DECISION OF THE EEA JOINT COMMITTEE No 215/2018

of 26 October 2018

amending Annex X (Services in general) and Annex XVIII (Health and safety at work, labour law, and equal treatment for men and women) to the EEA Agreement [2021/498]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

Directive 2014/67/EU of the European Parliament and of the Council of 15 May 2014 on the enforcement of Directive 96/71/EC concerning the posting of workers in the framework of the provision of services and amending Regulation (EU) No 1024/2012 on administrative cooperation through the Internal Market Information System (‘the IMI Regulation’) (1) is to be incorporated into the EEA Agreement.

Annexes X and XVIII to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following indent is added in point 3 (Regulation (EU) No 1024/2012 of the European Parliament and of the Council) of Annex X to the EEA Agreement:

‘—

32014 L 0067: Directive 2014/67/EU of the European Parliament and of the Council of 15 May 2014 (OJ L 159, 28.5.2014, p. 11).’

Article 2

The following is inserted after point 30a (Commission Decision 2009/17/EC) of Annex XVIII to the EEA Agreement:

‘30b.

32014 L 0067: Directive 2014/67/EU of the European Parliament and of the Council of 15 May 2014 on the enforcement of Directive 96/71/EC concerning the posting of workers in the framework of the provision of services and amending Regulation (EU) No 1024/2012 on administrative cooperation through the Internal Market Information System (‘the IMI Regulation’) (OJ L 159, 28.5.2014, p. 11).

The provisions of the Directive shall, for the purposes of this Agreement, be read with the following adaptation:

In Article 4(3)(c), as regards the EFTA States, the words “according to Regulation (EC) No 593/2008 (Rome I) and/or the Rome Convention” shall not apply.’

Article 3

The text of Directive 2014/67/EU in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 4

This Decision shall enter into force on 27 October 2018, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).

Article 5

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

Declaration by the EFTA States

to Decision of the EEA Joint Committee No 215/2018 of 26 October 2018 incorporating Directive 2014/67/EU into the Agreement [2021/…]

Directive 2014/67/EU of 15 May 2014 on the enforcement of Directive 96/71/EC concerning the posting of workers in the framework of the provision of services foresees provisions on the cross-border enforcement of financial administrative penalties and fines. The incorporation of this Directive is without prejudice to the incorporation of future acts containing provisions on the cross-border enforcement of financial administrative penalties and fines.
