Opinion of the Advisory Committee on restrictive agreements and dominant position given at its meeting of 15 March 2010 regarding a draft decision relating to Case COMP/39.351 — Swedish Interconnectors

Rapporteur: Romania

2010/C 142/06

1.

The Advisory Committee shares the Commission's concerns expressed in its preliminary assessment under Article 102 Treaty on the Functioning of the European Union and Article 54 of the EEA Agreement in June 2009.

2.

The Advisory Committee agrees with the Commission that the proceedings can be concluded by means of a decision pursuant to Article 9(1) of EC Regulation No 1/2003.

3.

The Advisory Committee agrees with the Commission that the commitments offered by Svenska Kraftnät are sufficient and proportionate to address the concerns expressed by the Commission in its preliminary assessment.

4.

The Advisory Committee agrees with the Commission that, in light of the commitments offered by Svenska Kraftnät, there are no longer grounds for action by the Commission, without prejudice to Article 9(2) of Regulation (EC) No 1/2003.

5.

The Advisory Committee asks the Commission to take into account any other points raised during the discussion.

6.

The Advisory Committee intends to recommend the publication of its opinion in the Official Journal of the European Union.
