DECISION OF THE EEA JOINT COMMITTEE No 300/2024
of 6 December 2024
amending Annex II (Technical regulations, standards, testing and certification) and Annex XX (Environment) to the EEA Agreement [2025/565]
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,
Whereas:

Regulation (EU) 2019/1010 of the European Parliament and of the Council of 5 June 2019 on the alignment of reporting obligations in the field of legislation related to the environment, and amending Regulations (EC) No 166/2006 and (EU) No 995/2010 of the European Parliament and of the Council, Directives 2002/49/EC, 2004/35/EC, 2007/2/EC, 2009/147/EC and 2010/63/EU of the European Parliament and of the Council, Council Regulations (EC) No 338/97 and (EC) No 2173/2005, and Council Directive 86/278/EEC (1) is to be incorporated into the EEA Agreement. |

Annexes II and XX to the EEA Agreement should therefore be amended accordingly, |
HAS ADOPTED THIS DECISION:
Article 1
Annex II to the EEA Agreement is amended as follows:

1. |
The following is added in point 7 (Directive 2010/63/EU of the European Parliament and of the Council) of Chapter XIII: ‘, as amended by:
The provisions of this Directive shall, for the purposes of this Agreement, be read with the following adaptation: In Article 43(4) and the third subparagraph of Article 54(2) the following sentence shall be added: “The EFTA Surveillance Authority shall, as regards the EFTA States, have access to the database.” ’ |

The following is added in point 9c (Regulation (EU) No 995/2010 of the European Parliament and of the Council) of Chapter XVII: ‘, as amended by:

Article 2
Annex XX to the EEA Agreement shall be amended as follows:

The following is added in point 1h (Regulation (EC) No 166/2006 of the European Parliament and the Council): ‘, as amended by:
|

The following indent is added in points 1i (Directive 2004/35/EC of the European Parliament and of the Council) and 32 (Council Directive 86/278/EEC):

3. |
Point 1j (Directive 2007/2/EC of the European Parliament and of the Council) is amended as follows:

4. |
The following is added in point 32g (Directive 2002/49/EC of the European Parliament and of the Council):
The provisions of this Directive shall, for the purposes of this Agreement, be read with the following adaptations:

Article 3
The text of Regulation (EU) 2019/1010 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.
Article 4
This Decision shall enter into force on 7 December 2024, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).
Article 5
This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
