COMMISSION IMPLEMENTING REGULATION (EU) 2024/2794

of 31 October 2024

amending Implementing Regulation (EU) 2021/1378 as regards the recognition of certain control bodies in accordance with Article 46 of Regulation (EU) 2018/848 of the European Parliament and of the Council as competent to carry out controls and issue organic certificates in third countries for the purpose of imports of organic products into the Union

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) 2018/848 of the European Parliament and of the Council of 30 May 2018 on organic production and labelling of organic products and repealing Council Regulation (EC) No 834/2007 (1), and in particular Article 46(1) thereof,

Whereas:

Annex II to Commission Implementing Regulation (EU) 2021/1378 (2) was adopted to contain the list of control authorities and control bodies recognised in accordance with Article 46(1) of Regulation (EU) 2018/848 as competent to carry out controls and issue organic certificates in third countries for the purpose of imports of organic products into the Union in accordance with Article 45(1), point (b)(i), of that Regulation.

Article 46(2) of Regulation (EU) 2018/848 lays down the criteria that the control authorities and control bodies must fulfil in order to be recognised in accordance with Article 46(1) of that Regulation. Commission Delegated Regulation (EU) 2021/1698 (3) lays down the procedural requirements to be met by those control authorities and control bodies when submitting to the Commission their request for recognition consisting of a technical dossier.

Since the adoption of Implementing Regulation (EU) 2021/1378, the Commission has received requests for recognition, submitted in accordance with Article 46(4) of Regulation (EU) 2018/848, from a number of control bodies.

The Commission has received and examined, in accordance with Article 1 of Delegated Regulation (EU) 2021/1698, the requests for recognition from ‘ACO CERTIFICATION LIMITED’, ‘CTR ULUSLARARASI BELGELENDIRME VE DENETIM LTD. ŞTİ.’, ‘DQS POLSKA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ’, ‘Florida Certified Organic Growers and Consumers, Inc. (FOG), DBA as Quality Certification Services (QCS)’, ‘IMOCERT Latinoamérica Ltda.’, ‘INDOCERT’, ‘ONECERT INTERNATIONAL PRIVATE LIMITED’, ‘Organic Crop Improvement Association International Inc’, ‘Organic Food Development and Certification Center of China’, ‘Organización Internacional Agropecuaria S.A.’, ‘ORSER KONTROL VE SERTİFİKASYON ANONİM ŞİRKETİ’, and ‘SRS Certification GmbH’. Based on the information contained in their technical dossiers, the Commission has concluded that it is justified to recognise for an indefinite duration those control bodies for certain product categories in certain third countries.

The Commission has also received and examined, in accordance with Article 2 of Delegated Regulation (EU) 2021/1698, a request for the extension of the scope of recognition from ‘Ecocert SAS’. Based on the information contained in its technical dossier, the Commission has concluded that it is justified to extend the scope of its recognition for an indefinite duration for the requested product categories in the requested third countries.

Implementing Regulation (EU) 2021/1378 should therefore be amended accordingly.

The measures provided for in this Regulation are in accordance with the opinion of the Organic Production Committee,

HAS ADOPTED THIS REGULATION:

Article 1

Annex II to Regulation (EU) 2021/1378 is amended in accordance with the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the third day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
