The product subject to registration (‘the product concerned’) is vanillin with the molecular formula C8H8O3 or C9H10O3, and with a purity level higher than 95 % by weight. This includes Synthetic Vanillin, Natural Vanillin, Bio-sourced Synthetic Vanillin (Biovanillin) and Ethylvanillin. The Chemical Abstracts Service Registration number (CAS number) for Synthetic Vanillin, Natural Vanillin and Bio-sourced Synthetic Vanillin (Biovanillin) is 121-33-5. The CAS number for Ethylvanillin is 121-32-4. The product concerned does not cover mixtures of different aroma chemicals containing concentrations of Vanillin below 95 % by weight.

The product concerned is currently classified under CN codes ex 2912 41 00 for Synthetic Vanillin, Natural Vanillin and Bio-sourced Synthetic Vanillin and ex 2912 42 00 for Ethylvanillin (TARIC codes 2912 41 00 10 and 2912 42 00 10). The CN and TARIC codes are given for information only and without prejudice to a subsequent change in the tariff classification.

Under Article 14(5) of the basic Regulation, imports of the product concerned may be made subject to registration for the purpose of ensuring that, if the investigation results in findings leading to the imposition of anti-dumping duties, those duties can, if the necessary conditions are fulfilled, be levied retroactively on the registered imports in accordance with the applicable legal provisions.

The Commission has decided to make imports of the product concerned subject to registration on its own initiative under Article 14(5) of the basic Regulation. The conditions for retroactive collection of duties will be assessed in the regulation imposing definitive duties, if any.

Any future liability would emanate from the findings of the investigation.

The allegations in the complaint requesting the initiation of an anti-dumping investigation estimate a dumping margin of 55,13 % and an average injury elimination level of between 45 % and 53 % for the product concerned for the period of January to December 2023. The amount of possible future liability would normally be set at the lower of those two levels according to Article 7(2) of the basic Regulation.
