COMMISSION DELEGATED REGULATION (EU) 2022/2074

of 20 July 2022

amending Regulation (EU) No 139/2014, as regards the definition of SNOWTAM

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) 2018/1139 of the European Parliament and of the Council of 4 July 2018 on common rules in the field of civil aviation and establishing a European Union Aviation Safety Agency, and amending Regulations (EC) No 2111/2005, (EC) No 1008/2008, (EU) No 996/2010, (EU) No 376/2014 and Directives 2014/30/EU and 2014/53/EU of the European Parliament and of the Council, and repealing Regulations (EC) No 552/2004 and (EC) No 216/2008 of the European Parliament and of the Council and Council Regulation (EEC) No 3922/91 (1), and in particular Article 39(1), point (a), thereof,

Whereas:

Commission Regulation (EU) No 139/2014 (2) lays down requirements and administrative procedures related to aerodromes, including provisions addressing the reporting of the runway surface conditions and origination of a notice notifying the presence or removal of hazardous conditions due to snow, ice, slush or standing water (SNOWTAM), as part of the global reporting format.

SNOWTAM should be originated under certain conditions, according to the provisions of Annex 15 to the Convention on International Civil Aviation, signed on 7 December 1944 in Chicago (‘the Chicago Convention’) and the provisions of the Procedures for Air Navigation Services – Aeronautical Information Management (PANS-AIM, Doc 10066), adopted by the International Civil Aviation Organization (ICAO).

The definition of SNOWTAM contained in Annex I to Regulation (EU) No 139/2014 should be amended to be in line with that of Annex 15 to the Chicago Convention and consistent with that of other Union legal acts in the field, such as Commission Implementing Regulation (EU) 2017/373 (3).

Regulation (EU) No 139/2014 should therefore be amended accordingly.

In accordance with Article 75(2), points (b) and (c), and Article 76(1) of Regulation (EU) 2018/1139, the European Union Aviation Safety Agency prepared and submitted to the Commission Opinion No 03/2022 (4) as regards draft implementing rules,

HAS ADOPTED THIS REGULATION:

Article 1

In Annex I to Regulation (EU) No 139/2014, point (41b) is replaced by the following:

‘(41b)

“SNOWTAM” means a special series NOTAM given in a standard format, which provides a surface condition report notifying the presence or cessation of hazardous conditions due to snow, ice, slush, frost, standing water or water associated with snow, slush, ice, or frost on the movement area;’.

Article 2

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
