COMMISSION IMPLEMENTING REGULATION (EU) 2025/641
of 25 March 2025
amending Annexes V, XIV and XV to Implementing Regulation (EU) 2021/404 as regards the entries for Bosnia and Herzegovina, Canada, the Republic of North Macedonia, the United Kingdom and the United States in the lists of third countries, territories or zones thereof authorised for the entry into the Union of consignments of poultry and germinal products of poultry, of fresh meat of poultry and game birds, and of meat products from poultry

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Articles 230(1) and 232(1) and (3) thereof,
Whereas:

Regulation (EU) 2016/429 provides that consignments of animals, germinal products and products of animal origin must come from a third country or territory, or zone or compartment thereof, listed in accordance with Article 230(1) of that Regulation in order to enter the Union. |
(2) |
Commission Delegated Regulation (EU) 2020/692 (2) lays down the animal health requirements that consignments of certain species and categories of animals, germinal products and products of animal origin, from third countries or territories, or zones thereof, or compartments thereof in the case of aquaculture animals, must comply with in order to enter the Union. |

Commission Implementing Regulation (EU) 2021/404 (3) lays down the lists of third countries, territories, or zones thereof, from which the entry into the Union of the consignments of the species and categories of animals, germinal products and products of animal origin falling within the scope of Delegated Regulation (EU) 2020/692 is permitted. Those lists and certain general rules concerning those lists are set out in Annexes I to XXII to that Implementing Regulation. |

More particularly, Annexes V, XIV and XV to Implementing Regulation (EU) 2021/404 set out the lists of third countries, territories, or zones thereof authorised for the entry into the Union respectively of consignments of poultry and germinal products of poultry, fresh meat of poultry and game birds, and meat products from ungulates, poultry and game birds. |

Canada has notified the Commission of two outbreaks of highly pathogenic avian influenza (HPAI) in poultry in the provinces of Nova Scotia and Ontario, which were confirmed on 4 March 2025 and 13 March 2025, respectively, by laboratory analysis (RT-PCR). |

The United Kingdom has notified the Commission of three outbreaks of HPAI in poultry in the county of North Yorkshire, England, and in the council area of Highland, Scotland, which were confirmed between 12 March 2025 and 18 March 2025 by laboratory analysis (RT-PCR). |

The United States has notified the Commission of 27 outbreaks of HPAI in poultry in the states of Colorado (1), Florida (1), Illinois (1), Indiana (6), New Jersey (4), New York (7), Ohio (3), Iowa (1) and Pennsylvania (3), which were confirmed between 27 February 2025 and 17 March 2025 by laboratory analysis (RT-PCR). |

Following those recent outbreaks of HPAI, the veterinary authorities of Canada, the United Kingdom and the United States established a restricted zone of at least 10 km around the affected establishments and implemented a stamping-out policy to control the presence of HPAI and limit the spread of that disease. |

Canada, the United Kingdom and the United States have submitted information to the Commission on the epidemiological situation on their territories and the measures taken to prevent the further spread of HPAI following those recent outbreaks of HPAI. |

That information has been evaluated by the Commission. In view of the animal health situation in the areas under restrictions established by the veterinary authorities of Canada, the United Kingdom and the United States, the entry into the Union of consignments of poultry and germinal products of poultry, and of fresh meat of poultry and game birds from those areas concerned by the recent outbreaks should be suspended, in order to protect the animal health status of the Union. Therefore, the entries for those third countries in the tables in Section B, Part 1 and in Part 2 of Annex V, and the table in Section B, Part 1 of Annex XIV to Implementing Regulation (EU) 2021/404 should be amended accordingly. |

In addition, on 17 March 2025, the Republic of North Macedonia notified to the Commission an outbreak of Newcastle disease in poultry. That outbreak is located in the municipality of Jegunovtse and was confirmed on 12 March 2025 by laboratory analysis (RT-PCR). |

Section A of Part 1 of Annex XV to Regulation (EU) 2021/404 currently specifies that no risk-mitigating treatment is required for the entry into the Union of consignments of meat products from poultry from the Republic of North Macedonia. Due to the risk of the introduction of Newcastle disease into the Union linked to the entry into the Union of consignments of meat products from poultry from the Republic of North Macedonia that have not undergone a risk mitigating treatment, it is necessary to protect the animal health status of the Union. As a consequence, risk mitigation treatment D, in accordance with Annex XXVI to Delegated Regulation (EU) 2020/692, should be required for the entry into the Union of consignments of meat products from poultry from the Republic of North Macedonia. The entry for the Republic of North Macedonia in the table set out in Section A of Part 1 of Annex XV to Implementing Regulation (EU) 2021/404 should therefore be amended accordingly. |

Furthermore, Bosnia and Herzegovina provided updated information to the Commission in relation to the epidemiological situation on its territory as regards HPAI which led to the suspension of the entry into the Union of consignments of fresh meat of poultry, as set out in Annex XIV to Implementing Regulation (EU) 2021/404, and the requirement on the application of risk-mitigating treatment D, in accordance with Annex XXVI to Delegated Regulation (EU) 2020/692, for the entry into the Union of consignments of meat products from poultry from that third country, as set out in the table in Section A of Part 1 of Annex XV to Implementing Regulation (EU) 2021/404. |

