DECISION OF THE EEA JOINT COMMITTEE
No 174/2014
of 25 September 2014
amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2015/1242]
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,
Whereas:

(1) |
Council Directives 76/117/EEC (1), 79/196/EEC (2) and 82/130/EEC (3), which are incorporated into the EEA Agreement, were repealed by Directive 94/9/EC of the European Parliament and the Council (4), which is incorporated into the EEA Agreement, and consequently the references to Directives 76/117/EEC, 79/196/EEC and 82/130/EEC should be deleted from the EEA Agreement. |

(2) |
Commission Directive 94/26/EC (5), which is incorporated into the EEA Agreement, has become obsolete and is consequently to be repealed under the EEA Agreement. |

(3) |
For practical reasons, the acts listed under the heading ‘ACTS OF WHICH THE CONTRACTING PARTIES SHALL TAKE NOTE’ in Chapter X of Annex II shall be renumbered. |

(4) |
Annex II to the EEA Agreement should therefore be amended accordingly, |
HAS ADOPTED THIS DECISION:
Article 1
Chapter X of Annex II to the EEA Agreement shall be amended as follows:

(1) |
the text of points 2 (Council Directive 76/117/EEC), 3 (Council Directive 79/196/EEC), 4 (Council Directive 82/130/EEC) and 7b (Commission Directive 94/26/EC) is deleted; |
|
(2) |
under the heading ‘ACTS OF WHICH THE CONTRACTING PARTIES SHALL TAKE NOTE’ points 8 (deleted) to 25 (deleted) are renumbered points 1 to 18. |
Article 2
This Decision shall enter into force on 26 September 2014, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (6).
Article 3
This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
