COMMISSION IMPLEMENTING REGULATION (EU) 2026/824

of 14 April 2026

correcting Implementing Regulation (EU) 2025/854 as regards the residue definition for fosetyl-Al and the list of commodities to be analysed for trimethyl-sulfonium cation

(Text with EEA relevance)

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EC) No 396/2005 of the European Parliament and of the Council of 23 February 2005 on maximum residue levels of pesticides in or on food and feed of plant and animal origin and amending Council Directive 91/414/EEC (1), and in particular Article 29(2) thereof,

Whereas:

(1)

Commission Implementing Regulation (EU) 2025/854 (2) aims to ensure compliance with maximum residue levels of pesticides and to assess the consumer exposure to pesticide residues. For that purpose, that Regulation sets out a control programme and the number of samples per Member State that are to be taken.

(2)

Part C of Annex I to Implementing Regulation (EU) 2025/854 contains two errors which affect the substance of the provisions concerned. First, as regards fosetyl-Al, the new residue definition for enforcement provided by Commission Regulation (EU) 2024/2619 (3) was not taken into account. Second, it is wrongly indicated that trimethyl-sulfonium cation is to be analysed in and on onions in 2027, instead of in 2026.

(3)

Implementing Regulation (EU) 2025/854 should therefore be corrected accordingly.

(4)

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

HAS ADOPTED THIS REGULATION:

Article 1

Implementing Regulation (EU) 2025/854 is amended in accordance with the Annex to this Regulation.

Article 2

This Regulation shall enter into force on twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

Done at Brussels, 14 April 2026.

For the Commission

The President

Ursula VON DER LEYEN