On 11 March 2025, Bosnia and Herzegovina submitted updated information on the animal health situation and the measures it has taken in relation to the outbreak of HPAI in poultry in the municipality of Rogatica in the Republika Srpska, which was confirmed on 10 February 2025 by laboratory analysis (RT-PCR). |

The Commission has evaluated the information submitted by Bosnia and Herzegovina, and considers that it has provided appropriate guarantees that the animal health situation that gave rise to the suspension of the entry of consignments of fresh meat of poultry into the Union from that third country, as set out in Annex XIV to Implementing Regulation (EU) 2021/404, no longer represents a threat to animal or public health in the Union, and that, consequently, the entry into the Union of those consignments from Bosnia and Herzegovina, from which entry into the Union had been suspended, should be reauthorised. In addition, as a consequence of the resolved outbreak, Bosnia and Herzegovina can again be listed for the entry into the Union of consignments of meat products of poultry with an assigned non-specific treatment “A” in column 10 of the table set out in Part 1, Section A of Annex XV to Implementing Regulation (EU) 2021/404, indicating that those meat products are not required to undergo any specific risk-mitigating treatment. Annexes XIV and XV to Implementing Regulation (EU) 2021/404 should, therefore, be amended accordingly. |

In addition, Canada, the United Kingdom and the United States have provided updated information to the Commission in relation to the epidemiological situation on their territories as regards HPAI that gave rise to the suspension of the entry into the Union of poultry and germinal products of poultry, and fresh meat of poultry and game birds, as set out in Annexes V and XIV to Implementing Regulation (EU) 2021/404. |

On 6 March 2025, Canada submitted updated information on the animal health situation and the measures it has taken in relation to an outbreak of HPAI in poultry in the province of Ontario, which was confirmed on 2 January 2025 by laboratory analysis (RT-PCR). |

On 10 March 2025, 17 March 2025 and 20 March 2025, the United Kingdom submitted updated information on the animal health situation and the measures it has taken in relation to six outbreaks of HPAI in poultry in the counties of Cornwall, East Riding of Yorkshire and Merseyside, which were confirmed between 27 January 2025 and 9 February 2025 by laboratory analysis (RT-PCR). |

On 14 March 2025, the United States submitted updated information on the animal health situation and the measures it has taken in relation to 57 outbreaks of HPAI in poultry in the states of Alabama (1), Arizona (2), California (17), Florida (2), Georgia (2), Idaho (2), Indiana (1), Iowa (3), Kansas (1), Minnesota (6), Misissippi (2), Missouri (1), Nebraska (2), North Carolina (1), Oklahoma (4), Pennsylvania (1), South Carolina (1), South Dakota (3), Tennessee (1), Washington (1), West Virginia (1) and Wisconsin (2), which were confirmed between 3 December 2024 and 28 January 2025 by laboratory analysis (RT-PCR). |

Canada, the United Kingdom and the United States informed the Commission that, following those outbreaks of HPAI, they implemented a stamping out policy in order to control and limit the spread of that disease, and also completed the requisite cleaning and disinfection following the implementation of the stamping out policy on the infected poultry establishments. |

The Commission has evaluated the information submitted by Canada, the United Kingdom and the United States, and considers that they have provided appropriate guarantees that the animal health situation that has given rise to the suspension of the entry of consignments of poultry and germinal products of poultry, and fresh meat of poultry and game birds into the Union from the affected zones, as set out in Annexes V and XIV to Implementing Regulation (EU) 2021/404, no longer represents a threat to animal or public health in the Union, and that, consequently, the entry into the Union of those consignments from the affected zones of Canada, the United Kingdom and the United States, from which entry into the Union has been suspended, should be reauthorised. Therefore, the entries for those third countries in the tables set out in Section B, Part 1 and in Part 2 of Annex V, and the table set out in Section B, Part 1 of Annex XIV to Implementing Regulation (EU) 2021/404 should be amended accordingly. |

In addition, on 11 March 2025, Canada informed the Commission on the measures it has taken in relation to outbreaks of HPAI in poultry in the Fraser Valley in the province of British Columbia, and the epidemiological situation as regards HPAI in certain parts of that area. Taking account of the improved animal health situation, Canada has requested the Commission to reduce size of the zones CA-2.239 and CA-2.245 by deleting municipalities Dewdney, Deroche, Durieu, and Miracle Valley from those zones. The Commission has evaluated the information submitted by Canada and considers that it has provided appropriate guarantees that the affected zones, as described in the entry for Canada in the table in Part 2 of Annex V to Implementing Regulation (EU) 2021/404, could be reduced in size as requested by Canada. Annex V to Implementing Regulation (EU) 2021/404 should therefore be amended accordingly. |

Taking into account the new HPAI outbreaks in Canada, the United Kingdom and the United States, and the Newcastle disease outbreak in the Republic of North Macedonia, and in order to avoid any unnecessary disruption in trade with Bosnia and Herzegovina, Canada, the United Kingdom and the United States, the amendments to be made to Annexes V, XIV and XV to Implementing Regulation (EU) 2021/404 by this Regulation should take effect as a matter of urgency. |

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS REGULATION:
Article 1
Annexes V, XIV and XV to Implementing Regulation (EU) 2021/404 are amended in accordance with the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.
