amending Implementing Regulation (EU) No 901/2014 with regard to the adaptation of the templates for type-approval procedures for two- or three-wheel vehicles and quadricycles to the environmental steps Euro 5 and Euro 5+ requirements

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard Regulation (EU) No 168/2013 of the European Parliament and of the Council of 15 January 2013 on the approval and market surveillance of two- or three-wheel vehicles and quadricycles (1), and in particular Article 27(4), Article 29(4), Article 32(1) and Article 38(2) thereof,

Whereas:

Pursuant to the requirements introduced by Regulation (EU) 2019/129 of the European Parliament and of the Council (2) as regards the application of the environmental step Euro 5 for L-category vehicles, certain sub-categories of vehicles will have to comply with additional technical requirements as from certain dates. Other sub-categories are exempted or are required to comply with certain requirements later than originally set out in Regulation (EU) No 168/2013.

The administrative type-approval templates laid down in Commission Implementing Regulation (EU) No 901/2014 (3) should be adapted in light of the amendments provided for in Regulation (EU) 2019/129 to facilitate the type-approval process and to enable national authorities to verify compliance with the requirements of environmental steps Euro 5 and Euro 5+ applicable at a given date.

Implementing Regulation (EU) No 901/2014 should therefore be amended accordingly.

The measures provided for in this Regulation are in accordance with the opinion of the Technical Committee – Motor Vehicles,

HAS ADOPTED THIS REGULATION:

Article 1

Regulation (EU) No 901/2014 is amended as follows:

(1)

the following Article 12a is inserted:

‘Article 12a

Transitional provisions

1.   Until 30 June 2020, national authorities shall continue to grant type-approvals to vehicle types in accordance with this Regulation in its version applicable on 11 March 2020.

2.   Until 31 December 2020, the Member States shall permit the placing on the market, registration and entry into service of vehicles based on a vehicle type approved in accordance with this Regulation in its version applicable on 11 March 2020.’;

(2)

Annexes I, IV, VII and VIII are amended in accordance with the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
