COMMISSION IMPLEMENTING DECISION (EU) 2026/803

of 10 April 2026

amending Implementing Decision (EU) 2023/2584 as regards an update of the referenced standards and the addition of new referenced standards

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 1025/2012 of the European Parliament and of the Council of 25 October 2012 on European standardisation, amending Council Directives 89/686/EEC and 93/15/EEC and Directives 94/9/EC, 94/25/EC, 95/16/EC, 97/23/EC, 98/34/EC, 2004/22/EC, 2007/23/EC, 2009/23/EC and 2009/105/EC of the European Parliament and of the Council and repealing Council Decision 87/95/EEC and Decision No 1673/2006/EC of the European Parliament and of the Council (1), and in particular Article 10(6) thereof,

Whereas:

In accordance with Article 17 of Directive (EU) 2016/797 of the European Parliament and of the Council (2), interoperability constituents and subsystems which are in conformity with harmonised standards or parts thereof, the references of which have been published in the Official Journal of the European Union, are to be presumed to be in conformity with the essential requirements covered by those standards or parts thereof set out in that Directive.

By Implementing Decision C(2023) 1057 (3) the Commission made a request to the European Committee for Standardisation (CEN) and the European Committee for Electrotechnical Standardisation (Cenelec) for the drafting and the revision of harmonised standards in support of Directive (EU) 2016/797.

The Commission, together with CEN and Cenelec, has assessed whether the standards drafted or revised by CEN and Cenelec comply with the request set out in Implementing Decision C(2023) 1057.

(4)

The harmonised standards drafted, revised and amended by CEN and Cenelec based on Implementing Decision C(2023) 1057 satisfy all the requirements which they aim to cover, except for standards EN 13261:2024, EN 16584-1:2025, EN 16584-3:2025, EN 16585-2:2025, EN 16586-1:2025 and EN 16586-2:2025. It is therefore appropriate to publish the references of those standards in the Official Journal of the European Union.

With respect to standard EN 13261:2024, the Commission has concluded that regarding Commission Regulation (EU) No 1302/2014 (4), the standard should only give presumption of conformity for point 4.2.3.5.2.1(2) of the Annex to that Regulation per Annex ZA of the standard. Also, concerning Commission Regulation (EU) No 321/2013 (5), the standard should only give presumption of conformity for the first two paragraphs of point 4.2.3.6.4 of the Annex to that Regulation per the same Annex ZA. The requirement on traceability of axles is not addressed in this standard. It is therefore appropriate to publish the references of that standard, with restrictions, in the Official Journal of the European Union.

As regards standard EN 16584-1:2025, the Commission has established that the standard does not give presumption of conformity for point 4.2.1.15(3) of the Annex to Commission Regulation (EU) No 1300/2014 (6). For points 5.3.2.8(4), 5.3.2.9(5) and 5.3.2.10(2) of the same Annex, the standard should only give presumption of conformity to the slip resistance. It is therefore appropriate to publish the references of that standard, with restrictions, in the Official Journal of the European Union.

For standard EN 16584-3:2025, the Commission has concluded that the standard does not give presumption of conformity for point 4.2.12(1) of the Annex to Regulation (EU) No 1300/2014. It is therefore appropriate to publish the references of that standard, with restrictions, in the Official Journal of the European Union.

Concerning standard EN 16585-2:2025, the Commission has concluded that the standard does not give full presumption of conformity for point 4.2.2.1.2.1(3) of the Annex to Regulation (EU) No 1300/2014 since the item regarding the unit intended to be operated exclusively within a seat reservation system is not addressed by that standard. It is therefore appropriate to publish the references of that standard, with restrictions, in the Official Journal of the European Union.

As for standard EN 16586-1:2025, the Commission has concluded that the standard does not give presumption of conformity for point 4.2.2.1.2(4) of the Annex to Regulation (EU) No 1300/2014 as Annex B of that standard does not provide enough content for that. It is therefore appropriate to publish the references of that standard, with restrictions, in the Official Journal of the European Union.

Regarding standard EN 16586-2:2025, the Commission has concluded that the standard does not give presumption of conformity for point 4.2.2.12.2(4) of the Annex to Regulation (EU) No 1300/2014 since clause 5.5 of the standard introduces a deviation not allowed by that regulation, while only automatic bridging plates are allowed pursuant to point 4.2.2.12.1(2) of the Annex to that regulation. Also, the standard should not give presumption of conformity for point 4.2.2.12.3(1) of the same Annex as the said point is a definition. It is therefore appropriate to publish the references of that standard, with restrictions, in the Official Journal of the European Union.

Standards EN 12663-1:2010+A1:2014, EN 12663-2:2010, EN 13232-2:2003+A1:2011, EN 13232-3:2003+A1:2011, EN 13232-4:2005+A1:2011, EN 13232-5:2005+A1:2011, EN 13232-6:2005+A1:2011, EN 13232-7:2006+A1:2011, EN 13232-8:2007+A1:2011, EN 13232-9:2006+A1:2011, EN 13803-1:2010, EN 13803-2:2006+A1:2009, EN 14067-4:2013+A1:2018, EN 15877-1:2012+A1:2018, EN 16235:2013 have become obsolete as they were withdrawn by CEN or Cenelec and they should not give the presumption of conformity regarding Directive (EU) 2016/797 anymore. It is thus necessary to withdraw their references from the Official Journal of the European Union. It is therefore appropriate to delete those references from Annex I to Commission Implementing Decision (EU) 2023/1586 (7).

Standards EN 16494:2025, EN 16584-1:2025, EN 16584-3:2025, EN 16585-1:2025, EN 16585-2:2025, EN 16585-3:2025, EN 16586-1:2025 and EN 16586-2:2025 have been revised or amended, so it is necessary to withdraw their references from the Official Journal of the European Union. It is therefore appropriate to delete those references from Annex I to Implementing Decision (EU) 2023/1586.

In order to give manufacturers sufficient time to adapt their products covered by harmonised standards EN 16494:2025, EN 16584-1:2025, EN 16584-3:2025, EN 16585-1:2025, EN 16585-2:2025, EN 16585-3:2025, EN 16586-1:2025 and EN 16586-2:2025, it is necessary to defer the withdrawal of the references of those harmonised standards.

Commission Implementing Decision (EU) 2023/2584 (8) should therefore be amended accordingly.

(15)

Compliance with a harmonised standard confers a presumption of conformity with the corresponding essential requirements set out in Union harmonisation legislation from the date of publication of the reference of such standard in the Official Journal of the European Union. This Decision should therefore enter into force on the date of its publication,

HAS ADOPTED THIS DECISION:

Article 1

Annex I to Implementing Decision (EU) 2023/2584 is amended in accordance with the Annex to this Decision.

Article 2

This Decision shall enter into force on the day of its publication in the Official Journal of the European Union.

Points (3), (5), (7), (9), (11), (13), (15) and (17) of the Annex shall apply from 13 October 2027.
