Form of order sought

The applicant claims the Court should:

annul the decision of 12 February 2025 rejecting the request for assistance submitted under Article 90(1) and Article 24 of the Staff Regulations of Officials of the European Union;

annul, so far as necessary, in that it supplements or amends the decision of 12 February 2025, the explicit decision rejecting the claim of 1 August 2025;

order the defendant to compensate the applicant for the damage resulting from the misconduct of the administrative procedure, assessed ex aequo et bono at EUR 10 000;

order, in the alternative and in so far as necessary, the production by the defendant of the administrative inquiry report and all its annexes pursuant to Articles 91(b) and 92 of the Rules of Procedure of the General Court of the European Union;

order the defendant to pay the costs.

Pleas in law and main arguments

In support of the action, the applicant relies on two pleas in law.

1.

First plea in law, alleging violation of the definition of harassment, failure to take a decision, (manifest) error of assessment and contradictions between the grounds and conclusions of the inquiry report and breach of the duty to provide assistance.

2.

Second plea in law, alleging breach of the duty of care and of the duty to provide assistance, maladministration, violation of the principle of reasonable time limits and unlawfulness of the suspension of the administrative inquiry. The applicant argues that those violations and breaches engage the non-contractual liability of the administration.
