on Plants, Animals, Food and Feed and publicly available on the Commission’s website (6). Such amendments should also take account of international standards, such as the Terrestrial Animal Health Code (7) of the World Organisation for Animal Health (WOAH) and justifications for zoning provided by the competent authorities of the Member States concerned. |

In the case of an outbreak of African swine fever in kept porcine animals in a Member State, Article 3, point (a), of Implementing Regulation (EU) 2023/594 provides for the establishment of a restricted zone by the competent authority of that Member State, in accordance with Article 21(1) of Delegated Regulation (EU) 2020/687. |

In the case of an outbreak of African swine fever in wild porcine animals in a Member State, Article 3, point (b), of Implementing Regulation (EU) 2023/594 provides for the establishment of an infected zone by the competent authority of that Member State, in accordance with Article 63 of Delegated Regulation (EU) 2020/687. |

In addition, following an outbreak of African swine fever in wild porcine animals in a previously disease-free Member State or zone, Article 6(2) of Implementing Regulation (EU) 2023/594 provides for the listing of that area as an infected zone in Part A of Annex II to that Implementing Regulation. |

Also, in the case of a first and single outbreak of African swine fever in kept porcine animals in a previously disease-free Member State or zone, Article 7(2) of Implementing Regulation (EU) 2023/594 provides for the listing of that area as a restricted zone, which comprises protection and surveillance zones, in Part B of Annex II to that Implementing Regulation. |

Italy has informed the Commission of the current African swine fever situation on its territory, following the confirmation of one outbreak of that disease in kept porcine animals in the Lombardy Region on 18 August 2023, in a previously disease-free zone. In accordance with Delegated Regulation (EU) 2020/687 and Implementing Regulation (EU) 2023/594, Italy established a restricted zone, which comprises protection and surveillance zones, where the general disease control measures laid down in Delegated Regulation (EU) 2020/687 are applied, in order to prevent the further spread of that disease. |
(12) |
Commission Implementing Decision (EU) 2023/1684 (8) was adopted following information received from Italy concerning this outbreak in kept porcine animals in a previously disease-free zone in the Lombardy Region of that Member State. Implementing Decision (EU) 2023/1684 applies until 28 November 2023. |

Also, in May 2023, Italy informed the Commission of the confirmation of an outbreak of African swine fever in wild porcine animals in the Campania region in a previously disease-free zone. Accordingly, the competent authority of that Member State established an infected zone in accordance with Delegated Regulation (EU) 2020/687 and Implementing Regulation (EU) 2023/594 and this infected zone was listed in Part A of Annex II to Implementing Regulation (EU) 2023/594. |

In addition, Sweden has informed the Commission of the confirmation in the municipality of Fagersta of one outbreak of African swine fever in wild porcine animals on 6 September 2023, in a previously disease-free zone. Accordingly, the competent authority of that Member State established an infected zone in accordance with Delegated Regulation (EU) 2020/687 and Implementing Regulation (EU) 2023/594. |

Commission Implementing Decision (EU) 2023/1778 (9) was adopted following information received from Sweden concerning this outbreak in wild porcine animals in a previously disease-free zone in the municipality of Fagersta of that Member State. Implementing Decision (EU) 2023/1778 applies until 6 December 2023. |

Since the date of adoption of Implementing Regulation (EU) 2023/1677 amending Implementing Regulation (EU) 2023/594, there have been new outbreaks of African swine fever in kept porcine animals in Croatia and in wild porcine animals in Italy and Croatia, and the epidemiological situation in certain zones listed as restricted zones I and II in Germany, and as restricted zones III in Latvia and Poland in Annex I to Implementing Regulation (EU) 2023/594 has improved as regards wild and kept porcine animals, due to the disease control measures being applied by those Member States in accordance with Union legislation. |

Following the recent outbreaks of African swine fever in wild porcine animals in Italy and taking into account the current epidemiological situation as regards African swine fever in the Union, zoning in this Member State has been reassessed and updated in accordance with Articles 6 and 7 of Implementing Regulation (EU) 2023/594. In addition, the risk management measures in place have been reassessed and updated. These changes should be reflected in Annex I to Implementing Regulation (EU) 2023/594. |

In September 2023, several outbreaks of African swine fever in kept porcine animals were observed in the Vukovar Srijem County in Croatia, in areas currently listed as surveillance zones in Annex II to Implementing Regulation (EU) 2023/594. Those new outbreaks of African swine fever in kept porcine animals constitute an increased level of risk, which should be reflected in that Annex. Accordingly, those areas of Croatia currently listed as surveillance zones in that Annex affected by those recent outbreaks of African swine fever, should now be listed as protection zones in that Annex instead of as surveillance zones thereof and the current boundaries of the surveillance zones also needs to be redefined to take account of those recent outbreaks. |

