Commission Implementing Regulation (EU) 2025/897 (2) approved the initial list of ports which comply with the conditions for applying the derogation from the margins of tolerance in estimating catches for unsorted landings or transhipments of small pelagic fisheries, industrial fisheries and tropical tuna purse seine fisheries.

In accordance with Article 6 of Commission Implementing Regulation (EU) 2024/1474 (3), Spain submitted an application to the Commission to include two ports located in its territory, namely the ports of Santa Eugenia de Ribeira and La Puebla del Caramiñal in the list of ports approved by Implementing Regulation (EU) 2025/897.

Based on the information and evidence submitted by Spain in its application and following an assessment carried out by the Commission as referred to in Article 7(1) of Implementing Regulation (EU) 2024/1474, the Commission found that the conditions set out in Chapter II of that Implementing Regulation for each port proposed to be listed have been fulfilled.

According to the information submitted by Spain, the ports of Santa Eugenia de Ribeira and La Puebla del Caramiñal meet the conditions required under Articles 2 and 3 of Implementing Regulation (EU) 2024/1474 for the listing of ports within the Union. Notably, the ports are equipped with weighbridges, and systems with equipment are in place to ensure the accurate weighing of all catches covered by Article 14(4), point (a), of Regulation (EC) No 1224/2009, in accordance with Article 2(2) of Implementing Regulation (EU) 2024/1474.

Specifically, although the ports are not equipped with a remote electronic monitoring (REM) system with closed-circuit television (CCTV) as referred to in Article 2(1), point (a), of Implementing Regulation (EU) 2024/1474, procedures are in place to enable the competent authorities to monitor the accuracy of the weighing process for each landing and transhipment of catches covered by Article 14(4), point (a), of Regulation (EC) No 1224/2009, providing a level of accuracy and reliability equivalent to that of a REM system.

Based on the information submitted, the ports proposed to be listed by Spain should therefore be approved and entered in the list of ports referred to in Article 14(6) of Regulation (EC) No 1224/2009.

Implementing Regulation (EU) 2025/897 should therefore be amended accordingly,