Considering the overall epidemiological situation of African swine fever in Italy and the new outbreaks of African swine fever in wild porcine animals in the Campania region, this area of Italy affected by those outbreaks of African swine fever currently listed in Part A of Annex II to Implementing Regulation (EU) 2023/594, should now be listed as restricted zones I and II in Annex I to Implementing Regulation (EU) 2023/594, and delisted from Part A of Annex II to that Implementing Regulation. |

In addition, on the basis of the information and justification provided by Germany, and taking into account the effectiveness of the disease control measures for African swine fever for wild porcine animals in certain restricted zones II listed in Annex I to Implementing Regulation (EU) 2023/594 being applied in Germany in accordance with Delegated Regulation (EU) 2020/687, and in particular those laid down in Articles 64, 65 and 67 thereof, and in line with the risk mitigation measures for African swine fever set out in the WOAH Code, certain zones in the states of Mecklenburg-Western Pomerania and Brandenburg in Germany, currently listed as restricted zones II in Annex I to Implementing Regulation (EU) 2023/594 should now be delisted from that Annex due to the absence of African swine fever outbreaks in kept and wild porcine animals in those restricted zones II for the past 12 months. |

Also, on the basis of the information and justification provided by Germany, and taking into account the effectiveness of the disease control measures for African swine fever for wild porcine animals in certain restricted zones I, and in the restricted zones that those restricted zones I are bordering, listed in Annex I to Implementing Regulation (EU) 2023/594 being applied in Germany in accordance with Delegated Regulation (EU) 2020/687, and in particular those laid down in Articles 64, 65 and 67 thereof, and in line with the risk mitigation measures for African swine fever set out in the WOAH Code, certain zones in the states of Mecklenburg-Western Pomerania and Brandenburg in Germany, currently listed as restricted zones I in Annex I to Implementing Regulation (EU) 2023/594 should now be delisted from that Annex due to the absence of African swine fever outbreaks in kept and wild porcine animals in those restricted zones I, and in the zones that those restricted zones I are bordering, for the past 12 months. |

Further, on the basis of the information and justification provided by Poland, and taking into account the effectiveness of the disease control measures for African swine fever for kept porcine animals in certain restricted zones III listed in Annex I to Implementing Regulation (EU) 2023/594 being applied in Poland in accordance with Delegated Regulation (EU) 2020/687, and in particular those laid down in Articles 22, 25 and 40 thereof, and in line with the risk mitigation measures for African swine fever set out in the WOAH Code, certain zones in the Lubuskie, Dolnośląskie and Wielkopolskie Regions in Poland, currently listed as restricted zones III in Annex I to Implementing Regulation (EU) 2023/594 should now be listed as restricted zones II in that Annex, due to the absence of African swine fever outbreaks in kept porcine animals in those restricted zones III for the past 12 months, while the disease is still present in wild porcine animals. Those restricted zones III should now be listed as restricted zones II in that Annex taking account of the current African swine fever epidemiological situation. |

Finally, on the basis of the information and justification provided by Latvia, and taking into account the effectiveness of the disease control measures for African swine fever for kept porcine animals in certain restricted zones III listed in Annex I to Implementing Regulation (EU) 2023/594 being applied in Latvia in accordance with Delegated Regulation (EU) 2020/687, and in particular those laid down in Articles 22, 25 and 40 thereof, and in line with the risk mitigation measures for African swine fever set out in the WOAH Code, certain zones in the Kuldīgas County in Latvia, currently listed as restricted zones III in Annex I to Implementing Regulation (EU) 2023/594 should now be listed as restricted zones II in that Annex, due to the absence of African swine fever outbreaks in kept porcine animals in those restricted zones III for the past 12 months, while the disease is still present in wild porcine animals. Those restricted zones III should now be listed as restricted zones II in that Annex taking account of the current African swine fever epidemiological situation. |

In the case of a first and single outbreak of African swine fever in kept porcine animals in a previously disease-free Member State or zone, Article 7(2) of Implementing Regulation (EU) 2023/594 provides for the listing of that area as a restricted zone, which comprises protection and surveillance zones, in Part B of Annex II to that Implementing Regulation. Consequently, the restricted zone established by the competent authority of Italy in the Lombardy Region should be listed in Part B of Annex II to Implementing Regulation (EU) 2023/594 and Implementing Decision (EU) 2023/1684 should be repealed. |

Similarly, following an outbreak of African swine fever in wild porcine animals in a previously disease-free Member State or zone, Article 6(2) of Implementing Regulation (EU) 2023/594 provides for the listing of that area as an infected zone in Part A of Annex II to that Implementing Regulation. Therefore, the infected zone established by the competent authority of Sweden in the municipality of Fagersta and parts of the municipalities of Surahammar, Norberg, Skinnskatteberg, Västerås, Sala, Smedjebacken and Avesta, should be listed in Part A of Annex II to Implementing Regulation (EU) 2023/594 and Implementing Decision (EU) 2023/1778 should be repealed. |

Finally, considering the overall epidemiological situation of African swine fever in Croatia and the outbreaks of African swine fever in wild and kept porcine animals the areas of Croatia affected by those outbreaks of African swine fever, should be listed for a longer time period in Parts A and B of Annex II to Implementing Regulation (EU) 2023/594. Accordingly, the infected and restricted zones in that Annex should now be listed until October 2023. |

In order to take account of the recent developments in the epidemiological situation of African swine fever in the Union, and in order to combat the risks associated with the spread of that disease in a proactive manner new restricted zones of a sufficient size should be demarcated for Italy, Latvia and Poland and listed as restricted zones I and II, certain parts of restricted zones I and II should be delisted for Germany in Annex I to Implementing Regulation (EU) 2023/594 and new restricted zones should be demarcated for Croatia and listed as protection zones in Annex II to that Regulation, and the existing infected and restricted zones for Croatia listed in Annex II to that Regulation should be extended. As the situation as regards African swine fever is very dynamic in the Union, when demarcating those new restricted zones, account has been taken of the epidemiological situation in the surrounding areas. |

Given the urgency of the epidemiological situation in the Union as regards the spread of African swine fever, it is important that the amendments to be made to Annexes I and II to Implementing Regulation (EU) 2023/594 by this Regulation take effect as soon as possible. |

This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on the Functioning of the European Union, and in particular the second paragraph of Article 246 thereof,
Having regard to the opinion of the European Parliament (1),
Whereas:

On 28 November 2019, the European Council adopted Decision (EU) 2019/1989 (2) appointing the European Commission for the period until 31 October 2024. |
(2) |
In a letter dated 15 May 2023, Ms Ursula VON DER LEYEN, President of the Commission, informed the Council that Ms Mariya GABRIEL had resigned from her post as a Member of the Commission. |
(3) |
In accordance with the second paragraph of Article 246 of the Treaty on the Functioning of the European Union, a vacancy caused by resignation is to be filled for the remainder of the Member’s term of office by a new Member of the same nationality. |
(4) |
A new Member of the Commission should therefore be appointed, |
HAS ADOPTED THIS DECISION:
Article 1
By common accord with Ms Ursula VON DER LEYEN, President of the Commission, the Council appoints Ms Iliana IVANOVA as Member of the Commission for the remainder of the term of office, which runs until 31 October 2024.
Article 2
This Decision shall enter into force on the date of its adoption.

amending Decision 1999/70/EC concerning the external auditors of the national central banks, as regards the external auditors of the Banco de España
THE COUNCIL OF THE EUROPEAN UNION,
Having regard to Protocol No 4 on the Statute of the European System of Central Banks and of the European Central Bank, annexed to the Treaty on European Union and the Treaty on the Functioning of the European Union, and in particular Article 27.1 thereof,
Having regard to the Recommendation of the European Central Bank of 20 June 2023 to the Council of the European Union on the external auditors of the Banco de España (ECB/2023/16) (1),
Whereas:

The accounts of the European Central Bank (ECB) and of the national central banks of the Member States whose currency is the euro are to be audited by independent external auditors recommended by the Governing Council of the ECB and approved by the Council of the European Union. |
(2) |
The mandate of the current external auditors of the Banco de España, the temporary association of undertakings Mazars Auditores, S.L.P. – Mazars, S.A., ended following the audit for the financial year 2022. It is therefore necessary to appoint external auditors from the financial year 2023. |
(3) |
The Banco de España has selected KPMG Auditores S.L. as its external auditor for the financial years 2023 to 2027. |
(4) |
The Governing Council of the ECB recommended that KPMG Auditores S.L. be appointed as the external auditor of the Banco de España for the financial years 2023 to 2027. |
(5) |
Following the recommendation of the Governing Council of the ECB, Council Decision 1999/70/EC (2) should be amended accordingly, |
HAS ADOPTED THIS DECISION:
Article 1
In Article 1 of Decision 1999/70/EC, paragraph 3 is replaced by the following:
‘3. KPMG Auditores S.L. is hereby approved as the external auditor of the Banco de España for the financial years 2023 to 2027.’.
Article 2
This Decision shall take effect on the date of its notification.

This Decision is addressed to the European Central Bank.

Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2018/1240 of the European Parliament and of the Council of 12 September 2018 establishing a European Travel Information and Authorisation System (ETIAS) and amending Regulations (EU) No 1077/2011, (EU) No 515/2014, (EU) 2016/399, (EU) 2016/1624 and (EU) 2017/2226 (1), and in particular Article 11(10) thereof,
Whereas:

Regulation (EU) 2018/1240 establishes the European Travel Information and Authorisation System (‘ETIAS’) applicable to visa-exempt third-country nationals seeking to enter the territory of the Member States. |
(2) |
The purpose of this Decision is to lay down the technical specifications for the implementation of the conditions of data retention provided for in Article 24(6), point (c)(ii) and Article 54(1), point (b), of Regulation (EU) 2018/1240, to enable automated verifications relying on the European Search Portal (‘ESP’). |
(3) |
Pursuant to Articles 24(6) and 54(1) of Regulation (EU) 2018/1240, the ETIAS Central System should periodically and automatically verify that the conditions for the retention of application files are fulfilled. |
(4) |
In order to fulfil this obligation, the ETIAS Central System should adhere to the retention period of the application file, this being five years from the last decision to refuse, annul or revoke the travel authorisation. |

In the case all the data giving rise to the decision to refuse, annul or revoke a travel authorisation is deleted prior to the expiry of the five-year retention period, the ETIAS Central System should automatically delete the application file within three days. For this reason, and in order to limit the amount of processing, the system should verify daily the compliance with data retention rules. In addition, in the case where a record should be deleted, it should be done within three days. |

Given that Regulation (EU) 2018/1240 builds upon the Schengen acquis, in accordance with Article 4 of Protocol No 22 on the position of Denmark, annexed to the Treaty on European Union and to the Treaty on the Functioning of the European Union, Denmark notified the implementation of Regulation (EU) 2018/1240 in its national law. Denmark is therefore bound by this Decision. |

This Decision constitutes a development of the provisions of the Schengen acquis in which Ireland does not take part. This Decision falls outside the scope of the measures provided for in Council Decision 2002/192/EC (2). Ireland is therefore not taking part in the adoption of this Decision and is not bound by it or subject to its application. |

As regards Iceland and Norway, this Decision constitutes a development of the provisions of the Schengen acquis within the meaning of the Agreement concluded by the Council of the European Union and the Republic of Iceland and the Kingdom of Norway concerning the association of those two States with the implementation, application and development of the Schengen acquis (3), which fall within the area referred to in Article 1, point A of Council Decision 1999/437/EC (4). |

As regards Switzerland, this Decision constitutes a development of the provisions of the Schengen acquis within the meaning of the Agreement between the European Union, the European Community and the Swiss Confederation on the Swiss Confederation’s association with the implementation, application and development of the Schengen acquis (5), which fall within the area referred to in Article 1, point A of Decision 1999/437/EC, read in conjunction with Article 3 of Council Decision 2008/146/EC (6). |

As regards Liechtenstein, this Decision constitutes a development of the provisions of the Schengen acquis within the meaning of the Protocol between the European Union, the European Community, the Swiss Confederation and the Principality of Liechtenstein on the accession of the Principality of Liechtenstein to the Agreement between the European Union, the European Community and the Swiss Confederation on the Swiss Confederation’s association with the implementation, application and development of the Schengen acquis (7) which fall within the area referred to in Article 1, point A of Decision 1999/437/EC read in conjunction with Article 3 of Council Decision 2011/350/EU (8). |

HAS ADOPTED THIS DECISION:
Article 1
Subject matter
This Decision establishes the technical arrangements for the implementation of the period of data retention and erasure of application files pursuant to Article 24(6), point (c)(ii), and Article 54(1), point (b), of Regulation (EU) 2018/1240.
Article 2
Data retention mechanisms and procedures
1. For the purposes of Article 24(6), point (c)(ii), and Article 54(1), point (b), of Regulation (EU) 2018/1240, the ETIAS Central System shall automatically verify the conditions of data retention referred to in those Articles daily.
2. In order to do so, the ETIAS Central System shall verify with the systems referred to in Article 24(6), point (c)(ii), and Article 54(1), point (b), of Regulation (EU) 2018/1240 by means of the unique reference number, referred to in Article 11(8) of that Regulation, whether the data that gave rise to the decision to refuse, annul or revoke the travel authorisation are still present in the respective system.
3. Where the ETIAS Central System determines that the conditions for retention have elapsed, the ETIAS Central System shall automatically delete the relevant application file:
(a) |
immediately, where the five-year retention period from the last decision to refuse, annul or revoke the travel authorisation has elapsed; |
(b) |
where the five-year retention period referred to in point (a) has not elapsed, within three days from the automatic verification referred to in paragraph (1) indicating that data in a record, file or alert registered in one of the systems referred to in Article 24(6), point (c)(ii), and Article 54(1), point (b), giving rise to the decision to refuse, annul or revoke the travel authorisation have been deleted. |
Article 3
Entry into force
This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
